Abstract

This study discusses the issue of legal certainty regarding the issuance of Building Use Rights (HGB) certificates over maritime areas, which has become a legal controversy in Indonesia. The background of this study is the emergence of conflicting interpretations between the agrarian law system, which strictly limits the object of HGB to land, and the increasing practice of granting HGB over sea areas, as illustrated by the case of HGB issuance in the waters of Sidoarjo Regency. The purpose of this research is to analyze the validity and legal certainty of issuing HGB certificates in maritime areas from the perspective of Government Regulation No. 18 of 2021 (PP 18/2021). Using a normative legal research method with a statutory and conceptual approach, this study examines the formal and material legality of HGB issuance based on existing legal norms. The discussion focuses on the discrepancy between the definition of “land” in agrarian law and the classification of “sea” in maritime law, which are governed by different legal regimes. The findings of the study indicate that sea areas, which are part of public spaces regulated Under maritime law, cannot legally be granted HGB unless they have undergone a reclamation process and have been formally designated as state land through administrative procedures. The issuance of HGB over unreclaimed maritime areas leads to administrative defects, violates the principle of legal certainty, and risks harming public interests, particularly the rights of coastal communities. The study concludes that the practice of issuing HGB in maritime areas is legally invalid and recommends regulatory harmonization and strict law enforcement to prevent similar legal violations and to ensure justice and certainty in Indonesia’s land administration system.

Abstract

This research aims to explore the dual role of generative AI technology in supporting human rights activism and gender equality. The primary issue addressed is how AI can empower individuals and organizations in advocating for human rights, while also posing risks such as the spread of misinformation and the perpetuation of bias. The methods used include case study analysis and literature review to understand the impact of AI in social and political contexts. The urgency of this research lies in the pressing need to develop ethical frameworks that safeguard human rights amid rapid technological advancements. The novelty of this study stems from its interdisciplinary approach, combining technology, human rights, and gender equality, while highlighting the philosophical and ethical challenges that arise alongside AI development. The findings of the research indicate that AI holds significant potential to enhance the visibility of human rights issues through more effective social media campaigns and compelling data presentation. However, the study also identifies substantial risks, including information manipulation and biases that could harm certain groups. The conclusion emphasizes the importance of creating strategies that maximize the benefits of AI while minimizing its risks. Thus, this research contributes to efforts to create an AI-driven future that not only supports human rights but also promotes gender equality, and it encourages further discussions about the boundaries between humans and machines in the context of these rights.

Abstract

Indonesia is a developing country that has a very large population, in this case, the natural resources in Indonesia must be utilized efficiently so that all citizens get the results evenly. must guarantee the right to freedom of citizens from hunger which is one of the basic needs in human rights whose fulfillment is guaranteed by law and international conventions on economic, social, and cultural rights. For this reason, the state's right to food must be fulfilled as a means of fulfilling food needs. Broadly speaking, the fulfillment of the right to food is still experiencing various problems in various aspects. Such as reduced agricultural land and decreased productivity due to climate change. This study aims to determine the role of the government in supporting the guarantee of the right to be free from hunger which is the basis of human rights. This research method is a qualitative method based on existing data on the fulfillment of the right to be free from hunger. The government is responsible for food availability through regional food security to support national food security based on the principles of sovereignty and independence. For this reason, a policy for the protection and conservation of agricultural land is needed, as well as a strong commitment and goodwill of the local government to prioritize the development of local food security.

Abstract

Di Indonesia, otonomi daerah sangatlah berperan penting bagi pembangunan. Sudah sepantasnya daerah dapat mengembangkan sumber daya daerahnya sebagai hasil dari penerapan UU Otonomi Daerah, yang mengatur pengalihan kekuasaan dan pengalihan tanggung jawab dari Pemerintah Pusat kepada Pemerintah Daerah, serta penerapan “Undang-Undang tentang Perimbangan Keuangan Pemerintah Pusat dan Pemerintah Daerah.” Dalam mewujudkan pembangunan pada setiap daerah, maka diperlukan adanya pembagian pajak. Tapi, dari berbagai penelitian menunjukkan bahwa pelaksanaan Otonomi Daerah justru menimbulkan distorsi dan biaya ekonomi yang tinggi. Penelitian hukum normatif digunakan dalam penelitian ini, dengan bahan/ data sekunder yang diambil dari bahan pustaka dan terorganisir secara sistematis. Dalam penelitian ini membahas tentang adanya pengaturan pemungutan pajak bumi dan bangunan di Kota Surabaya dalam rangka meningkatkan Pendapatan Asli Daerah (PAD). Secara khusus, wilayah Kota Surabaya menjadi fokus penelitian ini, yang bertujuan untuk mengidentifikasi objek Pajak Bumi dan Bangunan yang kepemilikan dan manfaatnya dilakukan oleh orang atau entitas di sektor perkotaan. Temuan penelitian ini menunjukkan bahwa pengaturan pemungutan Pajak Bumi dan Bangunan di Kota Surabaya belum optimal karena informasi belum terdistribusi secara merata, sehingga mengakibatkan banyak wajib pajak yang belum memahami pentingnya pajak dalam meningkatkan Pendapatan Asli Daerah di Kota Surabaya. Dalam hal ini, Pemerintah Daerah juga memiliki peranan yang sangat krusial untuk melaksanakan pemungutan Pajak Daerah. Selain itu, Pemerintah juga dapat memberikan sosialisasi kepada masyarakat sebagai Wajib Pajak agar masyarakat mengetahui pentingnya sekaligus tata cara dalam melakukan pembayaran pajak. Dengan melakukan kerjasama tersebut antara Pemerintah Daerah dan masyarakat sebagai Wajib Pajak, dapat membuka peluang besar dalam penyelenggaraan Otonomi Daerah yang tersistematis dan merata pada seluruh wilayah di Indonesia.

Abstract

Plenty aspect of human life across various regions, also Indonesia, utilizes electronic systems for a multitude of activities, and involving digital platforms. The concept of Digital Platform Powerplay is linked to the digital market and personal data protection. In Indonesia, the regulatory framework governing digital markets and personal data primarily relies on Law No. 11/2008 concerning Electronic Information and Transactions, which has undergone two amendments: Law No. 19/2016 amending Law No. 11/2008, and Law No. 1/2024 amending Law No. 11/2008 for the second time and Law No. 27/2022 concerning Personal Data Protection. As a implementation regulation Government Regulation No. 80/2019 concerning Electronic Commerce and Government Regulation No. 71/2019 concerning the Implementation of Electronic Systems and Transactions further elaborate on these regulations. These legal provisions are intended to provide legal certainty for users. It is essential to review all regulations related to electronic systems and digital platforms by comparing them with the regulatory frameworks in the European Union. The study addresses two primary issues: 1) the legal regulation of digital markets from the perspective of Indonesian positive law, and 2) the legal regulation of digital markets from the perspective of European Union law. This research employs normative legal research methodologies, utilizing both statutory and comparative approaches. The findings of this study suggest that Indonesia should consider adopting the European Union's Digital Markets Act and Personal Data Protection regulations by amending Law No. 11/2008 concerning Electronic Information and Transactions and its amendments, with particular emphasis on aspects related to Digital Platform Powerplay.

Abstract

Kesehatan merupakan salah satu bentuk dari hak asasi manusia. Penegasan Pasal 28H UUD NRI 1945 mengakui bahwa kesehatan adalah sebagai hak yang dijamin dan dilindungi oleh negara. Konsekuensi yuridis atas ketentuan tersebut maka pemerintah memiliki kewajiban untuk menghormati, melindungi dan memenuhi hak kesehatan kepada masyarakat. Dari permasalahan maka apakah pemerintah dapat diguggat apabila gagal dalam memberikan pelayanan kesehatan dan bagaimana prosedur untuk menggugat. Dalam penulisan ini menggunakan metode penelitian hukum normatif. Metode pendekatan yang digunakan dalam penulisan ini adalah Pendekatan perundang–undangan dan Pendekatan konseptual. Berdasarkan hasil analisis dikemukanan yaitu, pertama, UU Kesehatan, UU SJSN dan UU BPJS merupakan instrumen pemerintah untuk memberikan jaminan dan pemenuhan hak atas kesehatan. Tetapi dalam pelaksanaanya terdapat tindakan diskriminatif dan belum meratanya program pemerintah. Dengan kata lain pemerintah gagal dalam memberikan pelayanan kesehatan. Atas dasar tersebut pemerintah dapat digugat secara perdata dan secara administrasi. Kedua, dalam penyelengaaraan pelayanan kesehatan lahir gugatan berkaitan dengan Onrechtmatige Overheidsdaaad (OOD) atau Besckikingapabila terjadi kerugian yang diderita oleh masyarakat berkaitan dengan hak kesehatanya. Terhadap OOD dapat diajukan ke Pengadilan umum, apabila berkaitan dengan Besckiking dapat diajukan ke Peradilan Tata Usaha Negara. Selain itu masyarakat juga dapat melakukan pengaduan kepada Ombudsman.

The study emphasizes the significance of digital activism, transcending its role as a mere trend, and underscores its importance in holding authorities accountable. The narrative navigates through real-life examples, such as the case of sexual harassment at the Indonesian Broadcasting Commission, illustrating how social media acts as a catalyst for justice. The reflection section addresses the looming threats associated with this evolving trend and proposes strategies for mitigation. This research contributes to understanding the nuanced role of social media in Indonesian society, shedding light on both its transformative potential and the imperative need for responsible digital activism.

Abstract

The mechanism of Pergantian Antar Waktu (PAW) for legislators in Indonesia reflects a structural tension between popular sovereignty and party sovereignty. Although constitutionally recognized, PAW in practice is predominantly initiated and controlled by political parties, often without the involvement or consent of voters. This raises a fundamental constitutional problem concerning the erosion of representative freedom and the subordination of voters’ political will to internal party interests. Within a democratic constitutional, such a configuration invites critical scrutiny, particularly when assessed through normative theories of justice and freedom. This study aims to critically examine the legal construction and implementation of party-initiated PAW and to assess its compatibility with the principles of republican justice. The research seeks to demonstrate how PAW operates as a mechanism of arbitrary power that undermines the representative mandate and weakens popular sovereignty. This research employs legal research with a statutory approach and a conceptual approach. The study finds that party-initiated PAW institutionalizes a form of structural domination, where legislators and voters are placed in a condition of dependency on party discretion. The absence of public participation and effective accountability mechanisms renders PAW an exercise of arbitrary power incompatible with republican freedom. The novelty of this research lies in its application of Philip Pettit’s republican justice theory to Indonesian constitutional law, offering a critique that reconceptualizes PAW not merely as a procedural issue, but as a constitutional injustice rooted in domination over popular political will.

Abstract

This research examines The Legal Responsibility of Political Parties in the Use of Financial Assistance from the State Budget (APBN). Financial assistance to political parties represents a form of state support aimed at strengthening party institutions and enhancing their role in promoting political education among citizens. However, in practice, there are frequent occurrences of mismanagement and a lack of transparency in the use of such funds, which raises legal issues concerning accountability and the responsibility of political parties. This study employs a normative juridical research method with a statutory and conceptual approach. The sources of legal materials consist of primary, secondary, and tertiary legal materials, analyzed qualitatively. The results of the study indicate that the legal responsibility of political parties in utilizing state financial assistance must be based on the principles of transparency, accountability, and compliance with applicable laws and regulations, particularly Government Regulation No. 1 of 2018 concerning Financial Assistance to Political Parties. Every political party is required to prepare a financial accountability report that must be audited by the Audit Board of Indonesia (BPK). In cases where violations such as fund misuse are found, administrative sanctions may be imposed, including the termination of financial assistance, and criminal sanctions may apply if elements of corruption are identified. Therefore, the legal accountability mechanism serves as an essential instrument to ensure clean, transparent, and integrity-based governance of political parties in accordance with the principles of good governance.
