Abstract

Observing a lot of land conflicts in Indonesia which is constantly increasing, and followed by the rapidly growing populations that caused the demand for land will also increase automatically. While the number of the available land is limited (not increasing). This condition will surely causes problems on controlling and ownership of the land. This research aims to identify the factors which causes conflict (dispute) of land, by doing inventory to the lands which is owned by the community (whether it is registered or not registered). From this temporary research result, it is known that, the implementation of the land registration in Deli Serdang district (the research location) has not happened as expected. It can be seen from the number of land which has not been registered, this condition will certainly trigger conflicts or disputes in society, both ownership boundary disputes, control of illegal land (arable land), inheritance disputes, etc. Certificate ownership mostly only exist in urban area. The lack of interest by the community to join the land registration is due to various of reasons, which is: 1) the community do not recognized the purpose of land registration, 2) the cost is expensive, 3) the management is convoluted, 4) the community feels that it is not a necessary to do it, 5) arable land. In this research, the role of National Land Agency (NLA) as the organizer of land registration has not been surely prominent, it is visible that the NLA office is more passive, which is only waiting for the arrival of the owner land to register their lands, NLA should be more involved in land registration and followed by socialization, counseling for the community. As well for the land disputes which is in the region of the Land Office until this moment is currently unfinished and still having a lot of problems, in order to achieve the above purpose, Deli Serdang Land Office has taken steps by empowering all the existing abilities, it has been a huge duty for Land Office, by remembering there will be more and more usage and utilization in the future, while the available land is limited, and hoping that the community will be motivated to registered their lands for achieving the legal certainty.

Abstract

Undang-Undang Pokok Agraria Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria dalam Pasal 19 untuk memberikan kepastian hukum mengenai hak-hak atas tanah bagi rakyat Indonesia, maka kepentingan pemilik hak atas tanah tersebut dilindungi. Putusan pengadilan yang telah mempunyai kekuatan hukum tetap mempunyai kekuatan mengikat bagi para pihak yang terkait didalamnya untuk patuh dan taat pada putusan tersebut. Permasalahan dalam penelitian ini mengeni kedudukan hukum putusan pengadilan negeri yang sudah berkekuatan Hukum terhadap pembatalan sertifikat tanah. Perlindungan hukum terhadap para pihak. Analisa yuridis pertimbangan hukum hakim dalam putusan Pengadilan Negeri Tarutung Nomor 40/Pdt.G/2017/PN.Trt. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif atas aturan-aturan perundangan baik ditinjau dari sudut hirarki peraturan perundang-undangan (vertikal), maupun hubungan harmoni berupa putusan pengadilan (horizontal). Sedangkan sifat penelitian ini adalah deskriptif analitis. Hasil penelitian adalah kedudukan hukum putusan pengadilan negeri terhadap pembatalan sertifikat hak milik atas tanah yang tidak menempuh upaya hukum banding merupakan tahap akhir dalam pemeriksaan perkara dipengadilan. Perlindungan hukum terhadap para pihak yang bersengketa dalam putusan perkara tersebut dimana penggugat melakukan gugatan ke Pengadilan Tata Usaha Negara (PTUN) Pertimbangan hukum hakim dalam putusan Pengadilan Negeri Tarutung nomor 40/Pdt.G/2017/PN.Trt, terhadap sengketa kepemilikan hak atas tanah harus melakukan gugatan ke pengadilan negeri dengan gugatan perbuatan melawan hukum atas pembatalan sertifikat hak milik melalui Pengadilan Tata Usaha Negara atau melalui Badan Pertanahan Nasional.

Abstract

This research aims to explore in-depth the registration of the transfer of inheritance rights sourced from an agreement among heirs made before a notary. However, the registration of the transfer of rights, according to Article 37 of Government Regulation No. 24 of 1997 on Land Registration, can only be registered if proven by a deed made by a land deed official (PPAT). Consequently, there is a discrepancy in implementing the inheritance transfer according to Article 111 paragraph 3 of Regulation of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency No. 16 of 2021, which can be made in the form of an underhand deed by all heirs witnessed by 2 (two) witnesses or by a deed of inheritance division made before a notary. This research is classified as normative, and the data is analyzed qualitatively. The results indicate that an agreement is a crucial element in an agreement, where Article 1320 of the Civil Code emphasizes that an agreement is a requirement for the validity of an agreement. The agreement related to the inheritance object carried out by the parties can override what is regulated in inheritance law as long as it meets the elements of Article 1338 and does not violate Article 1321 of the Civil Code. To make the agreement a perfect evidence, it should be made before a notary with a notarial deed as referred to in Article 1870 of the Civil Code.

Abstract

Problems in the issuance of Management Rights Certificates are land problems that commonly occur in Indonesia as well as the resistance carried out by Tekardjo Angkasa against PT. Inalum (Persero). The problem studied is the existence of PT. Inalum (Persero) as the owner of Management Rights, legal certainty over civil ownership rights based on the basis of land certificate rights owned by Tekardjo Angkasa and legal considerations by the panel of judges in case Number 43/G/2022/Ptun-Mdn. The research method used is normative legal research which is presented descriptively. The research approach is carried out through the case approach method and the statutory approach. Data sources are obtained from primary, tertiary and secondary legal sources. Data is processed qualitatively and deductively inferred. The result of this research is the existence of PT. Inalum (Persero) obtained from state land in the form of contradictory decisions. SKT mer ownership

Abstract

Penelitian ini bertujuan menciptakan pembangunan berkelenjutan dalam bidang usaha pada sektor perkebunan dan menjadi perhatian yang sangat khusus dan strategis dalam mewujudkan perlindungan hak asasi manusia dan pembangunan ekonomi negara. Menurut teori keadilan yang dikemukakan L.A. Hart maka penegakan hukum yang adil seharusnya tidak memberikan penerapan diskriminatif terhadap subjek hukum tertentu. Metode penelitian ini menggunakan 274 putusan pengadilan sejak tahun 2015 - 2022 yang mengadili persoalan kepemilikan lahan Perkebunan antara Masyarakat dan Perusahaan. Hasil Analisa berdasarkan data putusan pengadilan memutuskan 274 putusan perkara penggunaan lahan perkebunan dijatuhkan sanksi pidana kepada Masyarakat dan tidak ada putusan yang menjatuhkan sanksi pidana terhadap korporasi. Terdapatnya inkonsistensi penegakan hukum pidana terhadap pelaku usaha perkebunan di dasarkan pada terjadinya disharmoni atas Pasal 14 Undang-Undang Nomor 6 tahun 2023 tentang Cipta Kerja dengan Undang-Undang Nomor 39 Tahun 2014 Pasa 107 tentang sanksi pidana dan administrasi atas pelanggaran terhadap lahan perkebunan. Kesimpulan dari penelitian ini terdapatnya inkonsistensi yang menimbulkan diskriminasi penerapan sanksi terhadap korporasi dengan masyarakat pelaku usaha perkebunan yang melakukan tindak pidana Pasal 107 Undang-Undang Nomor 39 tahun 2014 tentang Perkebunan.

Abstract

One of the main issues that arises when investors plan to make investments in Indonesia is the transfer of land rights to one of the five investment barriers, which are connected to obstacles to land certification, building licenses, and land zoning. This effort discusses how problems involving land transfers are handled by national criminal law and how giving foreign investors legal certainty is achieved by the effectiveness of criminal legislation against land transfers. The aim of this research is to find out whether criminal law can resolve disputes related to the transfer of land rights so as to provide certainty and security for foreign investors regarding the transfer of land rights. by investigating problems through normative legal research or legal research carried out in libraries using a jurisprudential approach and theory of legal objectives, we will get solutions to existing problems so that this research provides qualitative research results based on the data and theory used. The study's findings lead to the conclusion that Article 52, paragraphs (1) and (2) of the UUPA, which deals with criminal laws against the transfer of land rights, regulates the criminal law of land area for its infringement. The form of attained legal certainty in the transfer of land rights for investors is provided by the effectiveness of criminal law in enforcing the law against communities that occupy property over the subject matter.

Abstract

This study examines land ownership conflicts over abandoned land in Hamlets I and V of Bandar Baru Village, Sibolangit District, Deli Serdang Regency, within the framework of Indonesian agrarian law. As a strategic resource, land management must be carried out in accordance with Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia and Law Number 5 of 1960 concerning Basic Agrarian Regulations. This study aims to analyze the factors causing land ownership conflicts and the legal resolution of disputes occurring in the area. The research employs an empirical juridical method with a qualitative approach. Data were obtained through library research and field studies in the form of structured interviews with the National Land Agency (BPN) of North Sumatra, legal counsel, and the communities of Hamlets I and V of Bandar Baru Village. The findings indicate that the land ownership conflict has not yet reached a definite legal resolution due to the absence of legal certainty regarding the status of the land and the indecisiveness of the National Land Agency in addressing overlapping land claims. This condition has triggered prolonged conflicts between the community and the government concerning land control and utilization. In addition, weak land administration and the lack of optimal coordination among government institutions have hindered the realization of legal certainty and agrarian justice. This study recommends a comprehensive, transparent, and equitable reorganization of land legal status through inventory and verification of land rights by involving communities that have historically controlled and utilized the land.

Abstract

The dynamics of the convergence of telematics law within the national legal system, notably in the area of land, are represented by the Minister of Agrarian Affairs and Spatial Planning's Regulation Number 5 of 2020, which also serves as the head of the National Land Agency. One of the effects of land digitization is the Ministerial Regulation, which has changed the mortgage rights registration process from a traditional system to an electronic or digital one. Despite being virtual, the digitalization of Mortgage Rights registration involves actual legal actions with clear legal ramifications. The Land Deed Official is directly involved in the electronic execution of Mortgage Rights, which is governed by the Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency number 5 of 2020. The objective of this study is to investigate the consequences of the convergence of the Law on Mortgage Rights and the Telecommunication Law. This convergence results in the creation of digital-based Mortgage Rights via an integrated Electronic Mortgage Registration system, which is also known as the Electronic Mortgage System. The role and obligations of the Land Deed Official are also affected by this. This study employs a prescriptive, normative-juridical methodology. Based on the research findings, it is known that the conversion of the collateral registration system from a traditional system to a digital system is affected by the convergence of telematics legislation and the law of collateral guarantees. Because of the discord and breakdown of the Mortgage Law, the Electronic Information and Transactions Law, and the Regulations of the Land Deed Official, this also affects the status and legal obligations of the Land Deed Official, who fails to maintain the principle of justice..
