Abstract

Dalam penegakan hukum pidana, restorative justice merupakan alternative penyelsaian perkara tindak pidana yang semula mekanismenya berfokus pada pemidanaan atau penjatuhan sanksi pidana dan bersifat pembalasan, kemudian melalui proses mediasi yang melibatkan korban, pelaku, keluarga pelaku maupun korban dan pihak lain yang berkaitan baik itu tokoh masyarakat, tokoh agama,tokoh adat, pemangku kepentingan, serta pihak Kepolisian yang bertujuan pada pemenuhan hak korban guna pemulihan korban. Restorative Justice juga sering dikenal dengan keadilan restoratif. Dalam penelitian yang dilakukan oleh penulis, bahwa penerapan keadilan restoratif seringkali seakan dipaksakan walaupun beberapa kasus atau tindak pidana bisa dihentikan penyidikannya melalui Restorative Justice. Namun ada tindak pidana yang atas permintaan dari korban pada akhirnya penyidikan dihentikan sesuai Peraturan Kapolri Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif, meskipun korban menanggung kerugian secara fisik dan psikis. Penelitian ini disimpulkan rumusan masalah yang pertama implementasi penghentian penyidikan di Kepolisian melalui Restorative Justice dan yang kedua hambatan yang dihadapi pihak Kepolisian Resor Kendal dalam penerapan Restorative Justice pada penghentian penyidikan. Metode penelitian ini merupakan metode yuridis sosiologis dan hasil penelitian ini diambil dari hasil kesimpulan penulis sebagai saksi ahli di Kepolisian Resort Kendal yang merujuk pada Peraturan Kapolri Nomor 8 Tahun 2021 Tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif.

Abstract

The development of existing technology has an impact on the public service system in terms of online criminal case registration, online payments, online summons, and online trials. This study aims to determine the implementation of the Electronic-Based Government System application in services at the District Court. The research method used in this study was normative legal research. The results of the study show that the existence of e-court has had a major impact on the progress of the justice system in Indonesia while realizing justice based on simplicity, speed and low cost. The impact of the e-court system itself on the judicial process with the increasing development of digital technology, the transformation of courts into modern courts that utilize digital information technology to the maximum is a necessity. The results of the study are expected to provide strategic recommendations for the District Court in optimizing the implementation of SPBE in order to achieve the goals of good governance and improve the quality of public services.

Abstract

This research aims to determine the causes and efforts to prevent acts of violence in Islamic boarding schools. This research is library research. This research uses a qualitative approach through descriptive analysis methods based on literature studies obtained such as searching books, journal articles and other digital materials from the internet which are then used as analysis material. The results of this research show that there are many factors that cause acts of violence against students in Islamic boarding schools to still occur. These factors include the issue of unequal power relations between perpetrators and victims, the strong intensity of togetherness in Islamic boarding schools, Islamic boarding schools rarely select student input, especially Islamic boarding schools which still maintain the old way of educating students, during holidays and when students return home they do not receive adequate care. the same as Islamic boarding schools, the strict rules and regulations in Islamic boarding schools, problems with senior-junior relations, as well as closed attitudes and a tendency towards lack of cooperation in Islamic boarding schools. Therefore, in order to prevent acts of violence in Islamic boarding schools, there are several efforts that can be made, including building synergy between the roles of parents (guardians of students) and Islamic boarding school administrators, increasing legal awareness of students regarding acts of violence, forming a Team for Prevention and Handling of Violence (TPPK). ) in Islamic boarding schools and finally optimizing the role of supervision by the government. Abstract

The implementation of the First-to-File principle within Indonesia’s intellectual property law system often raises concerns regarding justice—particularly for individuals or entities who originally created or utilized a work but failed to register it promptly. This study seeks to evaluate the compatibility of the First-to-File principle with the principle of legality in the protection of intellectual property rights and examines the extent to which it upholds justice for the original creator. As a juridical-normative study, the research employs qualitative methods through the analysis of legal documents, case studies, and a review of both national and international scholarly literature. It also uses Rawls’ theory of justice and Dworkin’s theory of rights to frame the analysis. Findings indicate that the strong emphasis on administrative procedures in the intellectual property registration system tends to overlook the moral and historical dimensions of ownership. This emphasis is normatively inconsistent with the principle of legality, which aspires to ensure equitable and proportionate legal protection. Furthermore, the disproportion between formalistic registration requirements and substantive justice creates opportunities for unethical exploitation. Accordingly, the study highlights the need for a reformulation of legal norms and policies to better accommodate the rights of original creators and to establish a fairer evidentiary mechanism within the registration process.

Abstract

After the Covid-19 pandemic ended, MSMEs selling online increased. However, price competition in the digital market is very tight, so MSMEs with small capital cannot compete with large companies that have entered the digital market first. The aim of this research is to analyze the impact of using digital marketing, financial inclusion and financial literacy on business performance which is mediated through self-efficacy. This research tests causality through a quantitative approach. The population in this study was 100 MSMEs in Kendal, Indonesia. The sample in this study was selected based on purposive sampling with certain criteria. The data analysis method uses linear regression analysis which is tested statistically via SmartPLS. The results of this research found that the use of digital marketing can influence or improve business performance. The use of digital marketing can also increase the self-confidence of MSMEs in managing their business (self efficacy). Ease of access to use financial products and services (Financial inclusion) can improve business performance. Then the ease of accessing financial products and services can also increase self-confidence to be successful (self-efficacy) in managing a business. Self-efficacy cannot mediate the influence of digital marketing, financial literacy and financial inclusion on business performance

Abstract

Persuasive communication is very important in shaping awareness, attitudes, and behavior, especially in the development of Islamic communities. In Kendal Regency, socio-religious life is influenced not only by culture and tradition, but also by legal regulations that govern social order. This study aims to analyze how persuasive communication from a legal perspective contributes to the sustainable empowerment of Islamic communities. Using a qualitative approach, data was obtained through in-depth interviews, participatory observation, and documentation. The results of the study show that the integration of legal values and Islamic principles strengthens social participation, increases legal awareness, and encourages the formation of an independent and empowered society. This study offers an integrative conceptual model between persuasive communication and legal legitimacy as a humanistic, adaptive, and relevant da'wah strategy in the context of Islamic society at the local level.
