Abstract

Penelitian yang berjudul “Perlindungan Hukum Terhadap Kreditor Apabila Objek Jaminan Fidusia Ternyata Hilang Dan Debitor Wanprestasi (Studi Kasus di PT. Bank Perkreditan Rakyat Dinamika Bangun Arta Salatiga)” adalah untuk mengetahui bagaimana penyelesaian kredit bermasalah terhadap objek jaminan fidusia yang hilang dan apabila debitor wanprestasi pada PT. Bank Perkreditan Rakyat Dinamika Bangun Arta Salatiga dan untuk mengetahui sampai sejauh mana perlindungan hukumnya.Penelitian ini menggunakan metode pendekatan yuridis empiris. Spesifikasi dalam penelitian ini bersifat deskriptif analitis, dimana sumber datanya adalah data primer dan data sekunder.Penyelesaian kredit bermasalah dalam hal objek jaminan fidusia yang ternyata hilang dan apabila debitor wanprestasi pada PT. Bank Perkreditan Rakyat Dinamika Bangun Arta Salatiga ternyata dilakukan dengan cara yang sama yaitu : melakukan pendekatan secara kekeluargaan; melakukan penagihan secara langsung ke debitor; melakukan analisa ulang terhadap kredit; dan melakukan tindakan litigasi.Perlindungan hukum terhadap kreditor dalam hal jaminan fidusia adalah sampai sejauh mana eksekusi dapat dilakukan. Apakah kreditor dalam posisi safety untuk melaksanakan eksekusi dengan dokumen pengikatan kredit dan agunan yang ada. Pengikatan agunan secara fidusia harus didaftarkan, dimana akta jaminan fidusia harus didaftarkan pada Kantor Fidusia Kementerian Hukum dan Hak Asasi Manusia Republik Indonesia, sehingga terbitlah Sertifikat Jaminan Fidusia yang mempunyai kekuatan eksekutorial yang sama dengan putusan pengadilan yang telah memperoleh kekuatan hukum yang tetap. Kreditor juga mempunyai hak untuk menjual benda yang menjadi objek jaminan fidusia melalui pelelangan umum serta melakukan pelunasan utang dari hasil penjualan, atau penjualan di bawah tangan yang dilakukan berdasarkan kesepakatan bersama antara para pihak, dimana penjualan secara sukarela ini biasanya melalui penyerahan secara sukarela dari debitor kepada bank untuk melunasi hutang debitor. Kata Kunci : Perlindungan Hukum Kreditor Apabila Objek Jaminan Fidusia Ternyata Hilang Dan Debitor Wanprestasi

Abstract

Abstract. The purpose of this study was to: 1) To Know and analyze the application of the principle of notary prudence In Knowing the applicant. 2) To Detect and Analyze Effects Of Authentic And Notary Deed Not Applying the Precautionary Principle  In Knowing the applicant. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by the method of description and interpretation.Based on the results of data analysis concluded that: 1) The principle of recognizing User Services as referred to in paragraph (1) at least includes identification of User Services, User Verification Transaction Monitoring Services and User Services. Reporting to the Financial Transaction Analysis and Reporting Center (PPATK) is recommended if it is believed their suspicions of money laundering schemes will be carried out, the registration obligation remains to be done, the registration once for serving. Reporting through the application system GRIPS (Gatahering Report Information Processing System). 2) an authentic deed which turned out later proven to be pecucian money, then it becomes the responsibility of the applicant own. Notaries who do not register GRIPS, will apply sanctions in the form of the temporary closure of access to AHU account on line, and thus access to the system notary Legal Administration (SABH) will be automatically blocked.Keywords: Notary; Precautionary Principle; Protection.

Abstract

The research entitled The Application of Pacta Sunt Servanda Principle In Testament Made Before Notary in Perspective of Justice has problem formulation: 1) How is the application of pacta sunt servanda principle on testaments made before the present notary ?, 2) What legal effect arises when The testamen made before the notary does not apply the principle of pacta sunt servanda in the perspective of justice? And 3) How is the application of pacta sunt servanda principle to testament made before Notary in the perspective of justice ?.The results of this research are 1) The application of pacta sunt servanda principle on testaments made before the present notary can be described that the implementation of pacta sunt servanda principle is required at all stages, either before, during or after the process of making the testament deed. 2) Any legal effect that arises when a testament made before a notary public does not apply the principle of pacta sunt servanda in the perspective of justice is that the testament is essentially a statement made unilaterally by the testamenter set forth in a deed that must be executed by the will . 3) The application of the principle of pacta sunt servanda to the testament made before the Notary in the perspective of justice is that in the making of this testament it must be adhered to two principles namely, firstly, giving equal rights and opportunities to the widest freedom of the broadest extent of equal freedom for each person. Abstract

The purpose of this study was to describe the shape and scope of the Development and Supervision PPAT and for Knowing Function and Purpose Implementation and Monitoring of the PPAT developing and to know the effects in Implementation of Development and Supervision of the Land Deed Official (PPAT) Semarang.This study uses the Juridical Sociological Approach. The method used is Qualitative Research Methods in the form of observations, interviews, or review of documents.The form and scope of guidance and supervision over the PPAT in Semarang done by conducting seminars, debriefing and sharing the latest information in the world of PPAT or the development of new regulations and land surrounding PPAT. Direct guidance in the sense of providing direction directly linked PPAT, Application function of supervision by the Land Deed Official Officials at the Land Office of Semarang walk quite optimal in accordance with the legislation in force, hanya only in terms of the emergence of new regulations concerning the Council of Trustees and the Supervisory Officer of the Land Deed at the central level, region and area is still in the formation process and the preparation of Inhibiting factors in the application function of supervision by the Land Deed Official Officials at the Land Office of Semarang. The ratio between the number of PPAT by the number of clerks Land Office Land Office allows limited ability to be able to perform to the maximum guidance and supervision of the PPAT in Semarang.Keywords: Guidance; Control; Land Deed Official (PPAT)

Abstract

The purpose of this study was to: 1) Analyze determine and analyze the role of the notary in the completion of the loan agreement with collateral Mortgage PT. Bank Tabungan Negara (Persero) Tbk. 2). Analyzing the causes of a default in settlement of loans with collateral Mortgage PT. Bank Tabungan Negara (Persero) Tbk. 3) Analyze the settlement of disputes in the credit agreement with collateral Mortgage PT. Bank Tabungan Negara (Persero) Tbk.This research is a field research or empirical research with sociological juridical approach. Sociolegal research done by researching in the field (field research) by means of interviews with respondents who are the primary data and researching library materials is a secondary data and also referred to the research literature. Analysis of data using Qualitative analysis.The research results are: 1) Task, responsibilities and authority of the Notary is a deed of credit agreement requested by the bank based on information that is clear, to legalize the deed of credit agreement, and is responsible for the correctness, accuracy, completeness of documents, provide counseling to clients / debtors , conceal the identity of the debtor's creditors, enter into a deed of the District Court registry book. 2) Notarial acts as a public official entitled to a deed of credit agreement. And provide legal certainty for the parties to the credit agreement. Besides the role of the Notary as well as the authorities to check against collateral in the form of Encumbrance to ascertain whether goods such guarantee was legal or not, or to avoid if there is a possibility in the collateral Mortgage were made in the warranty is still disputed law or case law. 3) Barriers faced by a Notary is a lack of understanding on banking borrowers, thus providing an explanation to the parties concerned to a mistake in making the agreement can be minimized.Keywords: Deed; Loan Agreement; Encumbrance.

Abstract

Jabatan Notaris terus menerus mengalami perkembangan dan perubahan sesuai dengan perkembangan zaman dalam artian perubahan-perubahan di dalam mempersiapkan para Notaris untuk kepentingan masyarakat, diantaranya diundangkannya perubahan atas Undang-Undang Jabatan Notaris (UUJN). Salah satunya adalah mengenai pengertian tentang minuta akta dan kewajiban Notaris melekatkan cap ibu jari/sidik jari tangan penghadap. Penelitian dengan judul ”Akibat Hukum Pembubuhan Sidik Jari Tangan Para Penghadap Pada Minuta Akta Notaris Sebagai Sempurnanya Akta Autentik Menurut Undang-Undang Jabatan Notaris, bertujuan  untuk mengetahui  prosedur pembubuhan sidik jari tangan para penghadap sebagaimana dinyatakan dalam UUJN, karena bila tidak dilaksanakan Notaris bisa mendapatkan sanksi administratif.Dalam hal ini pokok permasalahannya yaitu bagaimana prosedur pembubuhan sidik jari tangan para penghadap berdasarkan UUJN dan sampai sejauh mana sanksi yang dikenakan atas akta yang dibuatnya serta sanksi kepada Notaris sendiri jika tidak melakukan kewajiban tersebut.Metode penelitian yang dipakai adalah penelitian hukum normatif, dengan menggunakan metode analisis kualitatif, yang dilakukan dengan teknik Deskriptif dan Interpretasi, adapun jenis dan sumber datanya menggunakan data sekunder sebagai sumber utamanya, yaitu mempelajari aturan hukum, prinsip hukum maupun doktrin-doktrin hukum guna menjawab mengenai isu hukum yang dihadapi serta melakukan wawancara dengan Notaris/PPAT sebagai nara sumber.Kesimpulannya adalah Notaris wajib melakukan pembubuhan sidik jari tangan para penghadap sebagaimana tersebut pada UUJN yang mengatur hal tersebut. Apabila Notaris tidak melakukan pembubuhan sidik jari tangan para penghadap dapat terkena sanksi administratif sebagaimana diatur dalam Pasal 16 ayat (11). Terhadap kedudukan aktanya tetap sah dan mempunyai kekuatan pembuktian yang sempurna. Sudah seharusnya Notaris melakukan kewajiban pembubuhan sidik jari tangan para penghadap dalam pembuatan akta, sehingga amanat Pasal 16 ayat (1) huruf c terpenuhi dan akta yang dibuatnya akan lebih sempurna.Kata Kunci : Pembubuhan Sidik Jari, Minuta Akta

Abstract

Reading the deed is an obligation in every authentic deed is made, the reading of the deed by a notary is part of the verlijden or the inauguration of the reading and signing of the deed in question. If the reading of this deed is related to the making of an authentic deed which is part of perfect proof, it is clear that making a notary deed requires the real presence and physical position of the parties concerned. The purpose of this research is to analyze the Notary Public is obliged to read out the deed made based on Act No. 2 of 2014 concerning the Position of Notary Public, To analyze the legal problems of reading deeds made by the Notary, To analyze the legal consequences of deeds that are not read by a Notary based on Act No. 2 of 2014 concerning the Position of a Notary Public. The method used in this research is the method used in this research is juridical empirical, namely an approach based on applicable law and based on reality in practice. Where in Article 16 paragraph 7, it is stated that the reading of the deed is not mandatory, if the viewer wants the deed not to be read because the viewer has read it himself, knows and understands its contents, provided that it is stated in the cover of the deed and also on every minuta deed page initialed by the parties, and witnesses, as well as a notary. The legal consequence of the deed which is not read out by the notary based on Act No. 2 of 2014 concerning the Position of Notary Public, the deed which is not read out is still an authentic deed as long as the reasons for not reading the deed are stated.

Abstract

Submission of location permit is required in the provision of social facilities and public facilities. Licensing is a unified process in the housing that is from the beginning to the management stage. The research that the author did in the city of Semarang, Central Java province. The research method applied in this research is the sociological juridical approach.The results of this study are: The role of PPAT has not been directly due to the formation of regulations from the central government and in the city of Semarang has not involved PPAT in the formation of Regional Regulations Semarang City. Factors affecting PPAT in the delivery of public facilities (fasum) and social facilities (fasos) to the Government of Semarang City, the pre-transaction stage where the developer must already have all the relevant licensing in the pre-transaction process until after / after the transaction developer must providing all social facilities and social facilities as promised during the first bidding process. Legal consequences with future PPAT role is expected to provide infrastructure and facilities from initial procurement to delivery based on the principles of openness, accountability, legal certainty, written warning. Suggestion from this research is for PPAT should the process of procurement and management of public facility (fasum) and social facility (fasos) is arranged pursuant to agreement of sale and purchase agreement (PPJB), for Government of Fasum and Fasos which have finished development process should be submitted from the developer to Government so that the responsibility for the management of public facilities and fasos is in the government, and for the National Land Agency (BPN), there must be a harmonious relationship between PPAT and the Land Office as an equal partner.Keywords: Role of PPAT, Submission of Social Facility, Semarang City Government

Abstract

Research on "Juridical Review of Notice Deed and Notary Accountability (Case Decision Case Study No. 10 / Pdt.G / 2015 PNDmk) aims to know the process of making authentic deeds made before the Notary, the juridical reasons for the occurrence of authentic authenticity deed made by a Notary Public, the responsibility of a notary against the cancellation of the authentic deed already made.In the Decision of the case registers Number 10 / Pdt.G / 2015 / PN.Dmk in the District Court Demak has stated that the notarial deed and PPAT in the event of sale and sale is declared null and void because it does not meet the form of deed as referred to in Article 38 Undang -The Republic of Indonesia Number 2 Year 2014 Concerning Amendment to Law Number 30 Year 2004 Concerning Position of Notary and contrary to Article 1320 of the Civil Code regarding the legal terms of the agreement. Deed which is declared null and void is directly related to the roles and responsibilities of a notary public, is there any relation to the negligence of a notary since in the case of the notarial deed which plays the role of a deed determined by law is notary as an official authorized by law .Keywords: Notary Deed, Reason for Deed of Deed, Liability of Notary.
