Abstract

In Indonesia's justice system, the poor are a marginalized group whose economic hardships hinder the ability to understand legal information and access legal services. To address this issue, Indonesia initiated a state-funded Legal Aid Program in 2011 leading to a surge of accreditation applications from Legal Aid Organizations (OBHs) seeking access to the funding. Therefore, this research aimed to examine the quality of legal aid services provided by state-funded OBH and to propose an ideal model for monitoring the quality of the services. A conceptual and comparative approach to relevant regulations was used and supported by primary data from interviews with Legal Aid Extension Officers at the Ministry of Law and Human Rights as well as Advocates affiliated with the organizations. The results showed that the quality of legal aid services in Indonesia remained poor due to the indication of double funding where both the Ministry and Regional Governments allocated budgets for the same services. Additionally, some OBH advocates still charge service fees and failed to provide assistance according to the service standards. Malaysia's legal aid system also showed better quality management as it integrated both state and private sector participation while assigning the assessment of legal aid eligibility to the Director of Legal Aid rather than the service-providing organizations. This approach led to more accurate implementation and better oversight. Furthermore, the research found an urgent need for integrated supervision of legal aid services in Indonesia, along with strict sanctions for both OBH and advocates who violated service standards. Malaysia’s firm approach to monitoring and eligibility determination served as a model worth considering.

Abstract

Penelitian ini bertujuan untuk mengetahui implementasi hukum Program Keluarga Harapan (PKH) dalam meningkatkan kesejahteraan masyarakat di Desa Onje Kecamatan Mrebet Kabupaten Purbalingga dan faktor yang cenderung berpengaruh terhadap implementasi hukum Program Keluarga Harapan (PKH) dalam meningkatkan kesejahteraan masyarakat di Desa Onje Kecamatan Mrebet Kabupaten Purbalingga. Penelitian in menggunakan metode penelitian kuantitatif dengan pendekatan yuridis sosiologis dan spesifikasi penelitian deskriptif. Penelitian ini mengambil lokasi di Desa Onje Kecamatan Mrebet Kabupaten Purbalingga dengan responden sebanyak 51 (lima puluh satu) orang peserta  atau penerima manfaat PKH. Pengambilan sampel penelitian menggunakan simple random sampling. Jenis sumber data meliputi data primer dan data sekunder yang diperoleh dengan menggunakan metode angket, dokumenter, dan kepustakaan. Data yang terkumpul diolah secara naratif dan tabel data. Analisis data kuantitatif menggunakan metode analisis isi dan analisis perbandingan. Hasil penelitian menunjukkan bahwa tingkat implementasi hukum Program Keluarga Harapan (PKH) dalam meningkatkan kesejahteraan masyarakat di Desa Onje Kecamatan Mrebet Kabupaten Purbalingga adalah efektif. Hal ini dibuktikan dengan hasil penelitian terhadap 2 (dua) indikator meliputi efektifnya pelaksanaan Program Keluarga Harapan (PKH) dan tingginya tingkat kesejahteraan masyarakat. Faktor-faktor yang cenderung memengaruhi implementasi hukum Program Keluarga Harapan (PKH) dalam meningkatkan kesejahteraan masyarakat di Desa Onje Kecamatan Mrebet Kabupaten Purbalingga meliputi faktor motivasi, pekerjaan, dan pendapatan.Kata kunci : Implementasi Hukum, Program Keluarga Harapan (PKH), Motivasi, Pekerjaan, Pendapatan.

Abstract

Desa Pandansari, Kecamatan Paguyangan, Kabupaten Brebes, memiliki potensi wisata alam, wisata budaya, dan wisata pendidikan yang dilengkapi dengan homestay, warung kopi, dll. Namun, dalam pengelolaannya terdapat permasalahan antara lain; pengunjungnya mengalami penurunanrata-rata 60 %, masih terbatas pada wisatawan domestik, tempat wisata jauh dari jalan utama,akses jalannya sempit dan rusak. Program pengembangan desa wisata di Desa Pandansari direncanakan 3 (tiga) tahun ke depan dengan melalui konsep makro dan mikro dengan membetukzona utama dan zona pendukung untuk membentuk jalur keterhubungan antar zona dan obyekdaya tarik wisata. Zona Utama adalah menuju wisata Desa Pandansari. Zona Pendukung adalahdimulai dari Desa Taraban, Kretek, Wanatirta, Ragatunjung Cipetung, Pandansari. Program tahunpertama antara lain: sosialisasi perencanaan zona, penyegaran kelompak bumdes dan pokdarwis, serta penguatan UMKM yang sudah ada diberikan bekal manajemen pemasaran dan penguatan modal melalui pembentukan prakoperasi syariah. Kegiatan dengan membuat rencanapengembangan usaha Bumdes, pengembangan wisata alam yang sudah ada dengan membuatkonsep yang unik dan menarik Masyarakat yaitu wisatawan bertani. Kendala program ini adalahpetani belum bisa mendukung sepenuhnya adanya konsep wisata yang akan direncanakan. Halini dikarenakan kebutuhan petani yang mendesak, biaya yang segera ada. Mereka masih berpikir,bahwa pariwisata, tidak bisa memberi kontribusi dalam waktu yang segera.

Abstract

In Indonesia, the role of attorneys in resolving legal issues is indispensable, yet the absence of standardized attorney fee regulations has led to significant barriers in accessing legal services. Despite attorneys' rights to receive fees for their services, the lack of clear guidelines has resulted in public perception that hiring legal representation is a luxury, with many unable to afford it. This study explores the urgent need for state regulation of attorney fees to ensure fairness and broaden access to justice for all segments of society. The findings indicate that the lack of fee standardization contributes to inequities in the legal system, creating barriers for lower-income individuals to access legal assistance. Furthermore, it reveals that establishing a clear regulatory framework would provide legal certainty, protect consumers, and promote a more equitable system for all citizens. The novelty of this research lies in its exploration of attorney fees as a critical element in improving access to justice in Indonesia, framing the issue beyond economics and highlighting its social justice implications. By addressing the urgency of regulating attorney fees, the study contributes to the ongoing legal reform discourse, providing policy recommendations for creating a fee structure that balances fairness with professional responsibility. The research emphasizes that deliberative processes, considering factors such as case complexity, impact, and operational costs, should guide the determination of fees. Ultimately, the study presents a compelling argument for rethinking how attorney fees are regulated to ensure that justice is accessible to all, not just the wealthy.

Abstract

Hospitals as health service institutions with legal entities are places that are prone to disputes. Article 60 Law no. 44 of 2009 assigned the Provincial Hospital Supervisory Board to receive complaints and make efforts to resolve disputes employing mediation. An analysis of the forms of hospital disputes and their settlement model through the Provincial Hospital Supervisory Board is very important to be done to avoid misinterpretation and provide legal certainty about who is the authorized party to handle them. The research method used was normative juridical and empirical juridical. The results of this study are to obtain an analysis of the forms of complaints that can be submitted to the Provincial Hospital Supervisory Board including disputes over hospitals as health service facilities where medical personnel and health workers provide health services that are detrimental to patients; disputes between the hospital as a health service facility and the patient as the recipient of health services related to the implementation of the obligations of both parties; disputes between the hospital as a legal entity and the hospital workforce related to internal management; the disputes between hospital as a legal entity and the third parties related to non-medical cooperation; the disputes between hospital as a legal entity and the environment. The hospital dispute resolution model implemented by the Provincial Hospital Supervisory Board of Yogyakarta includes the hospital dispute resolution model by the Provincial Hospital Supervisory Board in collaboration with hospitals, the Hospital Supervisory Board, Provincial Health Office, Provincial Legal Representatives (Ombudsman), YLKI, and PERSI.Keywords: Provincial Hospital Supervisory Board, Disputes Form, Dispute Settlement Model.
