Abstract

Perhatian tentang lingkungan di Indonesia dalam bidang eksekutif secara tidak langsung diberikan kepada Kementerian Lingkungan Hidup dan Kehutanan. Tulisan ini mengangkat dua persoalan hukum, Pertama, apakah ruang lingkup pelaksanaan pengawasan dan pengendalian baku mutu udara ambien hanya diletakan pada Dinas Lingkungan Hidup? Kedua, Bagaimana kewenangan dari Dinas Lingkungan Hidup dalam melaksanakan peraturan terkait baku mutu udara ambien di Indonesia?. Tujuan penulisan yakni agar konsisten dengan permasalahan yang diangkat, jadi tujuan pertama disesuaikan dengan rumusan masalah kesatu, tujuan kedua disesuaikan dengan rumusan masalah kedua. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan serta pendekatan analisis dan konseptual. Setelah dilakukan analisis, maka dapat disimpulkan, pertama ruang lingkup pelaksanaan kewewenangan tegas secara fungsional dari Dinas Lingkungan Hidup di Indonesia masih cenderung tidak konsisten perumusannya sehingga mengakibatkan adanya ketidakjelasan pada pelaksanaan fungsi tersebut; dan kedua, kewenangan untuk menjaga dan melestarikan fungsi lingkungan hidup tidak terletak kepada Kementerian lingkungan hidup pada obyek konkrit. Kata Kunci : Baku Mutu Udara Ambien, Lingkungan Hidup, Pengawasan.

Abstract

Setiap Negara memiliki aturan dan kedaulatannya untuk mengatur masyarakat khususnya untuk mengatur lalu lintas orang dalam melaksanakan kegiatannya untuk masuk dan keluar wilayah Negara. Untuk mengatur hal tersebut di Indonesia sudah terdapat Undang-Undang No. 6 Tahun 2011 tentang Keimigrasian. Pelayanan publik di Kantor Imigrasi Kelas 1 Khusus Ngurah Rai yang salah satunya mengatur tentang izin tinggal keberadaan warga Negara asing yang tinggal di Indonesia khususnya di Bali. Semakin banyak kita jumpai penyalahgunaan izin yang digunakan oleh warga Negara asing untuk bisa menetap di Indonesia salah satunya dengan cara menggunakan jasa yang dibantu oleh pihak sponsor, hal ini bisa menimbulkan penyalahgunaan izin tinggal terbatas yang tidak semata-mata sengaja diperbuat oleh warga Negara asing tersebut melainkan keterlibatan dari pihak-pihak perusahaan penjamin yang sering kali sengaja mengakali warga Negara asing untuk menyalahi aturan dari pihak Imigrasi. Dari pencerminan hal tersebut penulis menggunakan metode penelitian hukum yuridis empiris yang nantinya dapat diketahui penyelsaian dari praktek izin illegal bebas visa kunjungan. Salah satu upaya yang dapat dilakukan adalah meningakatkan sumber daya manusia keimigrasian, menyempurnakan sarana dan prasarana. pelaksanaan dapat diwujudkan dalam mekanisme sistem pengamanan teknis pemberikan izin keimigrasian serta penindakan terhadap pelanggaran keimigrasian. Abstract

The establishment of Government Administration Law brings significant change to the competence of the previously restricted Administrative Court to become expanded. This study aims to find the philosophical considerations from the extension of Administrative Decision meaning on Government Administration Law, to classify the legal implication arising from the regulation of the expansion of administrative decision meaning towards dispute submission process in Administrative Court and to formulate ideal attitude of the State Administrative Judge in resolving State Administrative Disputes. This is a combination of normative and empirical legal research. The study indicated that the legislator main consideration in regulating the expansion of administrative decision meaning on Government Administration Law is to expand the absolute competence of Indonesian Administrative Court which previously felt very narrow. The implication arises after new regulation consists of: the expansion of Administrative Court adjudicate authority for factual actions, subject expansion that have the authority to issue Administrative Decision, the expansion of the Administrative Court adjudicate authority over Administrative Decision which has a legal consequences although still need the approval from above instance, the regulation that Administrative Decision can be sued through the Administrative Court of any potential loss that may arise by the issuance of its Administrative Decision and the expansion towards the parties who have a chance to field a State Administrative accusation. The ideal attitude of State Administrative Judge is the judge should remain based on the strong theoretical concepts of the law so can create understanding and attitude in handling a case in Indonesian Administrative Court.

Abstract

Notary is one of professions lawful services to public, which has responsibilities related with authentic attesting instruments, such as, letters,certificates, or documents made by him/her in written form concerning various lawful actions Departing from the circumstances as preventive measures of prevention needs to be premature given information about the notarial deed (deed authentic) as evidence in the event of civil law in order to later villagers in any transaction in a very large amount in order to carry out the agreement in front notary officials. The fact that occurs in the community, some of them are less aware of the importance of a document as evidence that an agreement between the parties is done with a sense of mutual trust and made ??orally, but there are also some people who understand the importance of making a document as evidence that the deal is made in writing, that it will be presented as a means of evidence.

Abstract

Notary as a public official the only one authorized to make authentic act of the deeds , agreements and determination required by a general rule or by the concerned desired to be declared in an authentic document , ensure certainty the date, saveing , all along the deed was not also be assigned or excluded to the officer or others . As a public official duties and notary work not only makes authentic act but also to register and certify (waarrmerken) letters under a hand. This research is empirical nature of this research is descriptive. Data studied were the primary data (primary data) and secondary data (Secondary data). Sembung research sites in the village. Data collection techniques are literature research and interview techniques . Non probality Sampling Sampling techniques . Data analysis method is a method of qualitative analysis . Waarmerken deed made under the deed of hand function are made under the hand guarantees about the date and the signatures of the parties concerned on the evidence. Deed under the hand that has obtained waarmerken of Notaries has the force of law under these conditions, the deed under the hand that received waarmerken of notary can assist judges in terms of evidence, due to the recognition of the signature , then the contents of the deed was regarded as the agreement of the parties , because the deed under the hand the truth lies in the signature of the parties to the recognition of the signature by the parties and to those who acknowledge his signature on the letter means he also recognizes the contents of the letter that is above his signature that the certificate is a proof of perfect .

Abstract

Tujuan dari penelitian ini ialah untuk mengobservasi bagaimana pandangan hukum di Indonesia terhadap tindak pidana korupsi yang dilakukakn oleh korporasi. Penelitian ini menggunakan metode penelitian hukum normatif dengan metode pendekatan Statue Approach pendekatan undang-undang. Hasil studi menunjukkan bahwa di Indonesia suatu korporasi sebagai subjek hukum pidana hanya didapati dalam undang-undang pidana khusus. Jika memungkinkan, perusahaan dihukum sesuai dengan Hukum Pidana dan tidak lagi terbatas pada hukum pidana khusus. Pada tahun 2013, pemerintah mengajukan "Rancangan Undang-Undang Pidana", yang mencakup modernisasi hukum pidana, yang menetapkan bahwa perusahaan harus menjadi subjek hukum pidana agar dapat dipertanggungjawabkan secara pidana corporate criminal liability. Menurut Pasal 20 (3) sampai (6) undang-undang perseroan terbatas telah ditetapkan undang-undang acara pidana khusus untuk perusahaan yang melakukan korupsi oleh perusahaan. Undang-undang tersebut menetapkan bahwa mengenai wakil dari korporasi yang akan secara fisik mewakili korporasinya dipersidangan. Kata Kunci: Korporasi, Korupsi, KUHP ABSTRACT The purpose of this study is to determine the criminal responsibility of Indonesian companies in the Draft Corruption Criminal Code in Indonesian Positive Law. This study uses the normative legal research method with the approach method used is the Statue approach approach to the law. . The results of the study show that in Indonesia, corporations as subjects of criminal law are only found in special criminal laws. If possible, the company is punished in accordance with the Criminal Code and is no longer limited to specific criminal laws. In 2013, the government submitted a "Draft Criminal Code", which includes the modernization of criminal law, which stipulates that companies must be subject to criminal law in order to be held accountable for corporate criminal liability. According to Articles 20 (3) to (6) "UUPT", a special criminal procedure law has been stipulated for companies that commit corruption by the company. Abstract

Tujuan penelitian ini adalah untuk memberi pemahaman mengenai pengaturan pembiayaan penempatan pekerja migran di Indonesia dan untuk memahami akibat hukum terjadinya konflik norma terkait pembiayaan penempatan pekerja migran Indonesia. Metode yang dipergunakan pada artikel terkait konflik norma pada pembiayaan penempatan PMI ini mempergunakan penelitian hukum yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan yakni jika Pengaturan pembiayaan penempatan pekerja migran di Indonesia pada dasarnya sudah dilakukan pengaturan melalui “UU No. 13.2003 tentang Ketenagakerjaan; UU No. 6/2012 tentang Pengesahan International Convention on The Protection of The Rights of All Migrant Worker and Member of Their Families (Konvensi internasional mengenai perlindungan hak-hak seluruh pekerja migran dan anggota keluarganya); UU No. 18/2017 tentang Pelindungan Pekerja Migran Indonesia; PP No. 59/2021 tentang Pelaksanaan Pelindungan Pekerja Migran Indonesia”. Selanjutnya akibat hukum terjadinya konflik norma terkait pembiayaan penempatan pekerja migran Indonesia maka akan dilakukan pemanfaatan oleh pihak-pihak yang tidak dapat dipertanggungjawabkan, pematokan harga tinggi (overcharging) saat proses ditempatkannya PMI, dan penipuan yang lebih menjurus pada tindak pidana perdagangan orang. The purpose of this study is to provide an understanding of the financing arrangements for the placement of migrant workers in Indonesia and to understand the legal consequences of conflicting norms regarding the financing of the placement of Indonesian migrant workers. The method used in this article related to the conflict of norms in the financing of PMI placements uses normative juridical legal research, with a statutory approach and a conceptual approach. The results of the study show that if the arrangement for financing the placement of migrant workers in Indonesia has basically been carried out through "Law no. 13.2003 concerning Manpower; UU no. 6/2012 concerning Ratification of the International Convention on The Protection of The Rights of All Migrant Workers and Members of Their Families (international convention on the protection of the rights of all migrant workers and members of their families); UU no. 18/2017 concerning the Protection of Indonesian Migrant Workers; PP No. 59/2021 concerning the Implementation of the Protection of Indonesian Migrant Workers”. Furthermore, the legal consequences of conflicts of norms related to the financing of the placement of Indonesian migrant workers will be exploited by parties who cannot be accounted for, high price fixing (overcharging) during the process of placing PMI, and fraud which is more likely to lead to criminal acts of trafficking in persons.

Abstract

Penelitian ini bertujuan untuk mengetahui kewenangan PTUN dalam memutus perkara nomor: 87/G/PU/2019/PTUN-JKT setelah diundangkannya UU Administrasi Pemerintahan, beserta dasar pertimbangan hakim dalam memutus perkara tersebut sesuai dengan syarat pembatalan KTUN dalam substansi UUAP. Metode penelitian dalam studi ilmiah ini adalah yuridis-normatif, denganpendekatan konsep, kasus, dan undang-undang.Hasil studi menunjukan bahwa ditetapkannya UU Administrasi Pemerintahan berimplikasi terhadap perluasan makna dari konsep KTUN dalam UU PERATUN, sekaligus meluaskan kompetensi absolut PTUN. Dengan meluasnya makna KTUN, maka KTUN dalam perkara Putusan Nomor: 87/G/PU/2019/PTUN-JKT merupakan objek KTUN yang dapat digugat ke Peradilan Tata Usaha Negara. Berdasarkan terbitnya KTUN yang dipersengketakan pada Putusan Nomor: 87/G/PU/2019/PTUN-JKT, bahwa penerbitan KTUN tersebut tidak mengindahkan tahapan-tahapan peraturan perundang-undangan, serta tidak sesuai dengan asas good governance (pemerintahan yang baik). Untuk itu, sesuai dengan ketentuan UU Administrasi Pemerintahan KTUN tersebut dinyatakan mengalami cacat prosedur dan memenuhi syarat untuk dilakukan pembatalan. This study aims to decide the legitimacy of the State Administrative Court in deciding case number: 87/G/PU/2019/PTUN-JKT after the promulgation of Government Administration Law (UU Administrasi Pemerintahan), along with the basis for the judge's considerations in deciding the case by the conditions for canceling the state administrative decision. In the substance of the Government Administration Law. This study uses juridical-normative research methods, with a statute, conceptual, and case approach. The results of the study show that the enactment of the Government Administration Law has implications for expanding the meaning of the state administrative decision’s concept in the Administrative Court Law, as well as expanding the absolute competence of State Administrative Court. With the expansion of the meaning of state administrative decision, decision number: 87/G/PU/2019/PTUN-JKT is a state administrative decision that can be sued by the State Administrative Court. Based on the issuance of the state administrative decision which was the object of dispute in decision number: 87/G/PU/2019/PTUN-JKT, the issuance of the state administrative decision did not heed the stages of the laws and regulations, and was not by the general principles of good governance.For this reason, by the provisions of the Government Administration Law, the state administrative decision is declared to have had a procedural defect and meets the requirements for cancellation.

Abstract

Studi ini bertujuan untuk mengkaji dan memahami konsep umum Deferred Prosecution Agreement (DPA) serta keberadaannya di Indonesia sebagai kewenangan dari kejaksaan dalam penyelesaian perkara korporasi yang melakukan Tindak Pidana Pencucian Uang (TPPU) ditinjau dari sistem peradilan pidana. Metode penelitian yang digunakan yakni hukum normatif dengan pendekatan konseptual, perbandingan, dan perundang-undangan. Hasil studi ini menunjukkan bahwa konsep ideal DPA yakni kewenangan jaksa untuk mengalihkan perkara dari proses peradilan dengan syarat tersangka mengakui kesalahannya. Konsep DPA dapat diterapkan di Indonesia dengan memperhatikan dan menyesuaikan budaya hukum di Indonesia. Selain itu, DPA sebagai kewenangan kejaksaan sesuai dengan Asas Oportunitas dan perannya sebagai dominus litis. Keberadaan DPA memberikan pengaruh terhadap sistem peradilan pidana terkait dengan koordinasi dan sinkronisasi antar elemen penegak hukum dalam penyelesaian perkara TPPU melalui kerja sama pengadilan dengan kejaksaan dalam hal ini hakim sebagai pihak ketiga dalam proses negosiasi antar jaksa dengan terdakwa sehingga dapat mewujudkan tujuan sistem peradilan pidana yaitu due process of law. DPA yang masih mengalami kekosongan norma apabila diterapkan di Indonesia penting untuk memperhatikan sistem peradilan pidana dalam hal koordinasi dan sinkronisasi kebijakan DPA terhadap elemen penegak hukum lainnya. Kata Kunci: Deferred Prosecution Agreement, TPPU, Korporasi, Sistem Peradilan Pidana. ABSTRACT This study aims to examine and understand the general concept of the Deferred Prosecution Agreement (DPA) and its existence in Indonesia as the authority of the prosecutor's office in resolving corporate cases that commit Money Laundering (TPPU) in terms of the criminal justice system. The research method used is normative law with conceptual, comparative, and statutory approaches. The results of this study indicate that the ideal concept of DPA is the prosecutor's authority to divert cases from the judicial process on condition that the suspect admits his guilt. The DPA concept can be applied in Indonesia by taking into account and adjusting the legal culture in Indonesia. In addition, DPA as the Attorney General's authority is by the Opportunity Principle and its role as dominus litis. The existence of DPA influences the criminal justice system related to coordination and synchronization between elements of law enforcement in the settlement of ML cases through cooperation between the court and the prosecutor's office, in this case, the judge as a third party in the negotiation process between the prosecutor and the defendant so that it can realize the objectives of the criminal justice system, namely due process of law. DPA, which is still experiencing a void in norms when applied in Indonesia, is important to pay attention to the criminal justice system in terms of coordinating and synchronizing DPA policies with other law enforcement elements. Abstract

ABSTRAK Tujuan dari penulisan ini adalah untuk mengetahui tentang praktek persaingan usaha tidak sehat yang dijalankan oleh pemodal besar terhadap peternak ayam rakyat yang dimana ditinjau dari UU 5/1999 Tentang Persaingan Usaha Tidak Sehat. Metode penulisan yang digunakan adalah metode penelitian hukum normatif atau kepustakaan. Karena dalam penulisan ini untuk mengetahui hal-hal yang berkaitan dengan praktek persaingan curang yang dilakukan pemodal besar kepada peternak ayam rakyat dibutuhkan sumber hukum tertulis dan sumber pustaka hukum lainnya. Hasil studi menunjukan bahwa pakan ternak berupa jagung masih menjadi problematika di kalangan peternak rakyat. Hal ini terjadi karena adanya dominasi dari para pengepul dan perusahaan yang kekuatan modalnya lebih besar, sehingga peternak ayam rakyat kesulitan memperoleh jagung karena persediaan jagung di pasar tidak ada. Sehingga dalam kasus ini perlu untuk dianalisis terkait dengan praktek persaingan curang yang dilakukan oleh pemodal besar yang dikaji berdasarkan Undang-Undang Persaingan Bisnis. Selain itu, pentingnya peran serta dari pemerintah untuk mengatasi adanya dominasi-dominasi yang dilakukan oleh para pemodal besar sehingga, terciptanya persaingan usaha yang sehat diantara para pengusaha ternak ayam. Kata kunci : Praktek Persaingan Usaha, Dominasi, Pakan Ternak ABSTRACT The Purpose of this study is to find out about the practice of unfair business competition carried out by large investors against smallholder chicken farmers, which is reviewed from Law 5/1999 concerning Unfair Business Competition. The writing method used is a normative legal research method or literature. Because in this paper to find out things related to the practice of fraudulent competition carried out by large investors to smallholder chicken farmers, written legal sources and other legal literature sources are needed. The results of the study show that animal feed in the form of corn is still a problem among smallholder farmers. This happens because of the dominance of the collectors and companies with greater capital power, so that smallholder chicken farmers have difficulty obtaining corn because there is no supply of corn in the market. Therefore, in this case it is important to analyze the practice of fraudulent competition carried out by large investors under the Business Competition Law. In addition, the importance of the government's participation in overcoming the dominations carried out by large investors so as to create healthy business competition among chicken farmers.
