Abstract

The government continues to refine and strengthen the policy of governance of financial relations between the central and regional governments in order to achieve national goals by enacting Law Number 1 of 2022 concerning Financial Relations between the Central and Regional Governments, which regulates regional endowment funds. This regulation provides space for the formation of Regional Endowment Funds but also provides limitations with certain criteria. Law Number 1 of 2022 stipulates that the formation must consider, among other things, regional fiscal capacity and the fulfillment of mandatory Government Affairs needs related to basic public services. The objectives of this research areTo determine the urgency of establishing a Regional Endowment Fund.The results of the study show: First, the factors that encourage the formation of DAD, namely 1) The formation of DAD becomes a strategy to ensure the sustainability of long-term and cross-generational regional finances; 2) Optimization of regional spending in regions with established fiscal policies; 3) Encouraging regional investment activities in an effort to increase regional income. Second, the governance scheme in the formation of DAD is the establishment, management, use, and supervision. All of these stages must receive support from all parties, especially regional leaders.

Abstract

This study is based on the principle of meaningful community participation in the process of forming regional regulations, in realizing constitutional rights to obtain equal opportunities at each stage of the process of forming regional regulations. The mandate of the Constitutional Court (MK) Decision Number 91/PUU-XVIII/2020 emphasizes that community participation must be interpreted as the right to be heard, the right to be considered and the right to receive an explanation or answer to the opinion given (right to be explained). This authority is still found to be limited by the community in obtaining information about whether their opinions are rejected or accepted. In fact, this authority is an interpretation of the sovereignty of the people which must be manifested at every level of regional law formation. It shows the need for affirmation of comprehensive and representative meaningful community participation through regional regulations themselves. Collectively, meaningful community participation in the process of forming regions is only understood normatively, which results in the interpretation of meaningful community participation in the process of forming regional regulations only as a formal requirement. The formulation of the problem in this study is (1) How is the regulation of meaningful community participation in the process of forming regional regulations?, (2) What is the mechanism of meaningful community participation in the process of forming regional regulations?, (3) How is the implementation of meaningful community participation in the process of forming regional regulations?. This study uses a normative legal method with a conceptual approach, statue approach and case approach. This paper concludes that the implementation of meaningful community participation in the process of forming regional regulations has not been systematically arranged by the Regional People's Representative Council (DPRD) over the authority of meaningful communities in the process of forming regional regulations. In Langkat Regency, the implementation of meaningful community participation is only at the recess and public consultation stages or public hearings (RDPU). This paper recommends that the DPRD form a regional regulation in absorbing meaningful community participation. By emphasizing the definition of regional community involvement in a more meaningful direction, and reorganizing the systematics of representative regional institutions in accommodating meaningful community participation in the stages of the process of forming regional regulations.

Abstract

Putusan Mahkamah Konstitusi yang bersifat non-self implementing kerap memerintahkan pembentuk undang-undang untuk melakukan perbaikan terhadap ketentuan undang-undang yang dinyatakan bertentangan. Persoalan yang muncul adalah manakala pembentuk undang-undang tidak menindaklanjuti sesuai dengan perintah dalam putusan Mahkamah Konstitusi, justru menafsirkan berbeda. Dalam menjawab permasalahan tersebut penelitian ini menggunakan metodelogi yuridis normatif, dengan mengunakan pendekatan peraturan perundang-undangan, putusan Mahkamah Konstitusi, dan menggunakan bahan kepustakaan seperti buku, jurnal, maupun sumber bahan lainnya, serta studi perbandingan putusan Mahkamah Konstitusi Jerman dan Korea Selatan terhadap putusan non-selft implementing. Hasil kajian kemudian disusun secara sistematis dan dilakukan analisis secara kualitatif. Penelitian ini menyimpulkan pembentuk undang-undang sebagai adressat putusan seharusnya menindaklanjuti putusan Mahkamah Konstitusi dengan memperhatikan ketentuan hukum yang disampaikan oleh Mahkamah Konstitusi, yang tertuang dalam pertimbangan hukum maupun dalam amar putusannya. Sebagai petunjuk pelaksanaan, Mahkamah Konstitusi perlu memberikan batasan waktu atau penundaan pemberlakuan dengan memuat tanggal, bulan, dan tahun dalam amar putusannya secara tegas dan lengkap. Kata Kunci:    Putusan Mahkamah Konstitusi; Pengujian Undang-Undang; Pembentuk Undang-Undang Constitutional Court decisions that are non-self-implementing often order legislators to make improvements to the provisions of laws that are declared contradictory. The problem that arises is when legislators do not follow up according to the orders in the Constitutional Court decisions, but instead interpret them differently. In answering this problem, this study uses a normative legal methodology, using a statutory regulatory approach, Constitutional Court decisions, and using library materials such as books, journals, and other sources, as well as a comparative study of the decisions of the German and South Korean Constitutional Courts on non-self-implementing decisions. The results of the study are then compiled systematically and analyzed qualitatively. This study concludes that legislators as the addressees of the decision should follow up on the Constitutional Court's decision by paying attention to the legal provisions conveyed by the Constitutional Court, which are stated in the legal considerations and in the decision. As a guideline for implementation, the Constitutional Court needs to provide a time limit or postponement of implementation by including the date, month, and year in the decision in its decision explicitly and completely. Abstract

Program Legislasi Daerah (Prolegda) adalah instrumen perencanaan yang digunakan untuk membangun Peraturan Daerah Provinsi atau Peraturan Daerah Kabupaten/Kota secara terencana, terpadu, dan sistematis. Di Aceh, Prolegda dikenal sebagai Qanun Provinsi atau Qanun Kabupaten/Kota, yang dibentuk oleh Dewan Perwakilan Rakyat Kabupaten (DPRK) sebagai lembaga legislatif. Pembentukan Prolegda sangat ditentukan oleh potensi daerah dan diatur dalam Pasal 1 ayat 10 Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan. Maka penelitian ini bertujuan untuk menemukan jawaban terhadap realisasi Prolek Aceh Timur dan Kota Langsa, menjelaskan implikasi hukum yang dapat ditimbulkan, dan mengukur produktifitas Prolek di DPRK Aceh Timur dan Kota Langsa. Penelitian ini merupakan penelitian hukum yuridis normatif dengan metode analisis data kualitatif dan pendekatan deskriptif. Sumber data yang digunakan di peroleh dari telaah kepustakaan (library research) serta penggunaan data sekunder yaitu bahan hukum primer, sekunder dan tersier. Hasil dari penelitian yang pertama adalah Program legislasi kabupaten/kota harus mengikuti 5 tahapan, yaitu perencanaan, penyusunan, pembahasan, penetapan, dan pengundangan. Kedua Fungsi legislasi DPR sangat penting dalam mensejahterakan rakyat Indonesia melalui pembentukan perundang-undangan yang berkualitas dan berkeadilan. Dan yang terakhir adalah Program legislasi Kabupaten/Kota yang ideal memerlukan legislator yang peka terhadap masalah masyarakat, perencanaan yang seimbang, dan evaluasi serta pengawasan yang ketat.

Abstract

Divorce is a complex problem in married life. Whatever problems occur in the household, whether in state law or religious law in force in Indonesia, divorce is the last way to solve them. Divorce can only be carried out before the court if the court fails to reconcile the two parties through mediation. Basically, civil servant divorce is the same as other communities, but the difference is that civil servants must first obtain permission from their superiors before carrying out the divorce. Civil servants must ask their superiors for permission through a hierarchical system, which takes a long time to get permission to divorce. If you look at these requirements for civil servants who are going to divorce, it is very difficult, but if divorce is the only way, then it is certain that the civil servant will receive sanctions. And in practice, permission from superiors as a requirement for civil servant divorce is difficult to issue from superiors who wish to divorce. So that in some cases the court gave divorce decisions to Civil Servants without a letter of permission from their superiors. Whereas in legal religious law in Indonesia, divorce can occur if the terms and conditions are met. This is the topic of the problem that the author wants to examine in this paper. What becomes the formulation of the problem is how is the superior's permission in civil servant divorce from the point of view of religious law? The legal research method used is normative juridical, namely a scientific research procedure to find the truth based on the scientific logic of law from a normative perspective. The approach used is a statutory approach related to the subject matter involved. If viewed from the point of view of religious law that is recognized in Indonesia (Islam and Non-Islam), divorce is indeed not recommended in the rules of religious law, but if circumstances demand this to happen then one must follow the rules and reasons determined by every legal religion in Indonesia. Because this concerns a person's right to determine a peaceful, secure and prosperous life. Through the research process above, it can be concluded that the decision in determining divorce is always given to the decision of each individual. Because freedom in determining life choices and being able to take responsibility for every risk of that choice. Every rule in the official religion in Indonesia considers divorce not a recommended action but if in reality divorce is the final solution, the rules in religion will not prevent it. This is the real basis for each individual, including State Civil Apparatus, in choosing a decision in their marriage, namely ending it in divorce. Permission from superiors is only an obstacle to solving problems in the household of an State Civil Apparatus. From this article, it is hoped that in the future, permission from superiors in the event of an State Civil Apparatusdivorce does not interfere in principled matters in the marital life of its employees, but is only administrative in nature. So that the goal of a peaceful and prosperous State Civil Apparatuslife can be carried out properly.

Abstract

Kegiatan pembangunan nasional demi kemakmuran dan kesejahteraan seluruh Rakyat Indonesia dilakukan melalui eksploitasi sumber daya alam yang ada. Pemenuhan kebutuhan ekonomi nasional maupun daerah membawa dampak yang tidak diinginkan bagi keberlanjutan dan kelestarian lingkungan hidup. Permasalahan lingkungan hidup yang timbul seperti, pencemaran air sungai dan danau, rentanya perubahan iklim, kebakaran hutan, sampah yang menumpuk menunjukkan penurunan kualitas lingkungan hidup, dan merupakan ancaman serius bagi kelangsungan lingkungan hidup. Perlindungan dan pengelolaan lingkungan hidup yang berkelanjutan dan penegakan Hukum Lingkungan melalui pemberian sanksi (administratif) yang tepat dan pengawasan yang konsisten menjadi tolak ukur keberhasilan penegakan hukum lingkungan. Penelitian ini bertujuan memberikan masukan upaya-upaya yang dapat dilakukan oleh pemerintah Provinsi Sumatera Utara dalam memastikan setiap kegiatan pembangunan yang dijalankan mengedepankan lingkungan hidup. Penelitian ini bersifat yuridis empiris, bertujuan untuk memastikan penerapan UU No 32 tahun 2009 secara factual pada peristiwa hukum in concreto itu sesuai atau tidak pada setiap akiifitas pengelolaan lingkungan hidup.

Abstract

Situasi pandemi COVID-19, memaksa pemerintah untuk melakukan Pembatasan kegiatan, dan physical distancing. Cara ini dinilai efektif untuk mencegah penularan corona lebih luas. Pembatasan kegiatan memiliki dampak positif dan negatif, berkurangnya kegiatan manusia terhadap eksploitasi lingkungan menyebabkan aktivitas ekonomi berjalan dengan lambat. Positifnya,lingkungan menjadi lebih sehat. Permasalahan yang muncul adalah pandemi menyebabkan timbulan sampah meningkat, sampah rumah tangga, sampah plastik, tisu, masker maupun sampah medis. Bagaimana kebijakan pengelolaan sampah yang dilakukan oleh Pemerintah Kabupaten Deli Serdang sebelum dan pasca terjadinya pandemi Covid-19. Penelitian bertujuan untuk mengetahui upaya pemerintah dalam mengelola sampah. Metode yuridis normatif dipergunakan, untuk mengamati kesesuain data penerapan norma hukum dengan kondisi pengelolaan sampah di lapangan, kemudian dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan timbulan sampah yang terjadi berasal dari sampah rumah tangga dan sampah sejenis rumah tangga. Pemerintah membuat berbagai kebijakan dan berupaya memfasilitasi ketersediaansarana dan prasarana pengelolaan sampah serta meningkatkan kesadaran masyarakat untuk ikut mengelola sampah.

Abstract

This research aims to investigate the protection of personal data as a constitutional right of citizens based on Law Number 27 of 2022 concerning Personal Data Protection in Indonesia. In this study, the researcher identifies several main issues: the regulation of personal data protection in national law, personal data protection in the Political Party Information System (Sipol), and the resolution of disputes related to personal data protection by the Independent Election Commission (KIP) of Kabupaten Pidie. The research method used is normative and empirical with a legal regulation and case approach. Data collection was conducted through literature study and field research, followed by qualitative analysis to draw deductive conclusions. The research findings indicate that Law Number 27 of 2022 is the primary legal basis governing personal data protection, in accordance with the constitutional obligation stipulated in Article 28G paragraph (1) of the 1945 Constitution. The protection of personal data in Sipol includes oversight by the Election Supervisory Agency (Bawaslu), sanctions against the misuse of National Identification Numbers (NIK), and the importance of NIK verification. Dispute resolution is carried out through complaints from the public to KIP or Bawaslu, with individuals receiving a certificate regarding their membership status in Sipol. The conclusion of this research underscores the importance of law implementation in safeguarding citizens' personal data, particularly in political contexts such as Sipol. This protection not only ensures constitutional rights but also secures the integrity and security of personal data in the current digital era.

Abstract

Jumlah pemuda yang besar di Sumatera Utara merupakan salah satu potensi yang harus di kembangkan oleh semua pihak, termasuk juga dalam pemilu, khususnya dalam pemilu serentak 2019, yang akan segera dilaksanakan. Pemuda harus menjalankan peran yang penting dalam mensukseskan dan mengawasi jalannya pemilu. Partisipasi atau keikutsertaan pemuda dalam pemilu dapat dilaksanakan pada masa sebelum hari pencoblosan maupun pada hari pelaksanaan pencoblosan suara. Tujuan dari penelitian ini adalah sejauh mana peranan pemuda untuk dalam rangka menjalankan demokrasi dan berpartisipasi dalam pemilihan umum tahun 2019 mendatang. Penelitian hukum ini hendak mengkaji pelaksanaan atau implementasi ketentuan hukum positif secara faktual pada setiap peristiwa hukum tertentu pengkajian tersebut bertujuan untuk memastikan apakah hasil penerapan pada peristiwa hukum in concreto itu sesuai atau tidak dengan ketentuan peraturan perundang-undangan

Abstract

 Garbage is the final waste from a production activity and household activities in general. Garbage is a big problem faced by every country. Garbage if not managed and handled will cause various problems to the environment and for humans themselves. The presence of garbage has a bad impact and has become a threat to the survival of all mankind. Waste is generated by human activities, therefore awareness and the role of humans in overcoming and overcoming it becomes important.
