Abstract

This study examines issues related to the legal certainty analysis in judicial decisions regarding the authority of the Consumer Dispute Settlement Board (Badan Penyelesaian Sengketa Konsumen/BPSK) of Batam City, as observed in Batam District Court Decision Number 10/Pdt.Sus-BPSK/2021/PN Btm and Batam District Court Decision Number 25/Pdt.Sus-BPSK/2024/PN Btm. The core issue discussed in this research is the analysis of judicial considerations in ruling on matters related to the authority of BPSK Batam City and how these judicial decisions provide legal certainty in resolving disputes. The primary objective of this study is to analyze how judicial considerations influence legal certainty for parties involved in disputes concerning BPSK Batam City's authority. This research is normative in nature, employing a literature study approach. The data utilized comprises secondary data, including various laws and regulations, books, theses, and relevant journal articles. Data collection methods involve a literature study, and the analysis is conducted using qualitative methods to interpret and summarize the research findings. The results indicate that the authority of BPSK Batam City in handling consumer disputes is limited in accordance with Law Number 8 of 1999 on Consumer Protection, which allows consumers to choose dispute resolution through BPSK or the court based on the consumer's domicile. In the cases studied, BPSK Batam City frequently encounters challenges related to its competence in handling disputes that should be referred to the court, such as civil disputes or breaches of contract. [Penelitian ini mengkaji permasalahan terkait analisis kepastian hukum dalam putusan hakim mengenai kewenangan Badan Penyelesaian Sengketa Konsumen (BPSK) Kota Batam, seperti yang ditemukan dalam Putusan Pengadilan Negeri Batam Nomor 10/Pdt.Sus-BPSK/2021/PN Btm dan Putusan Pengadilan Negeri Batam Nomor 25/Pdt.Sus-BPSK/2024/PN Btm. Permasalahan yang dibahas dalam penelitian ini adalah menganalisis pertimbangan hakim dalam memutus perkara terkait kewenangan Badan Penyelesaian Sengketa Konsumen Kota Batam dan bagaimana putusan hakim memberikan kepastian hukum dalam menyelesaikan putusan sengketa, tujuan utama penelitian ini adalah untuk menganalisis bagaimana pertimbangan hakim mempengaruhi kepastian hukum bagi pihak yang bersengketa terkait kewenangan BPSK Kota Batam. Penelitian ini bersifat normatif dengan menggunakan pendekatan studi kepustakaan. Data yang digunakan adalah data sekunder yang terdiri dari berbagai peraturan perundang-undangan, buku, skripsi, dan artikel jurnal yang relevan. Metode pengumpulan data dilakukan melalui studi kepustakaan dan dianalisis menggunakan metode kualitatif untuk menginterpretasikan dan merangkum hasil penelitian. Hasil penelitian menunjukkan bahwa kewenangan BPSK Kota Batam dalam menangani sengketa konsumen terbatas sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, yang memperbolehkan konsumen untuk memilih penyelesaian sengketa melalui BPSK atau pengadilan sesuai tempat kedudukan konsumen. Dalam kasus-kasus yang diteliti, BPSK Kota Batam sering kali menghadapi tantangan terkait kompetensinya dalam menangani sengketa yang seharusnya diserahkan kepada pengadilan, seperti sengketa keperdataan atau perbuatan wanprestasi].

Abstract

This study aims to analyze the role of local government in formulating public policies for handling Cybercrime at BSI Syariah Bank in Tanjungpinang City. Cybercrime is a serious threat to the banking sector. Thus, local governments have a responsibility to protect the public and ensure security in transactions in this sector. This study uses qualitative research method using literature studies as a data source. Relevant literature sources such as journals, scientific articles, and related policy documents, are collected and analyzed qualitatively. The purpose of this study is to provide a better understanding of the role of local government in formulating effective public policies in handling cybercrime at BSI Syariah Bank in Tanjungpinang City. It is found that Bank BSI Syariah Tanjungpinang requires stronger prevention and control measures against Cybercrime. This includes increasing internal awareness, implementing appropriate security technologies, and collaborating with law enforcement authorities. Meanwhile, the Tanjungpinang City government needs to increase its role in enforcing strict policies and law enforcement against Cybercrime perpetrators, as well as strengthening cross-sector cooperation to deal with this threat effectively.

Abstract

Carbon emissions play an important role in the acceleration of climate change, which threatens the livelihoods of many people around the world. Electronic vehicles (EVs) serve as a solution to this problem by reducing the amount of pollution and enabling the use of renewable energy as a source. This research analyzes the incentives provided by countries that are trying to reduce their carbon emissions with EVs, namely Indonesia and Malaysia. The analysis is supported by a comparative legal research method and statutory approach. This research finds that Malaysia’s framework of incentives is superior to that of Indonesia’s, as incentives provided by Indonesia do not address the issue of carbon emissions entirely and are buried within a very fragmented legal framework. The research proposes a number of changes that need to be made in Indonesia to support the EV industry in all of the aspects that are relevant to its development, such as R&D, human resources, consumer support, and financial support for manufacturers.

Abstract

Indonesian Migrant Workers (PMI) who work in the domestic sector generally have received a lot of attention and attention from the public, as crew members of fishing boats owned by foreign companies receive less attention both regarding safety and the protection of their rights. Therefore, this research aims to emphasize the importance of Indonesia to ratify the convention as a form of effort to provide protection for workers on foreign ships, as well as provide a sense of security and legal certainty in the future. The Indonesian government has not taken serious steps to accommodate the interests of Indonesian crew members working on foreign fishing vessels. The research used in this research is juridical-normative legal research. The state has an obligation to provide human rights protection without having to be asked. Therefore, it is important for the Indonesian government to ratify ILO Convention 188 of 2007 in overcoming legal replacements left by national regulations, guaranteeing workers' rights, and creating legal certainty. The need for harmonization of existing and applicable laws and regulations regarding the protection of fishery workers in Indonesia should be taken into consideration when the government decides to ratify ILO Convention 188 of 2007.

Abstract

The existence of street children basically shows problems in efforts to implement SDGs, especially the existence of street children roaming around at night. The lack of supervision and the vulnerability of various forms of crime place these children in a position that is vulnerable to various dangers, which gives rise to the urgency of handling measures that can accurately respond to this challenge. The objective of this research is to analyze the effectiveness of curfew policies in protecting street children and to assess their alignment with the SDGs targets related to child protection and social welfare. Using normative legal research methods, the research aims to analyze problems related to the presence of street children at night, using the SDGs perspective as the main reference. The analysis found that efforts to remove children from street life can be hampered by a number of complex social factors, which the existing legal framework cannot yet address. Therefore, this research proposes a policy model for limiting curfews by combining elements from several existing laws and regulations, which can be used to prevent street children's activities at night, increase child protection, as well as identify the potential for exploitation that could occur. endanger street children, by linking the role of parents. This policy model is expected to enhance child protection efforts and assist in removing children from street life, as a means of fulfilling the SDGs. The limitation of this research lies in the normative nature of the findings, necessitating further qualitative testing through various forms of effectiveness studies, particularly regarding the existing regulations and those to be incorporated into the policy model framework. [Keberadaan anak jalanan pada dasarnya menunjukkan permasalahan dalam upaya penerapan SDGs, khususnya keberadaan anak jalanan yang berkeliaran di malam hari. Minimnya pengawasan dan rawannya berbagai bentuk tindak kejahatan menempatkan anak-anak ini di dalam posisi yang rentan terhadap berbagai bahaya, yang menimbulkan urgensi penanganan yang dapat dengan akurat menjawab tantangan ini. Tujuan penelitian ini adalah untuk menganalisis efektivitas kebijakan batasan jam malam dalam melindungi anak jalanan, serta mengkaji kesesuaiannya dengan target SDGs terkait perlindungan anak dan kesejahteraan sosial. Dengan menggunakan metode penelitian hukum normatif, penelitian bertujuan menganalisis permasalahan yang berkaitan dengan keberadaan anak jalanan di malam hari, dengan menggunakan perspektif SDGs sebagai acuan utama. Analisis menemukan bahwa upaya mengeluarkan anak-anak dari kehidupan jalanan dapat dihalang oleh beberapa faktor sosial yang kompleks, yang belum mampu dijangkau oleh kerangka hukum yang berlaku. Maka dari itu, penelitian ini mengusulkan model kebijakan batasan jam malam dengan menggabungkan unsur-unsur dari beberapa peraturan perundang-undangan yang sudah ada, yang dapat digunakan untuk mencegah aktivitas anak jalanan di malam hari, meningkatkan perlindungan anak, sekaligus mengidentifikasi potensi terjadinya eksploitasi yang dapat membahayakan anak jalanan, dengan mengaitkan peran orang tua. Model kebijakan ini diharapkan dapat meningkatkan upaya perlindungan anak dan mengeluarkan mereka dari kehidupan di jalanan, sebagai bentuk pemenuhan SDGs. Limitasi dari penelitian adalah temuan yang didapat dari analisis sepenuhnya bersifat normatif, sehingga diperlukan pengujian secara kualitatif melalui berbagai bentuk studi efektivitas, khususnya mengenai kebijakan pengaturan-pengaturan yang sudah ada dan akan dimasukkan ke dalam konstruksi model kebijakan].

Abstract

Introduction: COVID-19 vaccination is an important initiative in the Indonesian government's strategy to manage the pandemic and achieve herd immunity. Based on the Decree of the Minister of Health Number 6424 of 2021, the government intends to increase the coverage of the third and fourth doses as part of the national vaccination program.Purposes of the Research: The purpose of this study seeks to evaluate the effectiveness of this policy in Riau Islands Province, especially to examine the obstacles faced in achieving adequate vaccination coverage.Methods of the Research: Using an empirical legal methodology with a sociological legal approach, this study analyzes data related to the implementation of vaccination and the factors that cause the absorption of the third and fourth doses to be suboptimal.Results Main Findings of the Research: Key findings show that although the administration of the first and second doses yielded positive results, the uptake of the third and fourth doses was still hampered by a variety of challenges, including legal factors, law enforcement factors, as well as a lack of public awareness and cultural challenges. Based on these findings, the government is advised to increase public outreach efforts, increase socialization and legal education, improve regulations and policies, strengthen law enforcement, provide incentives, education based on local wisdom, and cultural incentive programs. In addition, policies that prioritize public understanding and engagement are critical to achieving desired vaccination goals.

Abstract

Introduction: Taxes are obligations requiring citizens to pay a specified amount of money to the state. Following the enactment of the Tax Harmonization Law in 2021, tax law enforcement in Indonesia has been directed toward recovering state revenue losses.Purposes of the Research: This study aims to describe and analyze the implementation of criminal fine execution in tax cases as outlined in Decision Number: 249/Pid.Sus/2022/PN.Tpg.Methods of the Research: The study employs a normative legal approach through library research, which includes references such as laws, articles, and journals. Secondary data were collected through literature review and analyzed using a qualitative juridical approach.Results Main Findings of the Research: The findings of the study show that the confiscation of land and buildings belonging to the convicts is not in line with Article 39 Paragraph (1) of the Criminal Procedure Code. In addition, the assets had been used as collateral by Bank Mandiri Tanjungpinang, a State-Owned Enterprise, before the investigation began. This results in a lack of legal certainty and becomes an obstacle in the execution process. To ensure legal certainty, the investigation process must be accompanied by the tracking and blocking of the assets found, in the settlement of tax criminal cases in Decision Number: 249/Pid.Sus/2022/PN.Tpg, deliberation or coordination regarding land and building assets can be carried out, because the ultimate goal is to return the results of the execution to the state.

Abstract

Human Trafficking is a global issue that continues to escalate, including in Batam City, one of Indonesia's Human Trafficking hotspots. This study aims to analyze the effectiveness of combating Human Trafficking Crimes (Human Trafficking) in Batam City by comparing Indonesian and Singaporean laws. The research addresses the implementation of Indonesian laws, regulatory comparisons between the two countries, and recommendations for ideal solutions.The study employs normative and empirical legal methods with legislative, conceptual, and sociological approaches. Data were collected through literature reviews and interviews with relevant institutions in Batam. The findings reveal that although Indonesia’s Law No. 21 of 2007 provides a comprehensive legal framework, its implementation faces challenges such as weak inter-agency coordination, limited support facilities, and low public legal awareness. In comparison, Singapore has more effective regulations with severe sanctions and advanced technology. Recommendations include revising specific articles in Law No. 21 of 2007, strengthening cross-sectoral coordination, enhancing victim protection facilities, providing intensive training for law enforcement officers, and applying technological support. These measures are expected to optimize the fight against Human Trafficking in Batam City.

Abstract

Although Indonesia possesses significant potential for solar energy, it remains behind Vietnam, highlighting the critical need for policy and investment reforms to meet the increasing demand for renewable energy. This study aims to explores the normative issues within the Indonesian legal framework for investment and benchmarks it against Vietnam’s to assess the legal gap that may have hindered Indonesia’s progress in supporting solar technology investments. This study adopts a normative-empirical approach by integrating normative legal analysis of regulatory frameworks with the presentation and examination of empirical data. The empirical dimension of this research incorporates analysis of implementation outcomes, including renewable energy capacity data, carbon footprint measurements, and regulatory effectiveness indicators. The results of this study highlights normative inadequacies from Indonesia, with the lack of foundational normative support, followed by the lack of support in the form of complimentary regulations. Vietnam, on the other hand, has a significantly more developed framework to support investments in solar technology, serving as comparative evidence of the stark contrast between the country’s success and Indonesia’s ongoing challenges.

Abstract

The increasing frequency and intensity of climate change impacts, coupled with alarming risks of natural disasters, have spurred a global urgency to strengthen climate resilience. This research critically examines the readiness of Indonesia's legal landscape to support initiatives for enhancing climate resilience and the protection of human rights (HAM) in the context of environmental issues, considering Indonesia's vulnerable geographical position. Employing normative legal research methods, this study reveals that the regulatory framework for environmental management and protection in Indonesia has not fully provided the necessary legal certainty for climate change adaptation and mitigation efforts, nor has it optimally integrated human rights principles in addressing climate threats. As a solution, this research proposes a legal reconstruction model aimed at overcoming these shortcomings by establishing more robust legal certainty for enhancing climate resilience, while simultaneously placing human rights protection as a fundamental pillar in all related policies and actions. The implementation of this legal model necessitates public policy updates through the revision or enactment of more comprehensive and human rights-oriented legislation.
