Abstract

Tujuan perkawinan adalah membentuk suatu keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Untuk mencapai tujuan tersebut diperlukan sosialisasi peraturan perundang-undangan bagi masyarakat dan penegakan peraturan oleh pejabat Pemerintah yang berwenang. Peneliti ini bertujuan untuk mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum yang positif yang kemudian dihubungkan dengan pembahasan yang menjadi pokok pembahasan. penelitian hukum yuridis normatif dilakukan dengan cara mengkaji aturan hukum bersifat formil seperti undang-undang, peraturan serta literatur yang berisi konsep-konsep teoritis. Hasil penelitian mendeskripsikan berdasarkan Deskresi yang dimiliki Kepala Desa diterbitkan Surat Keterangan Pernikahan oleh Kepala Desa dan Perangkat Desa Banjarsari Bekasi kepada masyarakat Desa yang melakukan pernikahan secara siri/dibawah tangan. Hal ini dimaksudkan untuk memberikan keringanan dalam memenuhi syarat administrasi untuk pembuatan dokumen penting. Berdasarkan peraturan perundang-undangan yang berlaku, Kepala Desa dan Perangkat Desa tidak memiliki legal standing untuk menerbitkan Surat Keterangan Nikah sehingga berpotensi melakukan pelanggaran Undang-Undang No. 1 Tahun 1974 tentang Perkawinan, Undang-Undang No. 30 Tahun 2014 tentang Administrasi Pemerintahan yang mengakibatkan Surat Keterangan Nikah tidak sah menurut hukum serta kepada Kepala Desa dapat dikenakan sanksi administrasi.

Abstract

Perkawinan sebagaimana diamanatkan Undang-Undang Perkawinan, disamping dilangsungkan sah menurut hukum masing-masing agamanya dan kepercayaannya, tiap-tiap perkawinan juga harus dicatat menurut peraturan perundang-undangan yang berlaku. Dalam kasus disini perkawinan hanya dilakukan berdasarkan adat istiadat serta agama dan kepercayaan yang dianut saja, tanpa dicatatkan menurut peraturan perudang-undangan yang berlaku. Metode yang dipergunakan adalah yuridis normatif dan pengumpulan data dilakukan melalui penelitian kepustakaan, yakni studi dokumen/kepustakaan yang terdiri dari bahan hukum premier dan bahan hukum sekunder. Berdasarkan hasil penelitian dapat disimpulkan bahwa suatu perkawinan harus dilakukan menurut hukum agamanya masing-masing dan dicatatkan pada kantor catatan sipil, sebagaimana diatur dalam pasal 2 ayat (1) dan (2) Undang-Undang Perkawinan. Agama mempuyai peranan penting untuk menentukan sah atau tidak sahnya suatu perkawinan dikarenakan agama mempuyai kekuatan yang sakral yang nantinya akan kita pertanggungjawabkan dihadapan Tuhan Yang Maha Esa. Sah atau tidaknya suatu perkawinan bukan ditentukan oleh pencatatan melainkan disyaratkan dengan langsung secara hukum agama masing-masing. Pencatatan merupakan hal yang penting dalam hukum Indonesia, tapi tidak mengurangi keabsahan perkawinan bila tidak dicatatkan.

Abstract

Marriage is a common thing in society with ubudiyyah elements in it. However, legal issues often accompany the sanctity of the marriage bond itself, such as the cancellation of a marriage due to an element of coercion from a third party. Article 71 Compilation of Islamic Law (KHI) states that one of the reasons for being able to apply for a marriage cancellation is because of coercion when the marriage took place. The purpose of this study is to analyze the meaning of the phrase "coercion" as a reason for annulment of marriage and its accompanying legal implications. This type of research is classified as normative-empirical legal research using a statutory approach and a conceptual approach plus a sociological approach as a tool. This research refers to a variety of primary, secondary and tertiary legal materials compiled and traced through literature studies and interviews with judges of the Religious Courts. The legal materials that have been collected are then analyzed descriptively and analytically. The results showed that what is meant by coercion in marriage is a marriage that occurs not because of one's own will or feels that he is under threat. As a form of legal consequence, annulment of a marriage by force is different from divorce, where the marriage bond that occurred before the breakup of the marriage is considered never to have occurred.

Abstract

Halal certification is a written fatwa of the MUI which states the halalness of a product in accordance with Islamic law. This halal certificate is a requirement to include a halal label so that a product is suitable for consumption by Muslim consumers. Business actors must meet certain requirements and go through a series of processes that have been determined by the MUI to obtain a halal certificate. After obtaining a halal certificate, business actors obtain a halal label from the MUI to then be included on the product label. This halal certificate is only valid for a certain period of time and business actors must extend it to obtain halal certification for their products again. Whereas the problem arises when Law Number 8 of 1999 concerning Consumer Protection does not make halal certification and labeling a mandatory form for business actors, but is voluntary. Therefore, it can be said that halal certification and halal labeling do not have strong legal legitimacy, so they do not provide legal protection and certainty for halal food products for consumers.

Abstract

Disputes over child custody often occur after a divorce. Although the regulation on child custody has been regulated in the Marriage Law and Compilation of Islamic Law (KHI), it is allegedly not responsive enough to gender justice that gives child custody to one party based on the particular type genitals. So this triggers gender inequality and injustice. This article analyses the problem of establishing child custody descriptively analytically with a gender approach as a tool of analysis. This article concludes that the laws and regulations in Indonesia regarding the determination of child custody are still classified as gender-biased and have not been responsive enough to the issue of gender justice. Reciprocal interpretation model (qira'ah mubadalah), as a new approach in understanding the text, if applied in following the rules can be interpreted with the perspective of distinction between men and women who place women and men as human subjects that are whole and equal. Thus, both mothers and fathers alike have the same opportunities in child custody as long as they have qualified abilities in terms of childcare.

Abstract

Perkawinan bagi masyarakat Indonesia dilakukan dengan itikad baik untuk membangun keluarga sepanjang hidup. Perjanjian kawin dikenal oleh masyarakat barat untuk mengatur harta warisan dan hak-hak individu, termasuk dalam perencanaan keuangan dan perlindungan aset. Sesuai perkembangan zaman, kondisi perjanjian perkawinan pun mulai dikenal oleh masyarakat Indonesia. Perjanjian kawin yang dilakukan oleh pasangan di Indonesia saat ini merupakan bentuk dari kesepakatan sosial, bahkan ada yang menganggap perjanjian kawin adalah hal yang tidak lazim dilakukan. Selain itu kerangka hukum terkait perjanjian kawin di Indonesia belum memiliki kekuatan hukum yang kuat dan dianggap tidak wajar melakukan perjanjian perkawinan.  Pada dasarnya perjanjian kawin memiliki potensi besar untuk melindungi hak-hak perempuan dalam perkawinan. Namun, keberhasilannya sangat tergantung pada kesadaran masyarakat, kesetaraan gender, dan dukungan hukum yang kuat. Perjanjian kawin akan sangat menguntungkan pada saat terjadinya perceraian, namun dalam hal terjadinya perceraian karena kematian maka perjanjian kawin tersebut menjadi harta waris bagi keluarga yang ditinggalkan. Penelitian ini fokus pada perjanjian kawin yang berdampak pada harta waris. Mengunakan  metode penelitian normative, penelitian ini melakukan analisis terhadap undang-undang perkawinan, KUH Perdata, Kompilasi Hukum Islam dan peraturan perundangan lainnya yang relevan.  Penelitian ini juga melakukan konsistensi dasar hukum perjanjian dalam hukum perkawinan di Indonesia.

Abstract

Perlindungan data pribadi merupakan bagian dari hak asasi manusia yang perlu memiliki dasar hukum untuk memberikan keamanan terhadap data pribadi, sesuai dengan amanat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Artikel ini bertujuan untuk mengkaji perlindungan data pribadi adalah untuk memastikan hak warga negara terhadap perlindungan diri pribadi serta untuk meningkatkan kesadaran masyarakat akan pentingnya pengakuan dan penghormatan terhadap pelindungan data pribadi. Analisis ini meliputi tinjauan terhadap peraturan perundang-undangan terkait, studi kasus, serta teori perlindungan hukum dan data pribadi.

Abstract

The monetary turmoil that occurred in 1998 plunged Indonesia into an economic crisis that had an unfavorable impact on the national economy, which at the time was dependent on foreign investment. In the end, to help improve the economy in Indonesia, the Government at that time took action to ask for assistance from the International Monetary Fund (IMF). The injection of funds from the International Monetary Fund (IMF) provided conditions for the Government of Indonesia to establish new bankruptcy regulations from the commonly used Dutch Bankruptcy Law of 1905 (Faillissements-Verordening, Staatsblad 217/1905 and Staatsblad 348/1906) so that the Government issued Government Regulation in Lieu of Law Number 1 of 1998 concerning Amendments to the Bankruptcy Law. In PERPPU 1/1998, it provides easy bankruptcy application requirements where the conditions only require 2 creditors and one of the creditors has a debt that has matured. Until Law No. 37/2004 on Bankruptcy and PKPU was enacted, the requirements for bankruptcy applications remained unchanged, so this paper aims to analyze the requirements for filing bankruptcy applications, which tend to be pro-creditor, so that it is straightforward to put debtors in a state of bankruptcy or PKPU, where the existence of the Bankruptcy and PKPU Law should provide help for debtors to find a solution to the debt pressure that has hit the debtor.

Abstract

Customary law is a collection of norms and rules derived from the habits or customs of the community, both written and unwritten. Marriage is a physical and mental bond between a man and a woman with the aim of building a family that is sakīnah, mawaddah, rahmah and barakah. The provisions of customary law and Islamic law have significant differences. Marriage in Islamic law regarding joint property and mutual inheritance between adopted children and adopted parents can be done through the institution of mandatory wills. These two legal provisions adopted from customary law are the result of the ijtihad of Indonesian scholars, because the second issue is not found in fiqh. This innovative creation of Indonesian scholars, apart from being a manifestation of the dynamic and creative characteristics of Islamic law, is also the identity of Islam Nusantara in the field of law. Seen from this aspect, the Indonesian KHI, in the language of the Law, can be referred to as Indonesian Jurisprudence because in addition to having an Indonesian personality, it also adopts customary law that lives in local traditions.

Abstract

A bank credit agreement is a standard agreement whose contents are determined unilaterally by the bank, with the aim of efficiency. Micro, small, and medium enterprises have an important role in economic development and growth. Small and medium enterprises often enter into banking credit agreements for business development. Due to the COVID-19 pandemic, the Indonesian government issued Presidential Decree No. 12 of 2020 stipulating the Determination of Non-Natural Disasters for the Spread of Corona Virus Disease 2019 (COVID-19) as a National Disaster. COVID-19 has had an impact on aspects of people’s lives. One of them has an impact on the decline in the economic capacity of the community which in turn can result in the debtor not fulfilling the achievements in the banking credit agreement. This study uses a normative juridical research method. The data collection method that the author uses is a literature study/documentation, namely data collection in a literature/document study is an activity of tracing, checking, and reviewing secondary data. The results of the research on the implementation of banking credit agreements are the fulfillment of the contents of the agreement in the form of implementation and obligations that have been agreed upon in the banking credit agreement. The COVID-19 pandemic has affected the implementation of banking credit agreements. The COVID-19 pandemic affects the ability of debtors to carry out their achievements. The government through the OJK issued POJK Number 48/POJK.03/2020, which is a regulation to provide restructuring to debtors. The COVID-19 pandemic can also be used as an excuse for debtors to experience force majeure. However, not all debtors are categorized as experiencing force majeure.
