Abstract

BNI pernah menerima hak atas merek sebagai objek jaminan tambahan fidusia meskipun belum ada hukum positif yang mengatur mengenai hal tersebut. Berbeda dengan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang telah mengatur hak cipta dapat digunakan sebagai objek jaminan fidusia, dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis hal tersebut belum ada. BNI menempatkan hak atas merek sebagai objek jaminan tambahan fidusia didasarkan kesepakatan dengan debitur dan kesukarelaan debitur untuk menempatkan hak atas mereknya sebagai salah satu jaminan. Penelitian ini menganalisis konsep hukum penempatan hak atas merek sebagai objek jaminan tambahan fidusia, serta akibat hukum jika dilakukan eksekusi pada hak atas merek. Penelitian ini menggunakan metode penelitian hukum dengan menggunakan pendekatan perundang-undangan dan koseptual yang dianalisis secara preskripsi dengan menempatkan isu hukum sebagai objek yang diteliti. Hasil penelitian menunjukkan bahwa penempatan hak atas merek sebagai objek jaminan tambahan fidusia didasarkan adanya kesepakatan para pihak dalam perjanjian berdasarkan asas kebebasan berkontrak dan pacta sunt servanda, dengan terlebih dahulu melakukan penilaian terhadap merek sebelum ditempatkan sebagai objek jaminan fidusia. Hak atas merek dapat digunakan sebagai objek jaminan tambahan fidusia karena merupakan benda bergerak tidak berwujud dan mempunyai nilai. Eksekusi hak atas merek sebagai objek jaminan tambahan fidusia dapat dilakukan apabila terdapat sertifikat merek dan telah didaftarkan sebagai objek jaminan tambahan fidusia. Eksekusi hak atas merek untuk pemenuhan kewajiban debitur kepada kreditur perlu diajukan ke pengadilan untuk dapat diputuskan bersamaan dengan objek pokok jaminan fidusia.

Abstract

Perjanjian pengikatan jual beli seringkali menjadi pegangan yang bersifat sementara bagi pembeli rumah susun. Selama ini perjanjian jual beli dibuat oleh pengembang dan bersifat baku. Hal tersebut dikarenakan masih banyak yang harus diselesaikan dalam proses penerbitan sertifikat hak milik satuan rumah susun. Dalam pembuatan Perjanjian Pendahuluan Jual Beli (PPJB), pengembang harus memenuhi persyaratan yang tercantum dalam Pasal 43 ayat (2) Undang-Undang Nomor 20 Tahun 2011 Tentang Rumah Susun. Untuk menarik pembeli, pengembang melakukan pemasaran dengan sistem Pre Project Selling yaitu penjualan yang dilakukan sebelum pembangunan dilaksanakan. Berdasarkan ketentuan Undang-Undang No. 20 Tahun 2011 tentang Rumah Susun, pemasaran rumah susun sudah dapat dilakukan sebelum pembangunan rumah susun dilaksanakan. Dalam hal pemasaran objek perjanjian yang baru akan ada di kemudian hari, pengembang harus memenuhi syarat yang tercantum dalam Pasal 42 ayat (2) Undang-Undang No. 20 Tahun 2011 tentang Rumah Susun. Penelitian ini ingin menganalisis apakah PPJB dengan objek yang akan ada dikemudian hari merupakan perjanjian yang sah beserta akibat hukumnya. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Bahan hukum yang digunakan yaitu hukum primer dan bahan hukum sekunder. Pemilihan bahan hukum dilakukan dengan memilah bahan hukum sesuai dengan permasalahan penelitian dan dianalisis menggunakan perskriptif. Hasil penelitian menujukkan bahwa PPJB merupakan perjanjian yang sah apabila telah memenuhi syarat dalam Pasal 1320 KUHPerdata dan Pasal 42 dan 43 Undang-Undang Rumah Susun dan akibat hukum yang terjadi apabila terjadi wanprestasi, dapat dimintakan pembatalan ke Pengadilan. Kata Kunci: Rumah Susun, Perjanjian Pendahuluan Jual Beli, Pre Project Selling.

Abstract

The portrait is copyrighted works protected by the Copyright Law. The problem raised in this study is that when a portrait is taken by a photographer, which is no visible face of the person being photographed. The purpose of this research is to analyze whether the object in the portrait but only in silhouette has a private right to copyright. The portrait to be studied is a portrait entitled "A Farmer's Quiet Journey". The method used is legal research at the legal dogmatic level. Legal research is a process to identify, analyze problems, then solve problems that exist. The results of this study indicate that the portrait with the title "A Farmer's Quiet Journey " contains the object of the person in it, although there is no visible face as identification of the person being photographed, it can still be detected that an object is a person, so the photographic work is assumed to be a portrait. Thus, the person in the portrait has private rights to the copyright of his portrait. Therefore, uploading it at Adobestock still has to be with the permission of the person who owns the silhouette

Abstract

labels aim to provide legal literacy for the target audience, namely MI Darul Ulum Rejomulyo students, Magetan Regency by looking at knowledge, understanding, attitudes and behavior of students before and after the activities given in the form of questionnaires and sheets observation. The results of the Community Service activities after the Community Service team provided legal literacy, showed that there was a significant increase in legal knowledge, legal understanding, and legal attitudes of students regarding the laws and regulations on processed food labels. However, the legal behavior still shows students who do not really care about processed food labels.

Abstract

SEMA 2 of 2023, issued by the Supreme Court, is oriented towards standardizing court decisions related to registering interfaith marriages. On the other hand, SEMA 2 of 2023 has instead created problems, particularly concerning human rights. From the perspective of human rights, marriage is viewed as a personal right, and registration is one of the citizens' rights, meaning that the state must fulfill marriage. The author uses normative legal research, emphasizing legislative, conceptual, and comparative studies with other countries. The research results indicate that SEMA No. 2 of 2023 was issued to address legal uncertainty in the judiciary regarding diverse rulings on the validity of interfaith marriages by providing clear instructions to judges to reject requests for the registration of interfaith marriages. The legal implication of this SEMA is that interfaith marriages occurring after the issuance of SEMA cannot be registered with the Dispendukcapil without a court ruling as the basis for recognition, due to the non-retroactive nature of circular letters. SEMA No. 2 of 2023 not facilitating interfaith marriages legally in Indonesia as a concrete effort to clarify provisions that have not been regulated explicitly in the Marriage Law.

Abstract

Counterfeit integrated circuit (IC) products have been traded illegally in Indonesia due to a lack of public awareness of intellectual property rights (IPR) and inconsistent law enforcement. Irresponsible parties have produced fake ICs in the form of imitation goods, illegally imported from China to Indonesia—an issue that appears to be a further implication of the global technological trade war. Due to prohibited modifications, a gray zone exists between the classification of bootleg and counterfeit products, even though both are fake. Bootlegs are “inspired-products” protected by registered brands and industrial designs, which makes them more challenging to investigate than counterfeits that directly replicate the original. As a result, the proof aspects differ. It is essential to differentiate between counterfeits or bootlegs to enforce the appropriate sanctions and protect ICs in Indonesia. Using a normative research method, this legal research analyzes the differentiation between bootleg and counterfeit ICs and the legal protection of integrated circuits in Indonesia through statutory and conceptual approaches. This paper recommends the urgent need for a definitive classification to facilitate proof and the imposition of sanctions. Futhermore, the Indonesian government should revise Law No. 32 of 2000 by adding regulations regarding priority rights, enabling foreign IC rights holders to be better protected in Indonesia. Law enforcement efforts against counterfeit and bootleg ICs must also be supported by Indonesia’s commitment to participate in the Anti-Counterfeiting Trade Agreement.
