Abstract

Abstract: The Dynamics of Social Change and Islamic Law are related each other in making a change. In the one hand,  social changeis caused by the Islamic law, but on the other hand, the change of Islamic law itself is causedby the social changes. The existence of Islamic law, which was brought  by Rasulullah Saw, had clearly changed the social community at that time;the changes started from jahiliyyah societyera that strongly held  their  tradition to the Islamic societyera that held Islamic law.By the same token, Islamic law had also made a change due to social changes. According to juries-prudency of Islamic law(regulations made by fukaha/Islamic cleric) that thechange of the fatwa (advice) was caused by the change of the periode, place, situation (niat) and tradition".  By doing the change of law, the Islamic law becomes dynamic, and adaptable and islamic lawswould be up to date in accordance with the current development and the social changes.الملخص: الدينا ميكية الاجتماعية والأحكام الشرعية مرتبطان في إيجاد التغير. من جهة كان التغير الاجتماعي بسبب وجود الأحكام الشرعية. ومن جهة اخرى تغيّر الحكم الشرعي بسبب التغيّر الاجتماعى . وجود الشريعة الاسلامية التي أتى بها الرسول الله صلى الله عليه وسلم غيّرت - بوضوح - المجتمعات فى ذلك الوقت من مجتمعات جاهلية متمسكة بالعادات إلى مجتمعات إسلامية متمسكة بالشريعة الاسلامية. ولكن الأحكام الشرعية أيضا تتغير بسبب التغير الاجتماعي الموافق بالقاعدة الفقهية التي وضعها الفقهاء " تغير الفتوى بتغير الزمان والمكان والاحوال والعادة " فبتغير الاحكام  تكون الأحكام الشرعية مرنة، عطوفة، لينة، قابلة للمواجهة ، اذن كانت الأحكام الشرعية قابلة للتجديد ومناسبة بتطور الزمان والتغير الاجتماعي. Abstrak: Dinamika sosial dan hukum Islam saling memiliki keterkaitan dalam melakukan perubahan. Satu sisi perubahan sosial karena hukum Islam. Di sisi lain, perubahan hukum Islam karena  perubahan sosial. Keberadaan hukum Islam yang dibawa oleh Rasulullah Saw. dengan jelas merubah sosial masyarakat pada waktu itu dari masyarakat jahiliyyah yang berpegang kepada adat kebiasaan mereka menjadi masyarakat Islam yang berpegang kepada hukum Islam. Tetapi hukum Islam juga melakukan perubahan karena terjadinya perubahan sosial. Sesuai dengan kaidah fikih yang dibuat oleh fuqaha: “berubahnya fatwa dengan sebab berubahnya masa, tempat, keadaan (niat) dan adat kebiasaan.” Dengan melakukan perubahan hukum, maka hukum Islam itu dinamis, dan mampu beradaptasi, sehingga hukum Islam itu op tu date sesuai dengan perkembangan zaman dan perubahan sosial.

Abstract

Islamic Financial Units (IFU), both banks and non-banks, have main activities to col-lect funds from people (clients) and then distribute them through financing, loan and services.After the units as investors distribute the funds to business managers, there are two possibilities:the business runs well because of good management or bad management leads to an unability onthe side of the managers to pay regular installments. In a situation when a dispute occurs betweenparties involved in a financing contract, maybe in the case of non-performing loan due to badbusiness management, or because one party does not fulfill the obligation, or some imperfectionsin the financing contract lead to different ways of understanding it, the resolution mechanismsare available in either court of law or outside it. This article discusses the legal bases for disputeresolutions through both ways, which include some laws, the regulations of the Indonesian Cen-tral Bank, an Islamic banks dispute resolution procedure, and the legal opinion of Sharia Na-tional Council.

Abstract

The study of KH. Salim Ma'ruf thought about buying and selling is important to do because sometimes his thought is in contrast to other scholars opinion. For example, KH. Salim Ma'ruf said that buying and selling done by a drunk person is valid/legal. However, if it is done by children under the permission of the guardians, according to KH.Salim Maruf, is not valid/legal. KH. Salim Ma'ruf also found that buying and selling to people whose treasure is doubtful is makruh. In addition, he also noted that buying and selling sacrificial meat is haram, bay 'al-'urbun, bay' munabadzah and bay 'mulamasah, bay'ataini fi bay'atin, bay 'malaqih. KH. Salim Maruf did not give the legal proposition on each of his thought published in the book of Risalah Mu'amalah while the law is said to be invalid or false is determined from the aspect of legal proposition, therefore, it is necessary to study and search of the arguments used in book.

Abstract

Sharia multilevel marketing is a part of Sharia economic activity that has not been internalized in Indonesian trade law. This article discusses the formation of legal norms for direct selling in Indonesia and analyzes the legal politics of establishing trade law against sharia multilevel marketing. This article is normative legal research that uses both statutory and historical approaches. The data for this study were sourced from literature and interviews and using the inductive method analysis. The findings are, firstly, the law of multilevel marketing in Indonesia, through the stages of regulation and legislation, aims to provide legal certainty and anticipate the practice of pyramid schemes. Second, in legal politics, the formation of national trade law is not responsive to the existence of a Sharia economic system, especially sharia multilevel marketing.

Abstract

Trade law in Indonesia has not accommodated Sharia Multilevel Marketing (Sharia MLM). The legitimacy of the Sharia status and supervision by the the National Sharia Council of the Indonesian Ulema Council (DSN MUI) does not have legal implications for the legality of the Sharia MLM company business entity. This article aims to explain the urgency of Sharia MLM regulation in trade law and provide input on the legal construction of licensing and supervision of Sharia MLM to maximize the achievement of trade law in Indonesia. This normative legal research uses statutory and conceptual approaches with a legal construction method. The legal materials were analyzed usingcontent analysis technique and prescriptive methodology. The results show that the legal construction of Sharia MLM in trade law is urgently carried out by the government using an integration-partnership model between DSN MUI and the Indonesian Ministry of Trade in the licensing and supervision system of Sharia MLM. The application of this model can legitimize the legal status of a Sharia MLM company so that it can become a locomotive for accelerating the Islamic economic ecosystem to advance the national economy.Hukum perdagangan di Indonesia belum mengakomodasi Multilevel Marketing Syariah (MLM Syariah). Legitimasi status Syariah dan pengawasan oleh Dewa Syariah Nasional Majelis Ulama Indonesia (DSN MUI) tidak berimplikasi hukum terhadap status hukum badan usaha perseroan MLM Syariah. Artikel ini bertujuan menjelaskan urgensi pengaturan MLM Syariah dalam hukum perdagangan dan memberikan masukan konstruksi hukum perizinan dan pengawasan MLM Syariah dalam rangka memaksimalkan tercapainya tujuan hukum perdagangan di Indonesia. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan dan pendekatan konseptual dengan metode konstruksi hukum. Bahan hukum dianalisis menggunakan teknik content analysis dan metode preskriptif. Hasil penelitian menunjukkan bahwa konstruksi hukum MLM Syariah dalam hukum perdagangan urgen dilakukan pemerintah dengan menggunakan model integrasi-kemitraan antara DSN MUI dan Kementerian Perdagangan dalam sistem perizinan dan pengawasan MLM Syariah. Penerapan model ini dapat melegitimasi status hukum perseroan MLM Syariah sehingga dapat menjadi lokomotif akselerasi ekosistem ekonomi Islam untuk memajukan perekonomian nasional.

Abstract

Abstract This article aims to conduct a comparative analysis of the istinbath (legal deduction) methods used by two groups in Islamic jurisprudence, namely Ahlul Hadis and Ahlurra’yi, and their implications for Islamic court decisions. The research method used is a literature study with a qualitative approach. Ahlul Hadis is a group that emphasizes the use of the hadith of the Prophet Muhammad SAW as the main source in extracting the law. They believe that the hadith of the Prophet is the second source of Islamic law after the Quran, so they highly uphold the authority of the hadith and reject the excessive use of ra’yu (reason). On the other hand, Ahlurra’yi is a group that emphasizes the use of ra’yu (reason) in establishing the law. They believe that ijtihad (independent reasoning) using human intellect is important and necessary, especially in responding to new problems that are not explicitly regulated in the Quran and hadith. The difference in the istinbath method between Ahlul Hadis and Ahlurra’yi has implications for the differences in the legal products produced by the two groups, which in turn also affect the decisions of Islamic courts. In the context of court decisions, the difference in the istinbath method can lead to differences in the interpretation and application of the law, which can impact the disparity of decisions between judicial institutions.   Keywords: Ahlul Hadis, Ahlurra’yi, Islamic Judiciary, Istinbath. AbstrakArtikel ini bertujuan untuk melakukan analisis komparatif terhadap metode istinbath (penggalian hukum) yang digunakan oleh dua kelompok dalam fikih Islam, yaitu Ahlul Hadis dan Ahlurra’yi, serta implikasinya terhadap keputusan peradilan Islam. Metode penelitian yang digunakan adalah studi kepustakaan dengan pendekatan kualitatif. Ahlul Hadis merupakan kelompok yang menekankan pada penggunaan hadis Nabi Muhammad SAW sebagai sumber utama dalam menggali hukum. Mereka meyakini bahwa hadis Nabi adalah sumber hukum Islam yang kedua setelah Al-Quran, sehingga mereka sangat menjunjung tinggi otoritas hadis dan menolak penggunaan ra’yu (nalar) yang berlebihan. Di sisi lain, Ahlurra’yi adalah kelompok yang lebih menekankan pada penggunaan ra’yu (nalar) dalam menetapkan hukum. Mereka berpandangan bahwa ijtihad dengan menggunakan akal pikiran manusia merupakan sesuatu yang penting dan dibutuhkan, terutama dalam merespons permasalahan-permasalahan baru yang tidak secara eksplisit diatur dalam Al-Quran dan hadis. Perbedaan metode istinbath antara Ahlul Hadis dan Ahlurra’yi ini berimplikasi pada perbedaan produk hukum yang dihasilkan oleh kedua kelompok, yang selanjutnya juga mempengaruhi putusan-putusan peradilan Islam. Dalam konteks keputusan peradilan, perbedaan metode istinbath ini dapat menimbulkan perbedaan penafsiran dan penerapan hukum, sehingga dapat berdampak pada disparitas putusan antar lembaga peradilan.  Kata Kunci: Ahlul Hadis, Ahlurra’yi, Istinbath, Peradilan Islam.
