Abstract

The phenomenon of personal data misuse has become increasingly prevalent in today's society. Data breach cases in Indonesia are common due to weak regulations specifically designed to protect the personal data of online marketplace users. This study aims to investigate and analyze the phenomenon and implications of the development of insurance transactions within the scope of online marketplaces in Indonesia, as well as to provide recommendations for legal improvements or enhancements that are appropriate and can support healthy growth in Indonesia's online insurance industry. This research employs a normative legal approach by utilizing library research techniques to examine various guidelines. Secondary data collected through library research were analyzed using a qualitative juridical approach. The study is also supported by primary legal materials such as legislation. The findings of this study indicate that insurance agreements can be utilized to protect the confidentiality of personal data, ensure the certainty and security of transactions, and minimize the risks of digital transactions, such as fraud, delivery failures, and financial losses. Legal regulations related to online insurance marketplace businesses in Indonesia require adjustments and revisions to accommodate the rapid development of technology and e-commerce.

Abstract

Commercial property disputes are one of the significant challenges in business practice in Indonesia, especially in the legal relationship between creditors and debtors. This study aims to analyze legal protection for creditors in commercial property disputes through a case study of the Batam District Court Decision No. 158/Pdt.G/Plw/GS/2022/PN Btm. The methodology used is normative legal research with an analytical-descriptive approach, which examines laws and regulations and related court decisions. The results of the study show that in this case it includes three dimensions of legal protection according to Philipus M. Hadjon's theory, namely preventive, repressive, and curative. In the preventive dimension, protection is provided through the binding of dependent rights and the use of the cession mechanism as an anticipatory measure. The repressive dimension, lawsuits and cession recognition by the courts ensure that creditors' rights remain protected after a dispute has occurred. The curative dimension, guarantee execution and litigation process play a role in the recovery of creditor rights due to debtor default. However, the study also found weaknesses in the implementation of legal protection, especially related to the long legal process and bureaucracy in the execution of bail. This study concludes that legal protection for creditors in Indonesia has been well regulated normatively, but its implementation needs to be strengthened, especially in the efficiency of guarantee execution and dispute management. Recommendations are given to creditors, debtors, and governments to improve dispute management and legal protection within the commercial property sector

Abstract

The phenomenon of e-commerce in Indonesia has demonstrated rapid growth, with high transaction values projected in 2024. However, the circulation of counterfeit products on digital platforms poses a serious challenge, endangering consumers. Although the legal framework for consumer protection in Indonesia provides a foundation for safeguarding consumer rights, oversight of counterfeit products in e-commerce has been deemed ineffective in ensuring consumer protection. This study employs normative legal research methods with comparative law, legislative, and conceptual approaches. The findings reveal that the Consumer Protection Act (UU Perlindungan Konsumen) has not been fully effective in ensuring the accountability of digital platforms, monitoring products, and resolving disputes. In comparison, EU regulations mandate the responsibility of digital platforms, the use of tracking technologies such as blockchain, regular audits, and strict sanctions for violations. The study recommends strengthening platform accountability in seller verification, adopting technology for product monitoring, and developing an integrated online dispute resolution mechanism through the Consumer Dispute Settlement Body (BPSK). Referring to progressive legal theory, Indonesia's regulatory framework must adaptively evolve to address digital dynamics, create legal certainty, and build public trust in a secure and equitable e-commerce ecosystem. [Fenomena e-commerce di Indonesia telah menunjukkan pertumbuhan pesat dengan nilai transaksi yang tinggi pada tahun 2024. Namun, peredaran produk palsu di platform digital menjadi tantangan serius yang membahayakan konsumen. Meskipun kerangka hukum perlindungan konsumen di Indonesia telah memberikan landasan hukum untuk melindungi hak konsumen, namun pengawasan terhadap produk palsu di e-commerce dinilai belum efektif dalam melindungi kosnumen. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perbandingan hukum, perundang-undangan, dan konseptual. Hasil penelitian menunjukkan bahwa UU Perlindungan Konsumen belum optimal dalam memastikan tanggung jawab platform digital, pengawasan produk, dan penyelesaian sengketa. Sebagai perbandingan, regulasi UE mengatur kewajiban platform digital, penggunaan teknologi pelacakan seperti blockchain, audit berkala, dan sanksi tegas bagi pelanggar. Rekomendasi penelitian mencakup penguatan tanggung jawab platform dalam verifikasi penjual, adopsi teknologi untuk pengawasan produk, dan pengembangan mekanisme penyelesaian sengketa daring yang terintegrasi dengan Badan Penyelesaian Sengketa Konsumen (BPSK). Dengan mengacu pada teori hukum progresif, regulasi di Indonesia perlu berkembang secara adaptif untuk menghadapi dinamika digital, menciptakan kepastian hukum, dan meningkatkan kepercayaan masyarakat terhadap e-commerce yang aman dan berkeadilan].

Abstract

Substantive justice in regional elections, which focuses on election outcomes that reflect social justice, inclusiveness, and fair distribution of power, requires a contextual approach in Asia, Europe, and Africa to address the unique challenges of each region and create more inclusive and just political systems. This study aims to explore the philosophical and sociological understanding and application of the concept of substantive justice and its impact on political representation and inclusiveness in regional elections in Asian, European, and African countries. This study uses normative legal methods with legislative, conceptual, and comparative approaches to analyze the concept of substantive justice and its application in regional elections in Asia, Europe, and Africa, relying on qualitative analysis of primary, secondary, and tertiary legal materials. The results of the study show that substantive justice in regional elections focuses on outcomes that reflect social justice, equality, and inclusiveness, with highly contextual applications in Asia, Europe, and Africa. In Europe, this concept is influenced by John Rawls’ theory of justice as fairness, with a proportional electoral system that is effective in representing the diversity of society. In Asia, values ​​of social harmony and cultural plurality influence the implementation of substantive justice, although challenges such as money politics and social inequality remain significant. In Africa, the philosophy of Ubuntu encourages community solidarity, but obstacles such as corruption and ethnic conflict hinder its implementation. In general, affirmative action policies, ongoing reforms, and public education are needed to strengthen inclusiveness and political representation at the local level in various regions.

Abstract

The demand for native and native-like English teachers in Asia has shifted preferences toward educators from countries like the Philippines, known for its high level of English fluency and nativized language forms. This study examines the unique challenges and attributes of Filipino English as a Foreign Language (EFL) teachers in Indonesia, focusing on their relatability to students and the high expectations placed on them as expatriates. The study utilized a qualitative case study approach, gathering insights from six Filipino EFL teachers working in Batam, Indonesia, across five schools. Data were collected through semi-structured interviews with 11 questions, complemented by classroom observations and document analysis. The teachers, with varying levels of experience, shared their classroom challenges and strategies for effective teaching. Findings highlight the importance of adaptability, cultural awareness, and pedagogical flexibility in effective EFL teaching. Teachers emphasized the need for instructional strategies tailored to students' diverse learning needs, integrating structured curricula with supplementary materials. Their reflections also underscored the value of self-awareness and continuous professional development in improving teaching efficacy. This study provides insights into the complexities of being an expatriate EFL teacher in Indonesia. The findings suggest that EFL teacher training should prioritize cultural sensitivity, adaptability, and flexible pedagogical approaches. Future research could expand on these findings, exploring the experiences of Filipino teachers in different regions of Indonesia, to further understand the dynamics of expatriate teaching in Asia.

Abstract

Corporate Social Responsibility (CSR) is a vital component of modern corporate governance, particularly in environmentally and socially sensitive sectors such as plantations. In Indonesia, although the legal framework for CSR is established through Company Law and sectoral regulations, its implementation often lacks strategic depth and sustainability. This study investigates the legal and empirical challenges of CSR practices within the non-palm plantation sector, focusing on how companies translate normative CSR obligations into effective, community-centered programs. The research aims to evaluate the effectiveness of CSR as a tool for sustainable development, identify gaps between regulatory expectations and field practices, and propose recommendations for optimization. Using an empirical juridical method, this study combines qualitative interviews with legal analysis of CSR frameworks to assess social and environmental outcomes of CSR programs. Findings reveal that CSR is frequently treated as a compliance obligation, with many initiatives lacking integration into long-term business strategy. Programs are often symbolic, with limited tangible benefits for local communities due to weak regulatory coordination, inadequate stakeholder engagement, and ineffective monitoring. The study concludes that CSR in the plantation sector requires a transformative shift—from superficial compliance to strategic sustainability. Integrating CSR into business core values, supported by clear legal standards, inclusive stakeholder collaboration, and transparent reporting, is essential to enhance its real-world impact. This research offers a model for evaluating CSR effectiveness and contributes to the broader discourse on legal reform and sustainable corporate governance in Indonesia’s agribusiness sector.

Abstract

The implementation of English language instruction in elementary schools under the K-13 curriculum has become widespread, yet there is limited understanding of how teachers interpret and apply the curriculum in their classrooms. This study aims to explore elementary school English teachers' interpretations of the K-13 curriculum and their pedagogical strategies. Adopting a qualitative descriptive approach, data were collected through classroom observations and structured interviews with three English teachers at the elementary level. The data were analyzed thematically, revealing key patterns in teaching strategies and challenges. Teachers reported using interactive methods, such as group discussions, student-centered activities, and technology integration, to engage students effectively. However, they faced significant challenges, including inadequate teaching resources, large class sizes, and limited time, all of which hindered the full implementation of the curriculum. These findings underscore the need for targeted professional development programs and improved resource allocation to address these challenges. The study provides actionable insights for policymakers and educators aiming to optimize English language teaching within the K-13 framework, emphasizing the importance of supporting teachers in overcoming obstacles to effective curriculum delivery.

Abstract

Despite the recent government legal updates, lobster seed smuggling remains a lucrative business in Batam City. This study aims to analyze the linkage of international and national laws with Batam City's efforts in combating lobster seed smuggling. It also examines the roles and challenges faced by the stakeholders in Batam City in tackling this issue. Utilizing empirical legal research and socio-legal approaches, the study relied on both secondary and primary data, incorporating literature studies and interviews with the Criminal Investigation Unit of Barelang City Police and the Batam Fish Quarantine Station. Qualitative analysis, guided by Mochtar Kusumaatmadja's Development Law Theory found that the Minister of Maritime Affairs and Fisheries Regulation No. 7 of 2024 has not stopped lobster seed smuggling via sea from Batam City to neighboring countries. It is concluded that this smuggling has an international dimension; consequently, CITES, UNCLOS, and UNTOC can serve to address the relationship between international law and local issues. Stakeholders in Batam City have implemented efforts by collaborating with stakeholders at the local, national, and international levels. Yet, they still encounter challenges, including educating the public. In response to these challenges, the best practices from Hong Kong, Australia, and Vietnam can be adopted by stakeholders in Batam City. They could also serve as references for other regions in Indonesia facing similar challenges. It is also concluded that Batam City's efforts to combat lobster seed smuggling offers key lessons, highlighting the need for legal reforms and broad collaboration involving the local community at all levels.

Abstract

he integration of artificial intelligence (AI) into various sectors, including banking, has grown increasingly prevalent. AI holds significant potential in the banking system, particularly in financial risk analysis. However, its utilization requires a robust legal framework to ensure ethical and accountable application. This study aims to analyze the direction of Indonesia's legal policy and develop a legal framework model that supports the ethical use of AI for financial risk analysis in the banking sector. The research employs a normative legal research method. Through this method, the study identifies several normative issues that may negatively impact the use of AI for financial risk analysis. These issues range from fundamental legal norms, such as accountability for AI utilization, to more technical concerns, including transparency, cybersecurity, and data privacy. The findings highlight gaps in the current regulatory framework, necessitating an urgent response to accommodate the complexities introduced by AI technologies in financial systems. This research proposes a legal framework development model to provide a normative construction for relevant regulations. The proposed model emphasizes the pivotal role of the Financial Services Authority (OJK) in implementing and monitoring regulations based on the framework. By addressing these regulatory challenges, the model seeks to facilitate the ethical and responsible deployment of AI in financial risk analysis while safeguarding stakeholder interests and ensuring compliance with prevailing legal principles. Pemanfaatan artificial intelligence (AI) dewasa ini semakin terintegrasi ke dalam berbagai sektor, seperti salah satunya sektor perbankan. AI memiliki potensi yang signifikan dalam sistem perbankan, khususnya untuk digunakan dalam analisis risiko finansial. Namun pemanfaatan ini perlu diakomodasi dengan kerangka hukum yang memadai, untuk memastikan pemanfaatan sistem AI yang etis dan bertanggung jawab. Tujuan penelitian ini adalah untuk menganalisis arah politik hukum Indonesia serta mengembangkan model pengembangan hukum yang dapat diterapkan untuk mendukung pemanfaatan AI yang etis untuk tujuan analisis risiko finansial dalam sistem perbankan. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Dengan menggunakan metode penelitian hukum normatif, hasil penelitian ini menemukan beberapa permasalahan normatif yang dapat berdampak negatif terhadap pemanfaatan AI untuk analisis risiko finansial, mulai dari norma hukum yang mendasar seperti pertanggungjawaban mengenai pemanfaatan AI, hingga yang bersifat lebih teknis seperti transparansi, keamanan siber, dan privasi data. Penelitian ini mengusulkan model pengembangan hukum yang dapat dimanfaatkan untuk memberikan gambaran konstruksi normatif bagi beberapa peraturan perundang-undangan relevan, dengan mendukung OJK sebagai bagian sentral dari penerapan dan pengawalan regulasi berdasarkan model tersebut.

Abstract

The wage system has a fundamental role in guaranteeing workers rights, including the right to earn a decent income to support a dignified life. The Job Creation Law is presented as a major reform in the national labor regulatory framework, with the main aim of increasing investment and encouraging economic growth. However, the implementation of this policy also has consequences that can affect workers' welfare, especially regarding the minimum wage determination mechanism which is very dependent on economic conditions and employment dynamics in each region. Setting minimum wages requires an approach that meets certain criteria to ensure fairness. This research was designed to examine the main issue, namely "To what extent does the implementation of the Job Creation Law affect the fulfillment of workers' rights to wages." Using a juridical-normative approach through a literature review, this research found that disparities in minimum wage determination between provinces and between districts/cities, as regulated in the Job Creation Law, have encouraged some entrepreneurs to move investment to regions with higher minimum wage standards. low.
