Abstract

Forms of imprisonment are divided into 2 (two), namely imprisonment for a certain time and imprisonment for life. Life imprisonment is a prison sentence that is served by the convict by remaining in prison until his death. This research is a legal research that uses a statutory approach, and a conceptual approach is used to find out the effectiveness and efficiency of life imprisonment as a form of punishment. This research also describes the ineffectiveness of life imprisonment and seeks to describe forms of punishment that are more appropriate to be carried out in this modern era for the sake of upholding justice and achieving the goals of punishment.

Abstract

Direksi merupakan salah satu organ perseroan disamping komisaris dan pemegang saham. Direksi merupakan organ perseroan terbatas yang mempunyai tugas untuk menjalankan segala aktifitas di dalam suatu perseroan terbatas, disamping itu Direksi berwenang untuk mewakili perseroan didalam dan diluar pengadilan. Direksi dalam melaksanakan tugasnya selalu berpedoman pada Anggaran Dasar/Anggaran Rumah Tangga (AD/ART) suatu perseroan terbatas, apabila seorang Direksi melakukan tindakan melebihi kewenangannya yang telah dicantumkan dalam Anggaran Dasar/Anggaran Rumah Tangga (AD/ART), maka tindakan tersebut dapat dikatakan sebagai tindakan Ultravires. Adapun contoh tindakan Ultravires tersebut adalah penggelapan pajak yang dilakukan oleh Direksi dengan membeli barang-barang untuk keperluan perseroan terbatas dari pasar gelap (black market). Terhadap penggelapan pajak ini tentu perseroan dapat dikenakan sanksi berdasarkan peraturan perundang-undangan yang berlaku. Direksi yang melakukan ultravires bisa saja karena kehendak pribadi Direksi itu sendiri diluar kehendak perseroan. Terhadap hal ini perseroan dapat melakukan upaya hukum terkait sanksi yang dijatuhkan terhadap perseroan terbatas tersebut dikarenakan penggelapan pajak yang dilakukan oleh Direksi. Penelitian ini merupakan penelitian hukum yang menggunakan pendekatan perundang-undangan dan pendekatan konseptual dalam memecahkan masalah sehingga didapatkan suatu hasil bahwa perseroan terbatas dapat melakukan upaya hukum terhadap Direksi yang melakukan Ultravires tersebut.

Abstract

Ilmu hukum dogmatik selalu berbicara mengenai hukum dan selalu berpikiran untuk mencari dan menemukan penyelesaian-penyelesaian konkret atas problematik hukum. Oleh karena itu maka tugas ilmu hukum dogmatik adalah memberi/mengadakan preskriptif, analisis, mensistematisasikan, menafsirkan, dan menilai hukum yang berlaku (terapan). Ilmu hukum (jurisprudence) merupakan suatu ilmu yang bersifat sui generis, maka fokus perhatian seharusnya berada pada hukum itu sendiri. Akan tetapi berbeda halnya menurut penganut mahzab ilmu empiris dalam hukum, mereka menganggap bahwa mempelajari ilmu hukum harus juga mempelajari cabang-cabang ilmu lain yang berkaitan dengan ilmu hukum. Kriminologi merupakan keseluruhan pengetahuan yang membahas mengenai kejahatan sebagai suatu gejala sosial. Termasuk didalamnya pembahasan proses pembuat undang-undangnya, pelanggaran terhadap undang-undang serta reaksi terhadap pelanggaran undang-undang. Sebenarnya kejahatan menurut hukum pidana dan kejahatan menurut kriminologi sebagian besar terjadi overlapping, mereka merupakan 2 (dua) lingkaran yang titik singgungnya tidak terletak satu sama lain dalam satu titik yang sama, akan tetapi juga tidak berjauhan. Kajian hukum pidana memiliki dimensi unsur kesalahan dan unsur melawan hukum, sedangkan kriminologi memiliki dimensi motif pelaku dan faktor sosial yang memberikan kesempatan pada pelaku untuk melakukan kejahatan. KataKunci :Kriminologi,IlmuHukum,HukumPidana.

Abstract

The agreement is the right of every person to enter into an agreement, but entering into an agreement must see the rules or provisions governing the agreement so that the agreement is valid. The lease-purchase agreement is a creation of practice based on the principle of freedom of contract. Freedom of contract is not purely as free as possible, there are limitations in carrying out or making contracts. One of the limitations of the principle of freedom of contract is Article 18 of Law Number 8 of 1999 concerning Consumer Protection, which lists several things that cannot be done in a contract. As a result, if this is done, the contract is null and void by law. Many lease agreements nowadays are agreements made unilaterally by the seller, which should have been made by both parties, what determines everything is that the seller and the consumer just have to agree and comply. This weak consumer position and cause many losses. It is this weak position that is exploited by the seller by imposing several things in the articles of the agreement such as taking back the unit if it does not pay without taking into account the payment made by the consumer beforehand. This research is a normative legal research that uses a statutory approach, a conceptual approach, and case approach that aims to find out the re-examination of motor vehicle lease-purchase agreement construction

Abstract

Applicability Constitution Number 11 of 2020 concerning Job Creation changes several arrangements previous employment _ arranged in Constitution Number 13 of 2003 Concerning Employment give rise to various polemic in proven implementation _ with he sued Constitution Number 11 of 2020 concerning Job Creation to Court The resulting constitution decision that Constitution the must repair, especially those related with employment. Because of That Government through the President set Regulation Government Replacement Law (PERPU) Number 2 of 2022 concerning Job Creation as an answer to the polemic and emptiness of the law that occurred. Study This is a study law normative with the use approach legislation and approach conceptual study about the constitutionality of PERPU Number 2 of 2022 concerning Job Creation which has been determined by the President Republic of Indonesia. PERPU is made only if a situation is critical. PERPU 2/2022 was created when the Job Creation Law was declared to need to be revised because it was decided by the MK to be in conflict with the Constitution, while the Covid 19 conditions required the state to continue to maintain economic stability, therefore PERPU 2/2022 was issued, however, this PERPU was also challenged by the MK because It is considered that some of the content does not reflect any form of protection for workers. Apart from that, the applicant's argument for a judicial review of PERPU also argued that PERPU 2/2022 was made even though it was not in a critical situation.

Abstract

Licensing is a spirit of administrative law that studies law in a moving state. Licensing is required for the running of a government, both central government and regional government. Based on the principle of decentralization, regional governments are allowed to regulate their own areas and for this reason permits are issued by the regional government. In practice, there is a lot of overlapping and overlapping regarding licensing between the central government and regional governments both in terms of substance and technical implementation in each existing Regional Work Unit (SKPD), the enactment of Law Number 6 of 2023 concerning the Determination of Replacement Government Regulations Law Number 2 of 2022 concerning Job Creation Becomes a Law changing the licensing constellation in Indonesia. In the area licensing is attempted to be carried out through a service system implemented by Online Single Submission (OSS) and One Stop Integrated Service (PTSPP), both of which must be integrated with OSS. Licensing services in areas that are integrated with or PTSP are the focus of this research study. This research is normative legal research that uses a statutory approach and a conceptual approach that will be used to answer existing legal issues.

Abstract

Pursuant to Article 24 paragraph (2) of the 1945 Constitution of the Republic of Indonesia (1945 Constitution of the Republic of Indonesia) it is stated that judicial power is exercised by a Supreme Court and judicial bodies under it within the realm of general courts, religious courts, military courts, state administrative courts and by a Constitutional Court. Based on Article 1 number 8 of Law Number 48 of 2009 Concerning Judicial Power (UU 48/2009) there is a special court that has the authority to examine and hear and decide on certain cases which can only be formed within one of the judicial bodies under the Supreme Court. regulated in laws and regulations. The limitation of judicial institutions as stipulated in Article 24 paragraph (2) of the 1945 Constitution of the Republic of Indonesia does not allow for judicial institutions that are not within the scope of the Supreme Court and/or the Constitutional Court. However, there is a judicial institution, namely the Tax Court as stipulated in Article 2 of Law Number 14 of 2002 concerning the Tax Court (UU 14/2002), which is a judicial body that exercises judicial power for taxpayers seeking justice in tax disputes. Regarding the Tax Court, the guidance is carried out by the Supreme Court and the Ministry of Finance. This makes the tax court not completely independent as a judicial institution in general that carries out a judicial function (there is still interference from the executive branch, namely the ministry of finance), plus that the Supreme Court, in order to be able to fully supervise the tax court both technically and administratively, the tax court should be under the judicial institutions under the Supreme Court. This research is a normative juridical research using statutory and conceptual approaches with the aim of finding an ideal arrangement regarding the institutional structure of the tax court in Indonesia

Abstract

In 2024, the number of Muslim population in the world in general and specifically in Indonesia will increase. Of course, this is also followed by market demand for consumer products that are guaranteed halal. In the past, halal product certification was carried out by the Indonesian Ulema Council based on applicable laws and regulations. Currently, there are improvements both in terms of regulation and from the side of institutions authorized to issue halal certification for a consumer product, one of which is the establishment of the Halal Product Assurance Organizing Agency (BPJPH) which is authorized to issue halal certification of consumer products. This research is a normative legal research that uses a statutory approach, and a conceptual approach to answer legal issues and produce findings regarding institutions authorized to issue halal certification of applicable consumer products.

Abstract

This research discusses identity forgery in marriage. Identity forgery is a form of crime that often occurs. The focus of the research raised is: 1) What are the forms of identity falsification in the context of marriage that occur in practice in the community? 2) How is the regulatory and legal framework in Indonesia that regulates cases of identity forgery in marriage? This research uses normative legal research methods, questions are analyzed by combining legal materials (which are secondary data). The conclusions of this research are: It is important to implement security measures and conduct careful identity verification in the context of marriage to prevent cases of identity forgery, it is also important to note that regulations and laws are subject to change, and up-to-date verification from official sources or consultation with legal experts is recommended for a more accurate and up-to-date understanding.
