Abstract

This study aims to discuss the implementation of the Bali Provincial Regulation which has given birth to various legal provisions regarding the registration of land rights, both for Customary Village and Temple land, both of which are recognized as legal entities. The material is presented using a normative approach to identify legal rules and principles. The legal sources for this study are derived from statutory provisions, including: 1) Law No. 5 of 1960 on the Basic Agrarian Law (UUPA), 2) Government Regulation No. 24 of 1997, 3) Bali Provincial Regulation No. 4 of 2019 on Customary Villages, 4) Ministerial Decree of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 276/KEP-19.2/X/2017 on the Designation of Customary Villages in Bali Province as Legal Subjects for Joint (Communal) Land Ownership, 5) Minister of Home Affairs Decree No. 556/DJA/1986 on Legal Entities Eligible for Land Ownership Rights. The results of the study show that the Traditional Village was officially designated as the subject of customary rights based on the Decree of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 276/KEP-19.2/X/2017 concerning the Determination of Traditional Villages in Bali Province as Subjects of Collective (General) Land Ownership Rights. Procedurally, the initial land ownership certification process for Pura followed the standard land certification procedure. It began with a written application submitted to the Head of the National Land Agency Office of Tabanan Regency, accompanied by the required administrative documents.

Abstract

The paper entitled “The Existence of Bale Kerta Adhyaksa as an Instrument for Resolving General Legal Cases in Bali” was prepared in connection with the enactment of the Draft Regional Regulation of the Province of Bali concerning Bale Kerta Adhyaksa into a Regional Regulation, which will take effect following the implementation of Law Number 1 of 2023 on the Criminal Code on 2 January 2026. This paper examines and discusses two legal issues relevant to the existence of Bale Kerta Adhyaksa, namely: (1) the authority of Bale Kerta Adhyaksa in Bali, and (2) the scope of the substantive provisions of the Regional Regulation on Bale Kerta Adhyaksa in Bali. The writing method is grounded in the doctrine of legislative law, thereby adopting a normative research type which utilizes normative or non-empirical research materials with a statutory approach and a conceptual approach, drawing from both primary and secondary legal materials. The analysis employs the concept of regulatory impact assessment and consistency analysis, applied both at the stage when the regulation was still in draft form and after its stipulation as a Regional Regulation of Bali Province. This analysis is carried out using systematic interpretation through inductive and deductive reasoning, presented in a structured and coherent manner. The authority of Bale Kerta Adhyaksa in Bali is to resolve general legal cases occurring within the jurisdiction of customary villages. Institutionally, it is expected to resolve cases by prioritizing a win–win solution, particularly for minor criminal cases and minor civil cases. Meanwhile, the scope of the substantive content of the Regional Regulation on Bale Kerta Adhyaksa in Bali includes the realization of an effective, efficient, comprehensive, and conclusive system for resolving general legal cases, as well as the reduction of the frequency of minor criminal and civil cases within customary villages areas. The formulation of case resolution is embodied in the form of a “Peace Statement Letter or Deed” and a “Peace Agreement Letter or Deed”, which are recorded in a mutual agreement between the parties, signed by them, and must be carried out in good faith. The decisions are final and binding.

Abstract

Indonesia mempunyai banyak sekali sumber daya berharga di perairan lautnya. Sumber daya tersebut perlu dijaga agar dapat memberikan manfaat bagi masyarakat Indonesia. Indonesia beruntung memiliki begitu banyak sumber daya alam, terutama lautan. Lautan di Indonesia adalah rumah bagi banyak tumbuhan dan hewan yang berbeda. Adapun rumusan masalah yang diangkat yaitu 1) Bagaimana pelaksanaan fungsi pengawasan oleh Balai Taman Nasional Bali Barat dalam hal pencegahan perusakan ekosistem laut di Kawasan Taman Nasional Bali Barat? Dan 2) Bagaimana pemberian sanksi terhadap pelaku perusakan ekosistem laut di Kawasan Taman Nasional Bali Barat? Tipe penelitian yang digunakan adalah tipe penelitian empiris. Hasil dari penelitian menunjukkan untuk melindungi laut dan hewan yang hidup di sana di tempat-tempat seperti Taman Nasional Bali Barat. Mereka memiliki orang-orang yang berpatroli di area tersebut dan melibatkan masyarakat untuk membantu menjaga semuanya tetap aman. Taman Nasional Bali Barat memiliki aturan untuk menghukum orang yang melakukan penangkapan ikan secara ilegal. Mereka dapat disuruh melakukan pelayanan masyarakat, menulis surat permintaan maaf, atau membayar uang untuk mengganti kerugian yang mereka timbulkan.

Abstract

Perjudian dalam game online melibatkan taruhan uang, dan salah satu yang paling populer adalah judi slot. Promosi konten judi online oleh streamer game mobile menjadi masalah serius di era digital. Penelitian ini mengkaji pengaturan hukum terhadap promosi situs judi online oleh streamer game mobile serta sanksi pidana yang diberlakukan. Penelitian ini menggunakan Metode Hukum Normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa promosi situs judi online oleh streamer diatur dalam Pasal 303 dan Pasal 303 bis KUHP. Sanksi pidana diatur dalam Pasal 27 ayat (2) Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik, dengan ancaman penjara hingga 6 tahun atau denda maksimal 1 miliar rupiah. Pemerintah perlu menerapkan regulasi dan penegakan hukum yang tegas terhadap promosi judi online oleh streamer game mobile. Streamer harus memahami jenis konten yang aman dan bermanfaat untuk dipromosikan, dan masyarakat perlu meningkatkan kesadaran tentang bahaya dan dampak negatif dari promosi situs judi online di platform digital.

Abstract

Mengenai pertanggungjawaban korporasi dalam tindak pidana korupsi terkait pengadaan tanah. Korporasi sering terlibat dalam proyek pengadaan tanah yang bernilai besar, dan tidak jarang ditemukan praktik-praktik korupsi yang melibatkan penyalahgunaan wewenang dan penyuapan. Dalam penelitian ini penulis akan membahas bagaimana pengaturan pertanggungjawaban korporasi dalam tindak pidana korupsi dan bagaimana pertanggungjawaban korporasi sebagai subjek tindak pidana korupsi pada kasus pengadaan tanah. Skripsi ini menggunakan tipe penelitian Hukum Normatif serta Ppendekatan Pperundang-Uundangan, konseptual dipergunakan dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa beberapa pengaturan hukum telah mengatur secara jelas tentang pertanggungjawaban korporasi dalam tindak pidana korupsi. Korupsi pengadaan tanah adalah salah satu bentuk korupsi yang merugikan negara dan masyarakat, pencegahan dan pemberantasan korupsi pengadaan tanah sangat penting dilakukan. Kasus ini menggambarkan konflik norma yang kompleks., antara undang-undang satu dengan undang-undang lainnya. Dalam hal ini, korporasi yang melakukan tindak pidana korupsi dapat dituntut pertanggungjawaban dan dapat dijatuhkan pidana, baik terhadap korporasi dan atau pengurusnya.

Abstract

Purpose: This study analyzes the legal regulation of foreign nationals within the Indonesian legal system and the sanctions imposed on them as perpetrators of online lending activities. Research Methodology: This research employs a normative legal approach using statutory, conceptual, and case analyses. Legal materials are examined qualitatively through literature review and deductive reasoning. Results: The findings show that foreign nationals are recognized as legal subjects under the principle of territorial jurisdiction and are subject to Indonesian law when conducting legal acts within its territory. Sanctions for involvement in online lending may include civil liability for breach of contract and unlawful acts under the Civil Code, criminal penalties, and administrative measures such as immigration sanctions. Conclusions: Indonesian positive law provides a sufficient legal framework to impose civil, criminal, and administrative sanctions on foreign nationals engaged in online lending. However, enforcement remains limited by practical constraints. Limitations: This study focuses on existing regulations and court decisions and does not examine international legal cooperation mechanisms in depth. Contributions: This study contributes to the literature by offering an integrated analysis of the legal position of foreign nationals in Indonesia’s online lending regulation.

Abstract

The recurring practice of vigilantism (eigenrichting) in Indonesia reflects a growing tendency to usurp the State's exclusive authority to administer criminal justice, thereby undermining due process of law, the presumption of innocence, and legal certainty. Previous studies have primarily examined vigilantism from criminological, sociological, and human rights perspectives, while limited attention has been given to the absence of a specific criminal law framework recognizing vigilantism as an autonomous criminal offence. This study analyzes Indonesia's existing criminal law policy and formulates a criminal law policy model to strengthen legal certainty. Employing normative legal research, this study uses statutory, conceptual, case, and comparative approaches. The findings reveal that vigilantism is not specifically regulated, resulting in reliance on general criminal provisions that fail to reflect its distinctive legal character. The novelty of this study lies in developing a criminal law policy reformulation that recognizes vigilantism as an autonomous criminal offence through a specific legal definition, constituent elements, criminal liability, and sentencing principles. This study contributes to criminal law theory, provides normative guidance for legislative reform, and offers clearer legal standards for consistent law enforcement

Abstract

The increasing use of social media has facilitated online gambling promotion by influencers, creating significant challenges for criminal law enforcement in Indonesia. This research aims to analyze the challenges in enforcing criminal law against online gambling promotion by social media influencers and to formulate an integrated criminal law policy to strengthen legal protection for Indonesia's digital generation. This study employs normative legal research using statutory, conceptual, case, and comparative approaches, with qualitative analysis of primary and secondary legal materials. The findings indicate that ineffective law enforcement is caused by regulatory ambiguity regarding influencer criminal liability, limited institutional coordination, technological disparities, evidentiary difficulties, jurisdictional constraints, and the normalization of gambling-related content in the digital environment. To address these challenges, criminal law policy should be reformulated through clearer regulation of influencer liability, stronger inter-agency coordination, enhanced digital forensic capabilities, preventive legal education, greater accountability of digital platform providers, and the adoption of relevant comparative legal approaches. The novelty of this research lies in proposing an integrated criminal law reform model that combines Soerjono Soekanto's Theory of Law Enforcement and Lawrence M. Friedman's Legal System Theory, supported by judicial and comparative legal analyses. The proposed model provides theoretical development and practical guidance for strengthening Indonesia's criminal law policy against online gambling promotion
