Abstract

One of the most essential teachings of Islam is deliberation, because with it humans can solve all life's problems in a good and wise manner. Apart from that, in deliberations commendable qualities such as brotherhood, equality, mutual respect, not imposing their own will, understanding and acknowledging other people's views will be born even though there are differences (agree on differences). Deliberation is a negotiating activity by exchanging opinions from various parties regarding an issue to then be considered and decided and taken for the best for the common good. The term deliberation has become a public discourse among Muslim intellectuals in recent centuries, especially in the 21st century. This is due to the influence if not said to be cultural infiltration and western political theory on the Islamic world, especially in the discourse of democracy. At the time of the Prophet led the state of Medina and made deliberation one of the principles of statehood. This paper attempts to elaborate on the principle of deliberation contained in the Qur'an. Abstract

Perceraian adalah perbuatan yang mesti dijauhkan pada ikatan pernikahan, tapi bila terjadi masalah yang sudah berkepanjangan dan tidak bisa lagi disatukan kembali, jika dibiarkan akan mengakibatkan kemudaran bagi kedua belah pihak dan itu merupakan penyelsaian terakhir dari sengaketa keluarga dengan mengajukan permohona ke Pengadilan Agama. aktikel ini mengkaji Putusan Pengadilan Agman Kota Sungai Penuh Nomor 90/Pdt.G/2023/PA.Spn. tentang cerai talak, dengan menganalisis putusan pengadilan tersebut, melalui studi kepustakaan dengan pendekatan hukum normatif. Berdasarkan ketentuan Pasal 19 huruf f Peraturan Pemerintah Nomor 9 Tahun 1975 dan Pasal 116 huruf f Kompilasi Hukum Islam, yaitu adanya pertengkaran terus-menerus, tidak ada lagi harapan untuk bersatu lagi serta mereka telah berpisah tempat tinggal dalam waktu yang lama. Hakim mengabulkan permohonan cerai pemohon. Keputusan hakim telah selaras dengan hukum Islam karena perkawinan dimaksudkan untuk mewujudkan keluarga yang sakinah, mawaddah, dan rahmah. Bila sudah tidak ada keharmonisan dalam rumah tangga perceraian adalah hal yang dibolehkan.

Abstract

Salah satu perkembangan ilmu tafsir yang dinamis terjadi pada kajian para tokoh tafsir periode pertengahan dan macam-macam coraknya. Mufasir dengan latar belakang keilmuannya memberikan warna dalam perkembangan tafsir. Hadirnya membawa pembaharuan beriringan dengan perkembangan pemikiran manusia dan berbagai tantangan zaman dengan berbagai silang pendapatnya. Tulisan ini bertujuan menelaah perkembangan corak tafsir pada periode pertengahan. Penulis menggunakan metode kualitatif jenis kajian pustaka, dengan analisis deskriptif disertai ulumul Qur’an. Para mufasir periode pertengahan banyak menerbitkan berbagai macam kitab tafsir, ini menunjukan sebuah kemajuan dan bekembangnya aset ilmu tafsir dikalangan ulama periode pertengahan. Pada periode pertengahan ini (The Golden Age) para mufassir dengan karyanya melahirkan corak yang begitu komprehensif dan menjawab tantangan zaman serta menjadikan kajian tafsir lebih sistematis dinamis namun tetap mengacu kepada al-Qur’an dan sunnah. Ciri khusus dari suatu penafsiran merupakan kecenderungan seorang mufasir dalam menjelaskan isi kandungan dalam Al-Qur’an, para mufasir pada periode pertengahan ini dengan latar belakangnya menghadirkan berbagai bentuk corak penafsiran. Adapun yang menajdi karakteristik dalam penafsiran corak periode pertengahan yaitu pemaksaan gagasan pribadi kepada Al-Qur’an, bersifat Ideologis, bersifat repetitif, bersifat parsial, dan terpisahnya dengan hadits. Peneliti berharap pembaca mendapat manfaat dari penelitian ini. Demikian pula dikemudian hari, akan hadir penelitian-penelitian berikutnya yang dapat memperbaiki serta menyempurnakan apabila terdapat kekeliruan serta kekurangan di dalam penelitian ini.

Abstract

Umar Ibn al-Khattab (584-644 M) was the second caliph in Islamic history after replacing the caliph Abu Bakr al-Siddiq. He was one of the companions of the Prophet SAW who had strong morals, was energetic, fair, and wise, had a firm and complex character, and had managerial and administrative abilities. Umar as caliph, only ruled for more than ten years, but in that short period, there were many successes and advancements experienced by Islamic society, especially in the economic field. So it is prevalent in the history of the Islamic world that the reign of Umar was a golden age in Islamic history. The success of Umar's leadership, especially in reforming and developing the community's economic system and prospering their lives, is due to scientific abilities, ijtihad, and a well-established managerial system in regulating the country's foreign exchange. Utilization and proper distribution, as well as rigorous and disciplined supervision. This can be understood from the various economic law policies carried out when applying the principles of production, consumption, and distribution based on fairness in law enforcement and fair distribution. Abstrak Umar Ibn al-Khattab (584-644 M) sebagai khalifah kedua dalam sejarah Islam setelah menggantikan khalifah Abu Bakar al-Shiddiq. Ia adalah salah seorang sahabat Nabi saw yang memiliki moral kuat, energik, adil dan bijaksana, memiliki karakter yang tegas dan keras, serta kemampuan manajerial dan administratif. Umar sebagai khalifah, hanya memerintah selama 10 tahun lebih, akan tetapi dalam periode yang singkat banyak keberhasilan dan kemajuan yang di alami masyarakat Islam, terutama di bidang ekonomi. Sehingga sangat populer dalam sejarah dunia Islam bahwa masa pemerintahan Umar merupakan abad keemasan dalam sejarah Islam. Keberhasilan kepemimpinan Umar khususnya dalam mereformasi dan mengembangkan sistem perekonomian masyarakat sekaligus mensejahterakan kehidupan mereka, karena berkat kemampuan keilmuan, ijtihadi dan sistem manajerial yang mapan dalam mengatur devisa Negara. Pemanfaatan dan pendistribusian yang tepat serta pengawasannya yang sangat ketat dan disiplin. Hal tersebut, dapat dipahami dari berbagai kebijakan hukum ekonomi yang dilakukan ketika menerapkan prinsip-prinsip produksi, konsumsi dan distribusi, dengan dasar adil dalam penegakan hukum, dan adil dalam pendistribusian.

Abstract

Islamic education is a form of manifestation of the ideals of Muslims to preserve Islamic values for the next generation, so that the cultural-religious values aspired to can function and develop in society, so that Islamic educators try to form Muslim personalities that are in accordance with Islamic education goals. Islamic education is also based on the highest goal, which is to want students to be a blessing to all creatures. With this grace, it is expected to be able to spread the values of compassion by always advising one another on truth and patience. This research method uses library research and is descriptive, analytic and comparative. Source of data used in this research comes from primary and secondary data. Islamic education as in general education, trying to shape the human person must go through a long process, with results that cannot be known immediately. Many Islamic education experts provide an understanding of the purpose of education. There are those who formulate that the goal is something that is expected to be achieved after a business or activity is completed. While others say that the goal may point to futurity that is located at a certain distance that cannot be achieved except by trying to go through a certain process.

Abstract

Tasamuh is an attitude of respect for others to exercise their rights. We must not look down on ethnicity, religion, or other regional cultures, let alone contempt, hate, or antagonize them. Besides that, the meaning of tasamuh can also be interpreted as being patient in facing other people's beliefs, their opinions and their deeds even though they are contrary to beliefs and vanity in their eyes, and may not attack and criticize with reproaches that make that person sick and tormented by his feelings. Religious tolerance must be understood as a form of our acknowledgment of the existence of religions other than our own with all forms of systems and procedures for worship and giving freedom to carry out their respective religious beliefs. This research method is library research and is descriptive, analytic and comparative. Source of data used in this research comes from primary and secondary data. In collecting data using library books, journals, magazines, articles, interviews and documentation methods. The concept of tasamuh in the perspective of the Koran may not look down on ethnicity, religion, or other regional cultures, let alone contempt, hate, or be hostile towards them. In addition, the meaning of tasamuh can also be interpreted as being patient in facing other people's beliefs, their opinions and their deeds even though they are contrary to their beliefs and vanity in their eyes, and may not attack and criticize with reproaches that make the person sick and torment his feelings.

Abstract

Abstract  : The first time the law was born together with the existence of humans themselves, where there are humans, there is a law that binds them and also has its own relationship with the law that is currently in effect and also the law that was in force before. Human life is no exception, which has experienced many legal events that are not the same as the others, where the legal events that occur are passed by humans, including birth, death and also other legal events that have been passed by humans themselves, one of which is is a very sacred marriage done. So that marriage law is a law that always applies and must be owned by all Indonesian people. Life in the household or the pursuit of life in marriage is a hope and also a reasonable and healthy intention for all young people when they grow up. In this case there is a bright hope and an encouragement that gets stronger when they are physically and spiritually healthy where they already have things that are able to support their lives in the future and have built a household that they hope for, including having a stable job, having a potential partner they love and so on.Keywords: marriage, law, essence. Abstrak: Pertama kali hukum lahir bersamaan dengan adanya manusia itu sendiri, dimana adanya manusia maka disitu terdapat sebuah hukum yang mengikatnya dan juaga memiliki keterkaitan sendiridengan hukum yang berlaku saat ini dan juga hukum yang berlaku sebelumnya. Tak terkecuali kehidupan manusia yang telah banyak mengalami kejadian hukum yang terbilang tidak sama dengan lainnya, dimana adanya kejadian hukum yang terjadi tersebut dilewati oleh manusia diantaranya ialah kelahiran, kematian dan juga kejadian-kejadian hukum lainnya yang telah banyak dilalui oleh manusia itu sendiri, salah satunya ialah pernikahan yang sangat sacral dilakukan. Maka dengan begitu hukum perkawinan merupakan sebuah hukum yang senantiasa berlaku dan pasti dimiliki oleh seluruh masyarakat Indonesia. Kehidupan dalam rumah tangga atau sebuah pengejaran kehidupan dalam pernikahan ialah adanya sebuah harapan dan juga niat yang wajar serta sehat bagi seluruh kalangan muda saat dirinya bertumbuh dewasa. Dalam hal ini adanya harapan yang cerah dan sebuah dorongan yang kian kuat saat mereka sehat secara fisik maupun rohani dimana sudah memiliki hal yang mampu mendukung kehidupan mereka kelak sudah membangun sebuah rumah tangga yang mereka harapkan, diantaranya mempunyai pekerjaan yang stabil, mempunyai calon pasangan yang mereka cintai dan sebagainya.Kata kunci:  perkawinan, hukum, hakikat.

Abstract

Marriage of pregnant women out of wedlock is no longer a new thing among the people, even though Islam clearly forbids committing adultery and its causes. So that Islam encourages people to get married rather than commit adultery, because adultery is one of the factors that can destroy life. This study uses the method of library research (library research) with data collection techniques through a review of books and literature. This research uses content analysis research, which is research that relies on data and also a number of texts (such as the Al-Qur'an, Hadith, and the Thoughts of Ulama) to be processed and compiled into research material. Research Results: First, the marriage of a pregnant woman out of wedlock with a man who does not impregnate the perspective of Islamic law, according to Imam Abu Hanifah, it is permissible to marry her on the grounds that she should not have intercourse first and that sperm from adultery is not valued in the sense that her offspring is only assigned to her mother and not to his father. Imam Abu Yusuf and Zufar are not allowed to marry her because it is based on the prohibition of having sex with a pregnant woman. Second, the marriage of a pregnant woman out of wedlock with a man who is not impregnating from a gender equality perspective, a pregnant out of wedlock woman also has the right to choose her future life partner regardless of who she is pregnant with, and also has the right to refuse the man who made her pregnant. on the grounds that the man is not right to be her husband. Third, the status of children from marriages of pregnant women out of wedlock with men who are not pregnant, is only assigned to their mothers, so men who marry their mothers are obliged to declare an oath of li'an linafyil. the man does not have the right of relationship to the child.

Abstract

In Indonesia itself there is legal pluralism in the inheritance law section. Among them there is inheritance law based on Islamic inheritance law, inheritance law based on civil inheritance law. Grant or will is one way or effort in terms of transfer of property according to Islamic Law. A grant is a gift of property that occurs during the grantor's lifetime, while a will is a gift of property that occurs after the testator's death. Both of these instruments are encouraged in Islam, where if they are done correctly and in accordance with the requirements of the conditions then it can avoid disputes and struggles over property. The writing of this journal is carried out using normative juridical and empirical juridical methods where normative juridical is carried out by basing on applicable laws and regulations while empirical juridical is based on the implementation of laws and regulations that apply to society. The results of this study state that the relationship between grants and inheritance according to the Compilation of Islamic Law and the Civil Code is due to the transformation of Customary Law into Islamic Law (Article 211) of the Compilation of Islamic Law. A grant from a parent to his child can count as an inheritance. In the Civil Code, the relationship between grant and inheritance has existed since the creation of the Civil Code and the Compilation of Islamic Law itself. This is in the interest of all Indonesians
