Abstract

Pembuktian perjanjian secara lisan terkait hutang piutang menurut hukum di Indonesia serta penyelesaian perjanjian tersebut apabila terjadi wanprestasi. Di Indonesia, perjanjian lisan dianggap sah berdasarkan Pasal 1320 KUH Perdata, namun sering kali sulit dibuktikan di pengadilan tanpa adanya dokumen tertulis. Untuk mengatasi kesulitan ini, bukti-bukti lain seperti saksi, bukti elektronik, dan pengakuan dari pihak yang berhutang dapat digunakan. Jika terjadi wanprestasi, langkah pertama yang biasanya dilakukan adalah memberikan peringatan atau somasi. Penyelesaian sengketa dapat dilakukan melalui pengadilan atau alternatif lain seperti mediasi dan arbitrase untuk menghindari proses yang panjang dan mahal. Saran yang diberikan meliputi dokumentasi kesepakatan, menyimpan bukti pendukung, menggunakan saksi, mengirimkan peringatan tertulis, mempertimbangkan mediasi atau arbitrase, konsultasi hukum, dan menjaga komunikasi yang baik.

Abstract

Dengan perkembangan teknologi informasi dan komunikasi, khususnya media sosial, telah terjadi pergeseran besar dalam cara orang berinteraksi dan berkomunikasi satu sama lain.. Meskipun membawa banyak manfaat, teknologi ini juga menimbulkan dampak negatif seperti kejahatan, ujaran kebencian, penghinaan, dan penyebaran informasi yang merugikan. Kejahatan yang berkaitan dengan agama, ras, dan suku sering kali muncul dalam bentuk komentar dan unggahan yang menghina, sehingga mempengaruhi pandangan dan respons hakim terhadap kasus ujaran kebencian di media sosial. Penelitian ini bertujuan untuk memahami karakteristik ujaran kebencian dan menganalisis perbedaan dalam pertimbangan hakim saat memutuskan kasus tindak pidana ujaran kebencian di media sosial. Metode penelitian yang digunakan adalah Penelitian Normatif, dengan menganalisis putusan pengadilan yang mencerminkan pandangan hakim. Hasil penelitian memberikan wawasan tentang pertimbangan hakim dalam kasus-kasus ini, yang bervariasi tergantung pada faktor dan unsur yang dilakukan oleh terdakwa menurut Menurut Undang-Undang Nomor 11 Tahun 2008, siapa pun yang dengan sengaja dan tanpa hak menyebarkan informasi yang bertujuan untuk menimbulkan kebencian atau permusuhan terhadap individu atau kelompok tertentu berdasarkan suku, agama, ras, dan antargolongan (SARA) dilarang melakukannya. Pertimbangan hakim mencakup faktor-faktor memberatkan, seperti dampak terhadap masyarakat, serta faktor meringankan, seperti status terdakwa, belum pernah dihukum sebelumnya, dan sikap sopan dalam persidangan.

Abstract

Tourism is the activity of temporary travel of one or more people to a location other than their place of residence. In Batu Bengkung, residents depend on tourism for their livelihood. This study discusses legal protection for tourists by focusing on two aspects. First, Law no. 10 of 2009 concerning Tourism regulates legal protection for tourists and tourism industry players in the event of loss from both parties. Second, the manager's obligation to guarantee the security and safety of Batu Bengkung beach visitors if an incident occurs. The research method used is an empirical research technique with a sociological legal perspective. The results of the study show that Law Number 10 of 2009 concerning Tourism provides fair protection for travelers and tourism industry players. This protection covers the full rights and obligations of both parties. The responsibility of the manager for the safety and security of Batu Bengkung Beach tourists is to provide insurance claims and hospital medical expenses for victims.

Abstract

The standard clause which states "Loss of personal items is not the responsibility of the hotel" results in weak consumer legal protection for the use of accommodation or hotel services. The aim of the research is to analyze the hotel's responsibility in providing security guarantees for hotel’s guests. The type of research is normative juridical legal research. The research approach used is the Statue Approach and Case Approach. The method of collecting legal materials is through literature study with normative legal material analysis techniques. The results of the research prove that the responsibility of hotels as lodging service providers in providing security guarantees for hotel’s guests is that they are obliged to provide consumer comfort and security in the hotel area they manage and in the event of a loss provide compensation for hotel’s guests losses. The consumer protection provided to hotel’s guests in cases of loss of goods inside hotel room is the existence of consumer rights including the right to security and safety, the right to information, the right to be heard and the right to compensation.

Abstract

This study examines the juridical review of legal liability for road users who cause road damage in Indonesia. Using a normative legal research approach, this study analyzes the existing legal framework, specifically Law Number 22 of 2009 on Road Traffic and Transportation (UU LLAJ) and its related regulations. The findings indicate that road damage, often caused by over dimension over loading (ODOL) vehicles, creates a duality of responsibility. On one hand, the government, as the road operator, has a legal obligation to maintain and repair roads and can be subject to criminal sanctions for negligence. On the other hand, road users who cause damage are also liable for criminal penalties and civil compensation. Although the legal framework is robust, law enforcement remains suboptimal due to challenges like overlapping authority, budget constraints, and a lack of inter-agency coordination. Therefore, this study concludes that effective law enforcement requires synergy among institutions, the use of technology, and increased public legal awareness to create a safe and sustainable transportation system

Abstract

This normative juridical study analyzes legal sanctions for road traffic and transport violations as a vital instrument for achieving public order and safety. The research examines the legal foundation, forms of violations, and the effectiveness of sanctions regulated in Law Number 22 of 2009 on Road Traffic and Transport (LLAJ Law). The analysis indicates that violations are a multidimensional issue caused not only by individual factors but also by inconsistent law enforcement and social culture. The study asserts that sanctions, whether in the form of administrative fines or imprisonment, serve to provide a deterrent effect, reduce accident rates, and strengthen legal certainty. Although the regulatory framework exists, its implementation on the ground still faces challenges such as collusion and limited resources. As a recommendation, this study proposes a transformation in law enforcement through digitalization (electronic traffic ticketing/ETLE system), enhanced transparency, and the implementation of a demerit point system for driver's licenses. These measures aim to build a sustainable culture of traffic discipline and increase public trust in the justice system

Abstract

: Gambling is a game where players bet using money to choose one option among several options where only one option is correct and becomes the winner. Law enforcement against gambling is not optimal, gamblers and bookies are not punished in accordance with applicable law, even though gambling is clearly a criminal act that is against the law in Indonesia. The problem in this research concerns the legal aspects of online gambling based on Law Number 19 of 2016 concerning Electronic Information and Transactions and what are the inhibiting factors in law enforcement against online gambling based on Law Number 19 of 2016 concerning Electronic Information and Transactions. This research uses a normative research method. Research Results and Discussion: Legal aspects of online gambling have been regulated by Law Number 19 of 2016 concerning Information and electronic transactions and are enforced by law by carrying out preventive and repressive efforts. Inhibiting factors in law enforcement against online gambling are the legal factors themselves, human resource factors, infrastructure and facilities factors and community factors. The conclusion and suggestion in this research is that prevention efforts are needed by blocking sites that contain gambling content as part of the police's efforts to eradicate criminal acts of online gambling. Law enforcers must provide more information to the public about the dangers of online gambling crimes.

Abstract

This study analyzes the implementation of the law on Corporate Social Responsibility (CSR) obligations in mining companies in Indonesia. Although CSR has become a legal obligation regulated in Law No. 40 of 2007 concerning Limited Liability Companies and Government Regulation No. 47 of 2012, its implementation still faces various obstacles, including weak supervision and ineffective legal sanctions. The research method used is normative legal research with a legislative and conceptual approach to evaluate the effectiveness of regulations in ensuring companies' compliance with their social responsibilities. The results of the study show that the implementation of CSR in the mining sector tends to be an administrative formality without providing real benefits to the surrounding community. In addition, the incompatibility between national regulations and international standards such as ISO 26000 creates legal loopholes that allow companies to circumvent their CSR obligations. The government needs to strengthen the supervision mechanism, set clearer indicators of CSR success, and implement stricter sanctions for companies that violate legal provisions. Community participation is also an important factor in supervising and evaluating CSR programs in order to provide a more sustainable social and environmental impact..

Abstract

This study analyzes the legal aspects of franchise agreements in the culinary sector based on the Regulation of the Minister of Trade No. 71 of 2019. Franchising as a rapidly growing business model in Indonesia presents legal challenges related to contract transparency, legal certainty, and the balance of rights and obligations between franchisors and franchisees. This study uses a normative legal approach by analyzing laws and regulations, legal doctrines, and franchise business practices in Indonesia. The results of the study show that although the regulation has provided a clear legal framework, its implementation still faces obstacles, especially in the aspect of supervision and understanding of business actors regarding their rights and obligations. The franchisor has protection over intellectual property rights and operational control, while the franchisee is guaranteed through the franchisor's obligation to provide technical support and training. However, weak supervision and lack of legal education for franchisees still cause unfair practices in franchise agreements. Dispute resolution through arbitration is preferable to litigation because it is faster and more flexible, but cost constraints and procedural understanding are still major obstacles. Therefore, it is necessary to strengthen regulations, increase supervision, and legal education for business actors so that franchise agreements can run more transparently, fairly, and provide legal certainty for all parties involved..

Abstract

The development of financial technology (fintech) has changed consumption patterns in society, including among students. One popular innovation is the PayLater feature, which allows users to make transactions with delayed payment. However, this convenience may create legal and financial risks if it is not supported by adequate financial literacy and legal understanding. This study aims to analyze the role of legal education in improving students' financial literacy and in promoting the responsible use of PayLater services. The research uses a normative juridical method with a statutory approach by examining several regulations, including Law Number 8 of 1999 on Consumer Protection, the Electronic Information and Transactions Law, and Government Regulation on the Implementation of Electronic Systems and Transactions. The results show that legal education increases students’ awareness of their rights and obligations as digital consumers. Understanding PayLater regulations can also help prevent excessive consumption and misuse of digital services. Therefore, integrating legal education with financial literacy is important to foster a generation of young people who are legally aware and financially responsible in using digital financial services.
