Abstract

The research aims to analyze current presidential and vice presidential election systems, and has not yet been able to establish representative coexists, nor can it identify other models in the presidential election and vice president elections that could produce constitutional representation. This study is a normative-law study with a prescriptive nature. The approach used in the study is the approach to the legislation (conceptual approach), the conceptual approach (approach approach) and the comparative approach (approach), with a study of legal materials through library research). The study suggests that a hybrid election system, combining nominations by political parties and independent candidates, could better reflect the people's will and align with Constitutional principles. Such a system is more consistent with Modern Democracy, potentially leading to leaders with greater accountability and integrity. To address these issues, the author recommends implementing a hybrid system for the election of the President and Vice President to better realize constitutional representation. Additionally, there is a need to reconstruct the nomination process for presidential candidates in Indonesia to ensure a more representative and democratic election process. By adopting these changes, Indonesia can better align its presidential election system with democratic values and constitutional mandates.

Abstract

The purpose of this study is to criticize the authority of the Business Competition Supervisory Commission (KPPU) in overcoming and resolving business competition violations. The authority in question is regulated in Law Number 5 of 1999 concerning the Prohibition of Monopoly Practices and Unfair Business Competition (Business Competition Law) jo. Law Number 11 of 2020 concerning Job Creation. According to the provisions of laws and regulations, KPPU acts as an independent state auxilary organ. At the practical level, KPPU exercises the authority to investigate, prosecute, and decide. Normative legal research is used by researchers to answer related problems through a legal approach and a comparative approach with literature study methods. The results showed that the implementation of KPPU's authority in handling business competition violations can be said to be still not optimal. Researchers suggest that the ideal authority policy in handling business competition violations can refer to several countries that have similar business competition law enforcement agencies by making adjustments to business competition conditions in Indonesia.

Abstract

This study aims to analyze changes in regional government authority in controlling pollution and environmental damage following the enactment of the Job Creation Law and to formulate strategies to strengthen regional roles to maintain effective environmental protection. This research is a normative legal study with a descriptive-analytical nature. The legal materials in this study include secondary and primary legal materials obtained through literature review. The approach used is the legislative approach. The results show that the centralization of licensing through the OSS-RBA and a risk-based approach have reduced regional authority in issuing environmental permits, while regional governments remain burdened with the responsibility for supervision and initial action. This condition creates an imbalance of authority, legal uncertainty and weakens the effectiveness of pollution prevention. This study recommends first, the central government must ensure openness and integration of access to licensing information for regions; second, revise and harmonize implementing regulations governing the division of central and regional authority in the environmental sector; third, strengthen the authority of regional governments for administrative sanctions; and fourth, establish a joint governance model between the central and regional governments based on equal coordination and a clear division of tasks. Fifth, increase the human resource capacity of environmental supervisors in the regions and provide adequate monitoring infrastructure.

Abstract

The issue of climate change necessitates active state participation inmitigating greenhouse gas (GHG) emissions through the adoption ofequitable and sustainable policies. This study seeks to examine thenature of state responsibility in climate change mitigation inIndonesia, with a particular focus on the implementation of CarbonEconomic Value (NEK) as delineated in Presidential Regulation No.98 of 2021. This research constitutes a prescriptive normative legalstudy, employing a legislative approach. The findings indicate thatthe regulatory framework for Carbon Economic Value (NEK)provides a foundational structure for NEK as an environmentaleconomic instrument to facilitate the attainment of NationallyDetermined Contributions (NDCs) through various mechanisms.Nonetheless, this framework exhibits several deficiencies, includingthe legal status of carbon units, the mechanism for stateaccountability, and inadequate protection for indigenous peoplesand local communities. Consequently, the researchers advocate forthe government to fortify the legal foundation of NEC by formulatingmore detailed and integrated technical regulations and, in the longterm, to consider the development of specific legislation on carboneconomic value. These measures are anticipated to enhance theefficacy of NEC, ensure legal certainty, and achieve ecological justicefor both present and future generations.
