Abstract

Salah Cara memahami hakekat manusia adalah dengan pendekatan yang lebih mengarah kepada teori tentang kebutuhan manusia. Dewasa ini telah banyak penelitian yang dicapai oleh para ahli psikologi dalam usaha untuk menyusun teori kebutuhan manusia. Dalam Islam Allah telah mengatur dan menjadikan al-Qur’an sebagai pedoman hidup manusia termasuk hal-hal yang berkaitan dengan kebutuhan manusia. Penelitian ini merupakan penelitian kualitatif dengan analisis deskriptif dan konten analisis, yaitu mengkomparasikan konsep maqashid syariah dan The Hirarchy Of Human Needs Abraham Maslow serta mendeskripsikan interpretasi teks yang tepat. Maqshid syariah dan The Hirarchy of Human Needs merupakan tingkat kebutuhan manusia dari dua perspektif kebutuhan manusia yang berbeda. Hasil penelitian menyimpulkan bahwa maqashid syariah dirumuskan dengan pertimbangan utama sesuai dengan tujuan Allah dalam menurunkan syari’at terhadap manusia agar mereka berperilaku sesuai dengan norma yang diturunkan-Nya dan untuk memelihara kemaslahatan manusia di dunia dan akhirat. Sedangkan The Hirarchy of Human Needs dalam merumuskannya, Maslow dipengaruhi oleh filsafat humanisme yang terlepas dari bingkai agama (sekuler). Hirarki kebutuhan Maslow tidak memasukkan The spiritual needs atau motif beragama (kebutuhan terhadap agama) ke dalam teori hirarki kebutuhan manusia.

Abstract

This study analyzes the application of maqāshid sharī’a (objectives of shari'a) regarding substitute heirs as outlined in article 185 paragraphs 1 and 2 of the Compilation of Islamic Laws the research aims to find out the philosophical basis of maqāshid sharī’a regarding the importance of giving inheritance to substitute heirs. This research is a normative legal research that uses a philosophical approach. Data were collected using literature techniques, then analyzed descriptively qualitatively through maqāshid sharī’a theories. This study shows that the determination of inheritance for substitute heirs in Article 185 is important to realize because it contains many maslahah (benefits) both sociologically and psychologically. The philosophical foundation of maqāshid sharī’a in inheritance for substitute heirs is not only limited to protecting assets (hifzd al-māl) but also to improving their quality of life (tanmiyah al-nasl wa al-māl). Substitute heirs are not enough just to be given assets, they also need care and affection from their extended family. Viewed from the maslahah position, giving inheritance to substitute heirs to improve their quality of life is included as maslahah dharūriyah (urgent needs).

Abstract

Way to understand human nature is to approach that is more directed to the theory of human needs. Today there has been a lot of research accomplished by psychologists in an effort to compile a theory of human needs. In Islam, Allah has regulated and made the Qur'an a guideline for human life, including matters relating to human needs. This research is a qualitative research with descriptive analysis and content analysis, which compares the concept of maqashid syariah and Abraham Maslow's The Hierarchy Of Human Needs and describes the proper interpretation of the text. Maqshid sharia and The Hierarchy of Human Needs are levels of human needs from two different perspectives of human needs. The results of the study concluded that maqashid sharia was formulated with the main considerations in accordance with God's purpose in passing down syari'at to humans so that they behave in accordance with the norms that He sent down and to maintain the benefit of humans in this world and the hereafter. Whereas in formulating The Hierarchy of Human Needs, Maslow was influenced by the philosophy of humanism which was detached from religious (secular) frames. Maslow's hierarchy of needs did not include The spiritual needs or religious motives (the need for religion) into the theory of the hierarchy of human needs.

Abstract

Riba transactions in any form have been expressly, clearly and qat'i prohibited in the Qur'an and the hadith of the Prophet. At the time when it was forbidden, usury was ingrained and rooted in the ignorant society which was a means of extorting the rich against the poor. This research is a library research or library research that is looking for data related to research in the form of books, journals and documents with qualitative research that aims to analyze hadiths related to the ribawi profession. This research is a library research or library research. This research is a qualitative research with descriptive analysis and content analysis. The results of this study indicate that the Prophet has condemned usury eaters (creditors), usury givers (debtors), registrars (administrative officers) and witnesses (notaries) related to the opinion of scholars about the prohibition of usury. To curse in this context is to be kept away from Allah's mercy, namely the loss of the blessings of wealth obtained through usury transactions, blessings not in quantity, but in the quality of assets obtained. If it is correlated with working in a conventional bank, then the law is haram based on this argument, except in special conditions and missions to change the world of conventional banking into Islamic banking. Transaksi riba dalam bentuk apapun telah dilarang secara tegas, jelas dan qat’i dalam al-Qur’an dan hadis nabi. Pada saat diharamkan, riba telah berurat dan berakar pada masyarakat jahiliah yang merupakan sarana pemerasan orang kaya terhadap orang miskin. penelitian ini merupakan penelitian kepustakaan atau library research yaitu mencari data-data yang berkaitan dengan penelitian berupa buku-buku, jurnal-jurnal dan dokumen-dokumen dengan kualitatif yaitu penelitian yang bertujuan untuk menganalisis hadis-hadis yang berkaitan dengan profesi ribawi. Penelitian ini merupakan penelitian kepustakaan atau library research Penelitian ini merupakan penelitian kualitatif dengan analisis deskriptif dan konten analisis. Hasil Penelitian ini menunjukkan bahwa Nabi telah mengutuk pemakan riba (kreditur), pemberi riba (debitur), pencatat (petugas administrasinya) dan saksi-saksinya (notarisnya) dihubungkan dengan pendapat ulama tentang haramnya riba. Melaknat dalam konteks ini adalah dijauhkan dari rahmat Allah yakni hilangnya keberkahan harta yang diperoleh melaui transaksi riba, keberkahan bukan pada kuantitasnya, melainkan kualitas harta yang didapatkan. Apabila dikorelasikan dengan bekerja di bank kovensional, maka hukumnya adalah haram berdasarkan dalil tersebut, kecuali dalam keadaan dharurah dan misi tertentu untuk mengobah dunia perbankan konvensional menjadi perbankan syariah.

Abstract

This study aims to analyze the contribution of communication and the principles of Islamic law (maqāṣid al-sharī‘ah) in efforts to increase community economic independence, identify factors that influence multisectoral communication in stunting prevention, and explore the relationship between economic independence and stunting prevention. The locus of this research is Mandailing Natal Regency and Padangsidimpuan City, two areas in North Sumatra with high stunting rates. Maqāṣid al-sharī‘ah, which emphasizes the protection of religion, life, mind, descendants, and property, can provide a new approach to reducing stunting through increasing economic independence. A qualitative approach was used in this study, using the Focus Group Discussion (FGD) method to explore the views of the community and stakeholders. Increased economic independence contributes significantly to improving the nutritional status and health of children. Economic independence allows better access to nutritious food and health services, and increases parental knowledge about nutrition. Economic empowerment programs that focus on women can improve their social and economic status, which has a positive impact on childcare. Furthermore, greater economic independence improves families' ability to pay for health services and invest in children's education. The results of the study indicate that the synergy between communication activities and emphasizing the values ​​of Islamic law (maqāṣid al-sharī‘ah) in efforts to increase economic independence can contribute to reducing stunting rates. The application of communication principles and the maqāṣid al-sharī‘ah (Islamic principles) in economic empowerment programs focuses not only on stunting reduction but also on improving overall community welfare. Therefore, this research is expected to provide new insights into the importance of a holistic approach to stunting prevention that involves various sectors and sharia values.

Abstract

Pidoli Dolok Village in Panyabungan Subdistrict, Mandailing Natal, is predominantly an agricultural area where most residents depend on farming as their main source of income. The village benefits from major water sources, including the Aek Pohon River and irrigation from the Batang Gadis River, which support its agricultural activities. Within this context, the practice of mukhabarah—a form of agricultural partnership—has emerged, with a commonly agreed profit-sharing ratio of one-third for the landowner and two-thirds for the cultivator. This study aims to examine the implementation of zakat in such mukhabarah partnerships and to evaluate its conformity with Islamic legal principles. Employing a descriptive qualitative approach, this field research gathers primary data through observations and interviews with farmers, landowners, religious leaders, and other stakeholders, while secondary data are obtained from classical Islamic texts and relevant literature. The findings reveal that while the contractual elements of mukhabarah align with Islamic jurisprudence, the practice of zakat within these agreements does not fully meet the requirements of Islamic law regarding nishab. Therefore, there is a need for increased education and awareness to ensure zakat practices in agricultural partnerships are in accordance with Islamic principles.

Abstract

Gender-based violence in Indonesia is increasingly concerning, despite the existence of numerous laws and regulations aimed at its regulation. This violence significantly impedes development, as its multifaceted impact hinders women's participation, compromises health, and diminishes autonomy across political, economic, social, and cultural spheres. The research addresses several key questions: 1) What is the extent of legal protection against gender-based violence in Indonesia? 2) How is gender-based violence addressed within Islam? 3) How can legal protection against gender-based violence be optimized from an Islamic perspective? The research methodology is qualitative, using a normative approach and drawing from secondary sources like literature accessed through library research. Data analysis is conducted through descriptive analysis techniques. The findings of the research indicate that in Indonesia, legal protection against gender-based violence is addressed through various regulations, and similarly, within Islam, there have been numerous reforms pertaining to gender-based protection found in the Quran and hadith. Strategies like theological education, moral guidance, gender equality promotion, and family development with a gender perspective can enhance legal protection against gender-based violence in line with Islamic principles. Aligned with these findings, the article emphasizes the vital importance of preventive measures to reduce the rise of gender-based violence.

Abstract

Kabupaten Mandailing Natal berdasarkan data di Pengadilan Agama Panyabungan, selama tiga tahun (2020,2021,2022) ada 159 kasus permohonan dispensasi nikah, selain itu karena berbagai hal di masyarakat masih banyak pasangan Suami Istri yang menikah dibawah umur tanpa menempuh administrasi di Kantor Urusan Agama (KUA) atau nikah dibawah tangan. Guna menekan angka perkawinan dibawah umur dikalangan masyarakat, maka dibutuhkan adanya tindakan sosialisasi serta edukasi bagi masyarakat khususnya remaja (Naposo Nauli Bulung), Sosialisasi dan edukasi ini ditekankan pada aspek hukum yaitu perihal legalitas batas minimum usia untuk menikah baik bagi laki-laki maupun perempuan serta resiko ataupun akibat dari praktik perkawinan dibawah umur. sasaran sosialiasi adalah Naposo Nauli Bulung desa Sigalapang Kec. Panyabungan Kab. Mandailing Natal. Berdasarkan hasil pretest dan postest yang dilakukan kepada peserta, terjadi peningkatan pemahaman terkait batas usia minimal untuk melaksanakan perkawinan sebesar 72% (tujuh puluh dua persen). Mandailing Natal Regency based on data from the Panyabungan Religious Court, for three years (2020, 2021, 2022) there were 159 cases of marriage dispensation applications, besides that due to various things in the community there are still many husband and wife couples who marry underage without taking administration at the Office of Religious Affairs (KUA) or underhand marriage. In order to reduce the number of underage marriages among the community, it is necessary to have socialisation and education actions for the community, especially adolescents (Naposo Nauli Bulung), this socialisation and education is emphasised on legal aspects, namely regarding the legality of the minimum age limit for marriage for both men and women and the risks or consequences of underage marriage practices. the target of the socialisation is Naposo Nauli Bulung, Sigalapang village, Panyabungan sub-district, Mandailing Natal district. Based on the results of the pretest and posttest conducted to participants, there was an increase in understanding related to the minimum age limit to carry out marriage by 72%.

Abstract

In principle, public health insurance is one of the tasks of the state. Indonesia as a large country has regulated social security in the form of health prevention for the community, manifested in the form of the JKN (National Health Insurance) program organized by the Social Security Administering Body (BPJS). Indonesia as a country with a majority Muslim population, of course, does not accept the decision of the government regulation immediately, one of which is whether the contract in the BPJS health program is in accordance with Islamic law?, because Muslims cannot be separated from their religious rules which regulate in all aspects, including health insurance. To answer this problem, research was carried out, using data collection techniques in the form of documentation of everything related to the research title. After the data was collected, it was analyzed by qualitative analysis using descriptive analysis method. The results of the study found that the contract used by the BPJS health program is allowed as long as the meaning is understood by each party (no gharar) and the existence of mutual blessing (an taradhin) is the main requirement in every muamalah contract, so that it does not result in consuming other people's property in a false way. or not contrary to sharia provisions.
