Abstract

Pembangunan suatu negara hampir mustahil dilakukan jika hanya bermodalkan dana dari dalam negeri semata. Untuk itulah diperlukan investasi yang berasal dari luar negeri. Dalam rangka mendatangkan investor asing tersebut, maka diperlukan regulasi yang mendukung dan memudahkan investor untuk menanamkan modalnya tersebut. Dalam konteks Indonesia UU Penanaman Modal dibuat untuk memudahkan investor asing masuk ke Indonesia, sehingga banyak pasal yang termaktub ternyata bertentangan dengan UUD 1945 yang menjadi pedoman dan acuan dalam membuat aturan yang ada dibawahnya. Politik hukum seperti ini tentunya dikhawatirkan akan memberikan dampak negatif bagi keadulatan ekonomi nasional. Penguasaan serta kemudahan yang diberikan keapada investor asing tersebut akan memarginalkan potensi-potensi sumber dana dan sumber daya yang berasal dari dalam negeri. Abstract

The insurance program for fishermen must be continued and developed to guarantee the future life of fishermen's families. Currently the government has provided insurance policies to fishermen from Sabang to Merauke. Fishermen's Insurance Premium Assistance is considered very important, to guarantee fishermen who die and disappear on the high seas while working. Fishermen need to be guaranteed protection for their lives and work accidents they experience, the impact of that is that fishermen's families and even fishermen themselves have the confidence to carry out their activities at sea. The form of government attention in carrying out an effort aimed at protecting fishermen and their families through the provision of the Insurance Premium Assistance Program for Fishermen (BPAN). Law of the Republic of Indonesia Number 07 of 2016 concerning the Protection and Empowerment of Fishermen, Fish Farmers and Salt Farmers has regulated the provision of protection for work risks experienced by fishermen through the provision of insurance. Providing insurance through the Insurance Premium Assistance Program for Fishermen (BPAN) is a program to guarantee better fishermen's activities in the fishing business, so that the rights and obligations of fishermen become clear and will be protected in their fishing business activities. However, the fishermen's insurance premium assistance program is still not running effectively, many fishermen do not know about it and the implementation of socialization has not been evenly distributed. As a result, fishermen do not know how to be registered as beneficiaries of fishermen's insurance benefits, how much they actually have to get and how to get it (claims) if they experience risks in working as fishermen

Abstract

Penggunaan mata uang virtual yang dihasilkan dari sistem kriptografi. Sistem ini menjamin kemanan mata uang sehingga mata uang tersebut tidak dapat dipalsukan. Uang virtual tengah mendominasi Indonesia yaitu bitcoin. Problem formulations for this journal are; bagaimana kedudukan kripto (cryptocurrency) sebagai mata uang dalam transaksi bisnis berdasarkan hukum di Indonesia?, bagaimana pengawasan penggunaan kripto (cryptocurrency) sebagai komoditas perdagangan berjangka menurut hukum positif di Indonesia?, dan Bagaimana perlindungan hukum terhadap nasabah pengguna kripto (cryptocurrency) sebagai komoditas perdagangan berjangka menurut hukum positif di Indonesia? This research is normative legal research accompanied by supporting data. The research data was collected through literature study. The analysis was carried out using qualitative methods. Based on the research results, it is concluded that: First, Kedudukan kripto (cryptocurrency) dalam transaksi bisnis berdasarkan UU Nomor 7 Tahun 2011 tentang Mata Uang tidak diakui sebagai alat pembayaran yang sah, (cryptocurrency) diakui secara sah sebagai komoditi yang dapat diperdagangan melalui perdagangan berjangka. Second, Pengawasan penggunaan kripto (cryptocurrency) sebagai komoditas perdagangan berjangka berdasarkan Pasal 1 angka 3 Undang-Undang Nomor 10 Tahun 2011. Abstract

The rapid development of information and communication technology has affected human development throughout the world. Technological advances in the digitalization era have been made by humans to facilitate human activities such as accessing information and knowledge so that humans can do many things in a short time. Cases of immoral crimes almost always occur in Indonesia and attract public attention. The level of immoral crimes in Indonesia is very high and varied. The perpetrators of immoral crimes also range from children, adults, to the elderly, even early childhood. Two components consist of immoral crimes: norms of decency and norms of decency. In order to function as a basis for providing a sense of justice and legal certainty to the people of Indonesia, the norms of decency play a very important role. This research is normative legal research, namely legal research that places law as a building system of norms. Pornographic crimes that occurred in the Republic of Indonesia are clearly contrary to the principles held by Indonesian society. Pornography crimes often cause concern for the community. The Electronic Information and Transaction Law is a provision that applies to anyone who commits legal acts whether within the scope of Indonesian jurisdiction and/or outside Indonesian territory and causing harm to Indonesia's interests

Abstract

Tulisan ini bertujuan menjelaskan formulasi kebijakan terkait peran FKPPI sebagai organisasi kemasyarakatan dan subjek pembangunan nasional. Jenis kajian ilmiah ini adalah yuridis normatif, dengan pendekatan perundang-undangan, dan data yang dianalisis adalah data sekunder melalui metode studi dokumen, sedangkan analisis data dilakukan secara kualitatif. Hasil analisis menunjukkan dalam rangka mewujudkan tujuan negara dan tujuan FKPPI sebagai organisasi kemasyarakat, maka setiap pengurus dan anggota FKPPI perlu memainkan perannya sebagai subjek pembangunan, dengan cara: (1) meningkatkan iman dan taqwa; (2) meningkatan kesadaran kebangsaan; (3) menumbuhkan dan meningkatkan semangat pengabdian; (4) mendorong terciptanya perekonomian nasional sebagai usaha bersama; (5) mengembangkan tatanan sosial ekonomi yang mandiri; (6) mendorong, mengembangkan dan meningkatkan terselenggaranya pendidikan, serta pelatihan ketenagakerjaan; (7) menciptakan, mempersiapkan dan meningkatkan kualitas untuk menjadi kader yang berdaya guna, serta berwawasan kebangsaan; dan (8) menjalin kerjasama dan menciptakan suasana kekeluargaan dengan sesama potensi Ormas. FKPPI adalah salah satu ORMAS di Indonesia, yang harus mendukung pelaksanaan kebijakan atau regulasi yang telah dibuat oleh pemerintah, dengan demikian perlu direkomendasikan bahwa FKPPI hendaknya dapat mengambil peran sebagai subjek pembangunan guna mewujudkan tujuan negara, selain tentunya harus berpedoman pula pada tujuan ORMAS yang disebutkan dalam UU ORMAS dan tujuan FKPPI yang telah ditentukan Anggaran Dasar dan Anggaran Rumah Tangga FKPPI. This paper aims to explain policy formulations related to the role of FKPPI as a community organization and subject of national development. This type of scientific study is normative juridical, with a statutory approach, and the data analyzed is secondary data through the document study method, while data analysis is carried out qualitatively. The results of the analysis show that in order to realize the goals of the state and the objectives of FKPPI as a community organization, every board and member of FKPPI needs to play its role as a subject of development, by: (1) increasing faith and piety; (2) increasing national awareness; (3) cultivate and increase the spirit of devotion; (4) encourage the creation of the national economy as a joint effort; (5) develop an independent socio-economic order; (6) encouraging, developing and improving the implementation of education, as well as employment training; (7) creating, preparing and improving the quality to become effective cadres, as well as national-minded; and (8) establish cooperation and create a family atmosphere with fellow potential CSOs. FKPPI is one of the CSOs in Indonesia, which must support the implementation of policies or regulations that have been made by the government, thus it needs to be recommended that FKPPI should be able to take a role as a subject of development in order to realize state goals, besides of course it must also be guided by the objectives of CSOs mentioned in the Law on CSOs and the objectives of FKPPI that have been determined by the FKPPI Articles of Association and Bylaws.

Abstract

Pengawasan dibidang perikanan perlu dilakukan, sebab sumber daya perikanan yang potensial yang merupakan berkah dari tuhan yang maha esa dapat tetap terjaga dan lestari. Undang-Undang Nomor 45 Tahun 2009 tentang Perubahan Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan, memberikan tuntunan mengenai pengelolaan sektor perikanan yang berkelanjutan dan memberikan ancaman pidana bagi pelaku yang merusak sumber daya laut, namun tindak pidana dibidang perikanan masih terjadi. Tujuan dari penelitian ini adalah untuk memberikan solusi hukum dalam melakukan pengawasan tindak pidana perikanan melalui peran serta masyarakat. Kebijakan pengawasan dalam pengelolaan sumber daya perikanan salah satu sumber data dalam penelitian ini. Tahapan yang akan dilakukan adalah persiapan dan pelaksanaan penelitian dengan mengumpulkan data-data atau informasi lapangan melalui dokumen untuk dianalisis. Metode pada penelitian ini adalah yuridis normatif, yaitu mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan. Pengawasan tindak pidana perikanan selama ini dilakukan dengan cara normatif menggunakan hukum positif yaitu undang-undang perikanan dan kebijakan lainnya seperti peraturan daerah. Pengawasan telah dilakukan oleh pemerintah maupun masyarakat secara bersama maupun masing-masing. Kegiatan penyuluhan atau sosialisasi aturan dibidang perikanan dan bahkan sampai pada tindakan menghukum pelaku sudah dilakukan agar tindak pidana tersebut tidak terjadi lagi. Tetapi faktanya masih terjadi berbagai perbuatan yang dapat merusak sumber daya kelautan. Karena itu, perlu dilakukan peningkatan peran masyarakat dalam menjaga dan melestarikan laut agar sumber daya yang terkandung didalamnya dapat berkelanjutan

Abstract

Business activities are broader than trade, because the scope of business activities is not only trade, but covers broader fields such as production, processing, distribution, trade/marketing, export-import, procurement of goods/services, labor recruitment services, business consulting services , credit, credit guarantees, insurance, business cooperation, investment, mass media, property, capital markets, and others. The concept of resolution is that a private judge is not bound by various formalities, is quick in giving decisions, because it is in the final instance and is binding, which is easy to implement because the parties will obey it. Juridically based on Article 1 point 1 of Law no. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution (UUAAPS) arbitration is a method of resolving a civil dispute outside the general court which is based on an arbitration agreement made in writing by the parties to the dispute. The Supreme Court of the Republic of Indonesia said that ADR is a concept of cooperative resolution of conflicts or disputes outside of court which is directed at an agreement or solution to a conflict or dispute that is "win-win". What is meant by a "win-win" solution is a solution or agreement that is able to reflect the interests or needs of all parties involved in the conflict (shared interest).

Abstract

Horizontal conflicts occurred after the UUPD came into effect because there were regulations regarding changes in marine zoning for small fishing communities. Meanwhile, the authority of the district/city government over coastal areas and small islands has been regulated in the UUPWP3K that the authority of the regional government to manage coastal and small island resources. This study aims to analyze the provisions of laws and regulations on regional government and coastal area management as regulated in the regulations on coastal areas and small islands, and how to reconstruct the authority of the provincial government to the district/city government as before. The research method used is normative legal research. Normative legal research is research that is carried out or directed at legislation, namely the relationship between one regulation and another and its relation to implementation in practice. The results of the study show that since the UUPD came into effect, the authority to manage the marine and fisheries sector as well as coastal areas and small islands by the district/city government has been reduced. The zoning area of 0-4 miles which was originally managed by the district/city government is now managed by the provincial government, thus making the provincial authority zoning 0-12 miles

Abstract

The form of BUMD governance as a regional company as regulated in UUPD and PPBUMD consists of Regional Public Companies (Perumda) and Regional Limited Companies (Perseroda). The establishment of Perumda is in the form of regional regulations based on regional needs and the feasibility of the business field of the Perumda to be formed. Perumda is a BUMD whose entire capital is owned by one region only and is not in the form of shares. One of the important organs in a company is the board of directors. The board of directors who control the company in daily activities has the authority to determine policies in carrying out its powers and obligations in managing the company must have good intentions, be responsible, have integrity, be honest, and be highly dedicated to advancing and developing the company. The board of directors is fully responsible personally for the company's losses if the person concerned is guilty or negligent in carrying out his duties. The board of directors can take or carry out actions to facilitate his duties as long as it is within the scope of his duties and obligations and does not conflict with customs, fairness, and propriety. Implementation of the business judgment rule (BJR) doctrine as a form of protection given to directors in carrying out their duties and responsibilities in running the company. Business decisions or actions taken by directors are intended to manage the company professionally according to their expertise to generate profits for the company, even though there are risks from these decisions and actions that can cause losses for the company

Abstract

The issuance of Law Number 1 concerning Financial Relations Between the Central Government and Regional Governments has had a negative effect on foundations. Based on the results of the study, it was found that the regulation on the provision of BPHTB reduction or exemption facilities owned by foundations is an order from Law Number 28 of 2009 concerning Regional Taxes and Regional Levies, which was then followed by the issuance of Law Number 20 of 2000 concerning Amendments to Law Number 21 of 1997 concerning Land and Building Acquisition Fees. The issuance of Law Number 1 of 2022 concerning Financial Relations between the Central Government and Regional Governments (HKPD) eliminates these facilities. There is a lack of synchronization in the implementation of Law Number 1 of 2002 with the regent/mayor regulations regarding the provision of BPHTB reduction or exemption facilities for foundations, considering that these regulations are still based on the old law.
