Abstract

This study aims to determine and analyze the function of the Press Council according to Article 15 of Law No. 40 of 1999 concerning the Press in its roles and actions in preventing hoax news. This research is a normative juridical analysis, by which the secondary data is in the form of the 1945 Constitution of the Republic of Indonesia Article 28 (F) and Article 15 of Law Number 40 of 1999 concerning the Press in particular. It is analyzed with a progressive legal theory from Satjipto Raharjo. The results of this study indicate that the Press Council, which has the status of an independent state institution, failed to maximize its role, especially its authority, in dealing with hoax news. The Press Law only has a simple function, like mediating press disputes. Due to its power, the Press Council has no authority to impose sanctions on violations committed by press companies. Moreover, the challenges faced no longer come from external sources but from the internal press itself, where currently, press companies often behave arbitrarily because the owners of press companies have used their media as a means of politics for the benefit of certain parties.

Abstract

The copyright infringement that is currently on the rise is the emergence of illegal TV streaming apps. The application is now very annoying to official broadcasting rights holders because the presence of such illegal streaming applications will cause losses. This paper aims to find out the form of legal protection as well as legal action for television stations that suffer losses from the piracy of such broadcasting activities.This study is a normative legal study with normative jurisprudence approach to critically analyse the criminal and civil law norms against piracy TV broadcasts through the Live Streaming application aimed at digging and revealing the protection and enforcement of the law for TV stations suffered losses as a result of such piracy.If a person is found to conduct broadcasting or distribution without the permission of the owner who violates the provisions of Article 25 paragraph (2) of the Copyright Act with the criminal punishment of Article 118 of the copyright Act. Whereas the perpetrator of illegal live streaming application that violates Article 32 paragraph (1) of the ITE Act, can be subject to criminal sanctions as referred to in Article 48 paragraph 1 of the Act. The resolution of copyright disputes can be carried out through litigation and non-litigation. It would be better for the public to choose to watch legally and subscribe through an official service despite having to pay for the safety and convenience of the user.

Abstract

Trademarks have played a significant role in safeguarding intellectual property within the fashion industry and have been instrumental in upholding the reputation of various companies, particularly those aspiring to adopt sustainability concepts. This research aims to delineate the legal challenges and potential solutions for protecting intellectual property rights related to trademarks and the integrity of claims for sustainability implementation in Indonesia, employing normative research methods and comparative analysis with Italy's legal framework. The analysis reveals several structural differences between Indonesia and Italy's trademark legal frameworks despite sharing similar objectives. Italy has already been able to foster the integrity of sustainable claims in the fashion industry through regulations from the European Union although no direct connection to trademarks exists. On the other hand, Indonesia has yet to regulate the integrity of sustainable claims in the fashion industry although it possesses a sufficient foundational framework that could be further developed through its connection to the communal intellectual property protection system. Secara tradisional, merek memiliki peran penting dalam melindungi kekayaan intelektual di dalam industri fesyen dan telah menjadi kunci dalam menjaga reputasi berbagai perusahaan, terutama yang berkeinginan menerapkan konsep keberlanjutan. Penelitian ini bertujuan untuk menguraikan tantangan hukum dan solusi potensial dalam melindungi hak kekayaan intelektual yang terkait dengan merek serta menjaga integritas klaim implementasi keberlanjutan di Indonesia, dengan menggunakan metode penelitian normatif dan analisis perbandingan dengan kerangka hukum Italia. Analisis ini mengungkapkan beberapa perbedaan struktural antara kerangka hukum merek di Indonesia dan Italia, meskipun memiliki tujuan yang serupa. Italia telah berhasil menggalang integritas klaim keberlanjutan di industri fesyen melalui regulasi dari Uni Eropa, meskipun tidak ada keterkaitan langsung dengan merek. Di sisi lain, Indonesia masih harus mengatur integritas klaim keberlanjutan di industri fesyen, meskipun memiliki landasan kerangka kerja yang memadai yang bisa lebih dikembangkan melalui keterhubungannya dengan sistem perlindungan kekayaan intelektual komunal.

Abstract

Program Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan inisiatif Pemerintah yang bertujuan untuk memberikan kepastian hukum dan perlindungan kepada rakyat Indonesia dalam hal kepemilikan tanah. Namun, persyaratan yang disederhanakan untuk membuktikan hak atas tanah dalam Program PTSL telah mengubah nilai hukum dari prosedur yang sebelumnya dijelaskan dalam Peraturan Pemerintah Nomor 24 Tahun 1997. Surat Keterangan Penguasaan Tanah (SKPT), yang dikeluarkan oleh kepala desa/lurah dan diakui oleh camat, tetap berfungsi sebagai bukti hak, tetapi telah dikecualikan dari Program PTSL. Di Kabupaten Karimun, telah diterapkan kebijakan untuk mengatur prosedur penerbitan SKPT melalui Peraturan Bupati Karimun Nomor 41 Tahun 2016. Namun, implementasi kebijakan ini tidak sejalan dengan Program PTSL. Akibatnya, program PTSL telah memperkenalkan tantangan baru dalam hal membuktikan hak atas tanah. Penelitian yuridis empiris, yang dilakukan dengan menggunakan teknik purposive sampling, telah mengidentifikasi beberapa faktor yang memengaruhi hambatan penggunaan SKPT sebagai bukti hak dalam Program PTSL. Faktor-faktor tersebut meliputi faktor hukum, penegak hukum, fasilitas infrastruktur pendukung, dan faktor yang terkait dengan masyarakat.

Abstract

The Batam City Regulation Number 1 of 2019 concerning the Arrangement and Empowerment of Street Vendors (Perda PPPKL) is implemented to regulate and organize street vendors who violate the regulations to ensure the protection of the rights of every citizen, especially in Batam City. This regulation emphasizes public interests to achieve justice in the Batam community. The Public Order Agency (Satuan Polisi Pamong Praja/Satpol PP) is responsible for enforcing this regulation. However, in reality, there are still many street vendors selling in public areas. The roads in the Ramayana Jodoh area to the Tos 3000 market in Batam have turned into street vendor stalls, making it difficult for traffic to pass through. This research aims to analyze the implementation of the 2019 Batam City Regional Regulation and the enforcement of the Regulation by the Public Order Agency (Satpol PP). Therefore, it uses empirical legal research with a sociological approach. The findings of this research indicate that there are still various obstacles in implementing the Perda PPPKL by Satpol PP, including the absence of the City's Spatial Plan (RTRW) and the easy entry of second-hand goods into Batam city.

Abstract

Pariwisata berkelanjutan tidak hanya merupakan perubahan yang diperlukan di sektor pariwisata, namun juga merupakan tren yang dapat merevitalisasi sektor pariwisata yang terbelenggu pandemi dan permasalahan sosio-ekonomi dan lingkungan. Kekayaan intelektual berperan penting, khususnya dalam mendukung industri kreatif sebagai bagian tak terpisahkan dari sektor pariwisata. Penelitian ini dibuat untuk memetakan peran kekayaan intelektual terhadap kemajuan industri kreatif di tengah pengembangan pariwisata berkelanjutan. Dengan metode penelitian hukum normatif dan pendekatan komparatif, penelitian ini membandingkan kerangka hukum Indonesia dengan Filipina, serta kecakapan masing-masing sistem hukum untuk mendukung industri kreatif dalam pariwisata berkelanjutan. Analisis menemukan bahwa Filipina memiliki kerangka hukum pariwisata yang lebih baik, yang sudah sekaligus mengatur secara detail penerapan konsep keberlanjutan, serta dukungan terhadap industri kreatif. Namun, Indonesia memiliki kerangka hukum kekayaan intelektual yang lebih baik, khususnya mengenai kekayaan intelektual komunal, yang secara definitif diatur dan sesuai dengan norma-norma mendasar dari kerangka hukum pariwisata.

Abstract

According to data from the anti-corruption education center released by Transparency International's Corruption Perceptions Index, Indonesia ranks 96th in 2021 in the corruption perception index with a score of 38 on a scale of 100. This study aims to determine the differences in the regulation and imposition of sanctions on perpetrators of corruption between Indonesia and Singapore. With Normative legal research, data is collected by literature study using secondary data which includes primary, secondary and tertiary legal materials which will be reviewed and studied one by one. This research provides results that show that there are several differences in preventing criminal acts of corruption in Indonesia and Singapore in terms of legislation, criminal sanctions, and anti-corruption institutions.

Abstract

The juvenile justice system is intrinsically related to youth development, as it is responsible for the education and rehabilitation of children who have committed or are suspected of committing a crime. Juvenile crimes must go through criminal proceedings before being tried in court. However, discussions on preventing duress during these proceedings in Indonesia remain limited. This research aims to analyze efforts to prevent duress during juvenile criminal proceedings in Indonesia, highlighting potential gaps and comparing them to the United Kingdom's juvenile justice system. Utilizing the normative research method with the support of the comparative approach, this study examines existing Indonesian laws and their implementation while juxtaposing them with the UK’s juvenile justice framework. The analysis reveals significant opportunities for duress to occur within Indonesia’s juvenile justice system, contrasting with the UK’s system, which has a more structured set of legal norms. Based on these findings, this research proposes a model for legal development, focusing on closing procedural gaps that allow duress to occur during juvenile criminal proceedings in Indonesia.
