Abstract

This study examines the contestation of religious authority in Indonesia in the social media era by analyzing how digital platforms reshape the production, circulation, and validation of Islamic legal opinions. Despite the growing influence of online preachers and digital fatwas, limited research has examined how social media transforms the mechanisms of religious authority and the formation of Islamic law in the Indonesian context. Using a qualitative case study design and netnographic methods, this research analyzes digital fatwa content, the performance of religious authority by online preachers, and audience interactions on TikTok, YouTube, and Instagram. The findings reveal a shift from institution-based authority, grounded in scholarly credentials and collective deliberation, toward digital authority that derives legitimacy from symbolic capital, emotional appeal, and algorithmic visibility. This transformation contributes to epistemic fragmentation, as simplified and viral legal opinions frequently overshadow methodologically grounded fatwas issued by formal religious institutions. The study concludes that strengthening digital religious literacy, improving institutional communication, and applying a maqāṣid-based evaluative framework are essential to ensure that Islamic legal guidance in digital spaces remains credible, ethical, and socially beneficial.

Abstract

This study examines the increasing phenomenon of divorce filings among teachers employed under the Government Employees with Employment Agreements (PPPK) scheme in Blitar Regency. The issue has generated social, moral, and religious concerns, particularly due to work placement policies that often separate spouses and potentially weaken family resilience. Existing studies predominantly focus on administrative and employment aspects of PPPK policies, while limited attention has been given to their implications for family welfare and the objectives of Maqasid al-Shari‘ah. This research employs a qualitative method with a normative-literature approach, analyzing maslahah mursalah in Islamic law, scholarly works, statutory regulations, and relevant media reports. The findings indicate that although divorce is legally permissible in Islam, the growing number of marital dissolutions associated with bureaucratic and placement-related pressures reflects insufficient consideration of public welfare and family protection. From the perspective of maslahah mursalah, public policies should not only pursue administrative efficiency but also safeguard family stability as a fundamental social institution. The study concludes that PPPK placement policies require greater integration of family-oriented considerations and that strengthening family resilience programs is necessary to minimize the risk of household disintegration and promote socially responsible governance.

Abstract

This study examines how Kiai Kampung in Jombang negotiate competiting legal systems and explores the implications for legal pluralism theory. Using  a qualitative socio-legal approach, the research draws on observations, in-depth interviews with seven Kiai Kampung, village officials, and local residents, as well as document analysis. The finding shows that Kiai Kampung act as consultants, educators, advisors, and mediators through five locally grounded strategies rooted in Javanese Islamic-values. The study identifies three variants of Kiai Kampung: textualist, culturalist, and moderate, each representing different approaches to reconciling faraid and customary inheritance practices. Unlike previous studies emphasizing legal contestation, this research introduces the concept of normative brokerage, referring to the ability of local actors to select, validate, and operationalize forms of ‘urf to transform normative conflict into complementarity. The study also extends structural-functionalist theory by demonstrating that social equilibrium in plural legal system depends on local actors capable of bridging competing normative frameworks.

Abstract

This study examines the complex dynamics between Panglima Laot's traditional authority as eleume (sorcery) holders and Islamic law implementation in Aceh's coastal communities, identifying effective harmonization strategies. The research addresses a critical gap in understanding how traditional maritime institutions negotiate their roles amid growing demands from Islamic law, particularly regarding the transformation of eleume practices and ritual adaptations. Previous studies have focused primarily on formal Sharia aspects without examining traditional ritual dynamics, leaving crucial aspects of cultural negotiation unexamined. Using a qualitative approach with ethnographic methods and case studies in Langsa City and East Aceh District, the study involved Panglima Laot, religious leaders, traditional leaders, and fishing communities as informants, using participatory observation, semi-structured in-depth interviews, and document analysis. Results revealed Panglima Laot's significant transformation through the integration of Islamic monotheism and fiqh values into traditional maritime rituals, replacing mantras with Quranic and Hadith prayers. Successful harmonization was achieved through intensive dialogue and local wisdom-based institutional strengthening, with customary institutions mediating between formal authorities and traditional fishing communities. These findings contribute to Islamic law anthropology studies and provide a conceptual framework for harmonizing tradition and modernity in other Indonesian coastal areas.

Abstract

This study examines the influence of the digital trend “Marriage Is Scary” on pre-marital anxiety among Generation Z students and explores their coping mechanisms from the perspective of Islamic Family Law. The study is motivated by the widespread circulation of algorithm-driven digital content portraying domestic violence, infidelity, and dysfunctional family relationships, which increasingly shape young adults’ perceptions of marriage. Despite growing scholarly attention to digital culture and family issues, limited research has examined how digitally induced anxiety interacts with Islamic Family Law in shaping attitudes toward marriage. This research employs an empirical legal method with a qualitative approach through semi-structured interviews with 16 senior students at UIN Malang. The findings reveal two levels of anxiety based on Stuart’s classification: mild anxiety, which encourages self-reflection and marriage preparation, and moderate anxiety, characterized by fear, legal skepticism, and concerns about family stability arising from financial uncertainty, personal experiences, and digital cognitive dissonance. Students respond through adaptive strategies, including digital content filtering and cognitive reframing. This study contributes to the development of Islamic Family Law by demonstrating how digital environments reshape contemporary legal culture and underscores the importance of cyber-based pre-marital education and digital literacy to strengthen Muslim family resilience.

Abstract

This study examines the philosophical coherence and practical effectiveness of Indonesia’s plastic waste management policies through Abdul Majid An-Najjar’s concept of hifz al-bi'ah within the contemporary Maqasid al-Shariah framework. Despite the enactment of government regulations and religious edicts to address the growing plastic waste crisis, few studies have evaluated these policies using hifz al-bi'ah as an analytical framework. This study aims to assess the relevance and implementation of Indonesia’s plastic waste policies based on An-Najjar’s theory. Employing a normative-juridical and philosophical approach, this qualitative library research analyzes Law No. 18 of 2008, Minister of Environment and Forestry Regulation No. P.75/2019, and MUI Fatwa No. 41 of 2014 through qualitative content analysis. The findings indicate that these legal instruments reflect four principles of hifz al-bi'ah: protection from environmental damage, pollution, excessive consumption, and environmental revitalization. However, policy implementation remains ineffective due to the dominance of end-of-pipe waste management, weak enforcement of Extended Producer Responsibility obligations, and the non-binding legal status of religious fatwas. The study concludes that stronger regulatory enforcement and integrated environmental governance are necessary to realize the objectives of hifz al-bi'ah in Indonesia.
