Abstract

The purpose of this writing is to analyze the developer's responsibility for canceling home purchases by prospective buyers. This paper uses a normative type of writing. The approach used is an economic analysis approach to law that serves to overcome legal problems and assess the impact of the application of certain legal rules. Based on the analysis, it shows that the developer is domiciled as a seller and the prospective buyer has not been domiciled as a buyer because the sale and purchase transaction occurs when the parties have signed PPJB. Then, the developer's responsibility related to the cancellation of the purchase of a house by a prospective buyer before the existence of PPJB is to make a refund of the money paid by the prospective home buyer as regulated by Article 22H Paragraph (2) PP 12/2021 which is a form of the principle of absolute responsibility of the developer. The refund of the purchase of the house is preceded by an agreement on the amount of money that can be returned, where the prospective buyer can only get a maximum refund of 80% of the amount paid. Abstract

The purpose of this research is to describe the impact of freedom to learnon Kampus Merdekaat Karyadarma University, Kupang, East Nusa Tenggara, Indonesia. This research was carried out with the Survey Method. The subject of this research is the entire academic community of Karyadarma University Kupang which consists of Lecturers, Education Personnel and Students. The data collection techniques and instruments used in this research are survey techniques using online questionnaires developed by the Spada Dikti Team. The data obtained were analyzed using descriptive analysis techniquesand regresianalysis. The result showed that the impact of freedom to learnon Kampus Merdekaat Karyadarma University Kupang is reflected through the implementation of the learning process, improvement of student soft and hard skills, improvement of student skills and capacity building of lecturers and education staff. The correlation of knowledge about freedom to learnin Kampus Merdekawith an increase in student soft and hard skills and an increase in student skills is in the weak category, while the correlation of knowledge about freedom to learnin Kampus Merdekawith an increase in lecturer capacity is in the high category

Abstract

This qualitative empirical study investigates leadership styles in formal organizations. The study utilized purposive sampling to select informants, and data was collected through observation and interviews. The snowball model was employed when data saturation was achieved. The qualitative descriptive analysis of the data involved data collection, classification, reduction, and interpretation. The study findings indicate that leaders in formal organizations predominantly utilize collaborative, participative, and democratic leadership styles, with occasional employment of autocratic style in specific situations. Transformational leadership style is less commonly observed, particularly in the public sector, while there is an emerging trend towards its adoption in the private sector. The study highlights that the participative leadership style involves decision-making through selection, the democratic style is based on election, and the transformative leadership style is rooted in education.

Abstract

A traditional village is a traditional institution that has the authority to regulate all activities of indigenous peoples and non-indigenous people who are active and live in their territory.This study aims to analyze the form of business entity for traditional villages in Bali to managinga tourism village as well as models and forms of investment between traditional villages in Bali and investors for the development of tourism villages in their area. The type of research used is normative juridical legal research with statutory and conceptual approaches. The results of the study show that the form of business entity that can be formed by traditional villages in Bali in managing tourist villages in order to facilitate investment from investors is BUPDA in accordance with Bali Regional Regulation No. 4 of 2019. Then, the investment model between traditional villages in Bali and investors in the development of tourist villages is by making joint operation cooperation agreements and partnership cooperation agreements as well as agreements in the capital aspect with the condition that investors are not allowed to take all or part of BUPDA ownership as village managers tourism in accordance with Bali Regional Regulation No. 4 Year 2022.

Abstract

Perekonomian Bali yang selama ini bertumpu pada sektor pariwisata memerlukan pilar alternatif untuk dapat menopang kokoh struktur perekonomiannya. Berbagai peristiwa di masa lalu telah menunjukan bagaimana kerentanan sektor pariwisata tatkala terjadi gangguan baik yang bersumber dari internal maupun eksternal. Kini, ekonomi kreatif digagas sebagai salah satu alternatif yang potensial menjadi sumber pendapatan di masa depan serta pilar penyangga perekonomian Provinsi Bali. Penelitian ini menggunakan pendekatan analisis deskriptif yang bersumber pada berbagai literatur dan data terkini serta bertujuan untuk memberikan gambaran profil industri pariwisata dan ekonomi kreatif di Provinsi Bali. Hasil penelitian ini diharapkan bermanfaat bagi pengambilan kebijakan oleh pemangku kepentingan dalam upaya untuk mengembangkan industri pariwisata dan ekonomi kreatif di Provinsi Bali.

Abstract

Tujuan dari ditulisnya artikel ini adalah untuk mengkaji dan menganalisis pertanggungjawaban pidana perusahaan swasta atas tindakan menghalang-halangi pemenuhan hak tenaga kerja kerja penyandang disabilitas. Penelitian ini menggunakan metode normatif serta analisis deskriptif yuridis. Berdasarkan hasil penelusuran menunjukkan bahwa belum adanya kejelasan aturan terhadap tindakan menghalang-halangi oleh perusahaan swasta dalam pemenuhan hak tenaga kerja penyandang disabilitas. Kemudian, pertanggungjawaban pidana perusahaan swasta dalam tindakan menghalang-halangi pemenuhan hak tenaga kerja penyadang disabilitas termasuk pertanggungjawaban korporasi karena subjek hukumnya perusahaan swasta adalah badan usaha yang berbadan hukum. Bentuk pertanggungjawaban pidana perusahaan swasta adalah pertanggungjawaban pengganti atau vicarious liability. Oleh sebab itu, jika terbukti adanya kesalahan korporasi dalam hal ini perusahaan swasta terhadap pemenuhan hak tenaga kerja penyandang disabilitas sebagaimana diatur dalam Pasal 145 UU Penyandang Disabilitas, maka pengurus korporasi dapat bertanggung jawab atas pelanggaran tersebut.
