Abstract

This library research article discusses child marriage in Indonesia usingcontent analysis of marriage regulations. It is also addresses consequences of child marriage. Marriage regulations open the possibility of childmarriage in case of necessity. This is an implementation of sad al-zari‟ahin order to prevent the bigger problems. However, child marriage oftenbrings negative impacts for the bride socially, economically andpsychologically.

Abstract

In the modern context, legal doctrine is often positioned as a perfect value. This attitude positioned legal doctrine as absolute and people will not be able to evaluate. Civil law and common law as a modern school of law consider this condition as the position to implement concept of justice. Islam has offered a different form of justice. In Islam, justice is not only about socio-religious rites but also the implementation of syariat and haqiqat by Indonesian Muslims. The concept of justice in Islam can be different from those of civil and common law. Justice in Islam is more in the equity of legal procedures and substantive character as the core of legal justice.

Abstract

One of the legendaries expert in Islamic astronomy (falak) in Indonesia was KH. Turaichan Adjhuri. He was a humble kyai inherited Islamic astronomy developed in pesantren in Indonesia. Abstract

Polygamy is a form of marriage that is not prohibited by the religion of Islam. But that does not mean skill, enables a person to polygamy, but requiring them to meet certain conditions and with the right reasons as has been determined in several laws in force in Indonesia, one of its provisions in the Compilation of Islamic Law. However, in fact polygamy became a phenomenon because of the many people who takeit as a final solution, so that the original aim to achieve domestic harmony, becomes a matter that is often considered to damage the rights of women, as well as degrading women by placing an object andnot as a subject that is on par with men in marriage. The fact that we can find in the practice of polygamy Kiai is the purpose of this paper formulation. This study will present some practice polygamy phenomena occurring in society, firstly, how the practice of polygamy Kiai in the town of Jember. Second, how the topography of religiosity in the town of Jember. Third, how the views KHI and Gender to the practice of polygamy Kiai in the town of Jember. The research method used is through a historical approach, geographic, and content analysis to read the practice of polygamy kiai in view of KHI andGender.

Abstract

The long process of regulation of Islamic law - especially the law of waqf - is always interesting to observe or study, because its presence cannot be separated from the things that underlie it. This study aims to examine the effect of Indonesia's political configuration on the character of waqf regulatory products in Indonesia. By using qualitative methods, it is hoped that this study will be able to describe the character of products of waqf regulation which are influenced by political configurations from the New Order Era to the Reformation Era with a historical approach. The results of this study indicate that the character of waqf regulations in Indonesia varies according to the political configuration that surrounds them. There are at least three important periods that show the dynamics of political configuration that affect the character of waqf regulation. First the Old Order Period, Law no. 5 of 1960 (UUPA), which also regulates waqf and land issues, is responsive in character. Secondly, during the New Order era, the regulations governing waqf during the New Order era were conservative / orthodox in character. The regulation that regulates waqf during the New Order era is PP. 28 of 1977 concerning Ownership of Land Owned, Law no. 7 of 1989 concerning Religious Courts (Chapter III), and Compilation of Islamic Law based on Presidential Instruction No.1 of 1991. In Chapter III. And there are also several regulations issued by the Minister and Director General level. And thirdly the Reformation Period, the Law that regulates waqf Law no. 41 of 2004 has a democratic character.AbstrakProses panjang regulasi hukum Islam utamanya hukum wakaf selalu menarik untuk diamati atau diteliti, karena kehadirannya tak lepas dari hal-hal yang melatarbelakanginya. Studi ini bertujuan untuk meneliti pengaruh konfigurasi politik Indonesia terhadap karakter produk regulasi wakaf di Indonesia. Dengan menggunakan metode kualitatif diharapkan studi ini akan bisa mendeskripsikan karakter produk regulasi wakaf yang dipengaruhi oleh konfigurasi politik mulai Era Orde Baru sampai dengan Era Reformasi dengan pendekatan historis. Hasil penelitian ini menunjukkan bahwa karakter regulasi wakaf di Indonesia berbeda-beda sesuai dengan konfigurasi politik yang melingkupinya. Setidaknya ada tiga periode penting yang menunjukkan dinamika konfigurasi politik yang mempengaruhi karakter regulasi wakaf. Pertama Masa Orde Lama, Undang-Undang Nomor 5 Tahun 1960 (UUPA) yang di dalamnya juga mengatur tentang wakaf dan permasalahan pertanahan adalah berkarakter  responsif. Kedua Masa Orde Baru, regulasi  yang mengatur tentang wakaf pada masa Orde Baru berkarakter konservatif/ortodoks. Regulasi  yang mengatur tentang wakaf pada masa Orde Baru adalah Peraturan Pemerintah Nomor 28 Tahun 1977 tentang Perwakafan Tanah Milik, Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama (Bab III), dan Kompilasi Hukum Islam berdasarkan Inpres No.1 Tahun 1991. Pada Bab III dan juga ada beberapa peraturan yang dikeluarkan oleh setingkat Menteri dan Dirjen. Dan ketiga  Masa Reformasi, Undang-Undang yang mengatur tentang wakaf Undang-Undang Nomor Nomor 41 Tahun 2004 berkarakter demokratis.

In the beginning of Islam, Muslim did not face problems as experienced by the later generations of Muslims therefore Muslims need to develop fiqh in accordance with  the  current  situation. In this case, philosophy may provide a new perspective in the development of fiqh. Abstract

Abstract Fiqh presents with the presence of Islamic studies that then isbeing practiced in the society. Fiqh epistemology in Indonesia asthe Islamic law has characters and Indonesian special featureseither written or unwritten in the book of law. All this time, fiqh isstill attached with cultural trademark and Middle-Eastern tradition.The socio-cultural condition of Indonesia society, however, givescontribution and historical setting of Islamic law in Indonesia sothat fiqh reformation that is identical with Indonesian is thedemand and the dynamic of modern Muslims nowadays. Fiqh as anecessity must be kept in touch with science as the integral partand takes into account to solve the modern problems through theupdate thought to form the Indonesian fiqh. The indigenization offiqh holistically uses the various patterns and methods. Thedemand of updating fiqh already causes the reshuffle of fiqhepistemology from teosentrisme epistemology to antroposentrismeepistemology. Therefore, the contextualization of fiqh alwaysfollows the socio-cultural and development of human knowledgewith various typology characteristics of society that are formed byits socio-culture and the culture around it. Hence, fiqh will befresher than before to answer the new problems in modern societyin Indonesian context.

Abstract

This study aims to determine 1) How is Istidlal (the process of searching for and using arguments) to invalidate ablution according to Imam Hanafi and Imam Syafii and 2) What are the factors that cause the difference of opinion between Imam Hanafi and Imam Shafii regarding the cancellation of ablution. The research method used in this study is descriptive qualitative with a comparative approach that compares the opinions of two scholars about the cancellation of wudlu. The research results obtained are: 1) Istidlal: Imam Hanafi's istidlal regarding the cancellation of ablution was inspired by analogues and qiyas, because he was nicknamed "ahlu alra'yu", while Imam Shafi'i's istidlal regarding the cancellation of ablution is to look for the rules and ushul of the problem of canceling wudlu, then after finding him combine it with a valid argument or basis and this is also chosen from a valid argument. 2) Factors: The factors that cause differences of opinion between Imam Hanafi and Imam Shafi'i regarding the cancellation of ablution are the time or era factor, the scientific factor possessed, the legal basis used, the search for a legal basis in determining the law, and the experience factor.Penelitian ini bertujuan mengetahui, 1) Istidlal (proses pencarian dan penggunaan dalil) batalnya wudlu menurut Imam Hanafi dan  Imam Syafii dan 2) Faktor-faktor apakah yang menyebabkan perbadaan pendapat antara Imam Hanafi dan  Imam Syafii tentang batalnya wudlu. Adapun metode penelitian yang digunakan dalam penelitian ini adalah Kualitatif deskriptif dengan pendekatan komparatif yang membandingkan pendapat dua ulama tentang batalnya wudlu. Hasil penelitian yang diperoleh adalah1)Istidlal Imam Hanafi tentang batalnya wudlu diilhami dengan analog dan qiyas, karena beliau dijuluki ”ahlu alra’yu”,sedangkan istidlal Imam Syafi’i tentang batalnya wudlu yaitu dengan mencari kaidah-kaidah dan ushul dari permasalahan batalnya wudlu, kemudian setelah ditemukan beliau memadukan dengan dalil atau dasar yang dan ini pun dipilih dari dalil yang sahih. 2) Faktor-faktor yang menyebabkan perbedaan pendapat antara Imam Hanafi  dan Imam Syafi’i tentang batalnya wudlu adalah faktor masa atau zaman, faktor Keilmuan yang dimiliki, faktor dasar hukum yang digunakan, faktor pencarian dasar hukum dalam menetapkan hukum, dan faktor Pengalaman.

Abstract

The least knowledge of fiqh in Islam resulted in many people who violate it. such as marriage issues. many people do not know about fiqh in the marriage process. So many who do wrong before marriage with courtship or free sex that is prohibited in Islamic law is prohibited.in Islamic law one of the processes in marriage is to see (nadzar) the prospective wife or husband. Seeing a potential wife or husband to be one cause to achieve happiness in the family. Prophet Muhammad advised his followers to see his future wife, so do not regret after married.
