Abstract

Abstract

ABSTRAC The purpose of writing this thesis is to find out and analyze the implementation of interfaith marriages and to find out and analyze interfaith marriages in the perspective of positive law and Islamic law. The research method is normative research type, namely research that is more oriented to the study of phenomena where all data obtained is based on research on legal materials in the form of legislation or books and documents that have to do with the topic of the research proposal. The results of this study show that: Interfaith marriages can cause psychological pressure, in the form of psychological conflicts, potentially choosing a secular lifestyle. In the Compilation of Islamic Law article 40 point c and article 44, it expressly prohibits interfaith marriages, both Muslim men and non-Muslim women and Muslim women with non-Muslim men. While in Figih law, there are views about interfaith marriages in four schools, namely Imam Abu Hanifah, Imam Syafi, Hambali School and Maliki School. 1/1974 concerning Marriage Law is not yet clear and complete in regulating interfaith marriages so as not to cause legalinterpretations which result in confusion in the community related to these problems and the consistency of the government must be emphasized again. ABSTRAK Tujuan penulisan skripsi ini adalah untuk mengetahui dan menganalisis Pelaksananaan Perkawianan Beda Agama Dan Untuk mengetahui dan menganalisiPerkawinan Beda Agama Dalam Perspektif Hukum Positif dan Hukum Islam. Metodepenelitian dengan tipe penelitian normatif, yakni penelitian yang lebih berorientasipada kajian fenomena dimana semua data-data yang diperoleh berdasarkan penelitian terhadap bahan hukum berupa perundang-undangan atau buku-buku dan dokumen yang ada hubungannya dengan topik proposal penelitian. Hasil penelitian ini menjunjukkan bahwa: Perkawinan beda agama dapat menimbulkan tekanan psikologis, berupa konflik kejiwaan, berpotensi memilih pola hidup sekuler.berdampak negatif baik bagi keutuhan rumah tangga, keyakinan maupun pendidikan anak, dalam Kompilasi Hukum Islam pasal 40 point c dan pasal 44 dengan tegas melarang perkawinan antar agama baik laki-laki muslim dengan wanita non muslim maupun wanita muslim dengan laki-laki non muslim. Sedangkan dalam hukum Figih, terdapat pandangan mengenai perkawinan beda agama dalamempat mahzab yaitu Imam Abu Hanifah, Imam Syafi‟i Mazhab Hambali dan mazhabMaliki Rekomendasi penelitian ini adalah Perlu rumusan ulang atau revisi tentangperkawinan antar agama, karena dalam UU No. 1/1974 Tentang Hukum Perkawinanbelum jelas dan tuntas dalam mengatur perkawinan beda agama sehingga tidakmenimbulkan penafsiran hukum yang berakibat adanya kebingungan padamasyarakat yang terkait dengan permasalahan tersebut dan konsistensi pemerintah harus dipertegas lagi.

Abstract

This article critically examines the interaction between Patuntung beliefs and sharia in implementing the pilgrimage, which has led to syncretism. This is qualitative research, with data sourced from interviews and library research. This study reveals that one of the Patuntung teachings practised by the Ammatoa Kajang CLC (Customary Law Community) is the Akkattere tradition of cutting young children's hair. Akkattere is symbolized by the pilgrimage in  Islamic law because capable people perform both, and both expect rewards  from Tu Rie' A'rana (God) on the next day (hereafter). People who perform Akkatrere are not required to perform the  pilgrimage in Makkah. The essence of Akkattere is a ritual of sacrifice (in its material element), and the salvation of Riallobokona Tu ride A'ra'na. The Ammatowa indigenous people consider Akkattere as the performance of taḥallul in the holy land, and they obtain the title of hajj, like people who have performed the pilgrimage in the holy land. The Ammatoa Kajang CLC believes that if people perform the Akkattere ritual and go on pilgrimage, they will get disaster.  Artikel ini bertujuan mengkaji secara kritis mengenai interaksi antara kepercayaan Patuntung dengan syariat Islam pada pelaksanaan ibadah haji yang menimbulkan sinkretisme. Jenis penelitian ini adalah penelitian kualitatif, dengan data bersumber dari wawancara dan studi dokumen. Kajian ini mengungkapkan bahwa salah satu ajaran Patuntung yang dipraktikkan masyarakat hukum adat Ammatoa Kajang adalah tradisi Akkattere berupa pemotongan rambut kepada anak kecil. Akkattere ini disimbolkan dengan pelaksanaan ibadah haji dalam syariat Islam, karena sama-sama dilakukan oleh orang mampu dan sama-sama mengharapkan pahala dari Tu Rie’ A’rana(Tuhan) pada hari kemudian (akhirat). Orang yang melaksanakan Akkattere tidak diwajibkan melaksanakan ibadah haji di Mekah. Esensi ajaran Akkattere terletak pada ritual pengorbanan (pada unsur materilnya) dan keselamatan Riallobokona Tu rie’ A’ra’na. Masyarakat adat Ammatowa menganggap bahwa Akkattere merupakan pelaksanaan taḥallul di tanah suci dan mereka memperoleh gelar haji seperti orang yang telah menunaikan ibadah haji di tanah suci. Masyarakat Ammatoa Kajang memiliki keyakinan jika orang telah melakukan ritual Akkattere kemudian berhaji akan mendapatkan musibah.

Abstract

Land disputes are one of the complex and frequent agrarian problems in Indonesia. Therefore, systematic and targeted efforts are needed to resolve land disputes in Indonesia. The National Land Agency (BPN) as a government agency tasked with managing land has an important role in resolving land disputes. This research aims to examine the role of BPN in resolving land disputes in Indonesia. The research method used in this study is a qualitative method. The data collection technique in this research is literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and drawing conclusions. The research results show that BPN has a central role in resolving land disputes in Indonesia. As an institution responsible for land administration and management, BPN plays a role in facilitating legal and administrative processes related to ownership, utilization and resolution of land disputes. BPN is tasked with providing legal certainty regarding land status, verifying ownership claims, and providing land certificates to the legal owners. Apart from that, BPN also plays a role in mediating and resolving conflicts between parties involved in land disputes, whether between individuals, traditional communities, or private parties. BPN's role is not only limited to administrative aspects, but also includes efforts to create fair and sustainable solutions, taking into account various social, economic and environmental aspects.

Abstract

Agrarian problems in Indonesia are still complex and have not been resolved completely. Inequality of land tenure, agrarian conflicts, environmental degradation, and land conversion are some examples of problems that continue to occur. In the midst of this situation, the role of civil society becomes important in fighting for sustainable agrarian policies. This research aims to analyze the role of civil society in agrarian policy advocacy in Indonesia. This research adopts a qualitative research method. Data collection is done through literature study. After the data is collected, the analysis is carried out in three stages, namely reducing data, presenting data, and drawing conclusions. The results show that the role of civil society in sustainable agrarian policy advocacy is very important in ensuring social justice, environmental protection, and strengthening the rights of farmers or indigenous peoples related to land. Civil society, through non-governmental organizations (NGOs) and activist networks, acts as a watchdog and critic of agrarian policies issued by the government. In addition, civil society also plays a role in providing education and understanding to local communities about their rights related to land, as well as mobilizing public support to strengthen their demands for equitable agrarian policies.

Abstract

The 1945 Constitution, Article 33 paragraph (1) grants the State the authority to regulate and manage natural resources, including land, for the welfare of the people. This authority is further elaborated in the Basic Agrarian Law (UUPA), which establishes regulations concerning land ownership, utilization, and management. The UUPA recognizes the state's right of control (recht van beschikking), customary land rights (hak ulayat), and land use rights for business purposes. However, these rights must align with the principle of prioritizing the public interest. In practice, the subordination of customary rights and land use rights to public interest policies can potentially lead to conflicts and economic losses for the rights holders. Issues such as inadequate compensation, lack of consultation, and improper recognition of customary rights often arise, particularly in regions where land is closely tied to indigenous traditions and livelihoods. To address these concerns, there is an urgent need for a standardized regulatory framework that balances the principle of public interest with the protection of customary rights and business land use rights. Such a framework should ensure legal certainty, equitable compensation, and mechanisms for conflict resolution to prevent injustice. By harmonizing state authority with individual and communal rights, the regulation can contribute to sustainable land management while upholding justice and public welfare. This study highlights the importance of legal reform to create comprehensive and inclusive land policies that safeguard the rights of all stakeholders.

Abstract

Based on the provisions of articles 28A to 28J of the 1945 Constitution, the state is obliged to fulfill, protect and respect the human rights of every citizen. This guarantee is not just written without reason or purpose, but this guarantee must protect every human being from the use of unlimited power or the actions of authorities who act arbitrarily. The research method uses library research, namely a research process carried out through collecting data and information from various related sources. The results of the research in this paper are that the right to education must be accessible to anyone regardless of the individual's background, so that everyone can receive education equally. Fulfillment of this right is implemented in the form of providing facilities, access or resources that enable the fulfillment of the right to education to all people, both those who have the ability to finance their education and those who do not have the ability to finance their education, or based on differences in ethnicity, religion, race, class. , gender, different social backgrounds

Abstract

Study This to study review criminology to act criminal human trafficking (TPPO), as well as factors that become reason the occurrence abuse narcotics in women in Makassar City. The method used is study law empirical with approach regulation legislation and approaches case For analyze existing regulations​ as well as challenge in enforcement law . Research results show that TPPO can understood as complex crimes , involving​ various factor economic , social and network criminal organized . Enforcement law to practice This faced with factors like lack of coordination between institutions and the lack of understanding public about risk law . Abstract

This study aims to analyze legal reform efforts in Indonesia to protect consumers in the digital era and to prepare consumers to face the era of rapid technological developments in digitalization. The method applied in this study is a normative method with a descriptive approach to identify regulatory gaps and challenges in their implementation. The results of the study show that although Indonesia has several regulations related to consumer protection in the digital world, regulatory reform is still very much needed, especially regarding personal data protection and more effective dispute resolution. In addition, consumer readiness in facing the digital era is also influenced by low digital literacy, which is an obstacle to increasing awareness of consumer rights. The government, digital platforms, and consumer protection institutions need to work together to improve public understanding of their rights and obligations as consumers in the digital era.

Abstract

Abstract This study examines the legal implications of online sales agreements based on the Indonesian Civil Code (KUHPerdata) and Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE). The research is motivated by the rapid growth of electronic transactions, which has given rise to various legal issues such as fraud, breach of contract, and weak consumer protection due to the limitations of conventional legal frameworks. The study employs a normative legal research method using statutory, conceptual, and analytical approaches, and is analyzed through four main theories: Contract Theory, Legal Certainty Theory, Consumer Protection Theory, and Cyber Law Theory. The findings indicate that an online sales agreement is valid as long as it fulfills the requirements stipulated in Article 1320 of the Civil Code, namely consent, legal capacity, a specific object, and a lawful cause. The UU ITE strengthens this legal foundation by recognizing electronic information and electronic signatures as valid evidence. However, in practice, issues persist, such as difficulties in verifying digital identities, personal data security risks, and the weak liability of e-commerce platforms for consumer losses. Legal consequences of imperfect online sales agreements may include annulment, compensation, and claims for breach of contract. These conditions underscore the need for synchronization between the Civil Code and the UU ITE to ensure balanced legal certainty and protection for sellers, buyers, and platform providers. This study emphasizes that Indonesian civil law must adapt to technological developments to remain relevant in the digital era. Strengthening derivative regulations, enhancing public digital legal literacy, and establishing effective online dispute resolution mechanisms are essential to realizing secure, fair, and trustworthy electronic transactions.
