Abstract

Constitutional Court Decision No. 85 / PUU - XII / 2014 to restore control over the water resources of the country, including in terms of management and enterprise. This study discusses how the construction of the state's right to control the management of the water resources of our doctrines of the welfare state. Methods used juridical empirical. This research resulted in the construction of the state's right to control the management of the water resources of our doctrines of the welfare state that is the heart of the Law on Water ResourcesPutusan Mahkamah Konstitusi RI Nomor 85/PUU-XII/2014 mengembalikan penguasaan atas sumber daya air kepada negara termasuk dalam hal pengelolaan dan pengusahaannya. Penelitian ini membahas bagaimana konstruksi hak menguasai negara dalam pengelolaan sumber daya air sebagai perwujudan doktrin negara kesejahteraan. Metode Penelitian yang digunakan adalah yuridis empiris. Penelitian ini menghasilkan konstruksi hak menguasai negara dalam pengelolaan sumber daya air sebagai perwujudan doktrin negara kesejahteraan yang merupakan jantung Undang-Undang tentang Sumber Daya Air

Abstract

The damage of Drainage Basin (DAS) comes to be a factor on the unavoidable flooding disaster area. In Indonesia, most of Drainage Basins – particularly in Java including Bengawan Solo Drainage Basin have experienced damage. This research is to analyze the urgency of the local regulation on the management of Bengawan Solo Drainage Basin in order to strengthen the function of ecosystem and good government. The method used in this research is a judicial-empirical or non- doctrinal method. The result of the research concludes that in such condition in which the threat of the crisis of support capability on ecosystem and environment being faced by Indonesia is so real. Hence, legislation of legal norms on the management of Integrated Drainage Basin at Bengawan Solo is highly needed along with the intention to strengthen the democracy and constitutional state and management of Good Governance. On the other hand, in Central Government, there has been Government Regulation No. 37 Year 2012 about the Management of Drainage Basin and it is time to follow up in the form of Local Regulation.

Abstract

The formulations of ideal legislative drafting in the formation of environmental-based Regional Regulation is of highly essential matter to be done in a constitutional democracy. On this basis, the research problem in this research is how is the ideal formulation of legislative drafting in order to realize a democratic state of law, especially in the formation of environmental-based regional legal products? The method used in this research is a normative juridical method with qualitative analysis. As a result, this study highlights that in order to realize the ideal of a democratic state of law, the formulation of legislative drafting, especially in the formation of environmental-based regional legal products, should contain regionally-based materials of the specific condition of the area as well as further elaboration of higher legislation. The program establishment of regional regulation as instruments for program planning of Provincial Regulation or District / City Regulation arranged in a planned, integrated and systematic way, operationally lists the Regional Design Regulations which were organized based on certain method and parameters as an integral part of the national legislation system based on the Constitution of Indonesian Republic Year 1945 and the philosophy of the State.Formulation, legislative drafting, ideal, state of law, democratic.

Abstract

Klinik kecantikan berkembang pesat, namun penyelenggaraannya harus disertai nilai keadilan sosial bagi stakeholder yaitu pasien pemerintah dan klinik kecantikan.  Artikel ini mengkaji keadilan sosial dalam penyelenggaraan klinik  kecantikan estetika. Kajian dilakukan dengan metode yang digunakan Socio Legal Studies yang dianalisis secara kualitatif, Analisis data pada penulisan hukum lazimnya dilakukan melalui pendekatan kualitatif.  Hasil penelitian menunjukkan bahwa keadilan sosial ini meliputi pemenuhan hak dan kewajiban stakeholder yang terkait dalam penyelenggaraan klinik kecantikan estetika, yaitu pasien, pemerintah dan klinik kecantikan estetika itu sendiri. Keadilan sosial dalam penyelenggaraan klinik kecantikan estetika di Indonesia dalam hal pemenuhan hak atas kondisi sehat, pelayanan kesehatan, jaminan perlindungan hukum, kepastian hukum, hak dan kewajiban pasien pemerintah dan klinik kecantikan

Abstract

Indonesia’s forest resources and watersheds are not contributing as they should to poverty reduction, economic and social development, and environmental sustainability. Instead, forest areas are threatened with degradation, fragmentation and destruction. A quarter of the “state forest area” lacks tree cover. In recent years, Indonesia has been losing up to 2 million hectares annually, mainly due to illegal cutting and land conversion fueled by excess processing capacity and a lack of effective management and law enforcement. Forest loss undermines rural livelihoods, ecosystem services and Indonesia’s ability to meet poverty alleviation goals. Poor forest governance damages the investment climate, rural economic potential, and Indonesia’s competitiveness and international reputation. Forest crime exacerbates problems of budget and fiscal balance, and diverts public revenues that could be better spent on poverty reduction and development goals. As Indonesia moves from transition to stabilization and growth, there is a tremendous opportunity to help the government find new ways of managing forest areas in partnership with local communities, contributing to democracy, justice, equity, rural sector investment, jobs and growth.

Abstract

The green development right paradigm will elaborate the ontology (nature), and the ways or methods in order to achieve the ultimate goal of the green development right. This ultimate goal will be focused on the creation of the  ideal maritime systems that may guarantee all related parties, such as individual, society, or community, private sectors and the government, to convert their potentials to be functional towards public welfare. The core elements of the green development right will emphasizes the series of norms in managing the coastal and frontline island potentials. The normative framework covers Environmental Law, Fishery Law, and Coastal Law. The research methods use an empirical approach and normative approach. The study documents the analysis consists  of constitutions, legislation and various policies relating to the subject matter studied in Indonesia area and the problems it faces and  report the results of  the various meetings, seminars, public hearings.

Abstract

The increase in population has an impact on the proliferation of illegal settlements. This study determines and analyzes housing policies and administrative law enforcement about illegal settlements. The study uses normative legal research, which compares legal issues in two countries, Singapore and Australia. This research is descriptive, using both statute and conceptual approaches. The concept of administrative law enforcement and protecting citizens' fundamental rights are used as the basis for our analysis, combining it with legal system theory and administrative law enforcement. The research results show that, in substance, Singapore has a housing policy through Housing & Development Board, which is carried out on a massive scale and is quite successful in dealing with illegal settlements in urban areas about the size of the country's territory. Structurally, government institutions carry out administrative law enforcement through warnings and demolitions. Meanwhile, Australia has not been entirely successful, even though collaboration has been carried out between governments through Australia for Affordable Housing, the private sector, and housing communities. Australia enforces the law by issuing orders to stop using unauthorized buildings and imposing financial sanctions. Affordable and fair housing policies that the enforcement of administrative law can accompany are more effective in reducing illegal settlements than relying solely on the enforcement of administrative law alone or even criminal law. According to a culture of legal awareness, settlers who face various economic and social pressures are more difficult to discipline.

Abstract

Space is an area that includes land space, sea space and air space, including space within the earth as a unified territory, where humans and other creatures live, carry out activities and maintain their survival. Increasing population growth has an impact on the economic development of the people of an autonomous region who will undoubtedly utilize space that is considered strategic to support their economic activities. The complexity of development growth in Indonesia requires priority development programs and plans in various aspects or fields, but this development must not conflict with the fifth principle of Pancasila, namely social justice for all Indonesian. There is no consistency in implementing regulations, especially in enforcing laws related to spatial planning, which results in inappropriate development growth which impacts the surrounding environment, and green open space becoming increasingly narrow.

Abstract

The imperative role of anti-pornography laws in shielding the younger generation from the pervasive influence of explicit content is indisputable. Nevertheless, the critique leveled against the formulation of criminal sanctions within the ambit of anti-pornography legislation necessitates a rigorous examination of the principle of proportionality. To elucidate this issue, juridical normative research is paramount, with a particular focus on comparative analyses involving Law No. 44 of 2008 and corresponding anti-pornography statutes in Sweden, the Philippines, Malaysia, and India. The findings derived from this comparative investigation reveal several key insights. Firstly, a nuanced exploration exposes both commonalities and disparities in the patterns underpinning the formulation of anti-pornography statutes across these jurisdictions. Secondly, while there is alignment between the gravity of the offense and the severity of criminal sanctions, a notable deficiency surfaces in the failure to distinguish between first-time offenders and recidivists, thereby falling short of the fundamental principle of proportionality. Furthermore, a critical observation underscores the absence of rehabilitative measures for adult offenders grappling with pornography addiction, presenting a lacuna in the current legislative framework. Lastly, the relative nature of anti-pornography formulations from diverse nations underscores a compelling correlation between the legal stance on criminality and the prevailing moral ethos of the respective societies. This comprehensive analysis serves as a clarion call for a recalibration of anti-pornography legislation, aligning it more closely with the principle of proportionality and accounting for the nuanced considerations in rehabilitating offenders.

Abstract

Criminal acts Indonesia's environmental law has numerous issues and has long been regulated in Indonesia. However, the question is whether the Corporate Penalty System on Environmental Regulation can implement this policy. This research aims to analyze the role of the corporate penalty system in environmental regulation. This is normative legal research with secondary data from primary, secondary, and tertiary legal materials. The research results show, first, that the Corporate Penalty System on Environmental Regulation has overlapping regulations and the need for more clarity regarding corporate punishment, substantive issues, and law enforcement. The Indonesian government must focus on this to achieve an integrated corporate punishment system. In environmental regulations, the overlapping provisions of administrative and criminal law contribute to the unjust nature of the corporate punishment system. Therefore, it tends to vary from one location to the next. Second, the threat of punishment is not proportional to the heinousness of the act. Third, the absence of harmonization with prior legal arrangements resulted in disparate sentences. The best way to enforce environmental crimes committed by corporations is to have adequate regulations to work from; encouraging harsher penalties for social and economic losses will be detrimental to environmental justice; and implementing an integrated system of corporate punishment requires a variety of measures, such as enacting new regulations and focusing on ecological criminal law enforcement.
