Abstract

The issue of citizenship is one part of the study of state studies or commonly referred to as State Administration Law. One element of state existence is citizenship (algemene staatslehre). In the context of citizenship, the issue of citizenship is critical because, in general, the state consists of three elements, namely the territory, people who are identical with citizens, and sovereign government as a constitutive element and the recognition of other countries as declarative elements. Every citizen must have citizenship because it is an essential thing. After all, citizenship has a close relationship between the citizen and the country in which the citizen lives. These matters relate to citizens related to identity, rights, obligations, participation or participation, and shared social ownership. In addition, with citizenship, citizens automatically have legal protection wherever they are. Having two citizenships is no longer a taboo for citizens and is likely to continue to develop in the future. The fact is that there are citizens aged 18 years or over who have dual citizenship, even though the ownership of dual citizenship should be limited. One of the rights of every citizen is the right to be elected and elected. However, there are still citizens who have dual citizenship. Because of dual citizenship, approaching the General Election confuses citizens of those who have dual citizenship but still wants to fulfill their rights in electing potential national leaders and also the right to lead Indonesia. Abstract

The most significant share of child laborers in the world is in agriculture and plantations, where they do various types of agricultural jobs, ranging from small to medium family farming to large agricultural, plantation or agroindustry businesses. The ILO estimates that more than 132 million girls and boys aged 5-14 years old are involved in planting, harvesting agricultural products, spraying pesticides and raising livestock in rural areas and plantations worldwide. The child labor phenomenon in tobacco plantations in Jember Regency has existed since the Dutch colonial era. Several studies have been conducted concerning child labor in tobacco businesses, such as YPSM (1988), Pusat Analisis Sosial Akatiga Bandung (1994 and 2002), Mahbubah (2003), revealed that the problem of child labor and its influencing factors are the "constant" issue. This phenomenon is ironic, considering that Jember tobacco is one of the leading export products for Indonesian tobacco, which significantly benefits the country and entrepreneurs. Although child labor has been banned, many plantations in Jember Regency still employ children. Many factors contribute to child labor in several plantations in Jember Regency, including economic and educational factors. Abstrak: Bagian terbesar pekerja anak di dunia bekerja di pertanian dan perkebunan, di mana mereka melakukan berbagai jenis pekerjaan pertanian baik usaha pertanian keluarga berukuran kecil maupun sedang hingga usaha pertanian, perkebunan atau agro industri yang besar. ILO memperkirakan bahwa di seluruh dunia lebih dari 132 juta anak perempuan dan laki-laki berusia 5-14 tahun terlibat dalam kegiatan penanaman, pemanenan hasil pertanian, penyemprotan pestisida dan pemeliharaan ternak di wilayah-wilayah pedesaan dan perkebunan. Fenomena pekerja anak di perkebunan Tembakau pada Kabupaten Jember sudah ada sejak zaman penjajahan Belanda. Beberapa penelitian yang telah dilakukan mengenai pekerja anak di usaha tembakau seperti yang dilakukan oleh YPSM (1988), Pusat Analisis Sosial Akatiga Bandung (1994 dan 2002), Mahbubah (2003) menunjukkan bahwa masalah pekerja anak dan faktor-faktor yang menyebabkannya merupakan masalah yang “konstan”. Hal ini tentu saja menjadi sangat ironis mengingat tembakau Jember merupakan salah satu produk andalan ekspor bagi tembakau di Indonesia yang banyak memberi keuntungan bagi negara dan pengusaha. Meskipun telah dilarang akan tetapi masih banyak perkebunan di Kabupaten Jember yang mempekerjakan anak, hal ini karena terdapat banyak faktor yang menyebabkan mengapa anak masih banyak yang terlihat di beberapa perkebunan di Kabupaten Jember, salah satunya adalah faktor ekonomi dan faktor pendidikan. Abstract

This article discusses Bondowoso District's regional human rights action plan (RADHAM) 2018. The focus of the 2018 RADHAM study explains the background and focus of Bondowoso's 2018 RADHAM policy as the basis for human rights-based policy making in the area. In the context of the division of power between the central and regional governments in the era of autonomy, human rights policy planning becomes complex because there are several regional and central policies that are mutually conflicting so that the mechanism for fulfilling human rights in the regions becomes complicated. To map this issue, local governments need a policy mechanism that focuses on mapping human rights issues that are used to determine the mechanism for solving problems and fulfilling human rights in their regions. This RADHAM policy will then be used as a reference for Bondowoso Regency to maximize the fulfillment of human rights in its territory.

Abstract

Citizen Lawsuit is a law enforcement process with a mechanism for filing a lawsuit by citizens. The implementation of Citizen Lawsuit in Indonesia is termed still gray because there are no specific laws or regulations that regulate the mechanism either substantively or procedurally. The basis of the existence of a Citizen Lawsuit is negligence or violation by the state administrator of the laws and regulations and the General Principles of Good Governance (AUPB). The Citizen Lawsuit mechanism deserves a deeper study, because in its development there have been many Citizen Lawsuit lawsuits submitted to the General Court in terms of environmental law enforcement, fulfillment of human rights, violations of the principles of good general governance, and so on. By looking at the essence of the Citizen Lawsuit, the idea emerged that the Citizen Lawsuit must be legally adopted as part of positive law in HAPTUN for the sake of legal enforcement and certainty. The study, entitled the relevance of Citizen Lawsuit as a positive legal instrument in the procedural law of the state administrative court, aims to examine and analyze how the concept of the Citizen Lawsuit mechanism in the perspective of the State Administrative Court and whether it can be adopted as part of its positive law. The author uses research methods with a normative juridical approach or legal research as well as scientific literacy literature studies. The author's ideas are expected to provide a more comprehensive view of the perspective of Citizen Lawsuit in State Administrative Procedural Law and the relevance of Citizen Lawsuit to positive law. Citizen Lawsuit in the perspective of HAPTUN relates to the subject matter of the Defendant, the claims in the lawsuit related to the demands of attitudes or actions by state administrators, and their functions or objectives in fulfilling the rights of citizens. The main reason for Citizen Lawsuit can be adopted into positive law is because the concept of Citizen Lawsuit never conflicts with laws and regulations, and in its implementation provides many solutions to existing citizen problems and improves the implementation of the rights of citizens by state administrators. However, it is necessary to review the mechanism of Citizen Lawsuit in making positive law by adapting and adjusting to the Indonesian legal system so that in practice it can run effectively and optimally.

Abstract

Perkembangan Pedagang Kaki Lima (PKL) di Jalan Jawa tidak terelakkan perkembangannya dari tahun ke tahun semakin banyak dan padat seiring dengan keberadaan mahasiswa yang semakin banyak menuntut ilmu di Universitas Jember. Kadangkala keberadaan Pedagang Kaki Lima tersebut menimbulkan ketidaknyamanan terhadap jalannya lalu lintas disekitar. Pemerintah daerah dalam hal ini mempunyai kewenangan mengatur permasalahan tersebut untuk mewujudkan Pemerintahan yang Baik (Good Governance) sesuai dengan asas-asas penyelenggaraan Pemerintahan yang Baik (AUPB). Penelitian ini bertujuan untuk mengetahui tentang tindakan pemerintah yang dilakukan untuk menangani permasalahan Pedagang Kaki Lima, kemudian bagaimanakah fakta di masayrakat khususnya mengenai Pedagang Kaki Lima (PKL) apakah sesuai apa yang diatur dalam peraturan perundang-undangan yang berlaku yaitu apa yang diatur dalam Peraturan Daerah Nomor 6 tahun 2008 tentang Pedagang Kaki Lima. Abstract

Indonesia is the Unitary State. It is understood that within a unitary state, the central government operates a high state sovereignty. In order not to be arbitrary, the activities of the central government are supervised and limited by the constitution. The government which is divided from the Central Government to the Regional Government included Regional Autonomy therein, as well as the authority of the Regional Government, is on duty to manage the Regional Property. In carrying out its authority as an administrator of local property, there are still many abuses or omissions committed by the local government in operating its authority in managing regional property, such as the negligence of the Regional Assets, the misuse of authority in the revocation of rights already granted by the regional government on the right to use of local property, using local property for personal interest. In the management of regional property required planning, implementation, and supervision by the local government in accordance with applicable laws and regulations in the constitution. Abstract

The original income of the village is income derived from the business of the village, the result of the village's assets, self-help and community participation, mutual assistance, and other village income. All revenues originating from original village revenues, regional revenue, and regional retribution, ADD, financial assistance from provincial and district / municipal governments, both general and specific, and non-binding third-party donations or contributions other legitimate village revenues must be recorded in an orderly manner. Other Original Revenues The villages are among others derived from village levies. The levies in the village are levies on the use of village halls, levies on prospective villagers, and so on. In Article 25 paragraph (1) of Regulation of the Minister of Home Affairs of the Republic of Indonesia Number 113 of 2014 concerning Village, Finance Management explains that the Village Government is prohibited from levies as acceptance of villages other than those stipulated in village regulations. Abstract

This article describes the relationship between the authority local governments and participation in the management of the potential of the region. The authors argue that local government has a broad authority within its jurisdiction to manage local potentials. One of the tasks borne by government is by following the country, namely hold some of the state as organization power, one of them is given to the public and private in publishing licensing. On one side, the role of the community is very important in the management of the potential of the region as a form of concern of the community development of area, then with the participation of the community hope to increase the income of the around and for the local government assets. On the other hand, residents as a their nets a an ongoing activity. Later in this article explain also forms of public participation in the management of the potential of the region. This article use the study literature regarding the authority local governments and the study legislation about the authority local governments that applies. The results of the study concluded that extent authority local governments one of which is the licensing on the management regional potential, on the other side, required public participation in the management of potential an area. Abstract

Integrity, good character, justice, and expert statesman of the constitution as the indicators to appoint Constitutional Judge should be taken into account by the Supreme Court, the House, and the President in the selection process. The cases of corruption named Akil Mochtar and Patrialis Akbar as the convicted and the suspected persons respectively should be regarded as an appropriate opportunity to evaluate law relating to the Constitutional Judges selection process in which it is not clearly defined in the Constitutional Court Act. To date, the law relating to selection is given to respective institutions where the Supreme Court takes the selection internally with no transparency, the House only requires to write and present article, and—in some cases—the President prefers to appoint with no adequate criteria. The article uses doctrinal research in addressing the case related to the current regulation on constitutional judge selection. It concludes that the Supreme Court, the House, and the President ignore the principles of transparency, participatory, objectivity, and accountability in the selection, including the possibility of resulting unqualified judge. The selection needs reconceptualization comprising the establishment of expert panel, unaffiliated candidate to a political party, and re-concept of selection mechanism. Abstract

Penerapan sistem otonomi yang diamanatkan UUD NRI 1945 berimplikasi pada terbaginya kekuasaan pemerintah pusat pada pemerintah daerah, hal tersebut didasarkan pada asas desentralisasi, dekonsentrasi dan tugas pembantuan. berdasarkan hal tersebut pemerintah daerah berhak membentuk perda untuk mengatur daerahnya, disinilah muncul salah satu peran pemerintah pusat dalam melakukan pengawasan dan pembinaan terhadap pemerintah daerah dengan melakukan pengawasan terhadap perda dengan cara melakukan pengujian perda (excecutive review). Pengujian perda tersebut bermuara pada mekanisme pembatalan perda yang dianggap bertentangan dengan ketertiban umum dan hukum yang lebih tinggi. Namun disini terdapat inkonsisten yang dilakukan oleh pemerintah dalam menggunakan instrumen hukum untuk membatalkan perda. Sudah tegaskan pada UU No. 32 Tahun 2004 Tentang Pemerintahan Daerah bahwa pembatalan perda dilakukan oleh Presiden dengan menggunakan Perpres, sedangkan pada Permendagri No. 53 Tahun 2007 Tentang Pengawasan Peraturan Daerah Dan Peraturan Kepala Daerah menyatakan bahwa pembatalan perda APBD, Pajak, Retribusi dan RTRW dilakukan berjenjang oleh Mendagri untuk perda pemprov dengan menggunakan Permendagri dan oleh Gubernur untuk perda Kabupaten/Kota dengan menggunakan Pergub. Tetapi dalam prakteknya pembatalan perda secara keseluruhan dilakukan oleh Mendagri dengan menggunakan Kepmendagri. Disinilah terjadi ketidakkonsistenan dari segi kewenangan dan penggunaan instrumen hukum oleh pemerintah dalam melakukan pembatalan perda. Hal tersebut tentu memiliki implikasi hukum terhadap perda-perda yang telah dibatalkan pemerintah melalui Kepmendagri. Kata Kunci : executive review, pembatalan perda, dan instrumen hukum.
