Abstract

Research problems: What is the maqashid al-syariah perspective regarding someone who gives divorce outside the court? Research purposes: knowing the losses (mafsadat) due to divorce outside of court from the perspective of maqashid al-syariah. Research methods; using normative legal research (library research). Research results show that Divorce outside a court session is not permitted from a maqashid al-syariah perspective, even though it is permitted according to the Qur'an and hadith. Still, both imply indirectly that Islam allows divorce but, on the other hand, hopes that divorce will not occur. Divorce outside of court can disturb children's mental health. Children who were originally in a harmonious and loving family are suddenly in a family environment that is the opposite; their children are also feared to be vulnerable to falling into the company of alcohol and illegal drugs; the status of children is unclear according to the lawn causing the court to have no legal power to force the ex-husband to provide maintenance to the ex-wife during the iddah period; shelter, clothing, food and to their children too.

Abstract

One of the pillars of Islam is paying zakat. Zakat is part of the assets we have that we must spend if we have reached the specified conditions. For Muslims who have the means, of course they are obliged to pay zakat, for example when paying zakat fitrah in the month of Ramadan. Zakat will be distributed to people who are entitled to receive it. The existence of the obligation of zakat is stated in the Koran and must be believed by every Muslim. The purpose of zakat is to train our caring attitude towards the people around us, and to become a form of obedience of Muslims to Allah SWT. in fulfilling obligations. In giving zakat we need to be sincere, without expecting anything in return. Because by giving zakat, the blessings we get do not decrease but increase. However, there are still Muslims who are reluctant to contribute to paying zakat due to their lack of awareness of zakat obligations and the wisdom of zakat itself. Therefore, there is a need for further explanation regarding what zakat is, what its benefits are, what the law is in Islam and the wisdom of giving zakat.

Abstract

Infak is a voluntary social charity institution run by one person and the owner has the freedom to determine the type of assets and level of assets to be issued. Infak can be used to help ease the burdens of others and also increase devotion to God Almighty. Apart from that, donations can impact religious activities, for example helping fund the construction of a mosque. This research was carried out to learn more about donations' implications in mosque construction. This research uses a normative literature study method, namely by conducting literature research; with collection techniques through written sources. With this research, it is hoped that students will be able to pay more attention to the surrounding conditions that need help

Abstract

The State of Indonesia is a state based on law, so for Indonesian people who are Muslim when they enter into a marriage, they must obey and comply with the Marriage Law (UUP) and the Compilation of Islamic Law (KHI), because UUP and KHI are legal products resulting from the government's (leader) ijtihad in regulating marital problems in Indonesia. The purpose of this study is to understand and analyze the obligation to comply with the Marriage Law and the Compilation of Islamic Law from the perspective of maqashid sharia. The research method used uses a descriptive-qualitative approach, with the type of library research with data sources based on Presidential Instruction (Inpres) No. 1 of 1991 concerning the Compilation of Islamic Law (KHI) and Law Number 1 of 1974 concerning Marriage (UUP) and materials -Other library materials. The results of this study prove that the basic obligation to comply with the Marriage Law (UUP) and the Compilation of Islamic Law (KHI) is because both are products of government ijtihad (ulil amri). The government's ijtihad is a manifestation of the thoughts and agreements of all the Indonesian people who have been represented by the DPR. So that the obligation to comply with UUP and KHI in the perspective of Maqashid Sayariah is mandatory because it brings benefit and avoids harm. The marital status of husband and wife and children born are legal and protected by law.
