Abstract

Arbitrase menjadi salah satu opsi dalam penyelesaian sengketa selain Pengadilan. Prosesnya yang cepat dan murah menjadi pilihan para pihak. Namun tidak jarang adanya ketidakpuasan terhadap putusan Arbitrase, yang membuat para pihak mengajukan pembatalan ke Pengadilan. Kasus dalam tesis ini meneliti terkait dua putusan pengadilan dalam pembatalan putusan arbitrase internasional, Putusan Nomor 88 PK/Pdt.Sus-Arbt/2014 dan Putusan Nomor 86/ PN/ Jkt.Pst/2002. Kasus di Putusan tersebut bermula ketika terjadi Putusan Arbitrase dan salah satu pihak tidak menyetujui Putusan tersebut, kemudian melakukan permohonan pembatalan di Pengadila Jakarta Pusat. Tujuan penelitian ini untuk menganalisis kompetensi Pengadilan Negeri di Indonesia dalam membatalkan putusan Arbitrase Internasional dan pertimbangan hakim dalam memutus perkara. Peneltian ini menggunakan metode yuridis normative, dengan pendekatan kasus (Case Approach), (Statue Approach), dan (Comparative Approach). Tesis ini menggunakan sumber bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Metode analisis data ini menggunakan normative kualitatif.Hasil penelitian menunjukan bahwa kompetensi pengadilan negeri Jakarta pusat dalam membatalkan putusan arbitrase internasional adalah tidak berwenang selama putusan arbitrase itu tidak dilakukan di Indonesia. Putusan Nomor 88 PK/Pdt.Sus-Arbt/2014, putusan Hakim sudah sesuai dengan UU Arbitrase terkait pembatalan Putusan Arbitrase pada Pasal 70 tidak dapat di buktikan dan Konvensi New York 1958 pada Pasal 5 Ayat 1 huruf e. Sedangkan Putusan Nomor 86/ PN/ Jkt.Pst/2002 Hakim tidak mendasarkan pada UU Arbitrase maupun dasar hukum pembatalan putusan arbitrase yang lain, hakim menilai bahwa keadaan Indonesia yang sedang krisis dan membuat hakim menyetujui pembatalan putusan arbitrase internasional.

Abstract

In the globalization era, there is less respect to the marriage institution due to the influence from different concepts of marriages from different countries. In the Indonesian context, one of the reasons comes from misunderstanding towards the nature of family law i.e. Marriage Law Number 1 Year 1974. Better understanding for all Indonesian to the law from phylosophical point of view is an essential effort to achieve the goal of marriage itself. Abstract

The validity of a covenant must meet 4 conditions, namely an agreement that binds him, the ability to make an agreement, about a certain matter, and a lawful cause. One example is in the Supreme Court Decision Number 655 K / Pdt / 2014 and Review Decision Number 636 PK / Pdt / 2016, there are differences in decisions regarding the Deed of Sale and Purchase and the Deed of Granting Rights of Dependents on the basis of a mock agreement. This study aims to analyze the validity of the sale and purchase deed and the deed of granting dependent rights as well as the legal consequences for the auction winner based on a mock agreement. The research method used is normative juridical, with a statutory approach, a conceptual approach, and a case approach. The data used in this study are secondary data obtained from literature studies. The results of the research obtained are the Validity of the Deed of Sale and Purchase of land rights based on receivables in the Supreme Court Decision Case Number 655 K / Pdt / 2014 states that the Sale and Purchase Deed made by PPAT is invalid and null and void. This is because in making the Deed of Sale and Purchase by PPAT based on the temple agreement made by a Notary, it does not meet the material requirements of an authentic deed, namely the non-fulfillment of the elements of a halal cause as stipulated in Articles 1335 and 1337 of the Civil Code, thus it also cancels the crossing out of the name in the land certificate from the Plaintiff to the Defendant carried out by BPN. In the decision of Review Decision Number 636 PK / PDT / 2016 stated that the Deed of Sale and Purchase and Deed of Granting Rights of Dependents were valid and there was no pretend agreement. The winner of the auction based on the Minister of Finance Regulation No. 93/2010 on auction implementation guidelines is the buyer who submits the highest bid and is certified as the winner of the auction by the Auction Officer. Article 41 paragraph (1) of Government Regulation No. 24/1997 on land registration explains that the transfer of land rights through transfer of rights by auction can only be registered if proven by quotation of auction minutes made by auction officials.

Abstract

Pencatatan perkawinan beda agama dilaksanakan melalui  penetapan pengadilan. Tujuan dalam penelitian ini adalah untuk mengetahui dasar pertimbangan hukum hakim pengadilan negeri Jakarta Utara Nomor: 423/Pdt.P/2023/Pn.Jkt.Utr dalam mengabulkan permohonan pencatatan perkawinan beda agama dan  mengetahui akibat hukum dikeluarkannya Surat Edaran Mahkamah Agung Nomor 2 Tahun 2023.  Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian preskriptif. Sumber data yang digunakan adalah data sekunder. Metode pengumpulan data dilakukan dengan studi kepustakaan. Berdasarkan penelitian diperoleh hasil bahwa hakim dalam memutus perkara Nomor: 423/Pdt.P/2023/Pn.Jkt.Utr. mempertimbangkan ketentuan Pasal 35 Huruf a Undang – Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, Pasal 50 ayat (3) Peraturan Menteri Dalam Negeri Republik Indonesia Nomor 108 Tahun 2019 tentang Peraturan Pelaksanaan Peraturan Presiden Nomor 96 Tahun 2018 Tentang Persyaratan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil, serta fakta bahwa Para Pemohon menikah secara Katholik. Putusan tersebut bertentangan dengan Surat Edaran Mahkamah Agung Nomor 2 Tahun 2023 tentang Petunjuk Bagi Hakim Dalam Mengadili Perkara Permohonan Pencatatan Perkawinan Antar-Umat yang Berbeda Agama dan Kepercayaan dan Pasal 2 Ayat (1) jo Pasal 8 Huruf f Undang- Undang Nomor 1 Tahun 1974 tentang Perkawinan. Sehingga, hakim seharusnya dapat menambahkan kedua peraturan tersebut sebagai dasar pertimbangannya. Surat Edaran Mahkamah Agung Nomor 2 Tahun 2023 melahirkan akibat hukum perkawinan beda agama tidak dapat dicatatkan secara administratif kependudukan dan menutup celah hukum bagi perkawinan beda agama untuk mendapatkan pengakuan melalui penetapan pengadilan.

Abstract

Tender pada dasarnya harus dilaksanakan dengan adil dan terbuka. Meskipun demikian, terdapat perilaku yang mendorong para pihak melakukan persekongkolan tender. Komisi Pengawas Persaingan Usaha (KPPU) telah banyak memutus kasus persekongkolan tender, salah satunya melalui Putusan KPPU Nomor 23/KPPU-L/2018. Perbedaan kedua putusan terletak pada pendapat Majelis Hakim Pengadilan Negeri Medan yang membatalkan putusan KPPU Nomor 23/KPPU-L/2018. Penelitian ini bertujuan menganalisis kedudukan Peraturan Komisi Pengawas Persaingan Usaha dalam Hukum Persaingan Usaha di Indonesia serta menganalisis penerapan Peraturan Komisi Pengawas Persaingan Usaha Nomor 2 Tahun 2010 tentang Pedoman Pasal 22 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Persekongkolan Dalam Tender dalam Putusan yang dikaji. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan undang - undang, pendekatan konsep dan pendekatan kasus. Penelitian menggunakan data sekunder yang didapat dari studi kepustakaan. Data disajikan dengan deskriptif normatif dan dianalisis menggunakan metode normatif kualitatif. Hasil penelitian menunjukkan bahwa Peraturan Komisi Pengawas Persaingan Usaha dapat menjadi dasar hukum hakim untuk memutus sengketa persekongkolan tender. Putusan KPPU Nomor 23/KPPU-L/2018, menerapkan hukum sesuai dengan peraturan perundang-undangan.Kata Kunci: Indikasi Persekongkolan; Peraturan Komisi; Persekongkolan Tender.

Abstract

This article critically examines the structural incapacity of Indonesian law to anticipate and regulate the transformation of natural resource exploitation into vectors of national security risk. Operating within the normative-doctrinal tradition, the study adopts statute, conceptual, and case-based legal approaches to interrogate the triadic relationship between corporate actors, ecological destruction, and political violence. The central argument advanced is that Indonesian law sustains a paradox: it simultaneously authorises resource extraction as a developmental imperative while failing to acknowledge that extractivism generates structural grievances which may radicalise affected communities, thereby constituting a pre-terrorism environment. Green criminology serves as the analytical framework, augmented by ecological justice theory, Rawlsian distributive philosophy, and Critical Legal Studies. Doctrinal analysis reveals that the Mineral and Coal Mining Law (UU Minerba), the Environmental Protection and Management Law (UUPPLH), and the Anti-Terrorism Law (UU Terorisme) operate in regulatory silos, producing normative gaps through which corporations escape accountability for harms that transcend environmental categories and enter the domain of human-ecological security threats. Case analysis of PT. Kallista Alam, PT. Adei Plantation, and related litigation demonstrates that courts have yet to articulate a jurisprudential framework linking corporate environmental crime to security consequences. This article concludes by proposing a 'Green Security Law Framework' an integrated normative architecture reconciling environmental, security, and counterterrorism law as the prescriptive response to a legal deficit that renders the Indonesian state structurally complicit in its own security vulnerabilities.

Abstract

AbstractLegal protection for the auction buyer/auction winner means that there is legal certainty of the auction winner's rights to the goods he bought through the auction, obtaining the goods and material rights to the goods he purchased or in other words the auction winner can control the auction object which he has legally and materially. And if there is a lawsuit, the winner of the auction should not participate as a defendant. This study discusses how the legal protection for the auction winner of the execution of mortgage over the control of the auction object and the obstacles experienced in the legal protection for the auction winner of the execution of the mortgage over the mastery of the auction object. The method used in this research is the normative juridical method, carried out through a literature study which examines mainly secondary data. The law has guaranteed legal certainty for auction buyers which is clearly stated in Vendu Reglement, HIR, and PMK Number 106/PMK.06/2013 concerning Amendments to PMK Number 93/PMK.06/2010 and PMK Number 93/PMK.06 /2010 Concerning Auction Implementation Guidelines. The Vendu Reglement is a regulation that regulates the basic principles of auction which has been in effect since April 1, 1908. In general, the Vendu Reglement only regulates the implementation of auctions, the auctioneer or currently referred to as the auction official, the parts and contents of the auction minutes. Article 42 of the Vendu Regulation states that the winner of the auction has the right to obtain a quote from the minutes of the auction as a deed of sale and purchase of the object of the auction. The excerpt of the minutes of the auction which will later be used as a deed of sale and purchase for the benefit of changing the name of the auction object if the object being auctioned is an immovable object. Keywords: Execution, Mortgage, Legal Protection, Auction Winner. AbstrakPerlindungan hukum terhadap pembeli lelang/pemenang lelang berarti adanya kepastian hukum hak pemenang lelang atas barang yang dibelinya melalui lelang, memperoleh barang dan hak kebendaan atas barang yang dibelinya atau dengan kata lain pemenang lelang dapat menguasai obyek lelang yang telah dimilikinya secara yuridis maupun secara materiil. Dan apabila terjadi gugatan, seharusnya pemenang lelang tidak turut serta sebagai tergugat. Penelitian ini membahas bagaimana perlindungan hukum bagi pemenang lelang eksekusi hak tanggungan atas penguasaan obyek lelang dan hambatan-hambatan yang dialami dalam perlindungan hukum bagi pemenang lelang eksekusi hak tanggungan atas penguasaan obyek lelang. Metode yang digunakan dalam penelitian ini yaitu Metode yuridis normatif dilakukan melalui studi pustaka yang menelaah terutama data sekunder. Undang-undang telah menjamin kepastian hukum bagi pembeli lelang yang secara jelas dinyatakan dalam Vendu Reglement, HIR, serta PMK Nomor 106/PMK.06/2013 Tentang Perubahan Atas PMK Nomor 93/PMK.06/2010 dan PMK Nomor 93/PMK.06/2010 Tentang Petunjuk Pelaksanaan Lelang. Vendu Reglement merupakan peraturan yang mengatur prinsip-prinsip pokok tentang lelang yang telah berlaku sejak 1 April 1908. Secara umum Vendu Reglement hanya mengatur tentang penyelenggaraan lelang, juru lelang atau saat ini disebut sebagai pejabat lelang, bagian-bagian serta isi dari risalah lelang. Dalam Pasal 42 Vendu Reglement, menyatakan bahwa pemenang lelang berhak memperoleh kutipan risalah lelang sebagai akta jual beli obyek lelang. Kutipan risalah lelang mana nantinya akan dipergunakan sebagai akta jual beli untuk kepentingan balik nama obyek lelang apabila yang dilelang adalah benda tidak bergerak.Kata kunci: Eksekusi, Hak Tanggungan, Perlindungan Hukum, Pemenang Lelang

Abstract

As public officials, Land Deed Officials (PPAT, Pejabat Pembuat Akta Tanah) must comply with the rules in the PPAT Position Regulation, including the primary duties, authorities, prohibitions, and PPAT Code of Ethics. This study examines the role of PPAT and the legal consequences of grant deeds canceled by the panel of judges in Supreme Court Decision Number 503K/Ag/2015. This type of research is normative juridical with statutory, conceptual, and case approaches. The data used is secondary data from primary, secondary, and tertiary legal materials. The results show that Muslim Indonesians are subject to the rules in the Compilation of Islamic Law and the Compilation of Sharia Economic Law and use the Religious Courts to resolve disputes. Grant legal acts must be legalized with a Grant Deed, which is the authority of PPAT. In making a Grant Deed, the PPAT must examine the origin of the granted property. The pillars and conditions of grants in KHI and KHES are cumulative and must be fulfilled. The grant can be canceled if one of the elements is not fulfilled. In the case of grant deed Number 112/II/GB/2003, the PPAT needed to fully carry out its role correctly. Despite having carried out duties by several articles in Government Regulation No. 37/1998 jo PP No. 24/2016, the PPAT violated Article 22 and the precautionary principle in the PPAT Code of Ethics. As a result, the grant deed was declared to have no legal force by the Panel of Judges of the Supreme Court. This research shows that violations by PPAT in making grant deeds can cause the deed to be invalid and null and void, eliminating legal certainty for the parties involved. PPAT's adherence to the rules and the precautionary principle is essential to ensure the legal validity of the deed made.
