Abstract

This research is normative legal research, an explanatory descriptive nature that aims to describe, disclose and explain the relationship between the non-criminal investigation of consumer protection with consumer guarantee agreements. The analysis is carried out using a juridical approach method which is then synchronized vertically or horizontally to related laws to see the existence of harmonization and certainty in the existing legal system. To further sharpen the results of the study also carried out an analysis of the effectiveness of the case. The results of the study provide an illustration that the Fiduciary Security Act has a problem in Article 15 regarding the provisions of the procedure for execution that is contrary to the HIR / RBg. Likewise, between Article 54 paragraph (3) and Article 56 paragraph (2) of the Consumer Protection Act, an inconsistency occurs in its application and implementation. With respect to agreements containing standard clauses, business actors and / or their management can be criminalized, in accordance with Article 18 in conjunction with Article 62 of the Consumer Protection Act. It is recommended that the Government and the House of Representatives of the Republic of Indonesia be able to revise these articles in order to realize legal certainty for all parties.

Abstract

The state is obliged to ensure that health services are provided for women, especially family planning (KB) services, pregnancy, childbirth, postpartum or exclusive breastfeeding. It cannot be denied that until now there are still many offices / companies and Malls that ignore the existence of lactation rooms. Whereas the obligation of work organizers to provide lactation space has been regulated in the Republic of Indonesia Minister of Health Regulation Number 15 of 2013. The regulation of procedures for providing breastfeeding space aims to provide protection to mothers in exclusive breastfeeding and fulfill children's rights to receive exclusive breastfeeding. The provision of this breastfeeding corner facility is devoted to meeting the needs of mothers and babies who still have to breastfeed, and at the same time aims to increase exclusive breastfeeding for babies as one of the main nutrients. This step also plays a role in reducing infant mortality, because the baby's immunity will increase through breast milk. However, the reality on the ground says differently. So the problem is what is the legal arrangement for lactation room facilities in shopping centers (Malls) in Medan City? and What are the legal consequences for the unavailability of lactation space in shopping centers (Malls) in Medan City? This type of research used in this research is normative legal research. Abstract

This study aims to determine the application of Article 2 Paragraph (2) to decision No: 29/Pid.Sus-TPK/2021/PN.Jkt.Pst. The subject matter focuses on how the application of Article 2 Paragraph (2) and the judge's consideration of the decision. The research method used is juridical-normative with a statutory and case approach with data analyzed descriptively and analytically. The results showed that the judge did not apply Article 2 Paragraph (2) but instead applied Article 12 letter b, even though the Covid-19 pandemic was included in the elements of certain circumstances. Whereas judges have the authority to make decisions outside the indictment to create decisions that are in favor of the community. Not applying Article 2 Paragraph (2), the judge could not apply Perma No. 1 of 2020 Sentencing Guidelines Article 2 and Article 3 in his considerations even though the defendant's actions had fulfilled the classification of the Perma. In addition, the mitigating consideration by the judge that the defendant had been found guilty and was reviled by the community did not reflect a just decision with an orientation towards moral, social, and legal justice.

Abstract

This research aims to analyze the law and the influence of globalization on the legality of medical marijuana. The influence of globalization can play a role in policy change. Countries may be responding to global trends regarding the legalization of medical marijuana and feel the need to follow emerging standards at the international level. In Indonesia itself, the discourse on the legality of medical marijuana has developed, but it has not been regulated in law. This research uses normative legal research methods. Data collection was carried out by literature study and document analysis. The research results show that the background to the legality of medical marijuana is related to a combination of medical, social, economic and political factors. The legalization of medical marijuana involves understanding its potential benefits in medicine as well as changing societal views and legal regulations. There are medical benefits from the cannabinoids found in marijuana, such as THC (tetrahydrocannabinol) and CBD (cannabidiol). That marijuana can help treat several medical conditions, including chronic pain, epilepsy, seizures, and symptoms of other chronic illnesses. In Indonesia, the National Narcotics Agency (BNN) as a government institution strongly rejects the discourse on the legalization of marijuana policy. The legalization of medical marijuana is guided by the bad effects and lack of urgency in the use of this plant. The economic reasons behind the policy of legalizing marijuana are considered wrong because if it is legalized there will be an increase in use and cause accidents which will result in medical and rehabilitation costs.

Abstract

Corruption are not adequately addressed by the current legal framework, which fails to provide appropriate sanctions or follow the Constitution in dealing with such crimes. Simply imposing prison sentences is insufficient; efforts must also be made to recover state losses incurred due to corruption. there are still significant constraints in the implementation and enforcement of the law. This study aim to analyze how the applicable laws are enforced to recover financial losses incurred by the state in cases of criminal corruption; and identify the factors inhibiting the effective implementation of laws related to the recovery of these financial losses. This study employs both normative legal methods and empirical research. The research results suggest that to restore the country's economy affected by criminal corruption, it is necessary to undertake measures such as the foreclosure of assets owned by the convicted individuals. Sanctions should include not only monetary compensation equivalent to the value of the assets obtained through corruption but also criminal fines and decisions on the confiscation of goods. One major internal constraint in recovering state finances is the tendency of convicts to opt for prison sentences rather than paying damages as determined by the court.

Abstract

This study aims to determine the Regulation of the Use of Marijuana for Medical Purposes: Comparison of Civil Law and Common Law Legal Systems. This research uses normative juridical research methods using literature studies derived from Legislation, scientific journals, books related to medical cannabis discourse and analyzed qualitatively. Regulations related to Class I Narcotics in Indonesia are regulated in Law Number 35 of 2009 and Regulation of the Minister of Health of the Republic of Indonesia Number 30 of 2023. The use of cannabis as medicine is an urgent need. European countries are at the forefront of legalizing medical cannabis. Some European countries with a Civil Law legal system have different regulations in legalizing marijuana for medical purposes based on ownership restrictions. Meanwhile, countries with a Common Law legal system establish medical cannabis legalization policies based on the needs of patients, the quality of health provision, and the protection of patient rights. This study concludes that countries with a Common Law legal system have a pragmatic, case-based legal style that functions through logical reasoning while countries with a Civil Law legal system are more about practical implications.

Abstract

The position of daughters in the inheritance distribution system based on Karo customary law in Nangbelawan Village stipulates that daughters do not inherit. When they receive an inheritance in the form of Pemere (gift) from male relatives, this provision does not ensure justice for daughters in obtaining their rightful inheritance. In contrast, the Civil Code and Supreme Court Jurisprudence Code No.179/K/SIP/1961 emphasize gender equality in inheritance rights, which often leads to family disputes. In cases of disputes in the village, conflict resolution is conducted through Arih-arih (consensus deliberations). This research combines normative and empirical legal studies using qualitative research methods, with secondary data sources and descriptive analysis. The findings reveal that daughters' positions in inheritance distribution differ from those of sons, with the allocation of one-third of the inheritance from brothers. The dispute resolution mechanism, Arih-arih, involves neutral mediators such as Anak Beru, Kalimbubu, and Village Heads. The customary inheritance system still prevails in the village, with limited progress in its development.

Abstract

Corruption is an act that not only harms state finances, but also the economy of society. The crime of corruption that often occurs is a national problem that must be handled seriously, sought to overcome through a balance of certainty and clear steps, involving all the potential that exists in society, especially the government and the parties responsible for law enforcement. This research method uses normative juridical. The data obtained is sourced from secondary data. The process of investigation and investigation in criminal acts of corruption begins with complaints from the public, NGOs (non-governmental organizations), and dumas (public complaints); then the Police analyze the case; then if a criminal act of corruption is found, the investigator will conduct a case title; then the investigator seeks and collects evidence; then the investigator determines the suspect; then the investigator prepares the case file; and the corruption case file is submitted to the prosecutor's office. The obstacles of the Police in tackling criminal acts of corruption are internal obstacles and external obstacles, as for the internal obstacles are budget problems, human resources, facilities and infrastructure, while the external obstacle is the lack of public understanding of anti-corruption culture.

Abstract

Penyediaan sayuran sehat dan bergizi dengan metode microgreen merupakan peluang yang dapat dimanfaatkan oleh kelompok PKK Desa Tanjung Sari dalam pemenuhan sayuran keluarga secara mandiri guna pencegahan stunting. Sayuran microgreen memiliki keunggulan dipanen lebih awal (7-21 hari setelah tanam), lebih bergizi 4-40 kali, lebih tinggi dibandingkan sayuran dewasa, variasi tanaman banyak warna yang menarik dan teknik budidaya yang mudah. Kegiatan pengabdian kepada masyarakat (PkM) bertujuan untuk : 1.Meningkatkan pengetahuan, keterampilan dan sikap (PKS) kelompok PKK Desa Tanjung Sari dalam budidaya tanaman dengan metode microgreen. 2. Memberdayakan kelompok PKK dalam swamedikasi sayuran microgreen untuk pembuatan jus dan smoothie sebagai minuman sehat bergizi pencegah stunting. Pelaksanaan kegiatan menggunakan metode training dengan pemberian materi manfaat microgreen, budidaya microgreen dan penyajian microgreen untuk dikonsumsi. Setelah peserta mendapatkan materi dilanjutkan dengan praktik secara individu dengan tim PKM. Peserta pelatihan adalah kelompok PKK Desa Tanjung Sari. Hasil evaluasi angket sebanyak 90% peserta pelatihan relatif puas dengan kegiatan pemberdayaan kelompok PKK Desa Tanjungsari, Deli Serdang dalam implementasi kreasi pangan berbasis microgreen menuju Desa Tanjungsari bebas stunting. Sebanyak 100% peserta mendapatkan pengetahuan berkaitan dengan stunting dan cara pencegahannya melalui konsumsi microgreen, 84% peserta telah memahami dan terampil dalam melakukan budidaya tanaman microgreen dan 100% peserta berniat melanjutkan kegiatan penanaman tanaman microgreen secara mandiri untuk pemenuhan sayuran sehat bergizi keluarga serta 88% peserta tahu dan dapat mengolah hasil panen microgreen menjadi makanan dan minuman sehat keluarga dan semua peserta (100%) meminta agar kegiatan ini berkelanjutan
