Abstract

The title of this study is a model of inter-regional cooperation in the Settlement Authority In District / Municipal Expansion. This research is motivated many conflicts / disputes regarding both the authority on government affairs and other matters between the Regional Holding with areas of the division. Results of the study include, first, the policy of regional expansion in addition to having the advantage in matters relating to the acceleration and improvement of public services and also has brought the potential development that could affect the relationship between regional harmonization with the Regional Holding Redistricting results, primarily due to a conflict of authority on asset management area. Second, the model of inter-regional cooperation in resolving disputes between the authority of the regency / municipality division of the District Holding wear two (2) approach, which is a formal legal approach and local wisdom approach, namely by providing “touch” argument that “touch” people’s emotional, the use of the term “interests of the whole community and mutual respect” with no regard to administrative boundaries of the Regional District of Holding and Expansion Results. This means that the interests of the community should be encouraged regardless of whether the incoming administration in the District or Regional Expansion.

Abstract

This research entitled: Study Focus of Provincial Autonomy In the constitutional system of the Republic of Indonesia. The result of the research can be concluded that the First, the 1945 Constitution does not give a clear regulation about the options in the unit of local authority where the policy emphasis autonomy placed. The Second, in the history of the accomplishment regional administration, the policy emphasis on the autonomy at the regional Level II/regency/City normatively used to be implemented at the time of the validity of Law Number. 5 of 1974 and Law Number. 22 of 2004. The third, in the normative perspective chances of emphasis on provincial autonomy in the future is very open, it is because at the Article 18 of the 1945 amendments to the results of an open policy (open legal policy) about regional autonomy and regional autonomy center of gravity. In these provisions, do not regulate in which the emphasis regional autonomy placed. Thus the focus wisdom of regional autonomy is highly dependent on the political will of the legislators with regard to the situation of country, such as politics, security, economy and society when the law was made and the policy of the center gravity of regional autonomy in the Provincial or the Regency/City is not contradictory with the Constitution of Republic of Indonesia Year 1945.

Abstract

Decision of Constitutional Court of Republic Of Indonesia Number 41/PHPU.D-VI/2008 is law breakthrough / invention of law ( rechtsvinding) because judge is not funnel of law, Judge have freedom in verdicting is reflection of independence / freedom of judge based on justice values and living law which growth and expand in society. By tekstual decision of Constitutional Court Number 41/PHPU.D-VI/2008 earning isn't transgression because reason of consideration of judge command the Lokal Commission of General Election of East Java to execute re- balloting can be concluded do not fulfill clauses as based in Section 219 sentence ( 1) and ( 2) of  The 2008 General Election Code Number 10, and have potency to impinge rule of Section 233 sentence (3) of  The 2008 Local Government Code Number 12 Second Change of The 2004 of the Local Government Code Number 32. Kata Kunci : Terobosan Hukum

Abstract

Judges supervision in Indonesia’s constitutional system in the future will only be performed by Judicial Commission. Judicial Commission involves Judicial Commission, Provincial Judicial Commission and District/City Judicial Commission based on each authority. The research discusses model of judges supervision to implement an independent judicial power for the future Indonesia. This research is a normative juridical research with statute approach and conceptual approach. The results show Local Judicial Commission has duties and authorities to; First, monitor and surpervise Judges’ behavior. Second, receive report from the people related to the violence of Ethic Code and/or Judges Code of Conduct. Third, verify, clarrify, ad investigate report related to presumption of violation of Ethic Code and/or Judges Code of Conduct covertly. Fourth, take legal action and/or other actions to individual, group or legal entity that degrade the honor and dignity of Judges.Keywords: Judicial Commission, judicial power, supervision

Abstract

Law Number 13 of the Year 2012 on Yogyakarta Special Region’s privileges containing a legal affirmative democracy system leads to the weakening of democracy and has implications for non-substantive democracy. It furthermore reflects the normative ambiguity of the democratic system which legitimizes Yogyakarta’s privileged affairs. Therefore, this research aims to analyze Yogyakarta’s privileged affairs based on Islamic Law Eclecticism by reconstructing the democratic system in Law Number 13. Using the normative-doctrinal method accompanied by statutory and conceptual approaches, this research used the content analysis method and legal descriptive techniques. This research shows that the democratic system of DIY is crystallized and simultaneously presented in the form of the Trilogy of Yogyakarta Democratic Principles. Those consist of ngencengke oyot, ngencengke pang, and njagani godhong lan kembang. Based on this, the reconstruction of the democratic system of Yogyakarta’s privilege affairs leads to communal democracy as a form of revitalizing its privilege affairs. Besides, that trilogy, based on Islamic Law Eclecticisms, refers to the interconnection of maqâṣid al-syarī’ah cum-rechtsidee and al-‘urf. The reconstruction of the democratic system in Law Number 13 potentially revitalizes Yogyakarta’s privileged affairs by making local wisdom its core value.

Abstract

The Republic of Indonesia’s reformation era, many human rights violations occurred during, including human rights violations in cases of Trisakti, Semanggi 1, and Semanggi 2. There were ethnic, racial, and religious conflicts. The state is obliged to provide protection for victims of human rights violations. The Human Rights Commissioner plays a role in issuing policies/decisions to resolve cases of human rights violations that require a long time to resolve. Unfortunately, the term of office of the Chairperson/Deputy of the National Commission for Human Rights (NCHR) only lasts 2 years and 6 months after which they can be re-elected. This is regulated in Regulation of the NCHR No. 2 of 2019 concerning the Order of the NCHR. It is impossible to properly settle cases of human rights violations with a commissioner term of office that is only limited to 2 years and 6 months. Therefore, legal construction is required to revise the term of office of the NCHR Chairperson and Deputy. This paper was library research, namely research using library data from books and journals. It was found that the NCHR had trouble resolving human rights cases due to political pressures. Then, the NCHR Chairperson and Deputy’s term of office should be revised to five years so that they have more time to serve the people by resolving cases of human right violations.

Abstract

Dewan Perwakilan Daerah lahir dari perubahan ketiga Undang-Undang DasarNegara Republik Indonesia Tahun 1945 (UUD NRI 1945). Gagasanpembentukan DPD adalah dalam rangka menghadirkan sistem checks andbalances baik antar cabang kekuasaan maupun dalam internal lembagalegislatif yang disebut sistem parlemen dua kamar (bicameralism).Namun,dalam pengaturan kewenangan fungsi pengawasan DPD tidak diatur samakuat dengan DPR sehingga menjadikan pelaksanaan fungsi pengawasanDPD tidak maksimal, hal tersebut juga menjadikan sistem checks andbalances di internal parlemen tidak berjalan sebagaimana yang diharapkan.Penelitian ini bertujuan untuk mengetahui implementasi fungsi pengawasanDPD berdasarkan UUD NRI 1945. Jenis penelitian yang digunakan adalahyuridis normatif yaitu penelitian yang dilakukan dengan cara meneliti datasekunder. Sumber data yang digunakan data sekunder yang bersumber daribahan hukum primer dan sekunder. Metode pengumpulan bahan hukummenggunakan studi kepustakaan. Analisis bahan hukum secara normatifkualitatif. Hasil penelitian diperoleh bahwa eksistensi fungsi pengawasan DPDterdapat dalam UUD NRI 1945, UU No. 17 Tahun 2014 tentang MPR, DPR,DPD dan DPRD (MD3) dan Peraturan DPD No. 2 Tahun 2019 tentang TataTertib. Pelaksanaan fungsi pengawasan DPD terdiri dari pengawasan kelembagaan dan pengawasan perseorangan, dimana pengawasan kelembagaan meliputi pengawasan atas pelaksanaan undang-undang dan pengawasan terhadap keuangan negara serta pengawasan perseorangan mengawasi terkait pelaksanaan undang-undang oleh pemerintah daerah. Hasil dari pengawasan DPD nantinya diserahkan kepada DPR sebagai bahan pertimbangan untuk ditindaklanjuti. Untuk mempertanggunjawabkan hasil pengawasanya kepada masyarakat DPD mempublikasi hasil pengawasan tersebut melalui media cetak dan elektronik.Kata Kunci: Dewan Perwakilan Daerah (DPD), Fungsi Pengawasan

Abstract

This article aims to identify the problems of implementing inter-regional cooperation from the widest possible autonomy perspective. This becomes important because cooperation between regions seems to run well shortly after policies in the form of laws and government regulations are enacted. However, in regional cooperation, many problems lurk and can lead to the failure of cooperation between regions. This research is legal research using a statute approach, a conceptual approach, and a historical approach. This research method and approach are appropriate to explain the problematic phenomenon of cooperation between regions in Indonesia based on Law No. 23 of 2014 concerning Regional Government. Based on the results of preliminary research, several problems arise in the implementation of regional cooperation, especially cooperation between regions, including the following: First, cooperation between regions whose object is related to income sharing often experiences difficulties in its implementation, especially in determining the amount of income/profits for each region; Second, the emergence of regional egoism, especially in the cooperation between the Parent Region and the regions resulting from the expansion; Third, the lack of data and information about the object of cooperation that has the potential to be better if implemented through cooperation between regions that are geographically close together; Fourth, the lack of initiation to carry out cooperation between regions due to the mindset of each region to deal with internal affairs only; and Fifth, no institution/agency specifically handles inter-regional cooperation.

Abstract

The formulation of procedural law within the constitutional court is a crucial requirement, as stipulated by Article 24 C paragraph (6) of the 1945 Constitution of the Republic of Indonesia. While the Constitutional Court Procedural Law is outlined in Law No. 24 of 2003 on the Constitutional Court, it merely provides general points. Special aspects, aligned with individual case characteristics, are deferred to the Constitutional Court for independent regulation based on Article 86 and the Explanatory Note to Law No. 24 of 2003. However, this delegation is inappropriate as procedural law should be governed by Law-level regulations, not by Constitutional Court Regulations (PMK). To date, the Constitutional Court continues to produce the Procedural Law in the form of PMKs. This study employs a normative juridical research method, with a statutory and conceptual approach, and conducts analysis in a qualitative descriptive manner. This paper concludes, firstly, that the creation of procedural law within the constitutional court holds philosophical, juridical and sociological significance. Secondly, the drafting process of the constitutional court’s procedural law must adhere to the process of forming sound laws and regulations and contain materials in line with their level as prescribed in the legislation.
