Abstract

The rapid development of technology has encouraged progress in the trade sector, necessitating the utilisation of electronic system technology to facilitate trade with all consumers from all over the globe. Consequently, business actors have employed electronic trade contracts in their efforts to reach all consumers from all over the world. In order to enhance efficiency, it is not uncommon for business actors to utilise a standard agreement containing standard clauses in conducting trade through electronic systems. The Standard Agreement is not prohibited by law; however, there is a clause that is prohibited by law, namely the Standard Agreement is prohibited from containing an exoneration clause. The purpose of this research is to identify the mechanism for creating electronic commerce contracts and the legal consequences resulting from exoneration clauses in the context of electronic commerce contracts. The research method employed is the Normative Law Research Method with a statute approach and a conceptual approach. The results of the research indicate that the mechanism for forming electronic trade contracts for goods or services, as regulated in PP No. 80 of 2019, begins with advertising, offering, acceptance, confirmation, followed by payment, delivery of goods or services, cancellation and dispute provisions. Furthermore, the legal consequences arising from the exoneration clause are null and void in accordance with what is regulated in Law No. 08 of 1999, namely in Article 18. PMSE Electronic Contract which results in losses to consumers, the standard contract maker can be retrieved to the Minister of Trade or BPSK

Abstract

One form of alternative punishment that is quite often used in developing criminal offenders is conditional punishment. Conditional sentences are decided by a court judge with conditions, namely that their implementation is supervised by an authorized officer, intended to improve the convict so that he is not influenced by prison subculture, conditional sentences are also intended to prevent the occurrence of crime. Based on the background of the problem above, this article aims to examine and analyze the role of prosecutors in supervising the implementation of criminal decisions and the obstacles faced by prosecutors in supervising the implementation of conditional criminal decisions at the Sampang District Prosecutor's Office. This research uses legal science research with empirical aspects or non-doctrinal legal research or socio-legal research with a descriptive qualitative research approach. The results of this research are the implementation of supervision of conditional criminal decisions carried out by prosecutors at the Sampang District Prosecutor's Office only by requiring convicts to report within a certain period of time (during the probation period), in addition to coordinating with the police, BAPAS and with the heads of the villages where they are located. the conditional convict's domicile for monitoring by sending a copy of the conditional sentence notification report letter (P-51). The obstacles faced by prosecutors at the Sampang District Prosecutor's Office in implementing supervision of conditional criminal decisions are; legal factors, law enforcement factors, facility factors and community legal culture factors.

Abstract

Program Keluarga Harapan (PKH) merupakan suatu kebijakan pemerintah yang berkaitan dengan pemberdayaan keluarga miskin. Program tersebut bertujuan untuk mempercepat penanggulangan kemiskinan secara terpadu dan berkelanjutan. Dalam memilih warga penerima bantuan, sering terjadi permasalahan salah satunya yaitu penerima bantuan yang tidak tepat sasaran berdasarkan ketentuan pemerintah. Pada praktiknya, petugas di Kantor Desa Teladan menggunakan pengelompokan data secara sederhana untuk menentukan kelayakan penerima bantuan dan cenderung lama Untuk mempermudah dan mempercepat seluruh proses tersebut.   Oleh karena itu maka dibuat sistem pendukung keputusan menggunakan metode Simple Additive Weighting (SAW). Konsep metode Simple Additive Weighting yaitu mencari penjumlahan terbobot dari rating kinerja setiap alternatif pada semua atribut. Sistem ini diharapkan mampu menjadi solusi dalam penentuan penerima bantuan sehingga tepat sasaran. Hasil dari penelitian ini adalah sebuah perangkat lunak yang dapat dijadikan dalam pengambilan keputusan, dalam hal ini maka nilai yang menentukan kelayakan penerima bantuan adalah 0,799166 sampai 1 dengan demikian dapat digunakan dalam pengambilan keputusan yang efektif dan efisien

Abstract

The United Nations Convention on the Law of the Sea (UNCLOS) in 1982 is an international legal The United Nations Convention on the Law of the Sea (UNCLOS) in 1982 is an international legal instrument that plays a key role in regulating the rights and obligations of countries related to the global use of the sea. Territorial conflicts in the North Natuna Sea, especially China's claims that are not by UNCLOS, are a serious challenge for Indonesia in upholding its maritime sovereignty. The 2016 South China Sea Arbitration Award, which rejected China's "Nine-Dash Line" claim, provided a strong legal basis for Indonesia to fight the unilateral claim. This study uses normative juridical methods with historical approaches and case studies, analyzing how the 1982 UNCLOS and the 2016 Arbitral Award are applied in the context of the North Natuna Sea. The results show that the 1982 UNCLOS, in particular Article 73, provides a legal basis for Indonesia to take decisive action in defending its EEZ, while the 2016 Arbitral Award strengthens the legitimacy of Indonesia's rejection of China's claimms. Thus, this research contributes to a deeper understanding of international legal strategies that Indonesia can adopt in facing maritime challenges in the North Natuna Sea.

Abstract

The Brantas River area in Malang City, East Java, has experienced a decline in water quality due to domestic waste. Many residents living along the riverbanks rely on the river as a primary water source, despite the deteriorating environmental conditions. Therefore, an in-depth study is needed on the policies and programs implemented by various related institutions using the Gender Analysis Pathway (GAP). This study examines gender mainstreaming (PUG) policies and programs adopted by government institutions in Malang City, particularly in the areas of waste management and water quality, as well as the implementation of PUG within communities residing along the Brantas River. This research is classified as empirical legal research, as it evaluates the implementation of regulations, policies, and gender mainstreaming programs within relevant agencies. The findings indicate that: (1) The implementation of PUG programs within government institutions in Malang City has not been maximized, as each department carries out programs based on its specific duties and responsibilities. (2) The implementation of PUG within communities along the Brantas River has not been carried out, as evidenced by the lack of gender-related socialization from government agencies. Additionally, community needs, such as waste bins, have not been effectively communicated to the government. There is also a desire among residents to independently measure the quality of well water, but they lack the necessary knowledge to do so. The community has expressed a willingness to learn and conduct independent water quality assessments. (3) The challenges in implementing PUG at the community level are evident, as residents lack awareness and understanding of gender-related issues, making it difficult to develop programs using gender-based indicators.  Keywords: Policy, Gender Mainstreaming, Environment

Abstract

Indonesia, as a mega-biodiversity country, faces serious threats from the illegal wildlife trade, including the slow loris (Nycticebus spp.), a protected endemic primate. This study aims to examine law enforcement efforts against wildlife trafficking within the jurisdiction of the Batu Police Department in East Java, as well as the role of the East Java Natural Resources Conservation Agency (BBKSDA). Using an empirical juridical approach, the study analyzes law enforcement practices through a case study of slow loris trafficking uncovered by the Batu Police cybercrime unit. The findings indicate that the success in revealing the case was due to collaboration between law enforcement and BBKSDA East Java, despite ongoing challenges. These include internal obstacles such as limited human resources and budget constraints, as well as external factors like low public awareness and the existence of organized crime networks. This study recommends a multisectoral approach, institutional capacity building, and improved public literacy as essential strategies for conservation efforts and combating wildlife trafficking in Indonesia.

Abstract

The Ministry of Education, Culture, Research, and Technology (Kemdikbudristek) issued an Independent Learning policy in order to achieve quality education for all Indonesian people. Quality education focuses on developing basic competencies and character to ensure students progress in learning so that they are more competent and have character. One of the Independent Learning policies that have been launched is the Educational Report platform. The Educational Report Platform that was launched, is a platform that provides data on reports on the results of the evaluation of the education system as an improvement on previous quality report platform. This research is a descriptive qualitative study to examine how the newly launched Indonesian Educational Report platform can be utilized in data-based education planning so that the planning carried out can be more targeted and the quality of education can be improved. The results of the study have shown that the use of Educational Report in data-based planning is a tool and a way to identify root causes, reflect on educational achievements, and become a material for constructive discussions with various education stakeholders to improve the quality of education.

Abstract

Studi ini mengeksplorasi peran penting "Guru Penggerak" dalam implementasi Kurikulum Merdeka di Tanjung Jabung Barat, Provinsi Jambi, Indonesia. Studi ini menyoroti bagaimana para guru ini, yang dilatih melalui program pembelajaran daring dan luring, berperan sebagai katalisator untuk transformasi pendidikan dengan menumbuhkan lingkungan belajar yang berpusat pada siswa. Penelitian ini menggunakan metodologi deskriptif kualitatif, dengan menggunakan wawancara dan observasi untuk mengumpulkan wawasan dari para guru yang telah berpartisipasi dalam program Guru Penggerak. Temuan menunjukkan bahwa para guru ini tidak hanya meningkatkan kompetensi mereka sendiri, tetapi juga menginspirasi rekan-rekan dan siswa mereka, sehingga berkontribusi pada budaya sekolah yang positif. Studi ini menekankan pentingnya kolaborasi antara pendidik, orang tua, dan masyarakat dalam mencapai tujuan pendidikan dan mengembangkan karakter siswa. Pada akhirnya, peran Guru Penggerak dianggap penting untuk mengembangkan praktik pengajaran yang inovatif dan efektif yang selaras dengan tuntutan abad ke-21.

Abstract

Penelitian ini memiliki tujuan untuk menguraikan bagaimana kepala sekolah bisa meningkatkan mutu pendidikan di era 4.0 melalui model kepemimpinan yang bersifat transformasional, visioner, serta autentik. Pendekatan analisa konten dipergunakan pada kajian ini untuk mengungkap makna yang represetatif dan berkaitan dengan tujuan penelitian. Hasil analisa memperlihatkan jika kepemimpinan ialah keterampilan yang sangat penting bagi kepala sekolah dalam mengarahkan guru supaya mencapai kinerja optimal. Kegagalan manajer dalam membentuk kerja sama tim bisa berdampak negatif pada kinerja organisasi dan mutu pendidikan. Gaya kepemimpinan transformasional, visioner, serta autentik memainkan peran kunci dalam meraih tujuan organisasi dengan meningkatkan kinerja serta komitmen dari anggota timnya, terutama di era 4.0 yang penuh dengan kompleksitas. Penting bagi pemimpin untuk memperhatikan sikap anggota tim terhadap pekerjaan yang harus dijalankan karena hal itu berpengaruh pada produktivitas pekerjaan serta mutu pendidikan secara keseluruhan. Gaya kepemimpinan transformasional, visioner, serta autentik memiliki dampak positif dan signifikan pada mutu pendidikan di era 4.0.

Abstract

This study aims to analyze the effect of career development, compensation and organizational commitment on turnover intention. The population in this study were 116 employees of PT. Mega Pasanggrahan Indah Unit Cinere Bellevue Mall. The sample used is 54 employees, calculated based on the Slovin formula. Sampling method using simple random sampling. This research is a type of causal associative research. The instrument of this research used a questionnaire. The data analysis method used in this research is the Smart PLS version 3.0 application. The results of this study prove that career development has a negative and significant effect on turnover intention, compensation has a negative and significant effect on turnover intention, and organizational commitment has a negative and significant effect on turnover intention
