Abstract

A large oil drilling project located in Alaska, United States, called Willow aims to explore significant oil reserves. Although the project is intended to increase fossil fuel production in the region, its impacts have raised concerns worldwide because of its potential to produce significant carbon emissions. These emissions could exacerbate climate change worldwide and threaten local Alaskan ecosystems, including flora and fauna that are vulnerable to noise and air pollution. These effects could also disrupt nearby communities that rely heavily on a clean and healthy environment. The Willow Project’s compliance with international environmental law—specifically the Paris Agreement—is evaluated through case study and normative juridical methods. One of the responsibilities of signatory countries to this agreement is to reduce carbon emissions that will limit global warming. The findings show that the Willow Project is in conflict with this commitment and shows that the United States is not on board with its efforts to combat climate change. In addition, the study examines how the Willow Project impacts human rights, particularly the right to a clean environment. Many issues relate to transparency and accountability because the public is not sufficiently involved in the decision-making process of the project. The results of this study confirm that stricter international regulations must be implemented and greater oversight is needed for high-risk energy projects. Therefore, the international community must push for decisive action to ensure environmental sustainability and human rights protection in the future.

Abstract

Pendaftaran Koperasi merupakan salah satu hal yang penting dilakukan oleh pendiri Koperasi untuk memperoleh status badan hukum. Hal ini mengingat jika badan usaha tidak disahkan oleh pemerintah dan tidak didaftarkan maka berdasarkan undang-undang yang berlaku, kedudukan Koperasi tidak bisa melakukan perbuatan hukum karena Koperasi belum berbadan hukum. Hal ini juga berdampak pada tidak terlindunginya hak para anggotanya. Pada praktiknya, tidak semua Koperasi memiliki akta pendirian termasuk belum didaftarkan, salah satunya Koperasi ABYAKTA. Sementara, Koperasi ini sudah berdiri sejak 2021 dan telah memiliki 20 orang anggota, anggota telah membayar simpanan pokok dan simpanan wajib. Oleh karena itu, penyuluhan ini penting dilakukan untuk memberikan edukasi bagi para pengurus dan anggota mengenai pentingnya dilakukan pendaftaran dan segera membuat akta pendirian untuk mendapatkan pengesahan dari Negara. Kegiatan penyuluhan diselenggarakan dalam bentuk sosialisasi dan diskusi terkait UU No. 25 Tahun 1992 khususnya mengenai tata cara pendirian dan prosedur pendaftaran Koperasi. Pada saat diskusi dan tanya jawab, para peserta sangat antusias dan memperoeh feedback yang positif, hal ini ditandai dengan tercapainya kesadaran peserta mengenai perlunya penyusunan akta pendirian Koperasi berikut penyusunan anggaran dasarnya. Dari kegiatan ini, akan ditindaklanjuti dengan pendampingan lebih lanjut, khususnya memberikan konsultasi informal dalam rangka percepatan pembuatan akta pendirian sekaligus pendaftaran Koperasi ABYAKTA

Abstract

Penyuluhan ini lebih mefokuskan pada upaya peningkatan pengetahuan dan kesadaran tentang bahaya penyalahgunaan narkoba di kalangan remaja dan upaya pencegahannya. Dengan target sasaran peserta adalah para siswa/I Kls.12 SMA Bunda Kandung. Pendekatan yang digunakan dalam bentuk sosialisasi dan pengambilan kuesioner kepada para siswa/i SMA. Dari pelaksanaan penyuluhan ini diharapkan akan dapat membentuk peer grup yang akan mentransformasikan kembali pengetahuan yang te telah diperoleh peserta kepada teman sebaya lainnya sehingga ada keberlanjutan informasi. Manfaat yang diperoleh dari kegiatan ini adalah meningkatkan pemahaman siswa/i terkait bahaya narkoba dan membangun kesadaran siswa/i untuk mencegah penyalahgunaan narkoba serta cara mencegahnya.

Abstract

Children’s right of participation legitimized in national and international instruments. It is giving children right be hear, to express their views and opinios in matters affecting them significantly, such as the climate crisis. However, exercising this rights still faces various obstacles. This study will describe an analysis of restrictions on children's participation as obstacles to fulfilling children's rights in the law-making process to assuring child involvement can be implemented. As a normative research, this study will examine legal literature materials. The finding shows that children's participation in the policy-making process is faced with the assumption of adults who use age and maturity as benchmarks. This is not in line with the meaning in the Convention on the Rights of the Child which has legally provided legal certainty for children to have the right to participate and make decisions without limiting them solely by age. The Convention only states that children are given the right to participate with a weight that is appropriate for the child. Therefore, policy makers should be able to provide a broader interpretation to children so that these restrictions do not become obstacles. It is necessary to take into account the perspectives of children and uphold the best interests of the child premise to achieve intergenerational equity as a whole.

Abstract

This paper aims to analyze the relevance of the Coordinating Ministry in carrying out the functions of synchronization and coordination among state ministries in the administration of government in Indonesia, and to compare it with practices in several countries that adopt a Presidential system. The research employs a normative juridical method with statutory, conceptual, and comparative approaches. The findings indicate that the Coordinating Ministry plays a strategic role in maintaining policy coherence among ministries. However, overlapping authority with other ministries that also possess coordinative functions, coupled with the relatively large number of Coordinating Ministers, has the potential to hinder government effectiveness if not managed properly. A comparative study with Presidential countries such as the United States, the Philippines, Brazil, and South Korea suggests that governmental coordination can be carried out more efficiently by a single office or specialized institution. Therefore, this study recommends a reduction in the number of Coordinating Ministers in Indonesia and the strengthening of a single strategic coordinating institution under the President, as well as the possibility for the Vice President to assume a coordinating role when directly mandated by the President.

Abstract

This study aims to uncover the problems that arise in asymmetric warfare, which are different from the challenges in conventional warfare. The main focus of this study is the challenges of implementing International Humanitarian Law (IHL) in the context of asymmetric warfare, involving state and non-state actors. This study identifies the challenges in implementing IHL principles, such as the principles of distinction, proportionality, and humanity that are often violated. In addition, this study also highlights global political constraints, especially the veto power in the UN Security Council and the involvement of foreign countries, which hinder the enforcement of international law. The results of the study show that although the international legal framework has been established, its application in asymmetric warfare such as in Aleppo requires in-depth evaluation and strengthening of fairer and more independent accountability mechanisms.

Abstract

Masyarakat adat merupakan kelompok masyarakat yang rentan terpinggirkan dalam agenda pembangunan manusia. Suku Laut sebagai salah satu kelompok masyarakat adat yang bergantung pada laut dalam kesehariannya akan sangat terancam hak atas lingkungannya di masa krisis iklim. Tulisan ini bertujuan untuk menganalisis keselarasan peraturan perundang-undangan mengenai lingkungan di tingkat nasional dan daerah dengan Agenda 2030 Sustainable Development Goals dan konvensi-konvensi internasional terkait. Penelitian dilakukan secara normatif dengan studi kepustakaan melalui pendekatan peraturan perundang-undangan yang berlaku dan pendekatan konseptual atau gagasan, yang kemudian dianalisis secara deskriptif kualitatif. Konsep perlindungan masyarakat adat dengan hak-hak tradisional termasuk hak lingkungan telah dirumuskan dalam Konstitusi yang diturunkan pada peraturan perundang-undangan di bawahnya sampai ke peraturan daerah tingkat kabupaten. Rancangan Undang-Undang Masyarakat Hukum Adat yang menjadi payung hukum utama tingkat nasional penting untuk memuat ketentuan tentang jaminan hak-hak atas lingkungan sebagai hak tradisional bagi masyarakat yang dapat memberikan perlindungan komprehensif bagi masyarakat adat di tengah krisis iklim.

Abstract

The protracted crisis of refugees as a marginal group is often neglected to fulfill their fundamental rights and well being in the sustainable development agenda. This paper aims to analyze well being indicators of refugees in the sustainable development agenda. The method used is normative research through literature study with a conceptual and analytical approach. The term of refugee are not written explicitly in the sustainable development agenda indicators as of they should be aligned with the general goals of the sustainable agenda, as well as institutional strengthening through policy reform, long-term financing, and requiring active cooperation from various actors in managing and fulfilling refugees fundamental rights, especially for hosting countries and humanitarian institutions at the global and national level.

Abstract

This study investigates the jurisdictional capacity of the African Court on Human and Peoples' Rights (AfCHPR) in adjudicating transnational human rights violations, with a focus on the Democratic Republic of Congo’s (DRC) case against Rwanda concerning alleged support for the M23 rebel group. Drawing on normative legal methods and qualitative analysis, the paper examines the limitations of DRC's domestic judicial system in addressing grave human rights abuses, particularly in conflict zones marked by institutional fragility, corruption, and impunity. Despite legal reforms and ratification of major human rights instruments, the DRC remains unable or unwilling to ensure accountability for violations, especially those involving foreign actors. In response to these systemic shortcomings, the DRC has turned to the AfCHPR, marking a significant legal milestone as the first inter-state case before the Court. The paper explores the legal foundations for the AfCHPR’s jurisdiction under regional and international instruments, while also analysing Rwanda’s objections concerning admissibility and territorial competence. By assessing relevant case law, including Zongo v. Burkina Faso and Ogiek v. Kenya, the research highlights the AfCHPR's growing legitimacy as a regional mechanism for human rights enforcement. This case signals a broader shift toward accountability and justice in Africa, challenging traditional notions of sovereignty in favour of state responsibility and victim protection.

Abstract

Indonesian business actors are often in unfavorable bargaining positions on international contract transactions. Mainly is caused by inconsistency between KUHPerdata as the legal instrument and its implementation. This paper aims to explain how KUHPerdata and CISG determine the bargaining position then analyze CISG normatively as the best legal instrument option to improve Indonesian business actors and lift up its unfavorable position. Research method uses normative legal conduct by statute and comparative approaches. KUHPerdata and CISG are primary legal instruments in comparison while supported with the best practices in Vietnam and China. Result shows that KUHPerdata holds at least four crucial weaknesses which leads to an unfavorable position for its beared actors. On the other hand, CISG could overcome those weaknesses with the fundamental breach concept as its effective limit manifestation. By ratifying CISG and adopting the best practices in Vietnam and China would improve Indonesian beared actors bargaining position in international contract transactions.
