Abstract

Ar-radhā’ah (breastfeeding) that establishes mahram status—a kinship relationship prohibiting marriage—must meet specific conditions in Islamic law, such as the child being under two years old and breastfed at least five times by a woman capable of pregnancy. These conditions are based on the Qur’an, hadith, and scholarly opinions. However, Indonesian family law, including Marriage Law No. 1 of 1974 and the Compilation of Islamic Law (KHI), does not explicitly specify who becomes mahram through breastfeeding or the criteria involved, creating a legal gap. This study uses a qualitative, normative-empirical approach and a literature review. Julia Kristeva’s intertextuality theory is applied to analyze how classical Islamic legal texts have influenced and been transformed within Indonesian national law. The results show that although Indonesian family law does not explicitly regulate breastfeeding as a basis for mahram status, there are traces of intertextuality indicating that Islamic legal principles have been absorbed into the national legal framework, both consciously and unconsciously. Mahram relationships from breastfeeding affect marriage prohibitions and certain social interactions, but do not impact other legal aspects such as inheritance or testimony. The study recommends updating legal interpretations to fill this gap and provide legal certainty for judicial practice regarding breastfeeding-based mahram status in Indonesia. Ar-radhā’ah (penyusuan) yang menyebabkan status mahram—yaitu hubungan kekerabatan yang mengharamkan pernikahan—harus memenuhi syarat tertentu menurut hukum Islam, seperti anak disusui di bawah usia dua tahun dan disusui minimal lima kali oleh perempuan yang dapat hamil. Ketentuan ini didasarkan pada Al-Qur’an, hadis, dan pendapat para ulama. Namun, hukum keluarga di Indonesia, seperti Undang-Undang Perkawinan No. 1 Tahun 1974 dan Kompilasi Hukum Islam (KHI), tidak secara eksplisit mengatur siapa yang menjadi mahram karena penyusuan dan syarat-syaratnya, sehingga menimbulkan kekosongan hukum. Penelitian ini menggunakan pendekatan kualitatif dengan metode normatif-empiris dan kajian kepustakaan. Teori intertekstualitas dari Julia Kristeva digunakan untuk menganalisis bagaimana teks hukum nasional menyerap dan mentransformasikan makna dari sumber hukum Islam klasik. Hasil penelitian menunjukkan bahwa meskipun hukum nasional tidak secara eksplisit mengatur penyusuan sebagai sebab mahram, terdapat jejak intertekstualitas yang menunjukkan bahwa prinsip-prinsip hukum Islam telah terserap dalam sistem hukum Indonesia. Hubungan mahram akibat penyusuan berdampak pada larangan pernikahan dan interaksi sosial, namun tidak memengaruhi aspek hukum lain seperti waris atau kesaksian. Diperlukan pembaruan tafsir hukum untuk mengisi kekosongan ini dan memberikan kepastian hukum dalam praktik peradilan.

Abstract

This study aims to examine the role of Islamic boarding schools (pesantren) in achieving economic sustainability through a Maqashid al-Shari’ah–based approach. Pesantren function not only as institutions for religious education but also as socio-economic entities with strategic potential to promote community empowerment and economic self-reliance. The Maqashid al-Shari’ah framework is employed as a normative foundation to analyze how pesantren-based economic activities can be oriented toward achieving public welfare (maslahah) and holistic well-being (falah).This research adopts a qualitative approach using a library research method by analyzing books and scholarly journal articles published from 2018 onward that are relevant to pesantren, economic sustainability, and Maqashid al-Shari’ah. The findings indicate that the implementation of maqashid principles particularly the protection of wealth (hifz al-mal), intellect (hifz al-‘aql), and life (hifz al-nafs) strengthens the economic sustainability of pesantren through ethical, just, and sustainable economic management. Moreover, the maqashid-based approach encourages transparent and accountable economic governance oriented toward community empowerment. This study concludes that pesantren have strong potential to serve as an alternative model of value-based sustainable economic development within the framework of Islamic economics, particularly in addressing contemporary economic challenges.

Abstract

The transformation of Islamic higher education in Indonesia, particularly the transition from IAIN to UIN, is not merely an administrative change, but a complex cultural and intellectual project. Ronald A. Lukens-Bull sees this phenomenon as an effort to build a unique “Islamic Modernity,” in which religion and science are not dichotomously separated. This study aims to analyze Ronald A. Lukens-Bull's thoughts on the evolution of Islamic higher education in Indonesia, focusing on three main elements: continuity, conflict of interests, and the future vision of Islamic education. This study uses a qualitative approach with a library research method. The primary data sources are Lukens-Bull's key works, such as A Peaceful Jihad: Negotiating Identity and Modernity in Muslim Java, as well as his journal articles related to the development of Islamic universities in Indonesia. This study found three crucial points in Lukens-Bull's thinking. Continuity, because Islamic higher education continues to maintain the roots of the pesantren tradition as a moral and intellectual identity. Lukens-Bull calls this “Peaceful Jihad,” where modernization is carried out without abandoning the essence of religiosity. Conflict, due to the emergence of tensions between the demands of global academic standardization (Western) and the preservation of traditional Islamic values. Conflict also occurs at the epistemological level in efforts to integrate religious and general knowledge. Future Direction, because Lukens-Bull projects Indonesian Islamic higher education as a model for the global Muslim world in managing diversity and democracy through a “hybrid” curriculum that balances professional skills with moral-religious character. Lukens-Bull's thinking emphasizes that Islamic higher education in Indonesia is at the forefront of redefining the relationship between Islam and modernity. The future of this institution depends on its ability to manage internal and external conflicts while remaining faithful to its mission of inclusive community service.
