Abstract

Abstract: The Dynamics of Social Change and Islamic Law are related each other in making a change. In the one hand,  social changeis caused by the Islamic law, but on the other hand, the change of Islamic law itself is causedby the social changes. The existence of Islamic law, which was brought  by Rasulullah Saw, had clearly changed the social community at that time;the changes started from jahiliyyah societyera that strongly held  their  tradition to the Islamic societyera that held Islamic law.By the same token, Islamic law had also made a change due to social changes. According to juries-prudency of Islamic law(regulations made by fukaha/Islamic cleric) that thechange of the fatwa (advice) was caused by the change of the periode, place, situation (niat) and tradition".  By doing the change of law, the Islamic law becomes dynamic, and adaptable and islamic lawswould be up to date in accordance with the current development and the social changes.الملخص: الدينا ميكية الاجتماعية والأحكام الشرعية مرتبطان في إيجاد التغير. من جهة كان التغير الاجتماعي بسبب وجود الأحكام الشرعية. ومن جهة اخرى تغيّر الحكم الشرعي بسبب التغيّر الاجتماعى . وجود الشريعة الاسلامية التي أتى بها الرسول الله صلى الله عليه وسلم غيّرت - بوضوح - المجتمعات فى ذلك الوقت من مجتمعات جاهلية متمسكة بالعادات إلى مجتمعات إسلامية متمسكة بالشريعة الاسلامية. ولكن الأحكام الشرعية أيضا تتغير بسبب التغير الاجتماعي الموافق بالقاعدة الفقهية التي وضعها الفقهاء " تغير الفتوى بتغير الزمان والمكان والاحوال والعادة " فبتغير الاحكام  تكون الأحكام الشرعية مرنة، عطوفة، لينة، قابلة للمواجهة ، اذن كانت الأحكام الشرعية قابلة للتجديد ومناسبة بتطور الزمان والتغير الاجتماعي. Abstrak: Dinamika sosial dan hukum Islam saling memiliki keterkaitan dalam melakukan perubahan. Satu sisi perubahan sosial karena hukum Islam. Di sisi lain, perubahan hukum Islam karena  perubahan sosial. Keberadaan hukum Islam yang dibawa oleh Rasulullah Saw. dengan jelas merubah sosial masyarakat pada waktu itu dari masyarakat jahiliyyah yang berpegang kepada adat kebiasaan mereka menjadi masyarakat Islam yang berpegang kepada hukum Islam. Tetapi hukum Islam juga melakukan perubahan karena terjadinya perubahan sosial. Sesuai dengan kaidah fikih yang dibuat oleh fuqaha: “berubahnya fatwa dengan sebab berubahnya masa, tempat, keadaan (niat) dan adat kebiasaan.” Dengan melakukan perubahan hukum, maka hukum Islam itu dinamis, dan mampu beradaptasi, sehingga hukum Islam itu op tu date sesuai dengan perkembangan zaman dan perubahan sosial.

Abstract

Abstract This article aims to conduct a comparative analysis of the istinbath (legal deduction) methods used by two groups in Islamic jurisprudence, namely Ahlul Hadis and Ahlurra’yi, and their implications for Islamic court decisions. The research method used is a literature study with a qualitative approach. Ahlul Hadis is a group that emphasizes the use of the hadith of the Prophet Muhammad SAW as the main source in extracting the law. They believe that the hadith of the Prophet is the second source of Islamic law after the Quran, so they highly uphold the authority of the hadith and reject the excessive use of ra’yu (reason). On the other hand, Ahlurra’yi is a group that emphasizes the use of ra’yu (reason) in establishing the law. They believe that ijtihad (independent reasoning) using human intellect is important and necessary, especially in responding to new problems that are not explicitly regulated in the Quran and hadith. The difference in the istinbath method between Ahlul Hadis and Ahlurra’yi has implications for the differences in the legal products produced by the two groups, which in turn also affect the decisions of Islamic courts. In the context of court decisions, the difference in the istinbath method can lead to differences in the interpretation and application of the law, which can impact the disparity of decisions between judicial institutions.   Keywords: Ahlul Hadis, Ahlurra’yi, Islamic Judiciary, Istinbath. AbstrakArtikel ini bertujuan untuk melakukan analisis komparatif terhadap metode istinbath (penggalian hukum) yang digunakan oleh dua kelompok dalam fikih Islam, yaitu Ahlul Hadis dan Ahlurra’yi, serta implikasinya terhadap keputusan peradilan Islam. Metode penelitian yang digunakan adalah studi kepustakaan dengan pendekatan kualitatif. Ahlul Hadis merupakan kelompok yang menekankan pada penggunaan hadis Nabi Muhammad SAW sebagai sumber utama dalam menggali hukum. Mereka meyakini bahwa hadis Nabi adalah sumber hukum Islam yang kedua setelah Al-Quran, sehingga mereka sangat menjunjung tinggi otoritas hadis dan menolak penggunaan ra’yu (nalar) yang berlebihan. Di sisi lain, Ahlurra’yi adalah kelompok yang lebih menekankan pada penggunaan ra’yu (nalar) dalam menetapkan hukum. Mereka berpandangan bahwa ijtihad dengan menggunakan akal pikiran manusia merupakan sesuatu yang penting dan dibutuhkan, terutama dalam merespons permasalahan-permasalahan baru yang tidak secara eksplisit diatur dalam Al-Quran dan hadis. Perbedaan metode istinbath antara Ahlul Hadis dan Ahlurra’yi ini berimplikasi pada perbedaan produk hukum yang dihasilkan oleh kedua kelompok, yang selanjutnya juga mempengaruhi putusan-putusan peradilan Islam. Dalam konteks keputusan peradilan, perbedaan metode istinbath ini dapat menimbulkan perbedaan penafsiran dan penerapan hukum, sehingga dapat berdampak pada disparitas putusan antar lembaga peradilan.  Kata Kunci: Ahlul Hadis, Ahlurra’yi, Istinbath, Peradilan Islam.

Abstract

Implementation of the self-declare concept in halal product guarantees, especially in the context of micro and small enterprise (UMK) economic actors, which is focused on understanding how the self-declare process can provide convenience and certainty for UMK in obtaining halal certification . The implementation of self-declaration is in line with changes to the halal certification system in Indonesia, this mechanism ensures that the self-declare policy only applies to UMK that meet certain criteria, in line with the government's efforts to encourage the growth of the UMK sector and increase the competitiveness of halal products. It is hoped that self-declaration can create certainty and guarantee of halal products for Muslim consumers, as well as support the growth of the halal industry at national and international levels. ‎

Abstract

AbstractIslamic law in Indonesia cannot be separated from the influence of the entry of Islam into the archipelago in the 12th and 13th centuries AD, at that time the first spreader of Islam in the archipelago was of the Shafi'i school of thought. The historical journey of the transformation of Islamic law is full of various historical, philosophical, political, sociological and legal aspects. Islamic law in Indonesia is seen from two points of view. First, Islamic law is applied formally or codified in the national legal structure. Second, Islamic law is applied normatively, meaning that it is intended to provide sanctions or equal legal action against Muslims. Keywords: Islamic Law, Indonesia Abstrak Hukum Islam di Indonesia tidak lepas dari pengaruh masuknya agama Islam ke wilayah nusantara pada abad ke-12 dan ke-13 Masehi, pada masa itu penyebar pertama agama Islam di Nusantara ini bermazhab Syafi'i. Perjalanan sejarah transformasi hukum Islam sarat dengan berbagai aspek sejarah, filosofis, politik, sosiologis dan hukum. Hukum Islam di Indonesia dilihat dari dua sudut pandang. Pertama, hukum Islam diterapkan secara hukum formal atau dikodifikasikan dalam struktur hukum nasional. Abstract

Islamic bankers have a central position and an essential role in the implementation of Sharia principles in Islamic banking practices because Islamic bankers are parties directly related to the operational implementation of Sharia contracts. This research attempted to reconceptualize the figure of the Islamic banker with the formulation of the ideal Islamic banker within the framework of Sharia norms. This research was qualitative research that applied a literature study. Referring to the Hadith of the Prophet, Atsar Umar bin Khattab and Qaul Abu Laits, which serve as the foundation for the formulation of the ideal Islamic banker in the ideas of banking jurisprudence related to Islamic Human Resources Management, Islamic bank management must consider the relevance of education in selecting employees as an application of the Islamic recruitment model. Furthermore, the ideal Islamic banker will be realized through Islamic training, which forms ways of thinking, competence, character, and work motivation within the Sharia framework. The results indicated that Islamic bankers had adequate knowledge of Sharia and enthusiasm and commitment, which was vital in implementing all Sharia provisions in banking transactions to create a Sharia compliance ecosystem in Islamic banking.

Abstract

As Islamic banking continues to expand beyond its traditional markets, the integrity of Sharia compliance emerges as a central concern within global financial governance. Nevertheless, much research revealed that Sharia supervision was still weak and not optimal. The research objective of this paper was to formulate a reconstruction of Sharia supervisors in Islamic banking as a solution to the Sharia supervision problem in Islamic banking, which was still considered weak and had not been optimal. This research was qualitative with a library research design. Based on the study conducted, the reconstruction of sharia supervisors as a solution to the problems of sharia supervision was carried out to overcome the problems of competence, independence, and effectiveness of supervisory performance. The reconstruction formulation was related to the certification of the Sharia Supervisory Board with the addition of training material on legislation and legal regulations for business and the financial industry, as well as strengthening the profession, the establishment of Sharia supervisory board regulations with provisions on the right to impose sanctions, then the decentralization of sharia supervisors with the formation of the Sharia Supervisory Secretariat  of representative in the province with authority as regional coordinator.

Abstract

The background of this research is that there are differences in retailers' preferences in choosing wholesalers in Paringin, South Kalimantan. This study aims to determine the factors that influence retailers' preferences in choosing wholesalers. This research is a qualitative approach using observation, interviews, and documentation. Then, the data is analyzed by descriptive analysis techniques qualitative. The results of the study found factors that influence the preferences of retailers in choosing wholesalers are: 1) Easily accessible location, 2) complete item, 3) item availability, 4) getting item practically, 5) Long opening time, 6) Price, 7) speed of service, and 8) goods benefits.

Abstract

Economic development in the 20th century had a huge impact on the sustainable development of mankind. On the other hand, however, it has a negative impact on living ecosystems. In many aspects such as the orientation of the interests of sustainable development, the economy and the environment are considered as two opposing aspects. Sustainable Development Based on this, a relatively new concept emerged, namely the green economy. The green economy is a concept that supports human well-being and cares about environmental and ecosystem sustainability in economic development. But on the negative side, economic development can also have an impact on the reduction of natural resources through over-exploitation, industrial pollution, oil, water, and air pollution due to flooding, and the impact on climate change. Islam has an ideal concept of sustainable development. At least there are fundamental rules for supporting sustainable development, namely the implementation of fiqh al-bi'ah based on maqashid sharia for the management of Islamic resources in the economy. Islam has an ideal concept of sustainable development. At least there are basic rules to support sustainable development, namely the application of fiqh al-bi'ah based on maqashid Sharia law to manage Islamic resources in the economy.

Abstract

Abstract This paper discusses the history, characteristics, and methods of istinbath of Islamic law during the prophetic and Companion periods. It explains how Islamic law developed along with the revelation to the Prophet Muhammad and how the Companions used ijtihad in determining the law. It also discusses the differences of opinion among the Companions and how they struggled to resolve legal issues using the original sources of Islamic law, the Qur'an and Sunnah. The Prophetic period, known as the infancy period, is the period of growth and formation of the Prophet's Islamic law for 23 years, from his elevation to the Apostleship in 610 AD until his death in 632 AD. This period is divided into two parts, namely the Mecca period and the Medina period. The characteristics of Islamic law during the prophetic period include several important aspects, such as tashri' divided into two phases with different focuses. The determination of law during the prophetic period began with events or questions posed by the people of Muhammad Saw to him. Meanwhile, the Companion period is also called the development period, and the characteristic of tashri' in this period is that ijtihad has begun to be carried out by the Companions because the Prophet as the authority of tashri' has passed away. Keywords: History, characteristics, istinbath method, Islamic Law Abstrak Tulisan ini membahas tentang sejarah, karakteristik, dan metode istinbath hukum Islam masa kenabian dan sahabat. Ia menjelaskan bagaimana hukum Islam berkembang seiring dengan turunnya wahyu kepada Nabi Muhammad saw dan bagaimana para sahabat menggunakan ijtihad dalam menetapkan hukum. Tulisan ini juga membahas tentang perbedaan pendapat di antara para sahabat dan bagaimana mereka berjuang untuk menyelesaikan masalah hukum dengan menggunakan sumber asli hukum Islam, yaitu Al-Qur'an dan Sunnah. Pada Periode kenabian, dikenal sebagai masa pertumbuhan, adalah masa pertumbuhan dan pembentukan hukum Islam Rasulullah selama 23 tahun, dari diangkatnya menjadi Rasul pada tahun 610 M hingga wafatnya pada tahun 632 M. Periode ini dibagi menjadi dua bagian, yaitu periode Mekkah dan periode Madinah. Karakteristik hukum Islam pada masa kenabian mencakup beberapa aspek penting, seperti tasyri' dibagi menjadi dua fase dengan fokus yang berbeda. Penetapan hukum di masa kenabian dimulai dengan peristiwa atau pertanyaan yang diajukan oleh umat Muhammad Saw kepadanya. Sedangkan, Periode sahabat disebut juga masa perkembangan, dan ciri khas tasyri’ pada periode ini adalah ijtihad sudah mulai banyak dilakukan oleh para sahabat karena Rasulullah saw sebagai pemegang wewenang tasyri’ sudah meninggal dunia.
