Abstract

Tujuan penelitian ini adalah elaksanaan bimbingan perkawinan di Kantor Urusan Agama Kecamatan Pontianak Tenggara; 2) faktor pendukung dan penghambat bimbingan perkawinan di Kantor Urusan Agama Kecamatan Pontianak Tenggara. Penelitian dengan metode kualitatif deskriptif, berjenis penelitian lapangan (field research) dan pendekatannya yaitu normatif-empiris, sumber data yang digunakan adalah sumber data primer berupa wawancara dengan Kepala dan Penyuluh Fungsional KUA Kecamatan Pontianak Tenggara yang sudah ditentukan subjeknya, kemudian sumber data sekunder dari buku, jurnal, Keputusan Dirjend yang dibuat pemerintah dan sumber lainnya, sehingga dapat melengkapi dalam penelitian ini. Teknik yang digunakan dalam mengumpulkan data penelitian ini adalah observasi, wawancara, dan dokumentasi. Adapun dalam analisis datanya, peneliti melakukan reduksi, sajian data serta simpulan. Kemudian data tersebut diperiksa keabsahannya dengan menggunakan member check. Adapun dapat disimpulkan: 1) proses pelaksanaan bimbingan perkawinan di KUA Kecamatan Pontianak Tenggara yaitu di mulai dari calon pasangan pengantin melakukan pemeriksaan berkas-berkas persyaratan pernikahan oleh petugas administrasi sampai mendapatkan sertifikat bimbingan perkawinan apabila sudah mengikuti bimbingan perkawinan hingga selesai; 2) Adapun yang menjadi faktor pendukung bimbingan perkawinan yaitu adanya regulasi yang mengatur pelaksanaan bimbingan perkawinan, adanya kesadaran dari calon pengantin mengenai pentingnya mengikuti bimbingan perkawinan. Sedangkan faktor penghambat bimbingan perkawinan yaitu ruangan bimbingan kecil maupun sederhana, dana anggaran bimbingan perkawinan yang tersedia terbatas.

Abstract

Penelitian ini mempunyai tujuan guna mengetahui : 1) Implementasi PP Nomor 48 Tahun 2014 mengenai Biaya Pencatatan Nikah di KUA Kecamatan Pontianak Barat; 2) Perbedaan pelayanan pendaftaran nikah sebelum dan sesudah berlakunya Peraturan tersebut di KUA Kecamatan Pontianak Barat. Penelitian ini menggunakan metode penelitian kualitatif yang berjenis penelitian lapangan dan pendekatan yang digunakan sosiologis, Sumber data dalam penelitian ini menggunakan data primer berupa Wawancara dari Kepala Kantor Urusan Agama Kecamatan Pontianak Barat yang telah ditentukan subjeknya, dan Dokumentasi. Dan data sekunder berupa buku-buku. Teknik yang digunakan dalam pengumpulan data adalah wawancara dan dokumentasi. Sedangkan Analisis data dalam penelitian ini menggunakan analisis yang bersifat deskriptif dengan pola induktif, yaitu guna memperoleh gambaran data yang dalam prosesnya berdasarkan fakta dan dituangkan dalam teori kajian. Analisis yang dilaksanakan peneliti yakni, menghasilkan kesimpulan bahwasannya 1) proses pencatatan nikah oleh pihak KUA tidak dipungut biaya (gratis). Sehingga dapat dikatakan bahwa pihak Kantor Urusan Agama Kecamatan Pontinak Barat telah melakukan prosedur sesuai dengan PP No.48 Tahun 2014. 2) Pelayanan dan pendaftaran nikah sebelum terbitnya PP Nomor 48 tahun 2014 bahwa calon pengantin melakukan pembayaran kepada pihak pegawai KUA atau yang sedang bertugas dan kemungkinan terjadi gratifikasi atau pungutan liar sesudah pemberlakuan PP Nomor 48 tahun 2014 bahwasannya prosedur pembayaran bagi calon pengantin yang menjalankan akad di luar atau di rumah harus membayar langsung melalui bank dan akan diberikan oleh pihak KUA yang namanya Billing yaitu kode pembayaran. Abstract

Analisis Putusan Perkara Perdata Mahkamah Agung Nomor 706 K/Ag/2015 Dalam Menetapkan Bagian Anak Perempuan Bersama Saudara. Fakultas Syariah Program Studi Hukum Keluarga Islam (Ahwal Syakhshiyyah) Institut Agama Islam Negeri (IAIN) Pontianak, 2021. Tujuan daripada penelitian adalah: 1) Supaya tahu akan bagian anak (perempuan) dalam waris jika bersama saudara kandung; 2) Supaya tahu akan pertimbangan hakim pada menetapkan warisan anak perempuan bila bersama saudara kandung. Metode dalam penelitian memakai metode kepustakaan. Teknik dalam pengumpulan data pada penelitian kepustakaan (library research) dengan dokumentasi. Sumber data pada penelitian yang digunakan yaitu data pustaka yang disatukan dengan usaha mencari data tertentu, mengemukakan dan melakukan analisis data bahan bacaan / yang berkaitan dengan sumber rujukan Putusan Mahkamah Agung. Penelitian ini menggunakan metode analisis data beserta pengurangan data, penyajian (menyampaikan) data, dan penarikan akan kesimpulan bersama (verifikasi) pemeriksaan data. Kemudian, metode pemeriksaan keabsahan data pada penelitian memakai bahan sumber acuan untuk mensupport dalam membuktikan bahan kajian yang sudah dijumpai si peneliti. Adapun hasil penelitian ini: 1. Bahwa dikalangan Para ?ahabat dan Ulama mengenai pemaknaan kata walad ada 2 pendapat: Pertama. Adalah lughah walad bermakna anak (lelaki). Kedua. Bahwa kata walad bermakna anak (lelaki) dan anak (perempuan). 2. Bahwa Mahkamah Agung Nomor telah menetapkan bahwa bila anak perempuan mendapat ‘a?abah karena seorang dan menghalangi bagian saudara kandung dalam pembagian harta warisan. Sehingga bagian anak perempuan dan bagian saudara kadung bisa Dan Adapun dampak dari kajian ilmiah supaya mampu sebagai bahan pembahasan untuk umum dan mereka peneliti saat sedang dalam penelitian. Abstract

The implementation of the study has some purpose of knowing: 1) How mediator’srole in the divorce mediation at Singkawang Religious Court. 2) How the successrate of the divorce mediation at Singkawang Religious Court. 3) What are theobstacle factors for mediator judges in the divorce mediation at SingkawangReligious Court. This study used empirical normative legal research (applied lawresearch). In addition uses a descriptive qualitative approach. This study uses twodata sources, there are primary data sources obtained from research subjects, as wellas secondary data sources consisting of primary and secondary legal materials. Thisstudy uses structured interview techniques and documentation. Data analysistechniques uses are reduction, presentation then verification the data. Then, usedtechnique of rechecking all of the data and information (member check) obtainedfrom the data collected. Through the findings obtained from the results of theanalysis of data that have been studied in this study, it can be concluded that: 1)Mediator judges in carrying out his role to reconcile the parties in divorce mediationat Singkawang Religious Court following Supreme Court Regulation Number 1 of2016 on Mediation Procedures. However, the final mediation is entirely based onthe parties’ will. 2) The success rate of mediation at Singkawang Religious Courtis low. 3) Factors that inhibit mediators in mediation at Singkawang Religious Courtare difficulty of reconciling the parties who have complicated problems in thehousehold, the absence of either litigant, the absence of goodwill of the parties orone party, the parties strong desire to divorce and position of the judge as a mediatorcauses a limited quantity of mediators.

Abstract

The purpose of this study is to find out what are the basic sociological considerations and what factors cause sociological considerations to judge the considerations of the Religious Court Class 1-A Pontianak, in granting or rejecting the case of the marriage dispensation. Researchers use qualitative research methods with the type of field research (field research), namely research to solve problems and find theories based on verification of data collected in the field. The normative juridical approach, namely legal research conducted by examining library materials or secondary data as the basis for research, by conducting a search on regulations and previous research relating to the problem under study. The results of the study show that: the basis of sociological considerations is to maintain or prevent a bigger problem from occurring, according to the fiqh rule that preventing damage is prioritized over bringing good, this pregnant woman candidate cannot be separated from the basic considerations by the judges even though it is not stated in the determination of considerations , also do not merely become pregnant as a marriage dispensation granted. There are several factors of sociological consideration of the judges of the Pontianak Religious Court class 1-A in determining the case of marriage dispensation. Among other things: the circumstances, the closeness between the prospective husband and wife and the agreement or agreement on the rights of a child.

Abstract

This study aims to find out why the people of Dusun Rantau Panjang choose to distribute zakat fitrah to traditional birth attendants and to know about the delivery of zakat fitrah to traditional birth attendants according to Islamic law. This study uses a qualitative method (field research) empirical normative type. Sources of primary data through interviews and secondary data from previous studies. While the data analysis technique consists of data reduction, data presentation and conclusions. Then the validity of the data is checked by doing a member check. The results showed that the distribution of zakat fitrah in Dusun Rantau Panjang was distributed directly and through amil zakat. The distribution of zakat fitrah to traditional birth attendants is still not in accordance with Islamic law because the traditional birth attendant is still considered a capable person. Some people channel their zakat to traditional birth attendants because they do not know their legal status. The distribution of zakat fitrah for dukun beranak is not in accordance with the provisions in the Qur'an at-taubah verse 60. Traditional birth attendants tional midwife can receive zakat fitrah if they fall into one of the eight asnaf categories.

Abstract

Abstrak:Problem mendasar yang menyebabkan terjadinya overcrowded di Lembaga Pemasyarakatan tidak lepas dari paradigma pemidanaan yang masih berorientasi retributive justice. Kebijakan kriminal yang didesain pasca reformasi justru masih terjebak pada paradigma pidana penjara sebagai bentuk paling efektif dan rasional dalam fungsi kontrol sosial. Hal ini dapat dilihat dari masifnya ancaman pidana dalam rentang 1998-2014 sehingga terkesan overkriminalistik. Oleh karena itu, penelitian ini ingin menelaah proyeksi kebijakan kriminal yang dapat menekan laju pertumbuhan overcrowded di Lapas. Selain itu, penelitian ini juga membahas grand design kebijakan kriminal di bawah naungan Kementerian Hukum dan HAM dalam menanggulangi kondisi overcrowded Lembaga Pemasyarakatan. Penelitian ini merupakan penelitian kualitatif dengan pendekatan yuridis normatif. Sifat penelitian adalah deskriptif, analitik dan preskriptif. Sumber data dalam penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Hasil penelitian menunjukkan tren kriminalisasi mengarah pada overkriminalisasi dengan dominasi ancaman pidana penjara. Kebijakan tersebut sangat berperan bagi laju pertumbuhan overcrowded. Proyeksi yang dibangun untuk menanggulanginya adalah konsep individualisasi pidana dalam RKUHP, diversi dan mediasi penal, subsidairitas terbalik pada model pemidanaan yang mengutamakan ultimum remedium, berkembangnya pola pembinaan extramural treatment dan sinkronisasi regulasi terkait. Adapun grand design yang dibangun adalah perlunya segera dilakukan sinkronisasi regulasi terkait tata kelola dan manajemen pegawai, penguatan kelembagaan di bawah kendali Direktorat Jenderal Pemasyarakatan, memperkuat peran penelitian masyarakat dan pola pembinaan ke arah extramural treatment. Abstract:The fundamental problem that causes overcrowding at the correctional institution cannot be separated from the sentencing paradigm which is still retributive justice oriented. The criminal policy designed after the reformation period is still trapped in the paradigm of imprisonment as the most effective and rational form in the function of social control. This matter can be seen from the nature of the imprisonment in the range 1998-2014 so that, it seems overcriminalistic.Threfore, the aim of this research is to review criminal policy projections that can reduce the growth of overcrowding at the correctional institution. This research also discusses the grand design of criminal policy under the authority of the Ministry of Law and Human Rights in tackling overcrowding at the correctional institution. This research is qualitative research with a juridical normative approach. The nature of this research are descriptive, analytic and prescriptive methode. The source of data uses secondary data with the composition of primary legal materials and secondary legal materials. The result of this research show that criminalization trends are overcriminalistic with the dominance of imprisonment. These trends have an impact on the overcrowded growth rate. Projections that built to reduce it are the concept of individualization in criminal punishment, diversion and mediation program, subsidiarity of sentencing model to prioritize ultimum remedium, extramural treatment as the progressive treatment for prisoners and regulatory synchronization on criminal regulations. Grand designs that have been developed are necessary to synchronize regulations related to the correctional administration, institutional management, strengthen institution under the authority of the directorate general of correction, strengthen the role of community research and to develop extramural treatment.

Abstract

One of the tasks of criminal law reform is to consolidate criminal law provisions that are scattered in various laws and regulations. The drafting team has incorporated several special offences into the National Criminal Code as a bridge between the norms, making the National Criminal Code the epicentre. This raises normative questions about the position of special offences, especially corruption offences, when the norms are shifted to general norms in the National Criminal Code, in relation to the systematic enactment of Book I of the National Criminal Code, and whether the changes in the criminal formulation are proportional to the spirit of eradicating corruption. This research will focus on answering the above-mentioned normative concerns. This type of research is a normative research that focuses on the content analysis of legal materials in the form of Book I of the National Criminal Code, articles on corruption in the National Criminal Code and the Corruption Act. The validation process of the analysis results was presented in a forum group discussion with several legal aid organisations and university research institutions. The results of the research show that the intention of the drafting team to include corruption offences is limited to the technical consolidation of corruption offences in the National Criminal Code in the form of bridging articles. In the context of the fight against corruption, there are five crucial reservations, namely the disparity of penalties, the categorisation of fines, the powers of the State Loss Calculation Institution, the stagnation of the regulation of bribery offences and the harmonisation of the United Nations Convention against Corruption.

Abstract

This article aims to discuss several criminal acts in the Indonesian Criminal Code that directly correlate with the right to freedom of expression and opinion. The analysis of these crimes employs the perspective of international human rights norms to assess the extent to which the mission of criminal law reform has been implemented in the reformulation process. This research uses a normative legal approach with statutory and conceptual approaches. The results of this study reveal that several criminal acts raise concerns regarding democratization and decolonization missions. These acts include the crime of attacking the dignity of the President and Vice President, the crime of participating in demonstrations, the crime of defaming the government and public control, the crime of defamation, and the crime of spreading disinformation. Although the crime of blasphemy has undergone significant transformation, it still possesses punitive potential if not restricted to material offenses. Moreover, the criminal act of disinformation requires further harmonization with the ITE Law. The incompatibility with the above missions confirms that some of these offences are disproportionate and potentially threaten freedom of expression and opinion.
