Abstract

Introduction: Regulation of Customary Law Communities in a state constitution is important to guarantee their existence and guarantee their protection. The regulation of Indigenous Law Communities in the constitution is also intended so that the regulations under the constitution can be in line with the constitution in facilitating Indigenous Law Communities.Purposes of the Research: The aim of this research is to formulate the basic principles of MHA which must be regulated in the constitution as well as efforts to amend the constitution to formulate the basic principles of MHA in the constitution.Methods of the Research: Normative legal research using case, concept and legislative approaches.Results of the Research: The basic principles of MHA that need to be formulated in the constitution include various basic values of MHA, such as having customary legal norms, having ulayat rights or traditional rights related to natural resource management, and having traditional apparatus with various characteristics that exist in each MHA. Revision of Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia as an effort to amend the constitution to include the basic principles and values of the MHA can be carried out by including basic values and principles in the MHA which include: the existence of customary legal norms, having customary rights or related traditional rights. With natural resource management, as well as having traditional apparatus with various characteristics that exist in each MHA..

Abstract

Perkawinan poligami sebagai salah satu bentuk perkawinan yang diakui secara terbatas dalam hukum di Indonesia menimbulkan sejumlah implikasi hukum, khususnya terkait kedudukan anak kandung dan hak waris para pihak yang terlibat. Penelitian ini bertujuan untuk menganalisis kedudukan hukum anak kandung dalam perkawinan poligami menurut KUHPerdata dan KHI, serta mengkaji akibat hukum yang timbul bagi ahli waris dari hubungan perkawinan tersebut. Metode yang digunakan adalah pendekatan yuridis normatif dengan mengkaji peraturan perundang-undangan, yurisprudensi, serta doktrin hukum. Hasil penelitian menunjukkan bahwa KUHPerdata cenderung memberikan pengakuan terbatas terhadap anak dalam poligami yang tidak dicatat secara resmi, sedangkan KHI mengakui status anak sepanjang perkawinan sah secara agama. Dalam hal warisan, terdapat perbedaan perlakuan yang dapat menimbulkan ketidakadilan hukum bagi anak dan istri dari istri kedua atau ketiga. Oleh karena itu, diperlukan harmonisasi regulasi agar hak-hak anak kandung dan ahli waris dalam perkawinan poligami dapat terlindungi secara adil dan menyeluruh. Polygamous marriage, as a form of marriage recognised in a limited sense within Indonesian law, creates several legal implications, particularly regarding the legal status of biological children and the inheritance rights of parties involved. This study aims to analyse the legal status of biological children in polygamous marriages under the KUHPerdata and KHI, and to examine the legal implications for heirs resulting from such marital relationships. This research uses a normative juridical approach by examining legislation, jurisprudence, and legal doctrines. The findings indicate that the Civil Code tends to offer limited recognition to children from unregistered polygamous marriages, while KHI grants recognition as long as the marriage is religiously valid. In terms of inheritance, differing treatments may result in legal injustice for children and wives from subsequent marriages. Thus, regulatory harmonisation is essential to ensure fair and comprehensive protection of the rights of biological children and heirs in polygamous marriages.

Abstract

Penelitian ini bertujuan untuk menganalisis secara kriminologis tindak pidana pencurian yang dilakukan oleh anak di Kota Makassar, dengan fokus pada dua aspek utama: upaya pencegahan dan faktor-faktor yang memengaruhi anak dalam melakukan tindak pidana tersebut. Tindak pidana pencurian yang melibatkan anak tidak hanya mencerminkan dinamika sosial dan ekonomi dalam masyarakat perkotaan, tetapi juga menunjukkan adanya celah dalam sistem perlindungan anak serta lemahnya pengawasan lingkungan. Secara kriminologis, anak sebagai pelaku tindak pidana umumnya berada dalam situasi yang kompleks, mulai dari pengaruh lingkungan keluarga, pergaulan, hingga ketimpangan sosial. Upaya pencegahan yang dilakukan oleh berbagai pihak di Makassar—termasuk pemerintah, aparat penegak hukum, lembaga pendidikan, dan masyarakat—masih bersifat parsial dan kurang terintegrasi. Oleh karena itu, diperlukan pendekatan preventif yang berorientasi pada keadilan restoratif, rehabilitasi sosial, serta penguatan nilai-nilai keluarga. Kajian ini merekomendasikan perumusan kebijakan yang responsif terhadap kebutuhan anak dan berbasis pada pendekatan multidisipliner agar dapat menanggulangi kejahatan anak secara lebih komprehensif. This study aims to provide a criminological analysis of theft crimes committed by minors in Makassar City, focusing on two main aspects: prevention efforts and the factors influencing children to engage in such criminal acts. Theft offences involving children reflect not only the socio-economic dynamics of urban life but also indicate gaps in child protection systems and weak environmental supervision. From a criminological perspective, children who commit crimes are often influenced by complex circumstances such as family environment, peer influence, and social inequality. Prevention efforts in Makassar—carried out by the government, law enforcement, educational institutions, and communities—remain partial and lack an integrated approach. Thus, a preventive strategy is needed that emphasises restorative justice, social rehabilitation, and the reinforcement of family values. This study recommends formulating responsive policies based on multidisciplinary approaches to comprehensively address juvenile delinquency and minimise recidivism among minors.

Abstract

Penelitian ini bertujuan untuk menganalisis strategi penanganan kasus persetubuhan yang melibatkan remaja yang tidak terikat dalam hubungan perkawinan, dengan fokus pada peraturan hukum yang berlaku serta faktor-faktor yang memengaruhi maraknya kasus tersebut. Fenomena ini kian kompleks seiring perkembangan teknologi informasi, pergeseran nilai-nilai sosial, dan lemahnya kontrol dari lingkungan keluarga maupun sekolah. Metode penelitian yang digunakan adalah metode hukum normatif, dengan pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus, dan pendekatan perbandingan. Hasil penelitian menunjukkan bahwa masih terdapat celah dalam penegakan hukum terhadap pelaku persetubuhan remaja, terutama dalam hal pembuktian persetujuan dan usia korban. Selain itu, masih lemahnya pemahaman aparat penegak hukum terhadap konteks psikologis remaja menyebabkan pendekatan yang digunakan cenderung represif daripada rehabilitatif. Oleh karena itu, dibutuhkan reformulasi kebijakan hukum pidana dan pendekatan sistem perlindungan anak yang lebih holistik, baik dari aspek pencegahan, intervensi hukum, maupun rehabilitasi. Kajian ini diharapkan menjadi rujukan akademik dan praktis bagi para pembuat kebijakan, akademisi, dan aparat penegak hukum dalam menangani kejahatan seksual terhadap remaja secara lebih adil dan manusiawi. This study aims to analyse the strategies for addressing sexual intercourse cases involving adolescents not bound by marriage, focusing on the applicable legal regulations and the contributing factors behind the prevalence of such incidents. The phenomenon is becoming increasingly complex due to the rapid development of information technology, the shift in social values, and the weakening of supervision from both families and schools. The research adopts a normative legal method with statutory, conceptual, case, and comparative approaches. The findings reveal significant gaps in the enforcement of laws against adolescent sexual offenders, particularly in proving consent and determining the victim’s age. Moreover, law enforcement officers often lack an in-depth understanding of the psychological conditions of adolescents, resulting in a more repressive rather than rehabilitative legal approach. Therefore, reformulation of criminal justice policies and a holistic child protection system are needed, encompassing prevention, legal intervention, and rehabilitation. This study is expected to serve as both an academic and practical reference for policymakers, academics, and law enforcement officials in addressing adolescent sexual crimes in a more just and humane manner.

Abstract

This research aims to determine and analyze restorative justice arrangements in criminal acts of narcotics abuse for children as well as obstacles and solutions in implementing restorative justice in criminal acts of narcotics abuse for children. The research method used in this research is normative juridical. The results of this research show that restorative justice in handling and resolving narcotics crimes committed by children and efforts to resolve problems related to the use of diversion tactics in juvenile narcotics crimes in general have not run optimally in accordance with the provisions of Law Number 11 of 2012 concerning the justice system. children and the formal criminal justice system. Research recommendations to law enforcement officials that it is best to implement Restorative Justice in handling criminal acts of narcotics abuse by children in Indonesia should take a comprehensive approach.

Abstract

Natural resource management is crucial for sustainable development, especially in regions abundant in biodiversity and natural assets. Nations worldwide face the challenge of managing their resources effectively while promoting economic growth, social justice, and environmental conservation. Customary law plays a significant role in resource governance, particularly in countries like Indonesia and Australia, where indigenous communities have deep-rooted connections to the land and its resources. This comparative study explores the role of customary law in natural resource management in Indonesia and Australia. Both countries possess diverse ecosystems and substantial indigenous populations, offering valuable insights into the interaction between customary and state legal systems in resource governance. In Indonesia, customary law, known as adat, influences resource management practices, albeit with variations in recognition and integration into formal legal frameworks. Conversely, in Australia, the colonization process has disrupted traditional governance structures, leading to ongoing struggles for indigenous rights and recognition. By examining case studies, legal frameworks, and policy initiatives in both countries, this study aims to identify challenges and opportunities for integrating customary law into broader governance frameworks and promoting more equitable and sustainable resource management practices. Additionally, this comparative analysis contributes to scholarly debates on the role of customary law in contemporary legal systems and its implications for environmental governance, indigenous rights, and social justice. Interdisciplinary perspectives from legal studies, anthropology, environmental science, and development studies offer valuable insights for policymakers, practitioners, and indigenous communities striving for more inclusive and effective resource management approaches.
