Abstract

Dalam Pasal 27 UUDNRI 1945 menegaskan bahwa, tiap-tiap warga negara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan lebih lanjut pada pasal 28 D ayat (2) UUDNRI 1945 mengatur mengenai hak asasi warga negara untuk bekerja serta mendapatkan perIakuan yang adil dan layak dalam hubungan kerja. Sebanyak 10 Badan Usaha di Provinsi Bali Tahun 2024 belum mendaftarkan pekerjanya ke dalam Program Jaminan Kesehatan Nasional dan sebanyak 118 Badan Usaha di Provinsi Bali belum patuh untuk membayarkan iuran Pekerjanya kepada BPJS Kesehatan akibatnya pekerja belum memiliki akses dalam mendapatkan Jaminan Kesehatan Nasional. Hal ini menunjukkan belum meratanya perlindungan jaminan Kesehatan nasional bagi seluruh masyarakat khususnya pekerja. Berbagai polemik ditimbulkan akibat ketidakpastian terkait penjaminan kesehatan bagi pekerja. Penelitian ini bersifat normative. Kebijakan terkait penjaminan jaminan Kesehatan nasional kepada pekerja belum memberikan perlindungan hukum bagi para pekerja karena di lapangan masih ada Badang Usaha yang belum patuh terkait pendaftaran dan pembayaran iuran bagi pekerjanya. Dibutuhkan sinergi dari seluruh pihak agar pekerja mendapatkan haknya karena penegakan kepatuhan dalam mendaftarkan dan membayarkan iuran pekerja tidak terlepas dari penegak hukumnya

Abstract

Digital transformation in higher education requires learning innovations that are adaptive to the characteristics of the millennial generation, especially in complex courses such as State Administration Law (HAN). At FHISIP University of Mataram, conventional lecture methods still dominate, causing boredom and low understanding of students to abstract concepts such as the principle of legality and discretion of public officials. Responding to these challenges, this service project developed VIP-HAN (Innovative Video of Learning Law of State Administration) as an interactive and easily accessible technology-based learning media. The implementation method consists of six stages: consultation with mentors, coordination with the Head of the Constitutional Law Section, collection of materials, video production using CapCut and Canva applications, socialization in class, and evaluation through Google Form questionnaires. The video material is compiled based on RPS and academic literature, with a storytelling approach and infographic animation to make it easier to understand. The evaluation showed that 85% of students found it helpful to understand abstract concepts, and 78% of lecturers appreciated the efficiency of teaching time. The discussion included technical challenges, adaptive strategies, and cross-disciplinary collaboration in content development. The project also sparked further innovations in the faculty environment, such as the development of podcasts and digital simulations by other study programs. In conclusion, VIP-HAN has proven to be effective as a hybrid learning solution that supports the digitization of legal education. Institutional support and strengthening of lecturer capacity are the key to the sustainability of this innovation in the future.

Abstract

Illegal investments in Indonesia cause substantial public losses and threaten financial system stability. This study analyzes legal threats against illegal investment operators and evaluates the effectiveness of Law No. 4 of 2023 on Financial Sector Development and Strengthening (P2SK Law) in protecting the public. Using a normative legal method with statute and conceptual approaches, the study examines legislation, legal literature, and official publications from the Financial Services Authority (OJK). Findings show that the P2SK Law explicitly prohibits unauthorized fundraising (Article 237) and imposes strict sanctions, including 5-10 years imprisonment and fines up to IDR 1 trillion (Article 305). OJK Regulations 22/2023 and 14/2024 strengthen preventive and enforcement mechanisms through integrated supervision and Satgas PASTI. The study concludes that P2SK significantly enhances legal protection and deterrence against illegal investments. Strengthening financial literacy, optimizing Satgas PASTI, and consistent law enforcement are essential for effective public protection and sustainable financial stability.

Abstract

Visi Indonesia Emas 2025 menjadikan Pembangunan Rendah Karbon (PRK) dijadikan arus utama pelaksanaan Pembangunan berkelanjutan. Kontribusi sektor swasta adalah faktor yang diperhitungkan. Tujuan penelitian adalah mengkaji kontribusi TJSL PT dalam agenda PRK di Indonesia. Kontribusi ini mengacu pada E NCD Indonesia 2022 dan RPJPN 2025-2045, pada sektor Kelautan dan Transportasi ditegaskan CSR/TJSL sebagai strategi pendanaan berupa penggalangan hibah, kategori pendanaan pendukunh (co-bebefit) bukan pendanaan pendanaan utama dalam strategi pendanaan PRK. PRK mengupayakan peningkatan kolaborasi dengan sektor swasta melalui skema pendanaan Public-Privat-Partnership (PPP/Kemitraan Pemerintah-Swasta. PPP adalah prioritas strategi aspek pendanaan sumber Dana Kreatif (Non-Tradisional) untuk sektor kritikal atau prioritas mitigasi emisi yaitu Sektor energi dan sektor kehutanan. Skema PPP belum bisa dipastikan apakah Dana TJSL PT termasuk yang diperhitungkan sebagai sumber pendanaan untuk PRK. Penguatan substansi regulasi dan implementasi TJSL adalah sisi krusial dalam kontirubusi TJSL terhadap PRK di Indonesia.

Abstract

The development of digital technology has brought tremendous convenience to various aspects of human life, ranging from work and education to lifestyle transformation. However, this advancement also opens opportunities for the misuse of technology, one of which is the rising phenomenon of online gambling that has become increasingly prevalent and difficult to control. This issue not only affects urban communities but has also spread to rural areas, including housewives and adolescents, who are particularly vulnerable to the negative impacts of the internet. This community service activity aimed to increase the legal awareness of the residents of Korleko Selatan Village regarding the dangers of online gambling from legal, social, and psychological perspectives. The method used was descriptive qualitative with an educational and participatory approach, in which the community actively participated in socialization sessions, discussions, and question-and-answer activities. The results showed an improvement in participants’ legal understanding and digital awareness concerning the impacts and legal consequences of online gambling. Moreover, this activity fostered a stronger community commitment to using technology wisely and avoiding illegal activities in the digital space.

Abstract

Unregistered polygamous marriages pose serious problems related to the protection of wives' inheritance rights in Indonesia. This study aims to analyze the protection of wives' inheritance rights in unregistered polygamous marriages according to Islamic law and the implementation of the principle of justice in that context. The research method used is normative juridical with a library approach, using primary, secondary, and tertiary legal materials analyzed through legal interpretation, descriptive-analytical analysis, comparative, and maqashid sharia. The results of the study indicate that from an Islamic legal perspective, wives in unregistered polygamous marriages still have the same inheritance rights as regulated in the Qur'an, Surah An-Nisa, verse 12 and the Compilation of Islamic Law Article 180, namely 1/4 if the husband leaves no children and 1/8 if the husband leaves children, which are divided equally among all wives. However, in the practice of positive law in Indonesia, unregistered marriages face legal obstacles that cause wives' inheritance rights to not be optimally protected. The implementation of the principle of justice faces challenges in the form of legal dualism between religious legitimacy and state recognition, unequal access to legal protection, and minimal public understanding of wives' inheritance rights. From the perspective of maqashid sharia, this lack of legal protection violates the principles of hifdz al-nasl (protection of offspring) and hifdz al-mal (protection of property). This study recommends five strategies to achieve justice: facilitating access to marriage itsbat, increasing legal socialization, strengthening judges' judicial ijtihad, integrating maqashid sharia into legislation, and developing alternative mechanisms for resolving inheritance disputes.
