Abstract

Article 154A of Law of the Republic of Indonesia No. 13 of 2003 on Manpower and Article 36 of Government Regulation No. 35 of 2021 on Fixed-term Employment Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment have regulated the reasons for termination of employment in a limitation and enumerative. However, there is a legal vacuum regarding the non-fulfillment of targets by workers or laborers as a reason for termination of employment, even though employers often use this reason. Based on these legal issues, the problem formulation in this article is first, how is the validity of not achieving sales targets as a reason for termination of employment? Second, what are the legal considerations of the Panel of Judges regarding the non-achievement of sales targets as a reason for termination of employment? This research is a normative legal research with statutory, conceptual, and case approaches. The results of this research are first, the reason for termination of employment related to the non-fulfillment of targets by workers or laborers can be used as a reason for termination of employment if the reason is regulated in the Work Agreement, Company Regulation, or Collective Labor Agreement and has previously been given the first, second, and third warning letters consecutively each valid for a maximum of 6 (six) months unless otherwise stipulated in the Work Agreement, Company Regulation, or Collective Labor Agreement. Secondly, based on existing court decisions, the reasons for termination of employment related to non-fulfillment of targets by workers or laborers are valid.

Abstract

The government conducts land registration throughout the territory of the Republic of Indonesia to ensure legal certainty. Landowners are also obliged to register their land ownership rights through sporadic land registration or Systematic Land Registration. Sporadic land registration or Systematic Land Registration produces a land title certificate as proof of land rights, issued by the Regency/City Land Office. With the issuance of a land title certificate, a guarantee of legal certainty has been realized for the owner of the land title certificate, including certainty of land title status, certainty of land title subjects, and certainty of land title objects. A guarantee of legal protection is also realized for the owner of the land title certificate, namely the ownership of the land title certificate cannot receive interference or lawsuits from other parties and the land title certificate cannot be withdrawn or cancelled by anyone.   Abstrak Perlindungan Hukum dan Kepastian Hukum Kepemilikan Tanah: Pengabdian Masyarakat di Tambak Kemerakan-Sidoarjo.Pemerintah mengadakan pendaftaran tanah di seluruh wilayah Negara Republik Indonesia dalam rangka menjamin kepastian hukum. Pemilik tanah juga berkewajiban mendaftarkan tanah Hak Miliknya melalui pendaftaran tanah secara sporadik atau Pendaftaran Tanah Sistematik Lengkap. Pendaftaran tanah secara sporadik atau Pendaftaran Tanah Sistematik Lengkap menghasilkan sertipikat hak atas tanah sebagai surat tanda bukti hak atas tanah, yang diterbitkan oleh Kantor Pertanahan Kabupaten/Kota. Dengan diterbitkan sertipikat hak atas tanah terwujud jaminan kepastian hukum bagi pemilik sertipikat hak atas tanah, meliputi kepastian status hak atas tanah, kepastian subjek hak atas tanah, dan kepastian objek hak atas tanah. Juga terwujud jaminan perlindungan hukum bagi pemilik sertipikat hak atas tanah, yaitu pemilik sertipikat hak atas tanah tidak mendapatkan gangguan atau gugatan dari siapapun dan sertipikat hak atas tanah tidak dapat dibatalkan oleh siapapun.

Abstract

Dalam upaya meningkatkan efektivitas pengadaan vaksin dan pelaksanaan vaksinasi Covid-19, Pemerintah pada tahun 2021 mengubah Peraturan Presiden Nomor 99 Tahun 2020 menjadi Peraturan Presiden Nomor 14 Tahun 2021. Perubahan tersebut dilakukan untuk mengoptimalkan penanggulangan pandemi Corona Virus Disease 2019 (Covid-19). Penelitian hukum sosiologis dengan pendekatan yuridis empiris digunakan untuk menganalisis implementasi peraturan ini. Data primer diperoleh melalui penelitian lapangan dan dianalisis secara kualitatif dengan pendekatan deskriptif analisis. Hasil penelitian menunjukkan bahwa implementasi kewajiban masyarakat untuk mendapatkan vaksinasi Covid-19 di Kabupaten Kampar, sesuai dengan Peraturan Presiden Nomor 14 Tahun 2021, belum berjalan sesuai ketentuan. Persentase partisipasi masyarakat dalam vaksinasi menunjukkan penurunan dari dosis pertama hingga dosis keempat. Kendala dalam implementasi kewajiban masyarakat tersebut berasal dari faktor hukum yang merumuskan kewajiban dan sanksi, kurangnya ketegasan penegakan hukum terhadap pelanggaran, serta keterbatasan sarana dan prasarana penegakan hukum. Selain itu, ketidakmampuan masyarakat dalam memilah informasi, terutama terkait kehalalan dan keamanan vaksin, juga menjadi faktor penghambat. Budaya hukum masyarakat yang masih rendah dalam mentaati hukum turut memperumit implementasi kewajiban vaksinasi Covid-19. Dalam konteks ini, diperlukan langkah-langkah perbaikan dan perkuatan, baik dari segi penegakan hukum maupun peningkatan literasi masyarakat, agar implementasi kewajiban vaksinasi dapat berjalan lebih efektif dan sesuai dengan tujuan pemerintah dalam mengendalikan penyebaran Covid-19.

Abstract

Desa Gunungsari, Kabupaten Madiun, memiliki potensi yang sangat besar untuk dikembangkan menjadi desa wisata hijau (Green tourism-village). Di setiap akhir pekan Pasar Punden di desa Gunungsari ramai pengunjung dari desa-desa lainnya. Sistem perdagangan yang unik dengan menggunakan token dari bambu berwarna-warni menambah ketertarikan desa ini. Melihat geliat perkembangan yang ada saat ini, desa Gunungsari dapat dijadikan desa percontohan wisata edukasi lingkungan. Salah satu isu yang utama adalah pemilahan sampah. Kegiatan sehari-hari di desa Gunungsari, dan utamanya kegiatan akhir pekan di pasar punden menyisakan banyak sampah baik berupa sampah plastik dan nonplastik. Belum dilakukannya upaya untuk memilah sampah serta masih minimnya tempat pembuangan sampah menjadikan pentingnya edukasi bagi masyarakat mengenai pengelolaan sampah. Mendasarkan pada analisa kebutuhan tersebut, maka pendampingan ini digagas untuk memberikan pemahaman dan pendampingan atas potensi desa Gunungsari sebagai Desa Edukasi Lingkungan melalui pemilahan sampah dari tahap awal. Pemahaman ini penting untuk menghapuskan pandangan bahwa sampah hanyalah sampah dan tidak bermanfaat bagi masyarakat secara ekonomi. Dengan melakukan pendampingan atas potensi desa ini sebagai Desa Edukasi Lingkungan, diharapkan akan memberikan efek domino bagai desa-desa lain di sekitarnya, juga bagi masyarakat pengunjung mengenai pentingnya melakukan pemilahan sampah.

Abstract

Activities in the creative tourism business can have a significant detrimental effect on the environment, including depletion of natural resources, pollution, and the physical impact of tourism. Environmental impact analysis, also known as EIA, and environmental law enforcement are critical to the creative tourism business. The EIA is a tool for preventing environmental pollution and/or damage, and enforcing environmental law is strongly tied to the apparatus's ability and citizens' compliance with applicable legislation, which covers three areas of law. The EIA is designed to keep environmental conditions at a certain level of quality to enable development continuity. EIA is one of the concrete tools for achieving and sustaining sustainable development. Since law enforcement is an attempt to ensure public order, as well as how crucial it is to comply with environmental law provisions to suppress the negative effects generated by environmental damage and pollution with the existence of tourism industry activities. This study is a normative legal study with applied statutory approach and conceptual approach. A literature review was undertaken to support the creative tourism industry, using primary and secondary legal documents in the form of legislation and legal literature that discuss EIA and environmental law enforcement.

Abstract

This study aims to determine the effect of the work environment and stress at work on employees' work productivity in a company. Illustrate for the community in general and the company, and several factors can cause the increase and decrease in work productivity. This study uses quantitative research with exploratory, descriptive data presentation by taking a sample at a university in East Java. With multiple linear regression techniques can be seen the relationship that occurs to these problems. The results of this study indicate that the Work Environment (X1) and Stress at Work (X2) influence Work Productivity (Y). This research also includes suggestions for improvement to increase work productivity

Abstract

Government construction projects operate under a public financial oversight regime that allows legal and financial consequences to arise after project completion and contractual payment. This study examines the legal implications of ex post audits conducted by the Audit Board of the Republic of Indonesia on legal certainty for construction service providers in government projects and analyzes their effects on business certainty during project implementation. This research is using socio-legal analysis with legal and economic perspectives. The findings indicate that ex post audits consistently generate financial recommendations with values that fluctuate widely across semesters, ranging from tens of billions to tens of trillions of rupiah. These recommendations emerge after construction completion and contractual payment, placing financial and administrative consequences in a retrospective position. Dominant audit indicators include weaknesses in internal control systems, statutory non-compliance, and uneconomical, inefficient, and ineffective use of public funds. This pattern shows that contractual finality in government construction projects depends on audit outcomes and follow-up implementation rather than contractual performance alone. The study indicates that legal and business certainty for construction service providers in government projects develop in a delayed manner under post-execution public financial oversight.

Abstract

Penelitian ini dilatarbelakangi oleh meningkatnya kasus kekerasan terhadap perempuan dan anak di Kabupaten Bima serta belum optimalnya penempatan strategis polisi wanita (Polwan) pada Unit Perlindungan Perempuan dan Anak (PPA) Polres Bima. Penelitian ini bertujuan untuk menganalisis pertimbangan strategis dalam penempatan Polwan serta implikasinya terhadap efektivitas kinerja Unit PPA. Metode yang digunakan adalah pendekatan kualitatif deskriptif dengan studi kasus dan fenomenologi. Pengumpulan data dilakukan melalui wawancara mendalam, observasi, dan analisis dokumen dengan melibatkan pejabat kepolisian, anggota Polwan, dan pihak eksternal terkait. Hasil penelitian menunjukkan bahwa pertimbangan strategis dipengaruhi oleh aspek psikologis dan sosiologis korban, kompetensi personel, kebijakan internal, serta ketersediaan dan distribusi Polwan. Kehadiran Polwan terbukti meningkatkan kualitas pelayanan, kepercayaan korban, efektivitas penanganan kasus, serta perlindungan psikologis. Namun, masih terdapat kendala seperti keterbatasan jumlah personel, distribusi yang belum merata, beban kerja tinggi, dan kurangnya dukungan organisasi. Kesimpulannya, penempatan Polwan memiliki peran penting dalam mewujudkan pelayanan kepolisian yang responsif gender, namun diperlukan model penempatan yang lebih strategis dan komprehensif agar efektivitas pelayanan dan perlindungan korban dapat ditingkatkan secara optimal.

Abstract

Toward the increase in village revenue sources, a post of published Law No. 6/2014 concerning Village, it is confirmed that the village can establish village-owned enterprises (BUMDes) based on family spirit and cooperativeness. Besides, BUMDes can run a business in the field of economic and/or public service in accordance with the provisions of the legislation. BUMDes is established by the village government to utilize all potential economic, institutional, natural, and human resources in order to improve the welfare of the villagers. In fact, implementation of the BUMDes management in some areas is not fully optimized, in many cases the problem is corruption. Therefore, we need a good management or governance practices to improving the livelihoods of the village. The study used statute approach, conceptual approach, and case approach. The conclusions of this study are directed to apply the concepts of strengthening national laws relating to the management of BUMDes in order to strengthen the village's economy in Indonesia and to achieve empowerment of rural community and reduce corruptionthat often occurs and harm the economy of the village.

Abstract

This research analyzes and formulates solutions to the problem of land law dualism in Indonesia which is characterized by the conflict between customary law (living law) and positive law (positive law). This dualism has created tensions between the recognition of indigenous peoples' rights to land and the state's authority to regulate the control and use of land, resulting in legal uncertainty, overlapping arrangements, and protracted agrarian conflicts. This research uses normative legal research methods with a focus on literature studies, examining primary legal materials such as the 1960 Basic Agrarian Law, the 1945 Constitution, and land-related regulations; secondary legal materials in the form of scientific literature, legal journals, research results, and the views of experts; and tertiary legal materials in the form of legal dictionaries, encyclopedias, and other supporting references. The approaches used include a historical approach to trace the roots of land law dualism since the colonial era, a conceptual approach to examine the theory of customary law and positive law, a legislative approach to analyze applicable legal norms, and a case approach through the study of land practices in Gorontalo, the Special Region of Yogyakarta, and Papua. The results of the study show the need for the integration of customary law into the national land law system through strengthening the position of customary law as a legitimate source of land law, the establishment of laws on indigenous peoples, and the preparation of regional regulations in areas that still have indigenous communities. This effort is expected to end the dualism of land law and create legal certainty that is in line with local values.
