Abstract

This paper examines the Passampo siri’ tradition (marriage of disgrace) in the Bugis community through paradigmatic analysis using the framework of Critical Theory. The research method used is a literature study to collect data from relevant literature sources. The data were analyzed qualitatively with a paradigmatic approach to achieve contextual and in-depth meaning related to the philosophical background of Passampo Siri’ and its implications for his abolition discourse. The results of the analysis show that Passampo siri’ is actually a socio-cultural entity born from the habitus of the Bugis people towards the concept of self-esteem (siri') as a core value. Removing them without a contextual understanding can threaten the integrity of the values that have been upheld and closely guarded so far. Therefore, this case reminds us of the importance of reflective attitudes and multidimensional analysis before deciding to "break" a tradition that is considered purely irrational. This research seeks to integrate epistemological reflections from critical theory in understanding the Passampo siri’, highlighting how power structures, ideologies, and social norms shape and influence those cultural practices. This study emphasizes that the abolition discourse must consider the historical and social context behind this tradition. The results of this study provide insight that cultural reform requires an approach that respects the complexity and richness of local values, while opening up a space for constructive critical dialogue.

Abstract

This research explores the adaptation of Islamic law through local wisdom, particularly the gotong royong tradition, in Muslim minority communities in Tomohon and Tana Toraja. Using a qualitative approach and case study method, the research involved 20 informants, including Islamic religious leaders, traditional leaders, and active Muslim community members. The findings show that the gotong royong tradition facilitates the practice of Islamic law in marriage, zakat management, and religious celebrations by integrating the values of inclusivity and local cultural solidarity. Harmony is created through intensive dialogue between Islamic and Christian religious leaders, strengthening interfaith relationships. Adjustments, such as the use of moderate adhan volume and distribution of zakat to all levels of society regardless of religion, serve as tangible evidence of this adaptation. This research contributes to the development of Fiqh Nusantara, demonstrating the flexibility of Islamic law that can align with local culture while supporting social inclusion. Practically, these results provide insights for policymakers to design policies that support religious harmony in multicultural regions. This research affirms that Islamic law not only maintains its essential teachings but can also become an integral part of pluralistic society. The implications of this research open opportunities for further studies on the harmonization of Islamic law in other minority communities.

Abstract

In recent years, the proliferation of online transactions has extended into diverse markets, including the mobile phone swap market. This study investigates the compatibility of such transactions with Sharia economic law, using Tuminting, Indonesia, as a case study. The research employed a qualitative approach, incorporating interviews and observations to gather data from participants engaged in online phone swap transactions. Key findings indicate that while these transactions provide convenience and accessibility, they raise significant concerns regarding compliance with Sharia principles, particularly in terms of economic justice and transaction transparency. The study proposes a framework for enhancing Sharia compliance in online swap transactions, suggesting modifications in transaction structures and regulatory oversight. This research contributes to the understanding of digital market dynamics in Islamic finance, offering insights for consumers, practitioners, and policymakers striving for ethical economic practices in digital transactions.

Abstract

This study examines the Compilation of Islamic Law (KHI) as a consideration for Religious Court Judges in North Sulawesi in resolving legal cases. This paper is empirical legal research using the sociology of law approach based on facts related to the considerations of judges and decisions of the religious courts in North Sulawesi as the application of the Compilation of Islamic Law. The data collection technique is based on literature review, especially court decisions and in-depth interviews with judges. The findings show that there are four forms of application of KHI, namely: First, KHI is the main reference with considerations: 1) if there is no basis for legal considerations in Laws and Government Regulations; 2) KHI is the agreement of the ulema and is a series of written laws; 3) KHI is jurisprudence, Second, KHI is a reinforcement reference to Government Laws and Regulations with the following considerations: 1) KHI is a reaffirmation of Government Laws and Regulations; 2) KHI provides Islamic characteristics and values; 3) KHI is a special provision for Muslims; 4) KHI realizes marriages must be carried out based on the provisions of the law of religion and belief. Third, KHI is a special reference with the considerations: 1) KHI regulates specifically, while it is not found in laws and Government Regulations; 2) KHI is a special reference for Religious Courts; 3) KHI has regulated while the laws and regulations have not regulated, and Fourth, KHI is not a reference at all with the consideration that no legal basis is found.

Abstract

The introduction of a new halal logo in Indonesia by the Halal Product Assurance Agency (BPJPH) in 2022 has triggered wide-ranging public responses, particularly from Muslim consumers and stakeholders. This study explores the perceptions of Islamic economics scholars regarding the new halal logo, analyzed through the lens of Muslim consumer behavior theory. Using a descriptive qualitative approach, data were collected through in-depth interviews with eight lecturers from the Faculty of Islamic Economics and Business at the State Institute for Islamic Studies (IAIN) Manado. The findings reveal that five out of eight participants expressed disapproval toward the new logo, citing its aesthetic complexity, lack of clear Islamic symbolism, and cultural partiality—factors they argue diminish recognition and trust among Muslim consumers. Conversely, three respondents supported the redesign, viewing it as a cultural representation of Indonesian identity and a fresh approach to halal branding. The study also uncovers critical reflections on the shift in halal certification authority from the Indonesian Ulema Council (MUI) to BPJPH. This research contributes to the growing body of literature on halal consumer perception and suggests that policy efforts must be accompanied by public education to ensure acceptance and functionality of halal symbols. The results underscore the importance of religious-cultural alignment and visual clarity in halal certification communication strategies.

Abstract

The integration between Tasyri's Philosophy and Sharia Philosophy in the context of Islamic law reform in Indonesia is the main focus of this study, especially in understanding how Islamic legal values can be applied effectively in the modern legislation system. The urgency of reforming Islamic law to answer the challenges of the times and the importance of understanding the relationship between the principles of tasyri' – as the basis for the formation of law – and sharia as the entire Islamic legal system that governs the lives of Muslims, are emphasized in the introduction. This research uses a qualitative approach with normative analysis, combining literature studies, the study of classical legal texts, and the interpretation of the views of contemporary scholars in Indonesia. The data obtained were critically analyzed to identify how Tasyri and Sharia Philosophy principles can be adapted into legislation responsive to social changes and the Indonesian context. The study results show that integrating Tasyri' and Sharia Philosophy in the reform of Islamic law in Indonesia allows the application of Islamic law that is more relevant to the needs of the times and enriches the legislation process with a strong ethical and moral basis. The main challenge in this integration is ensuring harmony between classical texts and modern social realities in Indonesia so that Islamic law continues to function as a dynamic and adaptive system, as a representation of religious law.
