Abstract

This research discusses the existence of indigenous peoples of the Amungme tribe and Kamoro tribe in the application of Law No. 4 of 2009 concerning Mineral and Coal Mining ( Minerba Law), renegotiation of contracts of work of PT. Freeport Indonesia is in connection with the Divestment of Shares , the legal position and involvement of the indigenous peoples of the Amungme and Kamoro Tribes and the economic rights of indigenous peoples affected by pt. Freepoint Indonesia. As is known that PT Freeport Indonesia is a mining company company that has a Contract of Work (KK) in the Grasberg and Ertsberg Mountains mining area which began in 1967 and will only end in 2021. Since implementation of the Minerba Law, PT. Freeport is required to dive shares to the Indonesian Government . in the process of divestment of shares , the the government has not been involved indigenous peoples who have customary rights in the mining area so that there are several problems such as conflicts in the mining area caused by the absences of arrangements regarding minerals and coal business in accordance with Pancasila and the 1945 Constitution , because the Minerba Law is only able to reach legal actions after the issuance of the Minerba Law and related matters related to KK that existed before the Minerba Law. in the other hand , the existence of KK PT. Freeport Indonesia is considered incompatible with Pancasila, namely the Fifth Precept " Social justice for All Indonesian People " and Article 33 paragraph (3) of the UUD 1945 Constitution concerning the substance of the earth , water , and natural wealth " controlled by the state " and " used to the greatest extents of people's prosperity "

Abstract

Perjanjian, seperti jual beli, menciptakan hubungan hukum dan konsekuensi yang diinginkan dalam bisnis. Namun, wanprestasi menjadi masalah utama. Penyelesaiannya krusial untuk menjaga kepastian hukum, membutuhkan pemahaman dalam prosesnya, yang dapat memperkuat fondasi hukum dan kepercayaan bagi pertumbuhan ekonomi yang berkelanjutan. Dalam penelitian ini, diputuskan untuk mengadopsi metode pendekatan Yuridis Normatif. Pendekatan ini mengarah pada penelitian yang menelusuri norma-norma hukum yang tercantum dalam peraturan perundang-undangan yang berlaku serta norma-norma yang telah tumbuh dan berkembang dalam masyarakat. Hasil dari penelitian ini Wanprestasi adalah ketidakmampuan atau kelalaian dalam memenuhi kewajiban perjanjian antara kreditur dan debitur, baik disengaja maupun tidak. Pasal 1243 KUH Perdata mengatur tentang penggantian biaya, kerugian, dan bunga akibat ketidakpenuhian perikatan, menekankan pentingnya mematuhi komitmen yang disepakati. Dalam konteks yang lebih luas, wanprestasi dapat berupa tidak memenuhi, melaksanakan secara tidak sempurna, atau terlambat dalam memenuhi prestasi, dipengaruhi oleh faktor internal dan eksternal. Dampak hukumnya dalam perjanjian jual beli signifikan, memicu penyelesaian sengketa melalui litigasi yang meski menghasilkan keputusan yang mengikat, juga dapat panjang, mahal, dan berisiko publisitas negatif, mendorong pencarian alternatif penyelesaian yang lebih efisien.

Abstract

One of the legal acts in the agreement is leasing, which is regulated in Articles 1548 to 1600 of the Civil Code. In Article 1548 of the Civil Code, leasing is defined as an agreement, by which one party binds himself to give the enjoyment of an item to the other party during a certain time, with the payment of a price agreed by the latter party. People can lease various types of goods, both fixed and movable. Sometimes a lease agreement often raises various legal issues, such as default or breach of promise or unlawful acts. Unlawful acts in a lease agreement can be interpreted as a negligent act or any act that violates agreed rights and/or obligations and is contrary to applicable laws and regulations, causing material or immaterial losses to others. This research is intended to analyze the legal consequences arising from unlawful acts committed by the renting party through Supreme Court Decision Number 2925 K/Pdt/2019. By using a normative juridical approach, the results of this study show that the actions of the subletting party can be categorized as unlawful acts because it terminates the lease agreement unilaterally, while there is still a validity period of the lease to which the tenant is entitled. This caused the tenant to be materially and materially disadvantaged, so they sued until the cassation level.

Abstract

The practice of child adoption has existed since ancient times. In the past, particularly among couples who had not been blessed with offspring by God, it was common to adopt a child who was still a relative, albeit a distant one. Consequently, child adoption in those times was not based on legal regulations, as the adopted child remained within the family. Therefore, the legality of adoption was not a significant concern in the past. The issues addressed in this paper include the factors and evidence considered by judges in granting adoption petitions and the regulations regarding child adoption under positive law in Indonesia. The research method employed is normative juridical, which involves legal research conducted through the examination of library materials, also known as library research. The findings reveal that the panel of judges considers several points of law, primarily the judges' conviction to grant the petitioners' request based on various pieces of evidence presented during the trial, including testimonies from the biological parents of Child X and witnesses from the relatives of Petitioner I and Petitioner II. The implementation of child adoption in Indonesia is based on the Child Protection Law and Government Regulation No. 54 of 2007 on Child Adoption, which stipulate that the adoption process involves several requirements and is carried out to meet the needs and best interests of the child.

Abstract

The pre-project selling system implemented by housing developers often results in consumer losses. When consumers suffer losses, they have the right to claim compensation from the respective developers. These compensation claims are governed by the legal protection framework outlined in the Consumer Protection Act and the Civil Code. This research aims to identify the legal consequences arising from the pre-project selling system conducted by housing developers and to evaluate the legal protection available to consumers in this context. The type of research used is normative research, which is based on the study of theories and applicable legal rules. This normative research also serves to provide legal arguments in situations of voids, ambiguities, and conflicts of norms. Thus, this research is considered very important as policy input to provide justice for the community.

Abstract

In unwritten agreements between customers and savings and loan cooperatives, defaults by customers can have significant legal consequences for both parties. Default occurs when customers do not fulfill their obligations in accordance with the agreed agreement, such as not paying installments on time. The legal consequences of this default may vary depending on the provisions contained in the agreement and the applicable law. The research method used is normative law. The results showed that for customers, the legal consequences of default can be in the form of fines or surcharges, cancellation of the agreement, or even lawsuits. Meanwhile, for savings and loan cooperatives, the legal consequences can include financial losses due to not receiving payments on time and a tainted reputation in the industry. The importance of clarity and certainty in agreements is an important emphasis in this context, so that the rights and obligations of both parties can be clearly understood. In addition, compliance with applicable laws and regulations is also a key factor in responding to defaults, so that both parties can maintain balance and fairness in their contractual relationship.

Abstract

This research aims to carry out collateral auction responsibilities, especially for customers, towards auction officials in the auction of collateral objects with a focus on a legal perspective. The auction execution process often involves complex problems, raising questions regarding the rights of the pawned object and legal protection for both the customer and the auction official. This research will analyse the legal framework that regulates customer rights and also the rights of auction officials regarding auctions of collateral objects without notification. This legal approach will include a review of applicable auction regulations, property rights, and legal protection for customers and auction officials. In addition, this research will evaluate the extent of applicable legal protection.

Abstract

Setiap orang memiliki peluang untuk menjalin hubungan dengan orang berjenis kelamin yang berbeda, yang pada akhirnya dapat mengarah pada pernikahan. Perkawinan harus didasarkan pada peraturan hukum, tetapi seiring waktu, perkawinan antara laki-laki dan perempuan dari agama yang berbeda dapat terjadi. Ini disebut perkawinan beda agama sendiri. Perkawinan ini terdiri dari laki-laki dan perempuan yang ingin membentuk keluarga atau rumah tangga dengan agama yang berbeda. Pasangan yang menikah dengan orang yang berbeda agama seringkali menghadapi tantangan tersendiri. Mereka harus menemukan cara untuk menghormati dan memahami keyakinan masing-masing sambil mematuhi aturan negara. Pernikahan yang berbeda agama juga ada di banyak tempat, baik di kota maupun di pedesaan, karena Pasal 2 ayat (1) dan ayat (2) UU Nomor 1 Tahun 1974 tentang Perkawinan menyatakan bahwa (1) "Perkawinan adalah sah, apabila dilakukan menurut hukum masing-masing agama dan kepercayaannya." (2) Setiap perkawinan dicatat menurut undang-undang yang berlaku, sehingga perkawinan dapat dilaksanakan sesuai dengan agama dan kepercayaan masing-masing. Hakim pengadilan harus membuat keputusan untuk mengesahkan perkawinan beda agama. Surat Edaran (SE) Ketua MA 2/2023 dikeluarkan pada tanggal 17 Juli 2023 untuk membantu hakim memutuskan kasus pencatatan perkawinan antara orang yang berbeda agama. Artinya, SE adalah standar jika pasangan meminta perkawinan beda agama.

Abstract

This research aims to analyse the form of legal protection for parties who own land rights and analyse the legal certainty of land rights certificate holders through a case study of Banjarbaru District Court Decision Number 62/Pdt.G/2022/PN Bjb. This research uses normative juridical research by analysing secondary data in the form of primary, secondary, and tertiary legal materials. The results showed that the court decision provided legal protection for Sudjar Wadi as a party with land rights through recognition of the validity of the land sale and purchase transaction, the right to appear before the Land Deed Official (PPAT), to transfer the name of the land certificate, and to take care of the lost certificate. This decision also emphasises the importance of legal certainty in protecting the rights of land certificate holders by ensuring Sudjar Wadi has legal rights to the disputed land. Law enforcement in this case achieved the goals of legal certainty, social benefit, and justice by determining the defendant to bear the costs of the case, providing incentives for effective law enforcement, and is expected to increase public confidence in judicial institutions and compliance with the rule of law.

Abstract

Mixed marriage is a marriage that occurs between an Indonesian citizen and a foreign citizen. Mixed marriages without a marriage agreement create a mix of assets, the mix of assets in the form of land can have an impact on the assets of each party, as then according to Law number 5 of 1960 concerning Agrarian Regulations that a citizen Foreigners cannot obtain/own land ownership, either through a will or by mixing assets due to marriage. The research method used in this writing is a juridical-normative research method, using a type of literature study with a statutory approach and a case approach. Regarding a mixed marriage that occurs and there is no separation of assets which causes the foreign citizen to indirectly violate the Agrarian Law Article 21 paragraph (3).
