Abstract

The coalition of political parties in nominating the presidential and vice-presidential candidate pair is a necessity. This is because none of the political parties received a majority vote, making them need support from other parties to meet the presidential threshold requirement. However, the established coalition mostly is not based on the same vision, mission, and ideology. The coalition is based on the developed political situations and conditions or for power-sharing such as sharing ministerial seats. As a result, the composition of the coalition in each presidential election always changes. This is obviously a coalition pattern that is oriented only to pragmatism. The research problems in this study were as follows. (1) What is the basis of the coalition of political parties in Indonesia? (2) What is the pattern of political party coalitions in Indonesia? (3) Why does a permanent coalition pattern between political parties need to occur? This study analyzed the coalition pattern of political parties and its implications for the implementation of the presidential election in Indonesia. The results showed that the coalition pattern of political parties in Indonesia occurred because most of the political parties do not make their vision, mission, and ideology become the basis for determining the direction of the coalition. Political parties build coalitions based on the agreement for a certain number of ministerial seats promised by the presidential and vice-presidential candidate pairs that they nominate. Political parties that were previously rivals (from the winning presidential and vice-presidential candidate pairs) can transfer their supporting positions to the elected presidential and vice-presidential candidate pairs. In fact, a permanent coalition is highly needed to ensure a check and balance of the winner of the general election. This means that the composition of political parties supporting the losing presidential and vice-presidential candidate pairs must be ready to become parties in the opposition ranks, not to become government coalition parties.

Abstract

The commissioner of the general election administration was discharged through the decision of the General Election Administrator Honorary Council (DKPP). The decision is not final and binding at the executive branch, considering that the decision can be cancelled by the Administrative Court. This study aims to define the authority of DKPP and PTUN in resolving ethical violations committed by election administrators and parse the implications and relationships of the decisions of the two institutions. This paper also proposes an ideal concept for the design of solving ethical violations of election administrators in the future. This study uses normative juridical methods. The results showed that the DKPP and PTUN have overlapping authority but with different decisions. DKPP purely adjudicates ethical issues, and the Administrative Court adjudicates the Presidential Decree, which is a follow-up to the DKPP decision. To avoid conflicting decisions on cases that intersect, violations of the code of ethics in the future must be resolved with a settlement mechanism by the judiciary.

Abstract

AbstractProblems arises in the implementation of elections between the election of the President / Vice President who are no longer held separately such as previous Elections. The technical implications are related to the ability of the Constitutional Court to adjudicate disputes over the legislative and presidential elections which are certainly unbalanced with the number of justices and the limited time. This study aims to map the problems experienced by the Constitutional Court in adjudicating disputes over simultaneous election results. The research method used is normative legal research using conceptual, legislation, history and case approach. The results shows that a separation of authority is needed between the disputes over the results of the presidential / vice presidential election with disputes over the results of the DPR, DPD and DPRD elections. The separation is needed to ensure that the election dispute resolution process does not accumulate in one judicial institution and results in a decision which passes the time limit given. With the separation of authority in adjudicating disputes over the results of the presidential election and legislative elections, the Constitutional Court will only focus on adjudicating cases of outcome disputes and other institutions will also focus on prosecuting thousands of legislative electoral disputes. AbstrakTerdapat permasalahan dalam penyelenggaraan pemilihan antara pemilihan Presiden/wakil Presiden yang tidak lagi digelar terpisah. Implikasi teknis berkaitan dengan kemampuan MK dalam mengadili perselisihan pemilu legislatif dan Pilpres yang tentu tidak berimbang dengan jumlah hakim konstitusi dan limitasi waktu yang dimiliki. Penelitian ini bertujuan untuk memetakan problematika yang dialami oleh MK dalam mengadili perselisihan hasil pemilu serentak. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan konsep, peraturan perundang-undangan, sejarah dan kasus. Hasilnya, diperlukan pemisahan kewenangan mengadili antara perselisihan hasil pemilihan umum Presiden/wakil Presiden dengan perselisihan hasil pemilihan umum DPR, DPD, dan DPRD demi menjamin proses penyelesaian perselisihan hasil pemilihan yang tidak menumpuk disatu lembaga peradilan dan berakibat pada putusan yang melewati batas waktu yang diberikan. Pemisahan ini akan membuat Mahkamah Konstitusi hanya fokus mengadili perkara perselisihan hasil saja dan lembaga lain juga fokus mengadili perselisihan Pileg yang jumlahnya ribuan.

Abstract

Pilihan penyelenggaraan Pemilu serentak untuk memilih anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Dewan Perwakilan Rakyat Daerah, dan Presiden/Wakil Presiden dalam satu hari yang sama telah menyebabkan banyaknya masalah pada tataran regulasi dan teknis sehingga menjadikan Pemilu tidak demokratis, efektif dan efisien. Oleh karenanya, perlu dikaji kembali tentang makna dan alternatif desain penyelengaraan Pemilu serentak yang tepat. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan pendekatan konsep, pendekatan peraturan perundang-undangan, pendekatan sejarah dan pendekatan kasus. Hasil penelitian menunjukkan bahwa Pemilu harus digelar serentak namun bukan berarti tidak dapat dipisah dalam beberapa tahapan penyelenggaraan. Terdapat banyak model pemisahan penyelenggaraan Pemilu serentak yang tetap dinyatakan konstitusional seperti Pemisahan penyelenggaraan berdasarkan kepada pembagian Pemilu Lokal dan Nasional, pemisahan penyelenggaraan berdasarkan tingkatan wilayah dan pemisahan penyelenggaraan kualifikasi cabang kekuasaan. Dengan berbagai tawaran desain tersebut maka penyelenggaraan Pemilu serentak tidak lagi dilaksanakan dalam waktu satu hari untuk pemungutan suaranya sehingga dapat mencegah banyaknya penyelenggara Pemilu yang meninggal dunia dan membuat keseluruhan proses Pemilu dan Penyelesaian sengketa Pemilu berjalan sesuai dengan prinsip-prinsip Pemilu yang diamanatkan oleh konstitusi.

Abstract

The purpose of this reseach is to describe the factors and implications of the proliferation of political dynasties and to find designs to create dynastic politics that do not conflict with the spirit of local democracy in Indonesia. The problem of this research is the factors and implications that make politics flourish in simultaneous Pilkada and the ideal dynastic political design. The research method used is normative juridical through the concept of an approach, legislation, case approach and historical approach. The results showed that dynastic politics mushroomed because the regional head as the ruler was unable to run again, the ruler at the national level wanted to use his power to place family members as rulers at the regional level. As a result, many candidates for regional heads are nominated without the competence and willingness to become regional heads. The ideal dynastic political design can be achieved with the requirements to be declared valid as a candidate for regional head as well as regulations that prevent unqualified regional head candidates from fulfilling formal or legal requirements as regional head candidates.

Abstract

This research aims to elaborate on the standing of Islamic law regarding regional head post-filling and how this post-filling is designed to conform with the principle of Islamic law. This research employed mixed methods and statutory, conceptual, case, and normative-theological approaches. The research results reveal that Islam holds the principles that can be adopted into the constructions of the national law in the matter of regional head post-filling. In the time to come, this post-filling should conform to the principle of al muhafadhotu ala qodimis sholih wal akhdzu bil jadidil ashlah, in which this post-filling should refer to the applicable model coupled with the development of this model with an asymmetric post-filling system. With this approach, areas with direct regional head elections will face reduction. Consequently, the areas not eligible to establish direct elections should consider another election model.

Abstract

Regional heads and Regional House of Representatives (DPRD) are local government. Both institutions were formed in order to support the running of local government within the framework of checks and balances. However, in practice, the relationship between the two institutions tends to be destructive and intrigue each other and result in a convergence of the priorities of the interests of the people. This research departs from questions about what are the factors that cause the fracture of relations between regional heads and DPRD, what are the implications of disharmony between regional heads and DPRD and how to design to prevent disharmony between regional heads and DPRD in the future. This research is qualified into the type of normative juridical research with a statutory approach, a case approach, and a conceptual approach. The results showed that the disharmony between the regional head and the DPRD was caused by the process of directly electing the regional head so that the regional head felt that they did not have a debt of gratitude to the DPRD. At the same time, at the time of nomination, the elected regional heads sometimes come from independent candidates and/or do not come from the majority party in the DPRD. In the future, the disharmony between regional heads and DPRD cannot be allowed to continue considering that the disharmony in relations has caused obstacles to the government. The design that can be taken to prevent disharmony in relations can be pursued by applying sanctions to regional heads and/or taking over temporary authority by superior organizations.

Abstract

The main requirement to become a regional head candidate is to be an Indonesian citizen. In the 2020 Pilkada, it was found that a foreign citizen won the Regional Head Election. This certainly raises a legal dilemma or polemic regarding the inauguration process. Whether the person concerned can be inaugurated as regional head or canceled. The formulation of the problem raised in this research is about the legal implications of the victory of foreigners in the Regional Head Election and the legal construction of the cancellation of the inauguration. This research is normative juridical research with a concept approach, legislation approach, and case approach. The results of the study found four things that resulted from the victory of foreigners in the Regional Head Election. Namely, the weakness of the regulation, the negligence of the organizers, the validity period of the dispute resolution of the limited nomination requirements, and the confusion to advance or continue at the inauguration stage. The choice of legal construction as a solution that can be taken is to cancel the inauguration of foreign election winners. The cancelation process can go through the judicial process through the mechanism of disputing the results in the Constitutional Court. Cancellation of the inauguration can also be done by the executive body through a decision from the Ministry of Home Affairs.

Abstract

Appraisal service companies are entities tasked with determining the true value of wealth or property for various trade transaction purposes, but they currently face a range of economic and legal challenges. This study analyses the appraisal team's principles of justice and legal responsibility in setting the minimum bid value for auctioned collateral. Employing a normative legal research method, this research draws on statutory, conceptual and case approaches supported by primary legal material. The findings show that the appraisal team is legally responsible for the values they determine for collateral auctions, with the liability encompassing three main areas, including civil liability. If the team is proven to have violated the provisions of the auction as mentioned in PMK Number 228 / PMK.01 / 2019 concerning Public Appraisers, they may face administrative sanctions, such as written warnings, restrictions on certain appraisal services, suspension of permits, or permit revocation. Furthermore, the Government has provided legal protection to auction buyers with good faith who participate in auctions in compliance with applicable regulations. Fairness must be achieved and upheld through just procedures to ensure fair results, giving all parties equal standing and rights in the auction process.
