Abstract

This study aims to find out whether corruption in the court can be prevented with Information Technology (IT). This research uses a qualitative descriptive approach where the main data source can be processed from relevant and current literature material with the theme of this article as secondary data. Information technology is the most influential factor in changing the world today. The administration of justice is an activity that includes the provision of information, communication, and production of new information. There is no denying that information technology will affect the way justice administration works. Corruption that often occurs in courts (judicial commissions) is in the form of petty corruption, namely administrative or bureaucratic corruption with a power approach, namely the exclusive power of decision makers. The results showed that optimal use of IT can support efforts to eradicate corruption in the court by using E-Court, paperless court, E-Filing, E-Skum, E-Payment, E-Summons applications. These various applications can prevent judicial corruption due to the application of transparency principles, efficiency principles such as cost savings, reduction of illegal levies, ease of information transfer, reduction of case broker practices, reduction of opportunities for corruption due to potential conflicts of interest and face. -face-to-face, reducing gratification and bribery which are the main requirements of smart governance so that efforts to eradicate judicial corruption can be effective.

Abstract

Supreme Court Regulation Number 02 of 2012 concerning Adjustment of the Limits of Light Criminal Acts and the Amount of Fines was created with the intention of facilitating law enforcement, especially judges, to administer justice in the cases they adjudicate. However, in practice, restorative justice with ADR methods has not been optimally applied to light criminal acts. One of the areas with the most disparities is the issue of light criminal acts in the field of the environment. Therefore, this research aims to determine what constitutes light criminal acts in the field of the environment and to understand the legal protection for perpetrators of light criminal acts in the field of the environment. The research method used is a normative juridical method using secondary legal sources. The results of the study indicate the scope of light criminal acts in the field of the environment. Criminal acts regulated in Law Number 32 of 2009 concerning Environmental Protection and Management are specified in Articles 41 to 44 of Law Number 32 of 2009. If there is minor theft for environmental results, the Criminal Code must also be considered as the legal framework specifically regulating theft (lex specialis derogat legi generali). Legal protection for perpetrators of light criminal acts in the field of the environment must align with the goals of criminalization, with sociological, ideological, and juridical-philosophical approaches, based on the fundamental assumption that criminal acts disrupt the balance, harmony, and coherence in community life

Abstract

Abstract

The advancement of blockchain technology has created challenges for traditional regulatory frameworks, regarding consumer protection in crypto asset ecosystems. This paper examines dichotomy between on-chain governance mechanisms embedded within blockchain protocols and off-chain regulatory approaches imposed by state authorities. Through normative legal research and comparative analysis of international regulatory practices, this study identifies critical gaps in Indonesia's current crypto asset regulatory framework. The research reveals that existing regulations, through government’s commodity-based approach, inadequately address the technological governance inherent in blockchain systems like smart contracts, decentralized protocols, and automated consensus mechanisms. The study proposes a hybrid regulatory construction that synchronizes technological governance with traditional state regulation to create comprehensive consumer protection. The findings demonstrate that integrating on-chain compliance mechanisms with off-chain oversight can enhance consumer safety while maintaining innovation momentum. This research contributes to digital law study by providing regulatory models suitable for Indonesia's legal system and broader emerging market contexts.

Abstract

This paper analyzes a legal loophole in Law No. 1 of 2023 concerning the Indonesian Criminal Code (KUHP) related to the exemption from criminal responsibility for persons with mental disabilities (Article 67 juncto Article 64 paragraph (1) letter c, Article 103, Article 38, and Article 39). This loophole has the potential to be misused by sexual offenders, such as sexual predators with paraphilic disorders, to avoid imprisonment and only receive action-based sentencing in the form of rehabilitation or even absolute acquittal. This research uses a normative method with criminological and victimological approaches. The findings indicate that the convergence between the provisions of the 2023 KUHP and the 2025 Draft Criminal Procedure Code (KUHAP), particularly Article 45 concerning the temporary suspension of investigations and diversion mechanisms, has the potential to cause the "attrition" of sexual violence cases before substantive trials. This undermines the deterrent effect, increases the risk of recidivism, and leads to secondary victimization. Therefore, this paper recommends revisions to the 2025 Draft KUHAP, including restrictions on the suspension of investigations and diversion for severe sexual crimes, as well as the establishment of stricter evidentiary standards for proving mental disability
