Abstract

Agama Islam mengajarkan manusia untuk realisasi diri terhadap kehadiran Tuhan yang disertai konsep pengalaman empiris, berupa tindakan sosial dan ritual yang di implementasikan ke dalam kehidupan sehari-hari. Prinsip ini merupakan panduan menjalani hidup yang baik di dunia bagi manusia menurut sistem Tuhan, dan sebagai bentuk manifestasi terpilihnya manusia sebagai khalīfah bumi sehingga, menjadi tanggung jawab manusia untuk melindungi bumi dari segala kerusakan, dan kekacauan, sehingga diharapkan manusia dapat menjalai hidup dengan aman, tenang, dan terhindar dari segala mara bahaya dan penyakit. Penelitian ini bertujuan untuk menjelaskan prinsip moral Islam dalam menghadapi wabah COVID-19 berdasarkan diskusi klasik tentang wabah dalam Islam yakni ṭā‘ūn menurut pemikiran Zakariyā al-‘Anṣārī dalam kitab Tuḥfah al-Rāgibīn Fī Bayāni ‘Amru al-Ṭawā‘īn dengan menggunakan metode penelitian kualitatif, dan jenis penelitian kepustakaan. Hasil penelitian menunjukkan bahwa konsep wabah yang diajarkan dalam Islam berdasarkan pemikiran Zakariyā al-‘Anṣārī dalam kitab Tuḥfah al-Rāgibīn Fī Bayāni ‘Amru al-Ṭawā‘īn yang secara garis besar di latar belakangi oleh prinsip menjaga diri (ḥifẓ al-nafs) dalam ajaran Islam, memiliki keterkaitan yang sama dengan sains, dan justru cenderung saling melengkapi, ini menjadi bukti bahwa tidak ada dikotomi antara keduanya. Dengan demikian ideologi ajaran Islam tentang wabah yang menunjukkan tata acara atau perilaku dalam menghadapi wabah tidak bertentangan dengan sains atau kajian ilmiah. Fakta ini menjadi nilai moral sendiri bagi muslim bahwa ajaran Islam adalah agama yang valid, dan hanya mengajarkan kebenaran untuk kebaikan keberlangsungan kehidupan manusia.

Abstract

Technology integration in education has become crucial in enhancing student engagement and learning outcomes, especially in Islamic studies such as Fiqh. Conventional teaching methods often fail to engage students, effectively leading to suboptimal learning achievements. This study addresses the issue by investigating the impact of a Nearpod-based Problem-Based Learning (PBL) model on students' performance in Fiqh lessons, specifically at MTs Al-Ma'arif Badung Bali. The research fills a gap in the application of interactive technology-integrated pedagogies within Islamic education, aiming to improve understanding and motivation. The study employed a Non-Equivalent Pretest-Posttest Control Group Design using a quantitative experimental approach. Sixty-three students participated and were divided into experimental and control groups through purposive sampling. Data collection involved tests, interviews, and documentation, analyzed using t-tests following normality and homogeneity testing. Key findings reveal a significant improvement in learning outcomes post-intervention. The experimental group taught using the Nearpod-based PBL model, achieved an average score of 73.44 compared to 61.41 in the pre-intervention phase. The significance value of 0.000 indicates a notable positive effect of the intervention. These results suggest that incorporating interactive technology and problem-based approaches enhances student engagement, critical thinking, and understanding of Fiqh concepts. This study underscores the potential of innovative teaching methods in transforming Islamic education. By leveraging technology, educators can bridge the gap between traditional practices and modern educational demands, fostering a more interactive and practical learning environment. The findings contribute to the growing discourse on integrating digital tools into pedagogical practices and highlight the need for broader implementation in diverse educational contexts.

Abstract

This study's purpose is to see the application of policies to accommodate population administration rights for unregistered married couples at the Population and Civil Registration Office of the Gresik Regency. This research is field research presented with a qualitative descriptive approach based on Gustav Radbruch's theory of legal objectives. Data is obtained by going directly to the field by conducting interviews with relevant department employees and documentation. The results of this study indicate that the provision of population administration rights for unregistered married couples at the Population and Civil Registration Office of Gresik Regency is following policy procedures and does not violate the rules. Based on Gustav Radbruch's idea of legal philosophy about the purpose of law, the granting of population administration rights for unregistered married couples has fulfilled the elements of legal objectives, namely justice, legal certainty, and legal benefits. Legal justice is indicated by the fulfillment of the constitutional rights of unregistered married couples to obtain public services equally. Married couples who do not have a marriage certificate or marriage certificate can still record their marriage as husband and wife on the family card. Legal certainty is indicated by the fulfillment of procedures by applicable regulations. Legal expediency is indicated by the fulfillment of the civil rights of children of unregistered married couples in the form of ownership of birth certificates containing the names of the father and mother parents.

Abstract

Abstract: This article is related to guaranteeing the rights of every child from rampant bullying cases that occur in society. Children are very difficult to speak out against what they receive, because they are limited in terms of knowledge of the law and moreover they are in the grip of adults. Children who are victims of acts of violence will become perpetrators of violence themselves when they are adults if they are not accompanied or handled optimally. Although prohibition of bullying or violence has been explained and affirmed in the Qur'an or Human Rights Act, in reality there are still many cases of Peru or violence. This article aims as additional knowledge for the community to provide more assistance to children and can avoid bullying. In Surah Al-Hujurat verse 11, it is clearly explained that Allah Swt expressly forbids his actions to do wrong to others by criticizing or obliging his dignity. Human rights analysis Bullying against children is a disgraceful act that can eliminate a person's rights, because in Article 28b paragraph (2) of the 1945 Constitution, it is emphasized that every child has the right to live, grow and develop and is entitled to protection from violence and discrimination.Keywords:  Accompaniment; Child Victim of Bullying; Interpretation; Human Rights.Abstrak: Artikel ini mendiskusikan terkait dengan jaminan atas hak-hak setiap anak dari maraknya kasus perundungan yang terjadi di masyarakat. Anak-anak sangat susah untuk bersuara menggugat apa yang mereka terima, hal tersebut dikarenakan mereka terbatas dalam hal pengetahuan terhadap hukum dan mereka berada dalam cengkraman orang dewasa. Anak yang menjadi korban tindak kekerasan akan menjadi pelaku kekerasan itu sendiri ketika sudah dewasa jika tanpa ada pendampingan atau penanganan secara maksimal. Meski larangan perundungan atau kekerasan telah banyak dijelaskan dan ditegaskan dalam Al-Qur’an ataupun dalam Undang-Undang Hak Asasi Manusia, namun dalam realitanya kasus perundungan atau kekerasan masih banyak terjadi. Artikel ini bertujuan sebagai tambahan pengetahuan bagi masyarakat agar memberikan pendampingan lebih kepada anak dan bisa menghindari sikap perundungan kepada anak. Pada surat Al-Hujurat ayat 11 dengan tegas dijelaskan bahwa Allah Swt secara tegas melarang makhluknya untuk berbuat dzolim kepada yang lain dengan mencela maupun merendahkan harkat dan martabatnya. Berdasarkan analisis HAM perundungan terhadap anak merupakan perbuatan tercela yang dapat menghilangkan hak-hak seseorang, karena dalam pasal 28b ayat (2) UUD 1945, ditegaskan bahwa setiap anak berhak atas kelangsungan hidup, tumbuh, dan berkembang dan berhak atas perlindungan dari kekerasan maupun diskriminasi.Kata Kunci: Pendampingan; Anak Korban Perundungan; Tafsir; Hak Asasi Manusia.

Abstract

Ulama plays various roles in the society, including as a social, economic, or cultural broker. However, when it comes to politics, ulama is sometimes only viewed as a magnet to attract electoral votes. This paper examined the representation of ulama in the media upon the nomination of KH. Ma’ruf Amin as Jokowi’s VP and aimed to shed a light on the extent such a representation could lead to the ulama’s image shift, by taking al-Mawardi’s concept of leadership into account. Considering the nature of the data, this study employed a descriptive-qualitative paradigm which attempts to produce descriptive information. The data; news texts were taken from four online media were collected through intensive reading and note-taking, while for social cognition purpose, the data were taken from student press activists and collected through a semi-structured interview. The results show that all the media under investigation employed a positive presentation upon KH. Ma’ruf Amin’s nomination by using various discursive strategies, such as presenting religious as well as political career background (authority), showing the burdens that imply a negative representation of others, and incorporating the numerical data to intensify the positive image being framed. Therefore, through those discursive vehicles, KH. Ma’ruf Amin’s image of leadership is solely projected in two qualities: religious authority and ability to manage public affairs.

Abstract

The allegations against the practice of institutionalized dorsumsisi in some parts of the world and teragenda as the material discourse fiqh, interesting to be responded and dismantled aspects of normatifitas and historicity. This paper discusses dorsumsisi, medical term to mention the practice of circumcision for women. Medically it is reported that dorsumsisi as a harmless operative procedure and in accordance with the biomedical theory of Victoria's biological determinism. This practice resulted in differences in legal status, Imam Syafii and some followers of Imam Hambali responded as obligatory. While some followers of Imam Hanafi, Imam Malik and some followers of Imam Syafii proclaim sunnah and followers of Imam Hanafi, some followers of Imam Malik and Hambali argue mustahab. Each with its own argument. Whatever the legal status that the ulama have produced, if this practice is carried out with an obsession with the medical benefits to be gained, then this practice is not a form of violence as expected. Tuduhan terhadap praktik dorsumsisi yang telah melembaga di beberapa belahan dunia ini dan teragenda sebagai materi wacana fiqh, menarik untuk direspon dan dibongkar aspek normatifitas dan historisitasnya. Tulisan ini membahas dorsumsisi, terma medis untuk menyebut praktik khitan bagi perempuan. Secara medis dilaporkan bahwa dorsumsisi sebagai prosedur operatif yang tidak berbahaya dan sesuai dengan teori biomedis dari determinisme-biologis Victoria. Praktek ini nembuahkan perbedaan status hukumnya, Imam Syafii dan sebagian pengikut Imam Hambali meresponnya sebagai sesuatu yang wajib. Sementara sebagian pengikut Imam Hanafi, Imam Malik dan beberapa pengikut Imam Syafii menyatakan sunnah dan para pengikut Imam Hanafi, sebagian pengikut Imam Malik dan Hambali berpendapat mustahab. Masing-masing dengan argumentasinya sendiri-sendiri. Apapun status hukum yang telah dihasilkan oleh para ulama, jika praktik ini dilangsungkan dengan obsesi manfaat medis yang akan didapat, maka praktek ini tidaklah merupakan bentuk kekerasan sebagaimana yang diduga.

Abstract

Life insurance marketed through banking institutions has become a widely used financial instrument in modern society. However, its practice has sparked legal debate among Islamic scholars, particularly regarding the potential presence of gharar, maisir, and usury (riba) in its contractual mechanisms. The differing views of contemporary Islamic jurisprudence (fiqh) on the legality of life insurance, both conventional and sharia, indicate the need for a comprehensive study that places this issue within the framework of Islamic transactions. This study aims to analyze the concept and practice of life insurance within banking institutions and review its legal status from a contemporary Islamic jurisprudence perspective. The study was conducted using a library research method by collecting data from classical and contemporary fiqh literature, fatwas from the National Sharia Council (MUI), financial authority regulations, and relevant scientific publications. The analysis was conducted descriptively and analytically to outline the legal issues and assess the conformity of life insurance practices with Sharia principles. The research results show that conventional life insurance still contains the potential for contract ambiguity and speculative elements, while sharia life insurance is considered more in line with the muamalah principle through the use of tabarru', mudharabah, or wakalah bi al-ujrah contracts. From the perspective of maqāṣid al-syarī'ah, the existence of insurance can be accepted as a form of protection for life and property as long as the mechanism is free from prohibited elements. Thus, life insurance in banking institutions can be considered valid according to Sharia if it is built on the principles of transparency, fairness, and trustworthy fund management in accordance with the provisions of contemporary jurisprudence.   Keywords: Life Insurance, Banking, Contemporary Jurisprudence

Abstract

Demonstrations serve as a symbol of public participation in a democratic state, yet they often escalate into anarchic actions that damage public facilities and disrupt social stability. This phenomenon reflects the tension between the ideal of freedom of expression and the reality of mass behavior on the ground. This study aims to examine the causes, dynamics, and legal implications of demonstrations that result in the destruction of public facilities, analyzed through the perspectives of state law and Islamic law. This research employs a qualitative method based on library research by reviewing regulations, academic literature, and the thoughts of both classical and contemporary scholars. The findings reveal that Law Number 9 of 1998 guarantees the right of citizens to express their opinions, while also providing strict limitations on actions that may lead to unrest or damage. Meanwhile, from an Islamic perspective, demonstrations are considered permissible as long as they do not cause harm and adhere to the principles of amar ma’ruf nahi munkar. The destruction of public facilities is classified as fasād, which is prohibited in Islamic law because it violates the principles of preserving property and life (ḥifẓ al-māl and ḥifẓ al-nās). This study concludes that demonstrations can only function as a constructive democratic tool when carried out peacefully, responsibly, and with respect for the public interest. A synergy between the community, security forces, and the state is needed to cultivate a mature and civilized democratic culture that does not harm public spaces.   Keywords: demonstrations, public facilities, Islamic law

Abstract

This article examines the phenomenon of cancel culture in the digital media era through the lens of Islamic ethics. Cancel culture, which refers to collective public punishment through social ostracism, online shaming, and reputational destruction, has become a dominant form of moral judgment in contemporary digital interactions. This study uses a conceptual and library research approach by analyzing classical and contemporary Islamic ethical principles, including adab al-ikhtilāf, ḥusn al-ẓann, al-amr bi al-ma‘rūf wa al-nahy ‘an al-munkar, and norms of public morality in Islamic scholarly tradition. The findings indicate that while Islam encourages accountability, moral correction, and the protection of public interest, the practices within cancel culture often contradict Islamic ethical values due to excessive blame, character assassination, absence of verification, and mob-based judgment. The study highlights that Islamic ethics emphasizes proportionality, restorative justice, and moral responsibility rather than punitive social destruction. Therefore, cancel culture reflects a crisis of moral communication rooted in digital anonymity, emotional amplification, and weakened ethical boundaries. This article concludes that Islamic ethical principles can provide a more humane, just, and constructive framework for addressing wrongdoing in digital spaces, preventing moral excesses while promoting responsible public discourse.   Keywords: Cancel culture, digital ethics, Islamic ethics, moral judgment, public morality.
