Abstract

Studies on the role of villages in combating human trafficking have not been much discussed. This paper examines the efforts of the grass roots to counter human trafficking in Lembata, Indonesia. Data based on observations, interviews with the government, and discussions with six migrant workers' communities in Lembata. The methods used are qualitative research methods with literary approaches and empirical approaches. The results of the research indicate that the people of the village in Lembata have succeeded in providing alternative livelihoods for the former Indonesian Labour Force through the strengthening of the productive economy. This community has also been able to train and support the candidate TKI to acknowledge its rights and duties. This study proves that the bottom-up system is an effective way to tackle human trafficking.

Abstract

The long and winding historical journey of the Prophetic Hadith has placed it as a subject that is never devoid of controversy and discourse disputes. One of the crucial issues often debated across various circles revolves around the history of the writing and compilation of Hadith. Indeed, discourse regarding this codification has been wielded as a potent weapon by Orientalists and those who deny the Sunnah (a group opposing the Sunnah) to discredit the Hadith or Sunnah and challenge its authenticity as the second source of Islamic law after the Quran. The contention among Muslims, as criticized by Orientalists, revolves around the issue of the validity of the writing and compilation of Hadith when viewed from normative considerations (such as the sayings of the Prophet, the reports of the Companions, and the followers), ultimately leading to doubts about the authority of the Sunnah itself within the broader framework of Islamic Law. This paper aims to provide initial clarification on the pros and cons surrounding the codification of the Prophetic Hadith.

Abstract

This study aims to examine the Islamic political concept of minority political participation and compare its implementation in the contexts of Indonesia and Singapore. The research is a qualitative study utilizing a comparative method, combined with descriptive and analytical approaches. The data sources are twofold: primary sources, such as the Constitutions of the Republic of Indonesia and Singapore, and secondary sources, including several academic works relevant to the research topic, sourced from both print and online media. Data analysis was carried out in four stages: data collection, reduction, presentation, and conclusion drawing. The findings of this study indicate that political participation refers to the actions of citizens to influence government policies, enabling the government to be guided towards issuing egalitarian policies. Minorities in Indonesia include Protestants, Catholics, Buddhists, Hindus, and Confucians, while minorities in Singapore comprise Muslims, Christians, Hindus, Confucians, Taoists, and atheists. Indonesia is a moderate country that blends Islamism and secularism, whereas Singapore is a secular state. The conclusion of this study reveals that most Islamic scholars argue that non-Muslim minorities cannot fully participate in politics unless in emergency situations. On the other hand, liberal Muslim intellectuals believe that non-Muslims can fully participate in politics, even outside of emergency contexts. The majority of Muslim intellectuals in both Indonesia and Singapore allow full political participation for minorities, including becoming president, as there are no restrictions in either country preventing minorities from holding the presidency. The comparative analysis shows that minorities in both Indonesia and Singapore have equal standing with the majority. However, in Indonesia, no minority has yet succeeded in becoming President, whereas in Singapore, Halimah Yacob, a Muslim minority, became the country’s first female president.

Abstract

This article explores the need for an MUI fatwa on persons with disabilities. Humans are creatures of God who are created to have a set of rights as humans that must be safeguarded and protected. Islam recognizes and respects the existence of people with disabilities and upholds their rights. This is because Islam encourages its followers to have compassion and love for all humanity. The method used in this research is qualitative research with a literature study research type. The literature research approach involves collecting and analyzing data from various literature related to the need for an MUI fatwa on persons with disabilities. The result of this research shows that the need for an MUI fatwa on persons with disabilities serves as an effort to increase the awareness of all Indonesian people, especially Muslims, about the importance of showing respect and value to persons with disabilities as humanitarian brothers, national brothers and even Islamic brothers. It can also be used to strengthen the rights of persons with disabilities in various fields and encourage the creation of an inclusive environment.

Abstract

This article is intended to answer questions on the legal considerations of the Constitutional Court Decision No. 22/PUU-XV/2017 regarding the minimum age of marriage for women and how the Judgment is seen from the Muhammad Saʻîd Ramaḏân al-Bûṯî's maslahah theory and the theory of gender equality in Islam. From the conducted studies, several conclusions can be drawn. First, the Judge's legal considerations in canceling the minimum age of marriage in decision No. 22/PUU-XV/2017 are based on consideration of discrimination acts, health and educational aspects, child exploitation, the minimum age requirement for marriage in various countries, and policy demands related to marriage age. Second, in terms of the al-Bûṯî’s maslaẖah theory, the Constitutional Court's ruling on the equalization of marital age between men and women is not categorized as a maslahah, since it does not meet the five criteria for something to be called as a maslahah. Third, according to the gender equality theory in Islam, it can be concluded that the Constitutional Court's decision is not suitable to the theory, since the meaning of equality in Islam is not to be equal but rather to the fulfillment of rights according to the level of needs.

Book Review: Euis Nurlaelawati, Modernization, Tradition, and Identity: The Kompilasi Hukum Islam and Legal Practice in the Indonesian Religious Court, Amsterdam: Amsterdam University Press, 2010.The introduction of the Compilation of Islamic Law (CIL) has to be seen in the context of the modernisation of Indonesia's Family Law. CIL was first introduced to accomodate the interests of Muslim families in Indonesia's legal system. CIL provides guidelines and references for judges at Religious Court in handling legal issues related to Muslim families. CIL was also introduced to provide Islamic judges alternative reference other than the conventional fiqh, which, in many cases, are not relevant to the current context of Muslim lives. Abstract

AbstractThis study is applied a descriptive-normative method which used to explain, describe, and analyze a particular event that is a proceeding submitted by the plaintiff against environmental pollution and damage, namely landslides on Mount Mandalawangi, using the concept of illegal acts The results of this study are: First, the compensation applied in the case of the Mount Mandalawangi landslide is based on the strict liability principle. The implication of the theory stated that the injured complainant is not required to prove the mistakes made by the defendant. Even if the defendant can prove that he is blameless, but there is a clear and proven impact of the loss in court, the defendant still obliged to pay for the compensation. Secondly, the Supreme Court's cassation decision is under the provisions of the prevailing laws and regulations in Indonesia, especially in the case of illegal acts, both confirmed in Article 1365 of the Civil Code (KUHPer) or regulated in the Protection Law and Environmental Management (UU-PPLH).Keywords: Environmental law, strict liability, claim for compensation, Supreme Court  Abstrak:Studi ini bersifat deskriptif-normatif. Studi ini akan menjelaskan, menggambarkan, dan menganalisis suatu peristiwa tertentu yaitu suatu peristiwa tuntutan hukum yang diajukan oleh pihak penggugat yang terhadap pencemaran dan rusaknya lingkungan yaitu longsornya lahan di gunung Mandalawangi, dengan menggunakan konsep hukum perbuatan melanggar hukum. Adapun temuan dari studi ini adalah: Pertama, ganti kerugian yang diterapkan dalam kasus longsornya gunung Mandalawangi ini berdasarkan pada asas strict liability. Implikasi dari penggunaan teori tersebut, penggugat yang dirugikan tidak diharuskan untuk membuktikan kesalahan yang dilakukan oleh tergugat. Bahkan, bilapun tergugat dapat membuktikan bahwa dia tidak bersalah, namun ada dampak kerugian yang jelas dan dibuktikan di pengadilan, tergugat tetap memiliki kewajiban untuk membayar ganti kerugian tersebut. Kedua, putusan kasasi Mahkamah Agung sesuai dengan ketentuan peraturan perundang-undangan yang berlaku di Indonesia, terutama dalam hal perbuatan melawan hukum, baik yang ditegaskan dalam Pasal 1365 Kitab Undang-Undang Hukum Perdata (KUHPer) ataupun yang diatur di dalam Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup (UU-PPLH).Kata kunci: Hukum lingkungan, strict liability, gugatan ganti rugi, Mahkamah Agung Аннотация В данном исследовании применяется описательно-нормативный метод, который используется для объяснения, описания и анализа конкретного события, представляющего собой судебную тяжбу, представленную истцом в отношении загрязнения и нанесению ущерба окружающей среды, а именно дело о лавине на горе Мандалаванги, с использованием концепции закона неправомерного акта. Полученные результаты в этом исследовании: Во-первых, компенсация, применяемая в случае схода лавины на горе Мандалаванги, основана на принципе Strict Liability. Вовлечение теории гласилo, что потерпевший истец не обязан доказывать ошибки, допущенные ответчиком. Даже если ответчик может доказать, что он невиновен, но существует явное и доказанное влияние потери в суде, ответчик все же обязан выплатить компенсацию. Во-вторых, кассационное решение Верховного суда соответствует положениям действующего законодательства и нормативных актов Индонезии, особенно в случае неправомерного акта, которые подтверждены в статье 1365 кодекса Гражданского права (KUHPer) или регулируются Законом о Защите и Регулировании Окружающей Среды (UU-PPLH).Ключевые слова: экологическое право, Strict liability, Тяжба о компенсации, Верховный суд

Abstract

This article discusses the legal politics of legal transformation for persons with disabilities in Indonesia. The Indonesian nation has always recognized and guaranteed respect for human dignity, including persons with disabilities. This can be seen in Law No. 4 of 1997 on Persons with Disabilities, which explains the government's efforts to protect the rights of persons with disabilities by focusing on rehabilitation, providing social assistance, and maintaining social welfare. However, the text content in the law still adheres to a charity-based paradigm, so it has not been able to handle and ensure equal opportunities for persons with disabilities. The method used in this research is normative juridical with primary legal materials Law No. 19 of 2011 concerning the Ratification of the Convention on the Rights of Persons with Disabilities and Law No. 8 of 2016 concerning Persons with Disabilities through a legislative and historical approach. The results of this study show that the legal politics of the formation of Law No. 8 of 2016 on Persons with Disabilities shows the realization of participatory democracy. The transformation of the law changes the paradigm from charity-based to human rights-based, which better guarantees the protection, promotion, and enforcement of the rights of persons with disabilities. Public education on the rights of persons with disabilities, the development of disability-friendly infrastructure, and increased participation of persons with disabilities in decision-making are important for implementation.
