Abstract

There have been a number of terrorist incidents in Indonesia that have led to extrajudicial killings in several cases by the police. Extrajudicial killing is an act that is carried out on the basis of the discretion of certain authorities to carry out acts of murder against perpetrators suspected of committing crimes of terrorism. Criminal acts of terrorism are regulated in Law Number 2 of 2002 concerning Eradication of Criminal Acts of Terrorism, the meaning of terrorism is a deliberate attack on public order so as to cause fear to the wider community. In criminal procedural law there is the principle of presumption of innocence, which means that a person is considered innocent before a judge's decision has permanent legal force. Because everyone also has human rights that must be protected by anyone, especially the police as law enforcers. This writing uses a normative juridical method, namely the study of legal principles, legal systematics, and legal comparisons. In addition, it discusses the doctrines in the science of law, and this writing has a descriptive-analytical philosophy that describes in detail, systematically, and thoroughly.

Abstract

National disintegration is a phenomenon of a country's division into separate parts due to various factors that threaten the integrity and unity of the nation. This phenomenon often arises as a response to the dissatisfaction of certain groups, such as attempts to secede by regions or communities that feel marginalized from the development and government process. In addition, socio-political problems such as injustice, corruption, and weak leadership also worsen the condition, eroding the solidity of a unitary state. The impact of national disintegration is not only limited to political and economic aspects, but also extends to social and cultural aspects. National identity can be eroded, relations between citizens deteriorate, and the sense of solidarity and togetherness fades. Concretely, disintegration can trigger open conflict, destruction of infrastructure, an increase in the number of internally displaced people, and the loss of national stability and cohesion. Therefore, efforts to prevent disintegration through strengthening unity, equitable development, and conflict management are very important.

Abstract

This research aims to analyze the role of investment law in public infrastructure development with a focus on equitable development in the regions, especially in the education sector in North Aceh. Equitable infrastructure development is one of the main goals of national development policy, but in reality in several regions, such as North Aceh, there is inequality in access to adequate educational infrastructure. This study seeks to explore the extent to which investment legal regulations can play a role in encouraging equitable development, and why, in the case of educational infrastructure development in North Aceh, this has not been achieved. Using a normative juridical approach and empirical studies, this research examines several aspects, including regulations related to investment, the legal framework governing infrastructure development, as well as the influence of the delegation of authority from the central government to regional governments, including in the local economic sector, on the implementation of development policies. This study also highlights the important role of government, both central and regional, in ensuring that investment policies and infrastructure development are carried out in a transparent and accountable manner. Strengthening regulations and increasing supervision are needed to ensure that development can proceed evenly, without intervention from interested parties.

Abstract

Abstract

The assets of a foundation are primarily intended to achieve the foundation’s purposes and objectives; therefore, their use in business activities requires clear legal limitations. This study aims to analyze the limitations on the use of foundation assets for business activities from the perspective of foundation law. This study employs normative legal research using statutory, conceptual, and analytical approaches. The legal materials consist of legislation and legal literature relating to foundations and the management of their assets. The results of the study indicate that a foundation may conduct business activities through the establishment of a business entity and/or participation in a business entity, provided that such activities are related to the purposes and objectives of the foundation. However, such authority is subject to legal limitations to prevent the misuse of foundation assets in a manner inconsistent with the foundation’s purposes. These limitations include restricting the participation of foundation assets to a maximum of 25% of the foundation’s total assets, requiring a connection between the business activities and the foundation’s purposes and objectives, restricting concurrent positions between foundation organs and business entity organs, and prohibiting the distribution of business proceeds to foundation organs. Accordingly, the use of foundation assets for business activities does not constitute an unrestricted freedom but must be carried out within the framework of achieving the foundation’s purposes while complying with applicable legal provisions. These limitations also serve as an instrument to ensure that foundation assets continue to be used in accordance with the functions and purposes for which the foundation was established.

Abstract

Domestic violence remains a legal and access-to-justice problem because incidents recorded by formal services do not necessarily represent all violence experienced by victims. This study analyzes how documented reporting barriers may disconnect victims from legal protection mechanisms in Indonesia and formulates a legally grounded model for strengthening access to protection. The study uses normative (doctrinal) legal research with statutory and conceptual approaches, examining the Indonesian legal framework in force by September 2026. Primary legal materials comprise Law Number 23 of 2004 on the Elimination of Domestic Violence, Government Regulation Number 4 of 2006 on the Organization and Cooperation for the Recovery of Domestic Violence Victims, and Law Number 3 of 2026 on the Protection of Witnesses and Victims. Official SIMFONI PPA materials are used only as administrative context. A structured supplementary search of PubMed and Google Scholar identified peer-reviewed studies on domestic/intimate partner violence reporting and help-seeking, principally from 2015–2025, with a 2026 systematic review included to capture the latest synthesis. Legal norms were extracted and interpreted doctrinally, while reported barriers in the supporting literature were thematically mapped into five analytical clusters and compared with available protection mechanisms. The synthesis identifies five interrelated clusters: normalization of violence as a private matter; economic dependence and unequal power relations; fear of perpetrators and repeated violence; family pressure, children-related concerns, and stigma; and limited information or institutional access. These barriers can operate before formal reporting and therefore expose a gap between legally guaranteed rights and practical access to those rights. The study proposes a four-stage protection model covering pre-reporting, reporting, protection and handling, and recovery/access to justice. Because no primary victim data were collected, the study does not estimate the prevalence or causal magnitude of underreporting; empirical studies and SIMFONI PPA data are used only to contextualize the doctrinal analysis.

Abstract

This study examines the legal adequacy of the settlement of PT Asuransi Jiwasraya (Persero)'s obligations to policyholders by using good faith as an explicit normative standard. The issue is examined across the restructuring, policy-transfer, and post-license-revocation stages rather than treating the existence of a settlement mechanism as proof that contractual rights have been fulfilled. This doctrinal legal research applies statutory, conceptual, and case approaches to ten core primary and official materials: the Indonesian Civil Code; Law No. 40 of 2014 on Insurance as amended by Law No. 4 of 2023; OJK Regulation No. 22 of 2023; three Central Jakarta District Court decisions concerning Jiwasraya; two OJK press releases issued in August 2024; and the 2025 OJK decision/announcement revoking Jiwasraya's life-insurance business license. Case-specific materials cover 2019-2025 and were purposively selected for authority, direct relevance to policyholder rights, and connection with restructuring or settlement. The materials were analyzed through grammatical, systematic, and teleological interpretation and deductively coded against five good-faith parameters: contractual certainty and continuity of benefits, transparency and adequacy of information, meaningful consent, proportionality and balance of interests, and access to legal protection and remedies. The analysis shows that restructuring and policy transfer are legally relevant settlement instruments, but they do not by themselves establish substantive fulfillment of all policyholder rights. OJK's reported 99.7% restructuring approval is treated as aggregate evidence of acceptance, not as proof that every consent was informed, voluntary, or equivalent to full contractual performance. The post-revocation stage also leaves continuing duties to protect unresolved policyholder interests. The study contributes a replicable doctrinal framework for assessing insurance-obligation settlements through good faith while recognizing that its conclusions are legal-normative rather than statistically generalizable.
