Abstract

The objective of this study is to investigate the act of postponing the execution of inheritance distribution in the Seunuddon village, located in North Aceh. This study employs sociological legal approaches, which are examined through the lenses of al-'urf and the notion of legal pluralism. Data was gathered through extensive interviews conducted with religious leaders, community leaders, and successors. This study determined that delays in the distribution of inheritance in Seunuddon had persisted for an extended period, with some cases resulting in patah titi and subsequent complications. The delay arises due to entrenched customs, the survival of one parent, inadequate economic conditions, lack of family discussions regarding inheritance division, reluctance to distribute the inheritance immediately due to feelings of embarrassment, and the incapacity of young children to handle the inheritance. Secondly, while examining customary Islamic law, the act of delaying the allocation of inheritance is encompassed within the concepts of 'urf sahih (valid custom) and 'urf fasid (invalid custom). Out of the four cases examined, three cases did not present any issues related to inheritance, as each party got and obtained the legacy funds. Nevertheless, there are instances in which the designated successor has deceased (patah titi), leading to complications in the process of inheriting assets. Within the framework of 'urf theory, the initial three instances can be classified as 'urf sahih, however, the final instance is deemed 'urf fasid due to its propensity for generating injustice, albeit preserving the bond of brotherhood. According to the doctrine of legal pluralism, there exists a dialectic and accommodation between Islamic law and societal customs to provide social harmonization and integration.

Abstract

This study discusses the nature of the curriculum in Islamic education which is an important component in education. This paper is qualitative in nature with an Islamic educational philosophy approach. The research concludes that the basic framework of the Islamic education curriculum is based on revelation and value of tauhid to Allah SWT. The curriculum has four foundations, namely; philosophical, sociological, organizational, and psychological, while the principles of the curriculum, for example, are based on Islamic values, integral and flexible. Then the first curriculum orientation is preserved Islamic values, students, labor and science and technology. In essence, the curriculum content must include three parts, namely; scientific intelligence (cognitive), skills (psychomotor) and values. Likewise the curve of evaluation and review as changes from social change and the times. Therefore, it is important to emphasize that essence, basic framework, principles, orientation and content refer to the reference to Islamic values ​​and monotheism as a characteristic and relationship of Islamic education. This characteristic of monotheism is what distinguishes Islamic education and Western education from a philosophical perspective.

Abstract

Islam entered the archipelago peacefully brought by Sufi scholars and is influential to this day. Sufism is a dimension of Islamic teachings that is able to answer the problems of society from the past to the present. Sufi scholars also fought against colonialism supported by Sufi brotherhood or tariqa in which there was a concept of obedience to the teacher. The reformulation of classical Sufism which is individual, personal, is important enough to become a communal collective. This article is a qualitative study analyzed using the perspective of sociology of religion. Today, Sufism remains important in various aspects of education, social movements, and moral improvement. If using the perspective of sociology of religion, Sufism is able to provide spirit and strength to humans so that Sufism values transform for the better. The values of Sufism in question are for example, qana'ah, patience, gratitude which provide solutions to the problems of human life. Not only limited to educational, social and moral improvement aspects but more than that.Islam masuk ke Nusantara secara damai dibawa oleh para ulama sufi dan berpengaruh sampai saat ini. Tasawuf merupakan dimensi ajaran Islam yang mampu menjawab problematika masyarakat sejak pada masa lalu sampai sekarang. Ulama sufi juga melakukan perlawanan terhadap kolonialisme yang didukung oleh persaudaraan sufi atau tarekat yang di dalamnya terdapat konsep ketaatan pada guru. Reformulasi tasawuf klasik yang bersifat individual personal cukup penting menjadi kolektif komunal.Artikel ini merupakan studi kualitatif yang dianalisis dengan menggunakan perspektif sosiologi agama. Saat ini kemudian bangsa Indonesia semakin maju sufisme tetap menjadi sesuatu yang urgen dalam berbagai aspek pendidikan, gerakan sosial, dan perbaikan akhlak. Jika menggunakan perspektif sosiologi agama, bahwa tasawuf mampu memberikan spirit dan kekuatan pada manusia sehingga nilai-nilai tasawuf bertransformasi ke arah yang lebih baik. Nilai-nilai tasawuf yang dimaksud misalnya, qanaah, sabar, syukur yang memberikan solusi problematika kehidupan manusia. Tidak hanya sebatas aspek pendidikan, social dan perbaikan akhlak akan tetapi lebih dari itu.

Abstract

This article discusses an interesting phenomenon in Gampong Lhok Pawoh, where the community continues to maintain and preserve the tradition of yasinan in the Rabu Abeh ritual despite the shifting or even extinction of many religious traditions in the modern era. This research employed qualitative methods (field research) and adopted Spradley's ethnography approach and the perspective of the living Qur'an. This study aims to describe how the Qur'an comes alive in the yasinan tradition of the Rabu Abeh ritual, which is still upheld by the community of Gampong Lhok Pawoh, as well as the significance of this tradition in their daily lives. The findings reveal that the yasinan tradition in the Rabu Abeh ritual is a tangible manifestation of the living Qur'an among the people of Gampong Lhok Pawoh in Aceh Barat Daya. This tradition is performed every year on the last Wednesday of Safar, as a plea for safety and protection from potential disasters on the day of Rabu Abeh. The community perceives the connection between verse 19 of Surah Al-Qamar/54, which depicts an unfortunate day, and the Rabu Abeh day; hence, they collectively recite Surah Yasin as a prayer and safeguard against potential calamities. The tradition holds strong spiritual and social meanings within the community, serving as an effort to seek salvation from Allah SWT, preserving cultural heritage, fostering social bonds, and cultivating excellent and respectful personalities. Moreover, the tradition reminds the community of the importance of maintaining harmonious relationships with nature while strengthening solidarity and preserving customs and culture

Abstract

The curriculum is a government policy in the field of education determined by the government. The curriculum has continued to change according to the times and advances in science and technology. This study uses a qualitative method by producing descriptive data as an observable social reality, namely the educational curriculum. The social reality is then analyzed using public policy theory. This article concludes that the curriculum as a political policy from the Indonesian government in the field of education is a logical consequence of social change and development of science. From 1999 to 2013 there were three changes to the curriculum, namely the Competency-Based Curriculum (KBK), the Education Unit Level Curriculum (KTSP) and the 2013 Curriculum (K-13). Each curriculum has its own focus and emphasis point. The purpose of the curriculum changes carried out by the government from a theoretical point of view of public policy is oriented towards fulfilling the needs and interests of the community. So that the curriculum can still be adapted to social changes, scientific and technological developments that occur in society in Indonesia and the wider world

Abstract

This study reveals teachers' innovation in teaching ikhfa material using the Problem-Based Learning model, significantly enhancing students' understanding of tajweed and critical thinking skills. The problem-based learning model is one of the appropriate strategies in improving the learning process, including learning the science of recitation, especially the law of ikhfa'. Ikhfa' legal material is very important to study, because it has difficulties in pronouncing it. The research question is how to apply the problem based learning model to ikhfa' legal material? How do students' Al-Qur'an reading skills improve after implementing the problem based learning model on ikhfa' legal material?  The method used in this research is Classroom Action Research (PTK) which consists of 2 cycles and each cycle consists of planning, implementation, observation and reflection stages. The research results found that in cycle I, Ustadzah's activities showed results of 73% in the good category and experienced an increase in cycle II with a score of 93% in the very good category. Student activities in cycle I got a percentage score of 72% in the good category and experienced an increase in cycle II with a percentage score of 94% in the very good category. The results of improving students' Al-Qur'an reading skills after implementing the problem based learning learning model on ikhfa' legal material in cycle I got an average score of 53.2 with the less successful category and experienced an increase in cycle II with an average score of 83.31 with the good category of success criteria. The application of the problem based learning model can improve the skills of reading the Al-Qur'an on Ikhfa' material for the students of TPA Raudhatul Qur'an in Aceh Besar.

Abstract

This study seeks to explore the challenges faced by the minority group of Muslim families in Bali and Hindu families in Makassar in practicing their religious beliefs, highlighting the insufficient facilities and community support available to them. They need to put in more effort to uphold the practice of worship, holidays, and fasting. Marriage significantly influences numerous facets of life, encompassing social, emotional, financial, and legal dimensions. The research method employed is qualitative, analyzed through a theological lens. Qualitative analysis techniques rely on qualitative data, which consists of words and is essential for drawing thorough and high-quality conclusions. Data were gathered through comprehensive interviews and a thorough analysis of the literature. The study's findings indicate that for Muslim families in Bali, interactions significantly influence theological aspects related to worship, culture, customs, and social interactions. In Bali, Muslim families experience significant interactions and acculturation, particularly in the realm of marriage, which profoundly impacts theological aspects, including the concept of worshiping God, differing from the beliefs held by the Hindu community in the region. Muslim families hold a belief in one God, whereas the Hindu-Balinese community embraces the existence of multiple gods and goddesses, leading to various forms of worship. Muslim families in Bali enjoy the freedom to engage with other communities, primarily Hindu, just as Hindu families in Makassar do, reflecting the open nature of the people in both regions. Consequently, it will influence inclusive, moderate, and tolerant theology regarding religious differences.

Abstract

Stunting, characterized by impaired growth and development in children under five years old, represents a significant global nutritional issue, particularly in Indonesia. This study aims to explore stunting prevention and child protection from the perspective of Islamic education. Employing a qualitative methodology with a phenomenological approach, the research seeks to understand and interpret specific events and social situations related to stunting and child protection within the Indonesian context. Data were collected through in-depth interviews and documentation, specifically involving lecturers at UIN Ar-Raniry Banda Aceh. The findings reveal that the incidence of stunting in Indonesia remains alarmingly high compared to other middle-income countries, leading to decreased cognitive abilities, heightened health risks, and diminished future productivity. The research concludes that stunting prevention and child protection are critical national programs that require synergistic implementation to secure a better future for children and ensure their right to quality education. From the perspective of Islamic education, these efforts are intrinsically linked, as Islamic teachings emphasize the importance of proper care, provision of halal and nutritious food, which positively influence both the physical and mental well-being of children. The study highlights the need for integrating Islamic educational principles in national stunting prevention strategies to foster holistic child development.

Abstract

Every family desire a happy household, but sometimes conflict within the family is unavoidable, resulting in domestic violence. This article aims to examine the forms of domestic violence, the determinants of domestic violence, and highlight the history of domestic violence and the implementation of Law No. 23 of 2004 concerning the Elimination of Violence. This research uses an empirical method with a gender and sociology of law approach. Data were collected in two ways: through in-depth interviews with victims of domestic violence, academics, experts in legal sociology, Islamic law, and gender experts, and through literature searches such as journal articles, books, and legal regulations. The results of the study concluded that forms of domestic violence were caused by physical, psychological, sexual violence and domestic neglect. Determinants of domestic violence include economic factors, the perpetrator's angry character, early marriage, and as a result of the social structure that exists in a patriarchal society where male power and domination are very dominant. The government has issued a law on the elimination of domestic violence to provide a clear legal basis for handling domestic violence cases (KDRT), but the implementation of the law has not been optimal. Therefore, violence against women is caused by various interrelated factors. Effective collaboration between all stakeholders not only the government, but also communities, educators, religious leaders, and non-governmental organizations is sociologically necessary to empower women. This study also found that women should be encouraged to have access to quality education that fosters intellectual development, awareness of human rights, and economic, social, and political capacity.
