Abstract

In Islam, adopting children has been known since the time of the Prophet Muhammad. Literally, tabbani means a family couple who tries to get a foster child from another family, then treats it as if it were their biological child. The reality of informants in Sawentar, Blitar, child adoption is based on the agreement of biological parents with adoptive parents, then the adopted child is manipulated as if he were the biological child of the adoptive parents, without going through the court process, Research qualitative approach type of observational research, field-research, determination of empirical approaches, subjected to 3 primary sources. Descriptive qualitative means using qualitative data, then described descriptively. Problems are solved by non-doctrinal empirical normative studies, sourced from primary and secondary data. The purpose of the research is to describe the process of adoption without trial, under HI / Islamic Law and or HP / Positive Law. Documentation, data collection by interviewing, observing reinforced the technique of analyzing documents in the design of descriptive qualitative methods, starting with reducing, presenting, ending with drawing conclusions, where the researcher holds the primary key. The conclusion was found that child adoption in Sawentar Village, the subject of the study carried out the adoption without going through the procedures as established by the government. This means that in positive law there is a violation of the law. The subject considers the judicial procedure to be a lot of time consuming, feels the complexity, does not meet the requirements of adoption, and the lack of understanding regarding child adoption according to the law. Implications, reviewing positive law, judicial child adoption is not fulfilled, if the socialization of adoption in the community is not intensified. Adoption is more about the agreement of both parties without a court process. Then, there is a lack of legal protection for adopted children, confidentiality in both, if not open, nasab (family ties based on blood relations, both up, down, and sideways) and the pleasure of the mother, father or biological person will be lost.

Abstract

Lately, there has been a lot of news about bullying cases in several Islamic boarding schools. This study discusses the optimization of prevention and advocacy of bullying cases in Islamic boarding schools. The data analysis technique uses content analysis by sorting things that are in accordance with the focus and objectives of the study. This study found that bullying is an act that is painful both physically and non-physically from the person who does it to the victim, such as teasing, hitting, kicking, mocking, cursing, gossiping, cursing, shouting, isolating, intimidating, pressuring, discriminating, and ignoring. Ways to prevent bullying in Islamic boarding schools can be done by explaining to students the verses of the Quran that have prohibited bullying. For example, Surah An-Nisa verse 30 prohibits committing violence against others. Surah Al-Hujurat verse 11 prohibits acts of belittling, mocking, and cursing others. There are even many more verses of the Quran that contain prohibitions on bullying. In addition, ways to prevent acts and advocate bullying in Islamic boarding schools can be done with four methods, namely the approach method, the consequence method, the special method, and the activity method. Meanwhile, preventing acts of bullying in Islamic boarding schools can also be done in three ways, namely prevention with spiritual awareness, prevention by maintaining harmony and breaking the cycle of problems, and prevention by eliminating inferior traits and honing assertiveness skills.

Abstract

Undang-Undang No. 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) menandai tonggak penting dalam perlindungan terhadap korban kekerasan seksual di Indonesia. Salah satu pendekatan yang dilakukan peneliti adalah restorative justice (keadilan restoratif), yang idealnya bertujuan untuk memperbaiki kerugian yang dialami korban, bukan sekadar menghukum pelaku. Namun, dalam praktik perundang-undangan dan pelaksanaannya, terdapat celah normatif yang menyebabkan pendekatan ini tidak mampu memenuhi tujuan pemulihan secara menyeluruh. Kegagalan pemulihan korban bukan hanya disebabkan oleh faktor teknis, tetapi juga oleh kelemahan dalam konstruksi hukum yang berlaku. Penelitian ini bertujuan untuk mengkaji dan menganalisis pengaturan hukum mengenai restorative justice dalam UU TPKS secara normative sehingga dapat menilai sejauh mana norma-norma hukum tersebut mampu menjamin hak-hak korban untuk dipulihkan secara utuh. Penelitian ini menggunakan metode normatif yuridis, yaitu penelitian hukum yang berfokus pada pengkajian bahan hukum primer dan sekunder. Pengaturan hukum belum secara eksplisit memberikan ruang bagi partisipasi aktif korban dalam menentukan bentuk pemulihan yang sesuai dengan kebutuhan dan kondisi mereka. Ketiadaan peraturan pelaksana (Peraturan Pemerintah atau Peraturan Menteri) menghambat efektivitas implementasi keadilan restoratif secara normatif. Jadi Secara normatif, pengaturan restorative justice dalam UU TPKS belum cukup kuat untuk menjamin pemulihan korban secara menyeluruh.

Abstract

Kekerasan seksual terhadap anak mengalami peningkatan signifikan di Indonesia, menimbulkan dampak fisik, psikologis, dan sosial yang serius bagi korban. Dalam menanggapi kondisi ini, pemerintah menerbitkan Peraturan Pemerintah (PP) No. 70 Tahun 2020 sebagai regulasi pelaksana Undang-Undang No. 17 Tahun 2016. Salah satu sanksi tambahan yang diatur dalam PP tersebut adalah kebiri kimia, yaitu pemberian zat kimia kepada pelaku kekerasan seksual untuk menurunkan libido seksualnya. Regulasi ini menimbulkan polemik, terutama dari sudut pandang hak asasi manusia dan etik kedokteran. Penelitian ini bertujuan untuk menganalisis urgensi penerapan kebiri kimia sebagai bentuk pemidanaan dalam upaya menanggulangi kekerasan seksual terhadap anak serta mengkaji kesesuaian PP No. 70 Tahun 2020 dengan prinsip-prinsip hukum pidana dan HAM. Penelitian menggunakan pendekatan yuridis normatif, yaitu dengan menelaah peraturan perundang-undangan yang berlaku, doktrin hukum, dan putusan pengadilan yang relevan. Analisis dilakukan terhadap norma-norma hukum dalam PP No. 70 Tahun 2020 serta ditinjau dari teori hukum pidana dan perlindungan anak. Hasil kajian menunjukkan bahwa pemidanaan kebiri kimia secara normatif memiliki legitimasi hukum dan dapat dipandang sebagai bentuk ultimum remedium dalam kasus-kasus kekerasan seksual terhadap anak yang berat. Namun, pelaksanaannya menghadapi tantangan, seperti penolakan dari kalangan medis, potensi pelanggaran HAM, dan masih lemahnya sistem rehabilitasi terhadap pelaku sehingga diperlukan penguatan regulasi teknis, pengawasan pelaksanaan, dan pendekatan multidisipliner untuk memastikan efektivitas kebijakan ini.
