Abstract

This article focuses on factors and impacts of child marriage from the perspective of sociology and psychology. Using descriptive qualitative analysis, this article attempts to address the problem in-deep. The Article 7 of Law No 1 Year 1974 states that the minimum age for marriage is 19 for male and 16 for female, thus child marriage is basically illegal. Child marriage is mostly bring negative impact for female such as premature aging syndrome due to her role as wife and mother.

Abstract

Any loan or financing agreement made by a sharia financial institution, whether bank or non-bank, more particularly KSPS Logam Mulia, usually requires a guarantee. Guaranteed goods guaranteed by the community or its members may be movable objects such as motorcycles or cars (guaranteed by BPKB) and may be non-moving objects in the form of buildings or land (guaranteed usually land certificates) .To to legalize the guarantee goods, the guarantee goods. For moving objects in the form of fiduciary and immovable property through mortgages.               With the existence of objects collateralized by the public or members of the Islamic financial institutions, both banks and non-banks with fiduciary guarantee will provide the legal force for the institution to execute objects that have been guaranteed if the people who borrow violate the promise or wanprestasi.But in fact, KSPS Logam Mulia has never executed forcibly to the community or its members who have neglected or are unable to perform its obligations ie paying installments on loans or financing it has received.               From the results of the research can be known execution fiduciary guarantee in KSPS Logam Mulia Klambu District Grobogan District does not execute fiduciary guarantee directly against members who do not perform the obligation mengangsurnya. What factors are the background of not directly executing tehadap assurance of fiduciary objects in KSPS Logam Mulia Klambu District Grobogan Regency is: The reason shariah and Reason kinship.

القرآن الكريم باعتباره كتابا مقدسا مثل الجوهر الواحد الذي لا يتجزأ ولن يتجزأ.تعاليمه وأحكامه مترابطة ومتكاملة. فبعض آياته يفسر ويبين بعضا آخر، ولا يمكنوجود أيّ اختلاف فيه وإن تعددت محتوياته وموضوعاته، لأنه منزل من عند اللهتعالى، ولن يأتي الباطل من بين يديه ولا من خلفه.والمفروض أن جميع ما في القرآن واضح دون ريب حتى تطمئن قلوب ممتثليها، فقدياأيها الناس قد جاءكم برهان من ربكم « قال تعالى في سورة النساء الأية 471ولكن هذا الوضوح قد لا يعرفه الناس الا القليلين وهم .» وأنزلنا إليكم نورا مبيناالعلماء. والكثيرون لم يصلوا إلى الفهم المراد به في القرآن، بل أخطؤا زعموا أن فيهاختلافات وتناقضات.

Abstract

Almost every life is always characterized by motion and dynamics.Starting from the movement and dynamics of change anddevelopment of thought with a variety of variants, always occurcontinuously without knowing the limits. Likewise in religion, theexistence of a religion will be judged to have a function for a life, ifreligion in practice opens a wide space for the demands of motionand the dynamics of life as intended. The same thing happens alsoin Islam, on the one hand it is considered a value system that isable to provide guidance and direction for human life, but on theother hand it requires dynamic space constructed from the basicsof norms that have the essence of universal truth, because in lifealways requires constant movement and change from situation tosituation and from conditions to other conditions.

Abstract

Marriage preparation course (Kursus Calon Pengantin – Suscatin) is a short course for engaged couples about domestic life. Legal basis for this course is Regulation from General Director of Islamic Community Guidance No DJ.II/491 Year 2009 renewed by No DJ.II/542 Year 2013. Therefore, the course is basically an effort made by the government – BP4 – to provide the couple with skill and psychological provision to overcome marriage problems. Thus, theidea of loving, affection and compassion in marriage may be achieved and at the same time also to realize a harmonious society and to avoid family conflict and divorce. Theoretically, materials of the marriage preparation course by Office of Religious Affairs (KUA) are comprehensive, covering: rules and procedures of marriage; religious knowledge; marriage and family laws and regulations; rights and obligations of husband and wife; female reproduction health; familymanagement; and also psychology of marriage and family. Unfortunately, the practice of the course has become a mere formality.

Abstract

Fazlur Rahman’s thought of constitutional law emphasises on certain issues:  First,  Islamic  countries  should  form  a  democratic  Islamic state. Head of State is directly elected by the people. Head of State is responsible to the people through parliament whose members are also elected by people directly. Second, relationship between Islam and the state is very close, because the foundation of the state and the system of law should come from the sources of Islam, namely the Qur’an and the Hadith. If government is violating Islamic value it is no longer credible and should be dismissed. Third, the concept of the Islamic state is debatable therefore Fazlur Rahman choses the concept of an Islamic democratic state. The head of state is elected directly by the people and the president as head of state responsible to the people through parliament. Fourth, there are many problems in the establishment of an Islamic state. According to Rahman, the establishment of an Islamic state is accomplished through a long struggle, such as the establishment of the Islamic state of Pakistan. It is started with the commitment of Muslims to carry out God’s command. The establishment of an Islamic state aims for safety and sovereignty of the country. Fifth, concerning the issue of the duty and authority of the head of state, according to Fazlur Rahman the head of state in charge of leading the government, in carrying out its duties and powers shall be in accordance with the interests of all the people.Key words: Thought, Law and State.

Abstract

The promulgation of Law No 7 of 1989 on Religious Courts, a milestone in the transformation of early Islamic law into national legislation in the judicial system in Indonesia. Religious Court is the process of judicial based on Islamic law for Muslims undertaken by the Religious Court and Religious High Court. The existence of the Religious Courts in the Indonesian national judicial system is one of judicial powers in Indonesia. In addition to the Religious Courts, Indonesia also recognized three other courts that have the same and equal position with the different authority, they are the General Court, Military Court, and State Administrative Court.Religious Courts can be viewed as a symptom of Islam because it can reveal many aspects of life especially in social issues. Indications of the Islamic symptoms are the enactment of Law No. 7 of 1989 on Religious Courts, and put it into the country's judicial system, Law No. 1 of 1974 on Marriage, and the Compilation of Islamic Law (KHI), all of which are in the realm of law in Indonesia, the concretization of a form of Islam and a product of applied normative law must be obeyed by the people of its adherents, as the living law.Keywords: Religious Courts, Islamic Symptoms, Transformation of Islamic Law

Abstract

Reflection of philosophy of law for legal development by reflecting back to the central questions in the philosophy of law which are based on the aspects epistimologi, ontology, and axiology. The epistemological aspect inquire/study the origin, nature, operational limits of the law. The ontology aspect inquire / learn where the law. The axiology aspect learn the purpose of the law. The relevance of philosophy of law for the development of law by finding links between schools or schools of law with legal developments. Which schools/school of law it plays an important role and influence on legal developments since centuries ago to the present.

Abstract

Regular cycle of day and night due to the rotation of the earth creates a difference time regions. The earlier area facing the sun has earlier time than the western side (M.Syahudi Islami , 48). For example, when Semarang is in the time of maghrib, in Lampung maghrib has not yet come since it is in the western side. Likewise, by the times of sunrise in Lampung, the sun has already high in Semarang. The time difference is about 1 hour every 15 degrees of longitude, or 4 minutes for every 1 degree of longitude. The calculation is drawn from required time for one rotation (360 degrees) for 24 hours. This paper will explain about equation of time, mean time, universal time/Greenwich Mean Time, ad local mean time which are vital aspects for religious prayers, especially for calculating prayer schedule.Keywords: rotation,time, prayer
