Abstract

Penelitian ini menggali pertimbangan etika notaris dalam membatasi jumlah pembuatan akta per hari dari perspektif falsafah Pancasila. Penelitian ini bertujuan untuk memahami dimensi etika dan dilema yang dihadapi notaris dalam mengelola beban kerja harian dan menjunjung tinggi prinsip-prinsip Pancasila dalam praktik profesional mereka. Penelitian ini menggunakan pendekatan penelitian kualitatif, dengan menerapkan wawancara mendalam dan analisis konten terhadap peraturan notaris yang relevan dan kode etik yang berlaku. Hasil penelitian mengungkapkan bahwa notaris menghadapi berbagai tantangan etika dalam mengelola beban kerja mereka, termasuk memastikan akurasi, ketelitian, dan kewaspadaan dalam penyusunan akta sambil tetap mengikuti prinsip etika. Penelitian ini menekankan pentingnya mencapai keseimbangan antara efisiensi dan praktik etika dalam pekerjaan notaris, yang menjadi krusial untuk menjaga kepercayaan publik dan menjunjung tinggi integritas profesi notaris. Penelitian ini menyimpulkan dengan rekomendasi untuk meningkatkan etika notaris melalui pengembangan profesional dan kesadaran terhadap prinsip etika Pancasila dalam praktik notaris.

Abstract

The COVID-19 pandemic has had a significant impact on business activities related to logistics access, which had stalled, resulting in potential non-fulfillment of obligations in business contracts. In the franchise business, there are many unilateral agreements that must be obeyed by business partners. Most of the people agree to the agreement that has been made unilaterally by the franchisor or franchisor. This research method uses a normative juridical approach, carried out with analytical descriptive analysis of juridical studies on authentic deeds, notarial cooperation agreements, franchise businesses and overmacht (Article 1245 of the Civil Code). The technique of collecting legal materials is done by studying literature, browsing internet materials in the form of articles and scientific journals. The urgency of the notary cooperation agreement deed in the franchise business is the legal basis to protect the rights and obligations of the parties. Article 1245 of the Civil Code provides legal protection for parties involved in the deed of agreement. An authentic deed becomes a technical step related to legal remedies that are carried out in the event of a compelling situation experienced by one of the parties in a franchise business agreement. Abstract

Tujuan penelitian ini menjelaskan konsep notaris mayantara dalam menghadapi tantangan persaingan global. Metode penelitian ini hukum normatif atau penelitian hukum doktrinal dengan pendekatan hukum klinis. Berdasarkan hasil penelitian dapat dijelaskan bahwa selain merujuk pada UUJN-P ditegaskan kewenangan notaris juga berdasarkan undang-undang lainnya. Kewenangan lain yang diatur dalam peraturan perundang-undangan, antara lain kewenangan mensertifikasi transaksi yang dilakukan secara elektronik, membuat akta ikrar wakaf, dan hipotek pesawat terbang. Pengaturan notaris Indonesia berdasarkan UUJN/UUJN-P dan peraturan perundang-undangan lainnya mengatur bahwa penghadap dalam arti fisik kertas (secara fisik tanpa media apapun ada dihadapan notaris). Dengan demikian, dokumen yang diperlukan masih harus diperlihatkan fisiknya. Kesimpulan penelitian ini bahwa konsep notaris mayantara menghendaki notaris dalam menjalankan tugas atau kewenangannya berbasis teknologi informasi khususnya dalam pembuatan akta. Dalam konsep ini, bahwa menghadap secara fisik atau langsung berhadapan tidak diperlukan. Tetapi, bisa menggunakan media pandang dengar, tanpa batas kota/provinsi bahkan tanpa batas wilayah negara (borderless). Dengan konsep ini, tidak perlu menghadap langsung dengan cara datang ke kantor notaris. Dalam pengembangan lebih lanjut, identitas diri penghadap tidak perlu diperlihatkan secara fisik, demikian pula dokumen yang diperlukan cukup dengan cara mengunduhnya. Dalam konsep ini, bukan hanya tanda tangan yang harus dilakukan secara elektronik, tapi juga dokumen dalam membuat akta.

Abstract

A brand is a sign that can be displayed graphically in the form of an image, logo, name, word, letter, number, color arrangement, in 2 (two) dimensions and 3 (three) dimensions, sound, hologram, or a combination of 2 (two) or These elements are used to differentiate goods or services produced by individuals or legal entities in the field of trade in goods and/services. Notaries play a role in the distribution of inheritance in making deeds of inheritance statements and certificates of inheritance rights as supporting documents in the transfer of rights to registered trademarks based on inheritance, the registration of which must be through an application to the Minister.

Abstract

The lease purchase agreement is a new type of agreement that arises in the community. As with the new type of agreement, leasing in Indonesia has not been regulated in the several definitions put forward by the legal experts above and also in the decree of the Minister of Trade and Cooperatives, there is no uniformity. However, if you pay attention, it can be concluded that the lease-purchase agreement is more likely to lead or lead to the form of a sale-purchase agreement, rather than a lease. Because in the lease purchase agreement, the transfer of property rights is the main point. So the purpose of leasing is to sell goods, not to rent or become tenants of goods. In the event that the tenant defaults in the lease purchase agreement, the tenant is fully responsible for the risk. This is in accordance with the contents of the lease-purchase agreement that has been agreed between the two parties. For the problem of resolving disputes in the motor vehicle rental agreement in practice, it can be reached in two ways, namely through deliberation and consensus and through a lawsuit in court. Court is the last resort taken by the dealer, if the tenant really does not want to be responsible for all his mistakes, namely with the intention of transferring the motor vehicle which is the object of the lease purchase agreement.

Abstract

Requests for Land Release by private parties often lead to disputes. This is a derivative of the difference in legal force of the proof of the Deed of Release of Land Rights made by the Head of the Land Office and the Statement of Release of Land Rights made by the Head of the Land Office. This study aims to obtain empirical knowledge about the comparison between notarial deeds and Certificate of Release of Land Rights by the Head of the Land Office in the process of releasing land rights for private interests. This article is classified as literature research with a qualitative approach. The method used is an empirical juridical study. The results of the study explained that in the process of proving the release of land rights for personal interests, a notarial deed was used which was an Authentic Deed and a statement made before the Head of the Land Office.

Pandemi Covid-19 melumpuhkan semua aktivitas masyarakat dan memaksa semua aktivitas dilakukan dari jarak jauh atau online. Notaris atau PPAT sebagai pejabat publik sebagaimana diamanatkan oleh Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris diberikan kewenangan untuk membuat Akta Otentik dan menjalankan tugasnya sehari-hari. Berdasarkan penelitian tersebut, Pemerintah perlu menetapkan aturan yang secara tegas mengatur pelaksanaan dan penerapan konsep Cyber Notary oleh Notaris dan mengatur keabsahan Akta Otentik yang dibuat oleh Notaris dengan menerapkan konsep Cyber Notary.The Covid-19 pandemic has paralyzed all community activities and forced all activities to be carried out remotely or online. Notaries/PPATs as public officials as mandated by Law Numberi30 of 2004 concerning the Position of Notaries are given the authority to make authentic deeds. and carry out their daily duties. Based on this research, the Government needs to establish rules that explicitly regulate the mplementation and application of the Cyber Notary concept by a Notary and regulate the validity of aniauthenticideedimadeibyiaiNotary by applying the Cyber Notary concept.

Abstract

Tujuan dari penelitian ini yaitu 1). Untuk menganalisis bentuk pelanggaran yang dilakukan Notaris dalam menjalankan jabatannya?, 2) untuk mengidentifikasi upaya MPDN dalam mencegah terjadinya pelanggaran yang dilakukan oleh Notaris? dan 3). Untuk mengidentifikasi sanksi yang diberikan oleh MPDN terhadap Notaris yang melakukan pelanggaran jabatannya?. Metodologi yang digunakan yuridis normatif, dengan pendekatan perudang-undangan dan konseptual. Hasil pembahasan: Notaris yang melanggar, dapat dikenakan sanksi karena merugikan para pihak serta notaris. Sangat dimungkinkan seorang Notaris melakukan pelanggaran tugas jabatannya. Bentuk-bentuk pelanggaran hukum yang dilakukan Notaris di Banten: (1) tidak membacakan akta, (2) pihak tidak tanda tangan di hadapan Notaris, (3) tidak berada di wilayah kerja yang ditentukan, (4) membuka kantor lebih dari satu, (5) plang nama Notaris terpampang tetapi tidak ada kegiatan, (6) tidak melapor apabila pindah alamat kantor, (7) membuat salinan akta tidak sesuai dengan minuta. Pencegahan dalam rangka penegakan hukum: (1) meningkatkan pembinaan (2) melakukan koordinasi dan kerjasama, (3) pengawasan yang kontinu. The objectives of this study are 1). To analyze the forms of violations committed by Notaries in carrying out their positions, 2) to identify MPDN's efforts in preventing violations committed by Notaries, and 3). To identify sanctions given by MPDN to Notaries who commit violations of their positions. The methodology used is normative juridical, with a legislative and conceptual approach. Result of discussion: Notaries who violate, can be subject to sanctions because it is detrimental to the parties and notaries. It is very possible for a Notary to violate the duties of his office. Forms of legal violations committed by Notaries in Banten: (1) not reading the deed, (2) the party does not sign before the Notary, (3) not being in the specified working area, (4) opening more than one office, (5) the Notary's name sign is displayed but there is no activity, (6) not reporting when moving the office address, (7) making copies of the deed not in accordance with the minutes. Prevention in the context of law enforcement: (1) improve guidance (2) coordinate and cooperate, (3) continuous supervision.

Abstract

The development of the current digital era has brought many changes, not only in the world of education and government, but in the role of Notaries as well. As a result of this change, notaries have new responsibilities in safeguarding the personal data of parties to notarial agreements. The research method used is normative research, where the author conducted a review of positive law in Indonesia, especially the regulations of Law Number 27 of 2022 concerning Personal Data Protection. Research findings indicate that Notaries act as guarantors of clients' trust and confidentiality with respect to personal information and bear responsibility for the safe and lawful handling of such information. Notaries are generally known as data controllers who have the obligation to maintain the confidentiality of personal information under their supervision. Notaries are obliged to provide warnings to the public and related agencies if there is a violation of the protection of personal identity information (PII) in their jurisdiction.

Abstract

Legal disputes over land rights have become a fundamental and complex problem in the history of the development of agrarian law in force in Indonesia. The inequality that occurs in the pattern of distribution of control, ownership, use and utilization of land, which is also exacerbated by the condition of many land being abandoned by land rights holders, either due to intentional or unintentional factors, has triggered widespread cases of land disputes that have occurred until At the moment. The government itself has attempted to create policies and related regulations, in order to find solutions in resolving cases of ownership disputes over abandoned land. This includes Government Regulation Number 20 of 2021, concerning controlling abandoned areas and land. In this research the author raises two issues, namely, what is the urgency of eliminating ownership rights to abandoned land based on Government Regulation Number 20 of 2021, and what legal remedies can be taken by land rights owners and/third parties who suffer losses due to their abolition rights to abandoned land based on Government Regulation Number 20 of 2021. This research is a form of normative legal analysis (normative legal research), using a statutory approach and a conceptual approach. This research also has important implications in the context of land law, especially in terms of protecting the rights of land owners and encouraging the use of productive land uses. It is hoped that the results will serve as a guide for land ownership rights holders, the government and legal practitioners to better understand the relevant regulations and the impact of loss of ownership rights to land due to abandonment in accordance with the provisions contained in Government Regulation Number 20 of 2021.
