Abstract

Penyusunan peraturan desa di Candi Pari oleh mahasiswa Universitas 17 Agustus 1945 Surabaya bekerja sama dengan perangkat desa merupakan inisiatif kolaboratif yang bertujuan untuk meningkatkan tata kelola desa dan kesejahteraan masyarakat. Penelitian ini berfokus pada proses penyusunan, pelaksanaan, dan dampak peraturan desa tersebut. Metode yang digunakan adalah pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara mendalam, observasi partisipatif, dan analisis dokumen. Hasil penelitian menunjukkan bahwa penyusunan peraturan desa ini melibatkan partisipasi aktif dari mahasiswa, perangkat desa, dan warga setempat. Prosesnya dimulai dengan identifikasi permasalahan utama yang dihadapi oleh masyarakat desa, diikuti dengan diskusi dan musyawarah untuk merumuskan solusi yang tepat dan berkelanjutan. Mahasiswa berperan sebagai fasilitator dalam mengumpulkan data dan menyusun draft peraturan, sementara perangkat desa memastikan bahwa peraturan yang disusun sesuai dengan kebutuhan lokal dan peraturan yang lebih tinggi. Implementasi peraturan desa ini mencakup berbagai aspek, seperti pengelolaan lingkungan, keamanan, ekonomi, dan sosial. Dampak positif yang teridentifikasi antara lain peningkatan kesadaran masyarakat terhadap kebersihan dan kesehatan lingkungan, peningkatan partisipasi warga dalam kegiatan desa, serta pengelolaan sumber daya yang lebih efisien dan produktif. Namun, terdapat beberapa tantangan dalam penerapannya, seperti keterbatasan sumber daya manusia dan finansial, serta resistensi dari sebagian warga. Penelitian ini menyarankan perlunya sosialisasi yang lebih intensif dan pelatihan berkelanjutan bagi aparat desa dan warga untuk mendukung penerapan peraturan secara efektif. Kesimpulannya, penyusunan peraturan desa di Candi Pari oleh mahasiswa Universitas 17 Agustus 1945 Surabaya bersama perangkat desa merupakan langkah penting dalam meningkatkan tata kelola desa, namun keberhasilannya memerlukan komitmen dan kerjasama yang kuat dari semua pihak.

Abstract

Sosialisasi kepada pemilih pemula memiliki peran strategis dalam meningkatkan kesadaran politik dan partisipasi dalam pemilu, terutama dalam memperkuat fondasi demokrasi di tingkat lokal. Di Kelurahan Wonorejo, Kota Surabaya, program pengabdian masyarakat yang dilaksanakan oleh mahasiswa dan dosen FH Untag Surabaya menjadi salah satu upaya konkret dalam membangun kesadaran demokrasi generasi muda. Program ini dirancang untuk menjawab tantangan rendahnya pemahaman politik di kalangan pemilih pemula, sekaligus mengajak mereka untuk berperan aktif dalam menentukan masa depan bangsa. Melalui pendekatan interaktif dan edukatif, sosialisasi ini tidak hanya berfokus pada penyampaian materi tentang pentingnya partisipasi politik, tetapi juga mendorong dialog kritis dan diskusi terbuka antara peserta dan fasilitator. Dengan metode ini, pemilih pemula diharapkan mampu memahami hak dan kewajibannya sebagai warga negara, serta implikasi dari partisipasi mereka dalam proses demokrasi. Pelaksanaan program sosialisasi, mulai dari perencanaan hingga evaluasi dampaknya terhadap peningkatan kesadaran politik pemilih pemula di Kelurahan Wonorejo. Relevansi program ini dalam konteks penguatan demokrasi lokal, khususnya dalam membentuk generasi muda yang melek politik dan berdaya kritis. Hasil program menunjukkan bahwa pendekatan interaktif dan edukatif berhasil meningkatkan pemahaman peserta mengenai pentingnya berpartisipasi dalam pemilu. Program ini dapat menjadi model yang efektif untuk diterapkan, sekaligus menjadi langkah kecil namun berarti dalam mendukung keberlanjutan demokrasi di Indonesia.

Abstract

Constitutional Court Decision No. 60/PUU-XXII/2024 changed the nomination mechanism for regional heads in Indonesia by canceling the nomination threshold provisions previously stipulated in Law No. 10 of 2016. The old provision required a political party or a coalition of political parties to win a minimum of 25% of the accumulated valid votes in the last general election to nominate a regional head pair. This requirement proved to limit the political participation of small parties that do not have seats in the Regional People’s Representative Council as well as independent candidates. With this new ruling, the Constitutional Court determined that the nomination requirement should be adjusted to the percentage of valid votes calculated based on the number of residents registered in the Permanent Voters List in each region, which better reflects political representation. This study aims to analyze the legal implications of the Constitutional Court’s decision No. 60/PUU-XXII/2024 on the political rights of regional communities. Through a legal research method using a statutory approach, conceptual approach and case approach, this research seeks to explain how the decision can expand political participation and improve representation in the regional head election process. In the context of social contract theory, this decision reflects a reinterpretation of the relationship between the state and citizens in terms of political participation. The state, through the Constitutional Court, demonstrates its commitment to protecting the political rights of its citizens by abolishing threshold provisions that are considered exclusionary. Thus, small parties and independent candidates have a greater opportunity to compete fairly, thereby expanding political representation and improving the quality of local democracy. Abstract

Election is a democratic means to elect leaders and representatives of the people, where Bawaslu has a strategic role as an election supervisory institution. Bawaslu is tasked with ensuring that each stage of the election is in accordance with laws and regulations, with the legal basis listed in Law No. 7 of 2017. As a quasi-judicial institution, Bawaslu has the authority to issue decisions that are final and binding. However, in practice, the implementation of follow-up to Bawaslu decisions often faces challenges, such as disobedience or suboptimal implementation by the KPU and related parties. This study aims to examine the urgency of legal certainty in supervising the implementation of Bawaslu decisions and to determine the ideal model of supervision to fulfill the principle of legal certainty. The method used is normative juridical with a legislative approach, with primary and secondary data sources. The results of the study show that there is a legal vacuum that hinders the optimal implementation of the decision. Therefore, this study emphasizes the urgency of an integrated supervision model with strict evaluation and sanction mechanisms, which can increase compliance with Bawaslu decisions and ensure the implementation of elections in accordance with legal provisions.

Abstract

The objective of this research is to examine legal regulations concerning the misuse of personal data for political purposes. Legal protection against the unauthorized use of personal data by Political Parties (Parpol) is a crucial issue in today’s digital era. With advancements in information technology, individuals' personal data have become increasingly vulnerable to misuse and privacy violations. The protection of personal data as a Human Right (HAM) must be guaranteed by all parties, including the government and the private sector. The current situation reveals weak regulations governing the collection, storage, and use of personal data, which may lead to violations of individuals’ privacy rights. This study employs a normative juridical method with a literature review approach. The findings indicate the necessity of clear and strict legislation to protect personal data from misuse, as well as the importance of public awareness regarding their privacy rights. Through collaboration between the government, the business sector, and civil society, a secure and sustainable digital ecosystem can be fostered. Concrete steps to enhance personal data protection in Indonesia include the enactment of Law Number 27 of 2022 on Personal Data Protection (UU PDP), which is expected to provide a strong legal framework for safeguarding individual privacy in the ever-evolving digital era.

Abstract

The establishment of a democratic state requires the active involvement of its citizens, primarily through political participation, via elections. An integral part of elections is campaigning, which is inherently a strategy sometimes used to undermine opponents. These campaigns are known as “Black Campaigns”. It involves the use of malicious and unethical tactics aimed at discrediting political opponents. One method that is commonly used today is the dissemination of false information, which leads to slander that erodes the dignity, reputation, and honor of election participants. This study aims to evaluate the implementation of election laws and the management of negative political campaigns spread through social media platforms. Using normative legal research methodology, this research uses legal sources in the form of laws or other regulations, legal principles, and relevant doctrines. This research reveals that black campaigns are explicitly regulated in Article 280 of Law No. 7/2017 and Article 69 of Law No. 1/2015. This law categorizes black campaigning as a prohibited act, which includes insults, incitement, and threats against individuals. In the event of black campaigning on social media, the provisions outlined in Article 27 paragraph 3 and Article 28 paragraph 2 of Law No. 19/2016 should be enforced. To address the problem of black campaigns on social media, effective countermeasures need to be proposed, such as proactively promoting media literacy to coordinating its handling with relevant institutions. Abstract

 Penelitian ini bertujuan untuk mengkaji penguatan sistem presidensial melalui penerapan ambang batas parlemen dalam pemilu di indonesia. Penelitian ini menggunakan jenis penelitian hukum normatif.. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan serta pendekatan konseptual. Hasil penelitian ini  menunjukkan pentingnya penerapan parliamentary threshold, dimana pembentukan suatu threshold sebenarnya merupakan upaya pemerintah dan DPR untuk merampingkan partai politik guna meningkatkan efektifitasnya dalam pemerintahan. Untuk mengkonsolidasikan partai politik dan meningkatkan stabilitas politik, yang pada akhirnya akan menawarkan kekuasaan, otoritas, dan martabat pemerintah, diperlukan ambang batas parlemen. dalam membentuk pemerintahan yang stabil adalah penerapan ambang batas parlemen. Di negara demokrasi ini, ambang batas parlemen adalah gagasan yang tepat untuk mengurangi jumlah partai politik. Ambang batas parlemen sekarang digunakan, tetapi dapat dikatakan bahwa itu tidak efisien karena lebih banyak partai politik yang memenuhi syarat untuk parlemen daripada lebih sedikit. Ini karena kompromi partai politik, bukan penelitian ilmiah, menentukan tingkat persentase yang digunakan. perhitungan persentase ambang batas parlemen perlu dilihat dari berbagai sudut, bukan hanya terletak pada jalan tengah yang tipis antara partai besar dan partai kecil. Selain itu, penggunaan ambang batas parlemen nasional dapat dipertimbangkan kembali agar penyederhanaan partai politik dapat terjadi secara nasional hingga ke daerah karena memperkuat pemerintah daerah sama pentingnya untuk membangun pemerintahan nasional yang stabil seperti memperkuat pemerintah pusat. Namun, karena setiap kepentingan daerah berbeda dan harus dipenuhi secara bertahap, penerapan ambang batas parlemen nasional tidak dapat dibagi secara seragam besaran persentasenya.Kata kunci : Ambang Batas, Parlemen, Partai Politik

Abstract

This study aims to analyze and find the legal reform of the division of authority for mineral and coal mining affairs between the Central Government and Regional Governments, so that a regulatory model can balance the principle of regional autonomy and national interests. This research is a normative legal research with a statute, conceptual, and case approach. This study found that after Law No. 3 of 2020 and Law No. 6 of 2023, there was a centralization of mineral and coal mining affairs, which led to the creation of injustice and legal uncertainty for autonomous regions. These regulations, from the perspective of balancing the principle of regional autonomy and the principle of national interests, need to be reformed trough the division of mineral and mining affairs between the Central Government and the autonomous regions based on the principle of justice by using the principles of externality, accountability, and efficiency. Meanwhile, the Central Government can use the principle of national strategic interests for several mineral and coal mining sub-affairs. In Addition, the delegation authority model should be removed and Article 18 paragraph (5) of the 1945 Constitution of the Republic of Indonesia needs to be amended, so that the division of government affairs provides justice and legal certainty for autonomous regions.

Abstract

This article constitutes an examination of the legal protection of the rights and obligations of political party members, focusing on the crucial role of political party members in maintaining the health and dynamics of the political process. Additionally, this article comprehensively outlines the rights and obligations that govern the behavior of political party members. This research was conducted using the normative legal research method by analyzing primary and secondary legal materials, and applying normative or prescriptive analysis techniques. The analysis results indicate that the rights of political party members include the right to associate, assemble, express opinions, engage in politics, and obtain public office. Meanwhile, the obligations of political party members encompass concrete actions such as practicing Pancasila, upholding state integrity, participating in national development, upholding the supremacy of law, conducting political education, ensuring the success of general elections, and ensuring financial transparency. Furthermore, this article proposes improvements to Law No. 8/2008 in conjunction with Law No. 2/2011 to enhance the protection of the rights and obligations of political party members. This includes the important role of supervisory institutions and law enforcement agencies in safeguarding the rights and obligations of political party members, as well as ensuring compliance with the principles of democracy and the supremacy of law within the scope of political parties. In conclusion, this article provides a significant contribution to understanding the participation, rights, and obligations of political party members in the legal and democratic context of Indonesia.

Abstract

Presidential Regulation No. 83 of 2024 was enacted under the pretext of addressing the critical issue of national nutrition. However, beneath the technocratic narrative and the sterile legal language, there are strong indications that this regulation conceals a deeper political-economic agenda. This study aims to examine whether the establishment of the National Nutrition Agency is a purely administrative response or a covert instrument of power hegemony. The contribution of this study lies in uncovering how a seemingly neutral policy on nutrition governance operates as a mechanism of executive aggrandisement. By applying a Critical Legal Studies framework, this research advances the understanding of how legal instruments can embed and normalise political centralisation under the guise of public health policy. This area remains underexplored in Indonesian legal scholarship. The methodology employed is a juridical-critical approach based on Critical Legal Studies, which involves a normative analysis of the regulation's content and its relationship to relevant laws and regulations. The study's findings reveal that the BGN has an expansive authority structure directly under the President, creating a potential for vertical control over the distribution of national nutrition resources. Furthermore, there is a potential overlap with other agencies (such as Bapanas, the Ministry of Health, and the Ministry of Social Affairs), weak oversight mechanisms, and the potential normalisation of power expansion through administrative law. In this context, the law is no longer an instrument of justice, but rather a tool of political legitimisation within a technocratic framework. This study recommends an institutional evaluation of the BGN and strengthening of legislative control over the expansion of executive bodies.
