Abstract

In the Banjarese culture of South Kalimantan, there are a number of ancient wedding traditions that are still practiced today. One of these is the maantar jujuran, which is used to determine whether or not a marriage will be successful. The purpose of this study is to examine the maantar jujuran tradition of Banjares marriage in South Kalimantan through the lens of Peter L. Berger's social constructionist theory. This study employed a descriptive quantitative methodology with phenomenological analysis of the Banjar community in South Kalimantan. Methods for compiling data from many sources of literature relevant to research. The results of this study show that traditional Banjarese marriages have been conducted in a manner similar to the heritage that constitutes the nenek moyang warisan. According to social constructionist theory, interactions between members of different communities regarding rural justice traditions have been going on for quite some time in this study. Many people still practice this tradition because they believe in its inherent goodness. Additionally, it is known that one of the goals of the Banjar people in carrying out this tradition is to elevate their social standing within the community. It is hoped that this study would contribute to the growth of knowledge, particularly in the field of family law; given that Indonesia has such a wide variety of cultural norms when it comes to conducting marriage ceremonies, this topic is particularly interesting from a sociological, cultural, political, and other vantage points. Dalam budaya Banjar Kalimantan Selatan, ada beberapa tradisi pernikahan kuno yang masih dilakukan hingga saat ini. Salah satunya adalah maantar jujuran, yang digunakan untuk menentukan berhasil atau tidaknya suatu perkawinan. Tujuan dari penelitian ini adalah untuk mengkaji tradisi maantar jujuran perkawinan Banjar di Kalimantan Selatan melalui teori konstruksi sosial Peter L. Berger. Penelitian ini menggunakan metodologi deskriptif kuantitatif dengan analisis fenomenologi masyarakat Banjar di Kalimantan Selatan. Metode pengumpulan data dari berbagai sumber literatur yang relevan dengan penelitian. Hasil penelitian ini menunjukkan bahwa perkawinan adat Banjar telah dilakukan dengan cara yang mirip dengan warisan leluhur nenek moyang. Menurut teori konstruksi sosial, interaksi antara anggota komunitas yang berbeda mengenai tradisi peradilan pedesaan telah berlangsung cukup lama dalam penelitian ini. Banyak orang masih mempraktekkan tradisi ini karena percaya akan kebaikan yang terkandung di dalamnya. Selain itu, diketahui bahwa salah satu tujuan masyarakat Banjar dalam menjalankan tradisi ini adalah untuk mengangkat derajat sosial mereka di tengah masyarakat. Diharapkan penelitian ini dapat memberikan kontribusi bagi pertumbuhan ilmu pengetahuan, khususnya di bidang hukum keluarga; Mengingat bahwa Indonesia memiliki norma budaya yang begitu beragam dalam pelaksanaan upacara perkawinan, topik ini sangat menarik dari sudut pandang sosiologis, budaya, politik, dan lainnya.

Abstract

Arranged marriages remain significant in Muslim Kerinci society, where cultural traditions and Islamic values shape family life. This study explores the factors sustaining marital harmony and how women negotiate agency within family expectations and religious norms. Using a qualitative approach with in-depth interviews involving community leaders, scholars, and couples in Air Hangat Barat District, the research highlights the interplay between structural norms and individual choices. Findings show that shared religious values, moderation in household management, tolerance of shortcomings, supportive parental roles, and affection rooted in Islamic teachings are key to harmonious families. While cultural and religious frameworks function as structural constraints, women exercise agency by negotiating their roles and influencing marital outcomes. The study’s novelty lies in integrating Islamic perspectives with sociological and gender theories to explain how tradition, faith, and agency interact to sustain arranged marriages in contemporary Muslim contexts.

Abstract

This study examines the mosque-based family corner in Malang Regency as a community institution implementing a legal awareness intervention programme for victims of domestic violence. The research specifically analyses the design and implementation of this intervention through the perspective of Jamaluddin Athiyyah’s maqāṣid al-usrah, while also evaluating key programme components such as legal education, counselling, mediation, and legal advocacy aimed at enhancing victims’ legal awareness. Employing field research with a descriptive-qualitative approach, data were collected through in-depth interviews with family corner counsellors, religious figures, and community leaders, complemented by direct field observations of programme activities. The findings demonstrate that the mosque-based family corner plays a significant role in assisting families affected by domestic violence, particularly by increasing victims’ understanding of their legal rights and encouraging informed decision-making through non-litigation mechanisms. The intervention programme contributes positively to strengthening family integrity, restoring communication, and fostering a shared commitment to preserving family unity following incidents of domestic violence. These outcomes are consistent with the core objectives of Jamaluddin Athiyyah’s maqāṣid al-usrah, including the realisation of sakinah, mawaddah, and rahmah within the family; the protection of life (ḥifẓ an-nafs); the safeguarding of religious values (ḥifẓ at-tadayyun); and the reinforcement of family institutions as a foundation of social stability. This study enriches the scholarly discourse on legal awareness among women victims of domestic violence, particularly those who choose counselling-based, non-litigation pathways, and highlights the strategic role of mosque-based community institutions in promoting access to justice and family resilience.

Abstract

Every year, the divorce rate in Indonesia continues to grow. Based on data released by the Central Bureau of Statistics (BPS) through the katadata database in early 2020, the divorce rate from 2015 has increased until 2019. In 2019 there were 408,202 cases of divorce. The high rate of divorce certainly has an impact on the lives of both partners, one of which is the issue of child custody or in Islam it is called hadhanah. A child who is still unable to take care of his life until adulthood must be cared for or given a decent life by their parents. Child custody is always an issue between the mother and father when they decide to divorce. Caring for and looking after children who are victims of divorce is obligatory for both parties. The research method used is qualitative normative. The result of this research is that the issue of hadhanah or child custody has been described in detail in the Compilation of Islamic Law in our country. If there is a dispute in this hadhanah issue, it can be resolved by arbitration.

Abstract

General Background Islamic inheritance is a central component of Islamic family law explicitly regulated by the Qur’an and Hadith, yet it remains debated because of gender-based disparities in relation to justice and public welfare. Specific Background This study examines contemporary debates on gender justice in Islamic inheritance law through a structured review of reputable journal articles published between 2015 and 2025, guided by hermeneutical reading and the maqāṣid al-sharīʿah perspective. Knowledge Gap Previous studies have often remained within two opposing poles, namely textualist-apologetic defense of the 2:1 inheritance ratio and revisionist-contextual demands for equal shares, without offering an integrative Islamic epistemological synthesis. Aims This study analyzes the normative basis of inheritance distribution, evaluates classical and modern debates on unequal inheritance rights, and offers a reinterpretive framework grounded in internal Islamic hermeneutics, maqāṣid al-sharīʿah, and maṣlaḥah. Results The study maps three major positions: textualist-apologetic, revisionist-contextual, and Islamic feminist critiques. It also reveals a movement toward proportional justice, where inheritance rights are considered in relation to real economic responsibility and contribution, especially when a person functions as the main provider. Novelty The study formulates maqāṣid al-sharīʿah as a manhaj wasaṭī, or mediating framework, that integrates textual authority, socio-historical context, and substantive justice. Implications This framework supports a contextual yet textually grounded understanding of Islamic inheritance law for inclusive and gender-responsive legal reasoning. Abstract

Pembatalan perkawinan tetap menjadi isu yuridis penting yang menyangkut perlindungan hak dan kepastian hukum dalam lembaga perkawinan. Studi-studi sebelumnya sebagian besar meneliti pembatalan perkawinan dari perspektif hukum normatif, dengan perhatian terbatas pada interaksi antara keadilan dan kepastian hukum dalam penalaran yudisial. Studi ini bertujuan untuk menganalisis dasar hukum dan pertimbangan yudisial dari keputusan pembatalan perkawinan di Pengadilan Agama Bandung melalui perspektif keadilan dan kepastian hukum. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan hukum perundang-undangan, kasus, dan teori hukum, dengan analisis kualitatif bahan hukum primer, termasuk Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam. Temuan menunjukkan bahwa penyebab utama pembatalan adalah pelanggaran Pasal 9 Undang-Undang Perkawinan, di mana salah satu pihak masih terikat secara hukum dalam perkawinan sebelumnya, ditambah dengan kelalaian administratif Kantor Agama (KUA) dalam memverifikasi status perkawinan. Keputusan tersebut mencerminkan keadilan korektif dan keadilan Rawls sebagai keadilan dengan melindungi pasangan yang dirugikan sekaligus memulihkan ketertiban hukum. Kebaruan terletak pada penyajian pembatalan perkawinan sebagai mekanisme untuk menyeimbangkan keadilan substantif dan kepastian hukum dalam peradilan hukum keluarga di Indonesia.
