Abstract

A prosperous nation is a nation that has a system of transparency and leadership trustworthy, honest, and intelligent sermons. Four things that become the basic law of nationality and the embodiment of leadership strength of law are evident. Corruption became a thorn, state institution run lameness healthy. The law became a thorn plucker should be included affirmation indiscriminately; there is no collusion and nepotism against any citizen there. Indonesia will be developed by 2020 on condition free of corruption. This fact would have been possible if it has a clean leader, law walk uprightly and fair, community synergies with trust laws and leaders. Leaders from the President to the price level as like; “civil organization” be absolutely necessary for the law and society. Free of strategy from corruption in 2020 is not likely to happen if the three pillars of the leaders, law and society work together with the unanimous support towards Indonesia clean of corruption. Abstract

According to UUD 1945 (the 1945 Constitution of Republic of Indonesia), where one of the inter-state institutions has correlation based on audit system and assessment is State Audit Board or Supreme Audit Board (BPK) is to investigate the management and accountability of state finances, there shall be a single Supreme Audit Board which shall be free and independent.The result of any investigation of state finances shall be submitted to The House of Representatives (DPR) in line with their respective authority. In handling corruption crimination cases in Indonesia, whether conducted by Polices, Prosecutors, and Corruption Eradication Commission (KPK), the investigators of the above institutions to determine the state loss by asking the expert witnesses from BPKP not from BPK, whereas based on Laws and Regulations who authorize in determining the state loss and also to appoint the expert witnesses in litigation is BPK not BPKP. The current situation of law enforcement is extremely debatable by criminal law experts at mass-media and at the Court of Corruption Crimination.

Abstract

Reversal of burden proof system arranged in Code Number 31 Year 1999 jo. Code Number 20 Year 2001. In this reversal of burden proof system, defendant have to prove that its estae not a result of public prosecutor and corruption also remain to have obligation to prove its assertion. Abstract

Green Constitusional is a concept contained in the Act of 1945 Amendments, which in Article 33 Paragraph (3) arranged on the environment that must be managed for the benefit of development based on sustainable principles (suistainable) and environment (pro-enviroment). Green Constitusional concept first introduced by Jimly Asshiddiqie the first time in which this is one of the ideas and developments in environmental protection efforts are put towards environmental rights arrangements in the constitution of the State as a commitment to environmental protection and management.Constitution of the Republic of Indonesia 1945 Amendments also referred to as the supreme law of the land, because in its articles have known or regulating the preservation of nature or has shades of green. This is also confirmed in the Constitutional Court Decision No. 013/PUU-III/2005 dated 12 September 2005 that the politics of Indonesia's forest is in the implementation of human rights in Indonesia today and future generations to gain a healthy environment and in order implementation of national development.Key Word : Ecological Constitution, Sovereignty, Indonesia

Abstract

Mahkamah Konstitusi (MK) diharapkan memainkan peran penuh dalam menjaga nilai-nilai konstitusi dan demokrasi, sehingga fungsi dan tugas MK  diposisikan sebagai: (1) pengawal konstitusi (the guardian of konstitusi), (2) interpreter akhir konstitusi (penafsir akhir konstitusi), (3) pengawal demokrasi (the guardian demokrasi), (4) perlindungan hak-hak konstitusional warga negara (pelindung hak-hak konstitusional warga negara), dan (5) hak perlindungan hak asasi manusia (pelindung hak asasi manusia). Sejak 13 Agustus 2003 sampai dengan 2009, setidaknya MK telah mengadili sengketa hasil pemilihan umum (Perselisihan hasil pemilihan umum) jumlah 45 kasus yang terdiri dari 274 kasus pemilu 2004 dan 71 kasus yang terdiri dari Pemilu 2009 dari 657 kasus, dan 27 kasus sengketa pemilu kepala daerah (perselisihan kepala hasil pilkada). Mahkamah Konstitusi juga menerima permohonan sengketa pemilihan Presiden dan Wakil Presiden tahun 2004 dan 2009 masing-masing satu kasus. Jadi, Mahkamah Konstitusi adalah palang pintu hukum dalam menyelesaikan konflik pemilu dengan orientasi dasar hukum dan menjalankan demokrasi yang muncul di negara Indonesia dengan sanksi hukum bagi pelanggar UU Pemilu.

Abstract

The republic of Indonesian is a law country with welfare state concept. Consequently, each activity should be oriented around the goals based on the law that organize state activities, government, and society. Abstract

ABSTRAK Setiap instansi pemerintah (termasuk Polda Jateng), wajib mempertanggungjawabkan kinerjanya. Oleh karena itu perlu disusun suatu sistem akuntabilitas kinerja instansi pemerintah yang terintegrasi dengan sistem perencanaan strategis, anggaran, dan akuntansi pemerintah sebagaimana tertuang pada Peraturan Presiden RI Nomor 29 Tahun 2014 tentang Sistem Akuntabilitas Kinerja Instansi Pemerintah (SAKIP). SAKIP meliputi perencanaan, pengukuran, dan pelaporan kinerja. Pelaporan kinerja dikenal dengan nama Laporan Akuntabilitas Kinerja Instansi Pemerintah (LAKIP). Pada realitanya, Polda Jateng mengalami beberapa kendala saat mengimplementasikan SAKIP dalam bentuk LAKIP. Hal ini disebabkan karena Polda bukan merupakan entitas/satuan kerja yang mengelola anggaran, namun hanya melaksanakan kewenangan manajerial.Tujuan penelitian ini adalah untuk mengetahui upaya-upaya yang dilakukan Polda Jateng dalam mengatasi kendala pembuatan LAKIP.Penelitian ini merupakan penelitian hukum yuridis empiris, bersifat deskriptif analitis. Lokasi penelitian di Polda Jateng. Jenis dan sumber data terdiri dari data primer (LAKIP Polda Jateng) dan data sekunder (berupa bahan hukum primer dan sekunder). Pengumpulan data dilakukan dengan menggunakan metode studi kepustakaan, observasi, dan wawancara. Analisis data menggunakan analisis kualitatif.Hasil penelitian menunjukkan bahwa untuk mengatasi kendala pembuatan LAKIP, maka Polda Jateng melakukan evaluasi pencapaian target per indikator kinerja utama setiap tri wulan guna mengantisipasi adanya kegiatan yang bias atau kurang mendukung pencapaian indikator kinerja. Tim pokja juga memberikan masukan kepada wakapolda agar diadakan evaluasi secara terintegrasi dengan semua penanggung jawab fungsi per sasaran indikator kinerja utama.Kata Kunci : akuntabilitas kinerja, indikator kinerjaABSTRACT Every government agency (including the Central Java Regional Police), shall be held accountable for its performance. Therefore, it is necessary to develop a performance accountability system of government agencies integrated with strategic planning system, budget , and government accounting as stated in Presidential Regulation No. 29 of 2014 on Government Institution Accountability System (SAKIP). SAKIP includes planning, measuring, and reporting performance. Performance reporting is known as the Government Institution Performance Accountability Report (LAKIP). In reality, Central Java Police experienced several obstacles when implementing SAKIP in the form of LAKIP. This is because the Polda is not an entity / work unit that manages the budget, but only exercises managerial authority.The purpose of this research is to know the efforts made by Central Java Police in overcoming the obstacle of making accountability reporting performance according to Presidential Regulation Number 29 Year 2014.This research is an empirical juridical legal research, analytical descriptive. Research location in Central Java Police. The types and sources of data consist of primary data (in the form of performance accountability report of Polda Jateng) and secondary data (in the form of primary and secondary legal material). Data collection was done by using literature study method, observation, and interview. Data analysis using qualitative analysis.The results showed that to overcome the problem of making LAKIP, the Central Java Police made various steps. This step is evaluating the achievement of the target per key performance indicator every quarter to anticipate the existence of activities that are biased or less support the achievement of performance indicators. The working group also provided input to the police commander for an integrated evaluation with all personnel responsible for the key performance indicators.Keywords : performance accountability, performance indicators

Abstract

The Criminal Justice System as a system in criminal law enforcement seeks to address crime issues is interpreted as an attempt to control or limit crime to be within the limits of public tolerance. Issues raised in this study include: 1) what are the obstacles faced by Police investigators in the implementation of the investigation related to the criminal justice system and how to deal with these barriers ?; 2) how is the criminal justice system investigation policy that should be implemented?The approach method used in this research is normative juridical approach method.The results of this research are: 1) obstacles faced by Police investigators in criminal investigation process are: a) lack of witness participation in giving information in process of investigation; b) there are still many investigators whose education level is still low; c) limited number of investigators; d) inadequate income / salary factor of the investigator; e) lack of budget for investigation; f) inadequate facilities and infrastructure to support investigator performance. The way to overcome the obstacles faced by Polri investigators in the implementation of the investigation related to the criminal justice system in the police station is: a) the need to make the law on duty and authority; b) the need for presence or willingness to bear witness to what is seen, experienced, and known; 2) the investigation is regulated in the Draft of Criminal Procedure Code II of Investigator and Investigation and Chapter IV Arrest, Detention, Body Search, House Income, Foreclosure and Letters Inspection. The investigation process of Police as regulated by Draft of Criminal Procedure Code is as follows: a) arrest; b) searches; c) detention; d) eavesdropping. Keywords: Investigation, Investigator, Police, Criminal Justice System

Abstract

The problem of seafarers' protection in the implementation is still far from expectations. This is evident in the employment practices in the maritime field there are still things that are not in accordance with those established in the Manpower Act. Where entrepreneurs still make their own rules for the benefit of the company regardless of what the rights of its workersBased on the results of the study it was concluded that the state protection for maritime workers is still weak and slow from the threat of maritime security and safety. Other issues such as wages, maritime employment contracts, Indonesian maritime profession certification, strikes, unilateral layoffs, severance pay, freedom of association of maritime workers, and foreign seafarers' labor are issues that have hitherto been a problem both from shipping companies and labor Indonesian seafarers. The state must be fair in the payroll system, the internal control function must still have external supervision, the need for ministerial or presidential decree on the standard salary of Indonesian seafarers.Keywords: Legal Protection, Sailors, Contract System

Abstract

ABSTRAKDalam penelitian ini permasalahan yang akan dibahas yaitu: Bagaimana peran dan tanggung jawab advokat sebagai penasehat hukum tersangka dan terdakwa dalam pendampingan perkara tindak pidana koropsi, Kendala-kendala apa saja yang dihadapi advokat sebagai penasehat hukum tersangka dan terdakwa dalam pendampingan perkara tindak pidana koropsi dan cara mengatasi kendala-kendala yang dihadapi advokat sebagai penasehat hukum tersangka dan terdakwa dalam pendampingan perkara tindak pidana korupsi.Penelitian ini menggunakan metode pendekatan secara yuridis normatif. Adapaun sumber dan jenis data dalam penelitian ini adalah data primer yang diperoleh dari studi lapangan dengan wawancara . Dan data sekunder diperoleh dari studi kepustakaan.Kesimpulan dari penelitian ini adalah Peran dan tanggung jawab advokat sebagai penasehat hukum tersangka dan Terdakwa, berawal dari konsultasi klient kepada advokat dan kesepakatan honorarium kemudian dibuatkan surat kuasa untuk mendampingi klien dari tingkat mana klien tersebut akan didampingi, apakah di tingkat penyidikan, penuntutan dan pemeriksaan dimuka sidang jadi tergantung penjelasan dari surat kuasa tersebut. Advokat memberikan perannya dalam semua tingkat pemeriksaan yakni peran di tingkat penyidikan advokat sudah mulai melakukan pendampingan dan mengikut jalannya penyidikan agar hak-hak tersangka bisa terpenuhi dan tidak ada tekanan maupun paksaan dari penyidik. hambatan yang berasal dari dalam advokat itu sendiri, hambatan internal ini seperti masalah SDM, Kesehatan , Cultural dan organisasai advokat itu sendiri yang terpecah sehingga mempengaruhi pembelaan nantinya, sebagai contoh hambatan SDM ini bahwa tidak semua advokat memiliki kemampuan hukum atau keahlian hukum yang lain dan apabila tidak sesuai dengan keahliannya advokat atau penasehat hukum yang bersangkutan dapat menolak perkara / kasus yang akan ditanganinya.Kata kunci: Penasehat Hukum, Korupsi, Terdakwa, perkara korupsi ABSTRACTIn this research, the issues that will be discussed are: What is the role and responsibility of the advocate as the legal counsel of the suspect and the defendant in the guidance of the criminal case of the corruption, What are the constraints faced by the advocate as the legal counsel of the suspect and the defendant in the assistance of the criminal case of the corruption and the way overcome the obstacles faced by advocates as legal advisors of suspects and defendants in the assistance of corruption criminal cases.This research uses normative juridical approach method. Adapaun source and data type in this research is primary data obtained from field study by interview. And secondary data obtained from literature study.The conclusion of this research is the role and responsibility of the advocate as the legal counsel of the suspect and the Defendant, starting from the client consultation to the advocate and honorarium agreement then made a power of attorney to assist the client from the level where the client will be accompanied, whether at the level of investigation, prosecution and examination in advance so the trial depends on the explanation of the power of attorney. Advocates provide their roles in all levels of examination, ie the role of the advocate's level of investigation has begun to assist and follow the course of the investigation so that the rights of the suspect can be fulfilled and there is no pressure or coercion from the investigator. barriers arising from within the advocate itself, these internal barriers such as HR, Health, Cultural and organizational issues of the advocates themselves are fragmented so as to affect the defense of the future, for example this HR barrier that not all advocates have legal or other legal skills and if not in accordance with the expertise of lawyers or legal counsel concerned can refuse cases / cases that will be handled.Keywords: Legal Counsel, Corruption, Defendant, corruption case.
